CC Resolution 1996-038#J RESOLUTION 96-38 A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL ASSESSMENT 96-312 PREPARED FOR GENERAL PLAN AMENDMENT 95-051 ENVIRONMENTAL ASSESSMENT 96-312 WALLY FRIEND/STUART ENTERPRISES/CITY OF LA QUINTA WHEREAS, the City Council of the City of La Quinta, California, did on the 4th day of June, 1996, hold a duly noticed Public Hearing on Environmental Assessment 96-312 and General Plan Amendment 95-051 to reconsider their April 2, 1996, decision to deny the elimination of the Rural Residential Overlay from various properties in the City Exhibit A); and WHEREAS, the City Council of the City of La Quinta, California, did on the 4th of June, after receiving public testimony finds that approval of GPA 95-051 Exhibit A) would not have a significant impact on the environment; and, WHEREAS, the City Council of the City of La Quinta, California, did on the 2nd day of April, 1996, hold a duly noticed Public Hearing on Environmental Assessment 96-312 and General Plan 95-051 to consider the recommendation by the Commission to eliminate the Rural Residential Overlay District from various properties in the City designated Low Density Residential 2-4 dwelling units per acre) generally located on the south side of 52nd Avenue, east of Jefferson Street, and north of 55th Avenue and denied the request on a 5-0 vote; and, WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 27th day of February, 1996, held a duly noticed Public Hearing, and after deliberation, recommended to City Council approval of Environmental Assessment 96-312 and General Plan Amendment 95-051; and, WHEREAS, said General Plan Amendment has complied with the requirements of The Rules to Implement the California Environmental Quality Act of 1970' as amended; Resolution 83- 68 adopted by the La Quinta City Council) in that the Community Development Department has prepared an Initial Study EA 96-312) for the project which was recommended to the Council by the Commission on February 27, 1996; and, resocc. 75-p BIB] 08-24-1998-U01 09:32:04AM-U01 ADMIN-U01 CCRES-U02 96-U02 38-U02 #J WHEREAS, the City Council has determined that said General Plan Amendment will not have a significant adverse effect on the environment and that a Negative Declaration of Environmental Impact should be filed; and WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts, findings, and reasons to justify certification of said Environmental Assessment: 1. The proposed General Plan Amendment will not be detrimental to the health, safety, or general welfare of the community, either indirectly or directly, in that no significant impacts can be identified beyond those associated with the current General Plan designation for the area. 2. The proposed General Plan Amendment will not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of rare or endangered plants or animals or eliminate important examples of the major periods of California history or prehistory, as no new impacts beyond those associated with the current General Plan have been identified. 3. The proposed General Plan Amendment does not have the potential to achieve short-term environmental goals, to the disadvantage of long-term environmental goals. No significant effects on environmental factors have been identified. 4. The proposed General Plan Amendment will not result in impacts which are individually limited or cumulatively considerable when considering planned or proposed development in the immediate vicinity, as development patterns in the area will not be significantly affected by the Amendment. 5. The proposed General Plan Amendment will not have environmental effects that will adversely affect the human population, either directly or indirectly, as no significant impacts have been identified which would affect human health, risk potential or public services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council for this Environmental Assessment. 2.
