A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, DECLARING ITS INTENTION TO
ALLOW THE TEMPORARY CLOSURE OF THE SOUTH LEG
AND PORTIONS OF THE NORTH LEG OF AVENIDA
MONTEZUMA BETWEEN EISENHOWER DRIVE AND
AVENIDA NAVARRO FROM 9:00 A.M. TO 5:00 P.M. ON
MARCH 14, 15, 16, AND 17, 1996, FOR THE LA
QUINTA ARTS FESTIVAL SUBJECT TO THE CONDITIONS
OF MINOR TEMPORARY OUTDOOR EVENT 95-097
APPLICANT: LA QUINTA ARTS FOUNDATION
WHEREAS, pursuant to Chapter 9.216 Temporary Outdoor Events) of
the Municipal Code, the La Quinta Arts Foundation applied for and received approval,
under Minor Temporary Outdoor Event Permit 95-097, for the La Quinta Arts Festival
to be held on March 14, 15, 16, and 17, 1996; and
WHEREAS, Condition 17 of Minor Temporary Outdoor Event Permit 95-
097 requires a street closure permit for the event; and
WHEREAS, the City Council has chosen the 5th day of March, 1 996, to
review and hear any public testimony on this request to temporarily close the south
leg and portions of the north leg of Avenida Montezuma, around the Frances Hack
Park, for the La Quinta Arts Foundation on March 14, 1 5, 1 6, and 1 7, 1 996, between
the hours of 9:00 A.M. to 5:00 P.M.; and
WHEREAS, the City Council finds the following facts and reasons to
justify approval of said temporary street closure:
1. The temporary street closure is allowed based on Chapter 1 2.32.080 D) of the
Municipal Code which permits the Council, by Resolution, to designate no
parking" areas by signing or applying red paint to the street curbing. The La
Quinta Arts Foundation shall post *no parking" signs and install traffic
barricades in all areas necessary to ensure traffic safety as required by the
Public Works Department unless other arrangements are made with the Public
Works Director.
2. The temporary street closure will have minor impacts on traffic in the
downtown area because other streets adjoining the site are available to provide
access to the immediate neighbors and/or businesses. Business owners have
been notified sent letters from the La Quinta Arts Foundation informing them
of the upcoming event pursuant to Condition 2 of Minor Temporary Event
Permit 95-097.

3. The City Council can grant an encroachment permit to allow activities on public
streets for specific periods if legitimate reasons can be found to allow the
closure and safety standards Chapter 12.16 of the Municipal Code, Traffic-
Control Devices) are provided such as traffic barricades and no parking*' signs
to insure that the public is not at risk attending the event.
4. Approval of the temporary street closure will not create conditions that may
threaten the public health and safety needs of the community at the March
festival event because specific conditions will be imposed and shall be met.
WHEREAS, the City Council imposes the following Conditions besides those
required for Minor Temporary Event Permit 95-097 and Special Advertising Device
95-070 to insure traffic safety for this upcoming outdoor event:
1. The Foundation shall prepare, or cause to be prepared, a traffic control plan
prepared by someone experienced with traffic control plans that can identify
the specific control measures, quantities, and their appropriate locations as
needed. The Foundation shall obtain an Encroachment Permit from the Public
Works Department prior to closing the street.
2. All traffic control measures needed to implement the street closure is the
responsibility of the Foundation. The Foundation shall implement and maintain,
or causing, the approved traffic control plan to be implemented and maintained
all four days of the street closure. The Foundation may contract with private
vendors, or the City, to secure the needed services if the Foundation does not
have the personnel and equipment within its organization to implement the
required measures. The City can prepare the traffic control drawings for
$150.00; lease the traffic control equipment for $250.00; and set up, take
down, and maintain orderly placement of the traffic control measures during
the four-day event for an additional $350.00. If the Foundation decides to
utilize all, or some, of the services offered by the City, the cost of the
Encroachment Permit will be increased according to the services provided as
indicated by these Conditions of Approval. The permit will cost $10.00 if it is
issued with no City provided services.
3. The Foundation shall securely rope, or otherwise cordon off, vacant properties
in the festival site vicinity where property owners have expressed opposition
to festival patrons parking on their land; the City maintains a list of such
properties and will identify them in the Encroachment Permit. The properties
shall be posted with no parking signs placed on 50-foot centers along the
property line perimeter indicating violators are subject to towing. The
Foundation shall assign public relations personnel to continuously monitor each

property during the hours the festival is open to the public to alleviate adverse
circumstances by advising festival patrons of the strict enforcement policy.
4. The Foundation may contract with private vendors, or the City, to provide the
roping and no parking signage services. The City can provide this service for
$850.00, but this service does not include on-site public relations personnel.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
La Quinta, California, as follows:
Section 1. That the above citations are true and correct and the findings of
the City Council in this case.
Section 2. The City Council approves the closure of the south leg of Avenida
Montezuma and portions of the north leg between Eisenhower Drive and Avenida
Navarro per attached Exhibit A" on March 14, 15, 16, and 17, 1996, from 9:00 A.M.
to 5:00 P.M. subject to conditions imposed by the Public Works and Community
Development Departments.
Section 3. The City Traffic Engineer, or his designee, can issue an
encroachment permit Chapter 14.1 6 of the Municipal Code) to the La Quinta Arts
Foundation regulating the closure of the street provided certain traffic control
standards and the Conditions of Approval for Minor Temporary Even Permit 95-097
are met.
Section 4. No parking" signs will be posted Chapters 12.16 and 12.32 of
the Municipal Code) on the south leg and portions of the north leg of Avenida
Montezuma between Eisenhower Drive and Avenida Navarro. The Riverside County
Sheriff's Department will tow any unauthorized vehicle within this area at the time of
the event. The applicant shall rope or otherwise cordon off vacant properties
adjacent to the festival site if the owners of the properties have indicated they do not
wish to allow festival parking on their land.
Section 5. In case of bad weather, the Community Development Director and
City Engineer are authorized to reschedule the street closure provided all conditions
of approval under MTOE 95-097 are met.
Section 6. The City Council authorizes City staff or other assigned safety
personnel to close the event if at any time all safety standards are not being met, and
thus could jeopardize those persons attending the function; and

Section 7. The City Clerk shall cause this Resolution to be posted within 72-
hours after its adoption in four 4) public places. Those places shall be: City Hall, the
La Quinta Library, the La Quinta Chamber of Commerce, and Albertson's..

Quinta City Council, held on this the 5th of March, 1 996, by the following vote, to
wit:
