CC Resolution 1996-031#J RESOLUTION 96-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA CONDITIONALLY APPROVING INSTALLATION OF A GOLF CART CROSSING ON PARK AVENUE APPROXIMATELY 700 FEET NORTH OF CALLE TAMPICO WHEREAS, pursuant to California Vehicle Code Section 21115.1 the City Council is authorized to establish crossing zones for use by golf carts on any street which has a posted speed limit of 45 miles per hour, or less, and which is immediately adjacent to a golf course; and, WHEREAS, the Riverside County Sheriff's Department has reviewed the proposed golf cart crossing and has found and determined that it is appropriate to establish the proposed crossing if it is implemented in accordance with the Conditions of Approval stated on Exhibit A attached hereto; and WHEREAS, the proposed golf cart crossing complies with the prerequisite requirements of Vehicle Code Section 21115.1 NOW, THEREFORE, the City Council of the City of La Quinta does resolve as follows: Section 1. Pursuant to the authority vested with the City Council as provided in Vehicle Code Section 21115.1, the City Council hereby authorizes the Director of Public Works to issue an encroachment permit to the KSL Recreation Corporation that allows the installation of a golf cart crossing on Park Avenue approximately 700 feet north of Calle Tampico in accordance with the Conditions of Approval contained in Exhibit A which is attached hereto and made a part hereof. Section2 The City Manager is authorized to execute a Conditional Grant of Easement Deed that conditionally conveys limited access rights to KSL Recreation Corporation and its assigns, across the Citrus Course boundary Tract 24889) at a location designated by the City Engineer. The easement access rights conferred by the conditional deed shall remain in effect as long as an active encroachment permit is maintained by KSL or its assigns. If the encroachment permit lapses, or is denied renewal, the easement rights that were conditionally granted shall be terminated. HONEYW**ty Attorney City of La Quinta, California * k BIB] 08-21-1998-U01 03:54:07PM-U01 ADMIN-U01 CCRES-U02 96-U02 31-U02 #J EXHIBIT A Conditions of Approval Resolution 96-31 These requirements are designed to implement a golf cart crossing that continues to give existing vehicular traffic on Park Avenue right of way priority, they shall be incorporated into any encroachment permit issued to KSL Recreation Corporation, or its assigns, for a golf cart crossing over Park Avenue 700 feet north of the Calle Tampico. 1. The permittee shall install 10-foot wide portland cement sidewalk on both sides of Park Avenue as shown on Plot Plan. 2. The permittee shall install curb opening ramps per City standards. 3. The permitteee shall furnish and install stop signs, stop bars, and stop legends on both sides of street on the cart path where it joins the street pavement as directed by City Engineer. 4. The permittee shall furnish and install cart crossing warning signs on Park Avenue 250 feet north and south of the cart crossing to advise motorists of the crossing as directed by the City Engineer. 5. The permittee shall furnish and install advisory signs on the residential side of both access gates to the Park Avenue right of way that advise golf cart drivers the street crossing can only be used during daylight hours per Vehicle Code 21115.1 6. No pavement markings will be installed on Park Avenue indicating the crossing location as they imply right of way priority belongs to the golf cart. 7. The permittee shall issue an initial letter, approved by the City Engineer, and repeat the letter issuance on an annual basis to all club members advising them of proper street crossing etiquette and vehicle code responsibilities regarding this crossing. 8. The permittee shall provide a plat and legal description for use with the Conditional Grant of Easement Deed. 9. The permittee is responsible for all improvement and maintenance costs associated with installing and maintaining the golf cart crossing. These costs will be factored into the encroachment permit cost on an annual basis. 10.
