A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, CERTIFYING
A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT FOR
ENVIRONMENTAL ASSESSMENT 96-315
PREPARED FOR STREET VACATION 96-028
ENVIRONMENTAL ASSESSMENT 96-315

WHEREAS, die City Council of th* C ity of La Quinta, California, did on the 19th day
of March, 1996, hold a duly noticed Public Hearing to consider Environmental Assessment 96-
315 and Street Vacation 96-028; and,
WHEREAS, said Street Vacation has complied with the requirements of 4The Rules to
Implement the California Environmental Quality Act of 1970" as amended; Resolution 83-68
adopted by the La Quinta City Council) in that the Community Development Department has
prepared an Initial Study *A 9&3 15); and,
WHEREAS, the Community Development Director has deternied that said Street
Vacation will not have a significant adverse effect on the environment and that a Negative
Declaration of*Environmental Impact should be filed; and
WHEREAS, pursaant to California Government Code Section 65402, The Community
Development Deparu*nt has found that the proposed Street Vacation is consistent with the La
Quinta General Plan; and,
WHEREAS, upon heaiing and considering all testimony and arguments, if any, of all
interested persons desiring to be heard, said City Council did find the following facts, findings,
and reasons to justify certification of said Environmental Assessment:
1. The proposed Street Vacation will not be detrimental to the health, safety, or general
weif*re of the community, either indirecdy or direcdy, in that no significant impacts to
circulation can be identified due to vacation and closure of the street segment in
question.
2. The proposed Street Vacation will not have the potential to degrade the quality of the
environment, substantially reduce the habitat of a fish or wildlife population to drop
below self sustaaing levels, threaten to elninate a plant or animal community, reduce
the number or restrict the range of rare or endangered plants or arllrllls or eliminate
important examples of the m*ior periods of California history or prehistory, as no new
impacts beyond those associated with the current General Plan have been identified

3 The proposed Street Vacation does not have the potential to achieve short-term
environmental goals, to the disadvantage of long-term environmental goals, as the street
segment is not identified as a necessary circulation improvement and would therefore
not contribute to, or detract from, any environmental goal.
4 The proposed Street Vacation will not result in impacts which are* individually limited
or cumulatively considerable when considering planned or proposed development in the
immediate vicinity, in that the status of this street segment, whether vacated or not, will
have no measurable effect upon surrounding development as it is not considered a
necessary facility in the La Quinta General Plan.
5. The p?oposed Street Vacation will not have environmental effects that will adversely
impact the human population, either directly or indirectly, as the street segment is
currently inaccessible and unused, and the act of vacation will have no physical
environmental effect.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of La Quinta, California as follows:
1. That the above recitations are true and correct and constitute the findings of the City
Council for this Environmental Assessment.
2. That it does hereby certify Environmental Assessment 96-315 for the reasons set forth
in this Resolution and as stated in the Environmental Assessjnent Checklist and
Addendum, attached hereto, and on file in the Community Development Department.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the La
Quinta City Council held on this 19th day of March, 1996, by the following vote, to wit:
