RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA
QUINTA, CALIFORNIA APPROVING A SUMMARY
VACATION OF PROPOSED PUBLIC STREET RIGHT-OF-
WAY DEDICATIONS FOR TRACT 25154
CASE NO*: SV 97-31
WHEREAS, the owners of Tract 25154 generally known as Rancho La
Quinta, have requested that the tract be allowed to be incorporated into the adjacent
private Rancho La Quinta Development; and,
WHEREAS, Tract 25154 had previously been approved requiring
dedication of the streets as they were to be public streets; and,
WHEREAS, the streets have never *en developed, are currently owned
by one owner and the originally proposed st fleet does not continue through such
ownership or end touching property of another; and,
WHEREAS, Chapter 4 of Streets and Highway Code Section 8334
provides for summary vacation under the circumstances presented by the request of
the owner.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
La Quinta, California hereby finds and resolves as follows:
1. This summary vacation is made pursuant to the authority in Chapter 4 of the
California Streets and Highways Code and specifically Section 8334 of that
Chapter.
2. A precis* map describing the previously dedicated street which is requested to
be vacated is attached as Exhibit A" to this resolution.
3. The summary vacation has been requested by the owner of the property and the
entire area requested to be vacated lies within property under one ownership
and the previously dedicated street does not continue through such ownership
or end touching property of another.
4. The fact that an emergency access" only open to emergency vehicles does
exists, does not constitute a continuing through" of the property for purposes
of Section 8334 of the Streets and Highways Code.

5. The vacation of all streets from public to private is subject to, and the retention
of, all public utility easements, the right of ingress and egress for public service
and emergency vehicles, and other easements of record existing within said
public right-of-way.
6. Retention of a 41-foot wide easement for roadway purposes in the middle of the
street 41-feet back of curb to back of curb).
7. The new front lines of adjoining lots should be to the easement roadway line.
8. A 9.5-foot wide public utility easement shall be provided on both sides of the
41-foot wide roadway easement.
9. The portion of the right-of-way for Sagebrush Avenue and Lot A" shall be
retained as public right-of-way as illustrated on Exhibit B".
10. Lots A", B", C", and D" with the exception as illustrated in Exhibit B", shall
be conveyed to a homeowners' association prior to the close of escrow for the
sale of the first lot.
11. Pursuant to Section 8336 the City Clerk shall cause a certified copy of this
Resolution of Vacation, attested by the City Clerk, to be recorded without
acknowledgment, certificate of acknowledgment in the Riverside County
Recorder's Office.
1 2. The vacation shall be effective after the date that the Resolution is recorded and
at that time the street shall no longer constitute a public street.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Council, held on this 1 5th day of April, 1 997, by the following vote, to wit:
