CC Resolution 1996-022^JvF RESOLUTION 96-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING A MITIGAThD NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR EA 96-311 PREPARED FOR CONDITIONAL USE PERMIT 96- 023 AND PLOT PLAN *571 FOR USA PROPERTIES ENVIRONMENTAL ASSESSMENT 96-311 VILLA LA QUINTA APARTMENTS WHEREAS, the City Council of the City of La Quinta, California, did, on December 19, 1995, remand the 128-unit affordable appartment complex back to the Planning Commission for further study; and, WHEREAS, the applicant revised the application under a new submittal, incorporating 116 units, as Conditional Use Permit 96-023 and Plot Plan 96-571; and, WHEREAS, the City Council considered the Commission's Report of Action on March 5, 1996, and on a 3-0 vote exercised their option to hold a public hearing on the project in April; and, WHEREAS, the City Council did hold a public hearing on April 2, 1996, and has determined that said revised Conditional Use Permit and Plot Plan, allowing a 116-units aparttnent complex, will not affect the environment and that a Mitigated Negative Declaration of environmental impact should be filed; and, WHEREAS, the Planning Commission, on February 13, 1996, held a public hearing on the revised project and the applicant's noise and traffic studies detailing the impacts of the project* After additional deliberation, the Commission approved the project as submitted with Conditions; and, WHEREAS, said revised applications have complied with the requirements of The Rules to Implement the California Environmental Quality Act of 1970" as amended; Resolution 83-68 adopted by the La Quinta City Council) in that the Community Development Department has prepared an Initial Study EA. 96-311); and, WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts, findings, and reasons to justify certification of said Environmental Assessment: RESOCC. 173-pdrive BIB] 08-21-1998-U01 09:27:28AM-U01 ADMIN-U01 CCRES-U02 96-U02 22-U02 ^Jv *, J*I I I i I I City Council Resolution 96-22 Page 2 1. The revised Conditional Use Permit and Plot Plan applications will not be detrimental to the health, safety, or general welfare of the community, either indirectly or directly in that mitigation measures have been prepared to insure environmental compliance before and during on-site construction work. 2. The revised Conditional Use Permit and Plot Plan applications will not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or anirnal community, reduce the number or restrict the range of rare or endangered plants or animals or eliminate important examples of the major periods of California history or prehistory, as no such habitats or species were found to exist to any significant degree. 3. The revised development request does not have the potential to achieve short-term environmental goals, to the disadvantage of long-term environmental goals, with the successful implementation of the monitoring program. 4. The revised Conditional Use Permit and Plot Plan will not result in impacts that are individually limited or cumulatively considerable when considering planned or proposed development in the immediate vicinity, due to the urbanized character of the surrounding area. 5. The revised project will not have environmental effects that will adversely affect the human population, either directly or indirectly, with the implementation of mitigation measures. NOW, ThEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council for this Environmental Assessment. 2. That it does hereby certify a Mitigated Negative Declaration Environmental Assessment 96-311) for the reasons set forth in this Resolution and as stated in the Environmental Assessment Checklist and Addendum, labeled Exhibit A" and on file in the Community Development Department.
