GENERAL PLAN AMENDMENT 96-052 AND ZONING
ORDINANCE AMENDMENT 96-050 ZONING CODE)
ENVIRONMENTAL ASSESSMENT 96-318

WHEREAS, the City Council ofthe City ofLa Quinta, California, did on the 18th day
of 3une, 1996, hold a duly noticed Public Hearing and continued Public Hearing on the 22nd day of
July, 1996, to consider the proposed Negative Declaration for the General Plan Amendment and
Zoning Ordinance Amendment, and;
WHEREAS, said acquisition has complied with the requirements The Rules to
Implement the California Environmental Quality Act of 1970" as amended) Resolution 83-68
adopted by the La Quinta City Council) in that the Community Development Department has
prepared Initial Study EA 96-318; and,
WHEREAS, the Community Development Director has determined that said Zoning
Ordinance Amendment and General Plan Amendment will not have a significant adverse effect on the
environment and that a Negative Declaration of environmental impact should be filed; and,
WHEREAS, the PIning Comm*on did on the 14th day of May 1996, by adoption
of Planing Commission Resolution 96-012, recommend certification of a Negative Declaration of
Environmental Impact; and,
WHEREAS, upon hearrng and considering all testimony and arguments, if any of all
interested persons desiring to be heard, said City Council did find the following facts, findings, and
reasons to justif** certification of said Environmental Assessment:
1. The proposed Amendment will not be detrimental to the health, safety, or general weiflire of
the community, either indirectly or directly in that the new standards and regulations are
brought into conformance with the 1992 update of the City's General Plan. The Ordinance
will apply City-wide and provide a comprehensive set of standards and regulations for
development thereby improving the quality of life for City residents.
2. The proposed Amendment will not have the potential to degrade the quality of the
environment, substantially reduce the habitat of a fish or wildlife population to drop below
self sustaining levels, threaten to eliminate a plant or animal commirnity, reduce the number
or rest:rict the range of a rare or endangered plant or *im*1 or eliminate important examples
of the major periods of California liistory or prebistory. Appropriate mitigation measures
have been adopted in the La Quinta Gemeral Plan to ensure mininaal nupact

3. The proposed Amendment will not have the potential to achieve short-term environmental
goals, to the disadvantage of long-term environmental goals in that it will establish more
stringent standards and regulations according to the goals and ot*jectives of the General Plan.
4. The proposed Amendment will not resuk in impacts which are individually limited or
cumulatively considerable.
NOW, ThEREFORE, BE IT RESOLVED by the City Council of the City of La
Quinta, California, as follows:
1. That the above recitations are true and coffect and constitute the findings of the City Council
for this environmental assessment.
2. That it does hereby certif** Environmental Assessment 96-31 g for a Negative Declaration for
the reasons set forth in this resolution and as stated in the Environmental Assessment
Checklist and Addendum, labeled Exhibit A" on file in the Community Development
Department.
PASSED, APPROVED, and ADOPTED at a regillar meeting of the La Quinta City
Council, held on this 22nd day of July, 1996, by the following vote, to wit:
