A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, APPROVING
AMENDMENT #2 TO SPECIFIC PLAN 85-006.
SPECIFIC PLAN 85-006, AMENDMENT #2
KSL LAND HOLDINGS, INC.
WHEREAS, the City Council of the City of La Quinta, California, did on the
1 7th day of February, 1 998, hold a duly noticed Public Hearing to consider the request
of KSL LAND HOLDINGS, INC., to amend the aforementioned Specific Plan to permit
minimum 6000 square foot lots having 55 foot lot width in the Oak Tree West Specific
Plan area consisting of the Citrus Country Club and the area bounded by 52nd Avenue,
Jefferson Street, 54th Avenue, and the mountains on the west; and,
WHEREAS, the Planning Commission of the City of La Quinta did on the
27th day of January, 1 998, continued from December 23, 1 997, hold a duly noticed
public hearing to consider the request of KSL Land Holdings, Inc. to amend the
aforementioned Specific Plan; and,
WHEREAS, said Specific Plan Amendment has complied with the
requirements of The Rules to Implement the California Environmental Quality Act of
1 970" as amended Resolution 83-68), in that the Community Development Director has
determined that this request is categorically exempted pursuant to the Guidelines for
Implementation of the California Environmental Quality Act, Section 1 5304, Class five
5); and,
WHEREAS, at said Public Hearing upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be heard, said City
Council did find the following facts and reasons to justify approval of the Specific Plan
Amendment:
1. The proposed Specific Plan Amendment is consistent with the goals and policies
of the La Quinta General Plan in that lot width and size requirements are not
specified in the General Plan.
2. The Specific Plan Amendment will not create conditions materially detrimental to
the public health, safety, and general welfare in that development allowed under
the Specific Plan Amendment is compatible with existing uses.

3. The Specific Plan Amendment will provide land use compatibility with zoning on
adjacent properties in that the changes proposed will require that uses be
reviewed to ensure they are compatible with the surrounding properties.
WHEREAS, the Planning Commission does recommend approval of Specific
Plan 85-006, Amendment #2, by adoption of Resolution 98-005;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
La Quinta, California as follows:
1. That the above recitations are true and correct and constitute the findings of the
City Council in this case.
2. That it does hereby confirm the conclusion of the Community Development
Director in that this request is categorically exempted pursuant to the Guidelines
for Implementation of the California Environmental Quality Act, Section 1 5304,
Class five 5).
3. That it does hereby approve the above-described Amendment request for the
reasons set forth in this Resolution and subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Council held on this 1 7th day of February, 1 998, by the following vote,
to wit:

CONDITIONS OF APPROVAL FINAL
SP 85-006, AMENDMENT #2
KSL LAND HOLDINGS, INC.
FEBRUARY 17, 1998
GENERAL
1. Specific Plan 85-006, Amendment #2, shall comply with the requirements
andstandards of the La Quinta Municipal Code and all other applicable laws,
unless modified by the following conditions.
2. The Specific Plan text on file in the Community Development Department, shall
be revised to include the following conditions with final texts submitted to the
Community Development Department within 30 days of final approval.
3. Developer agrees to indemnify, defend, and hold harmless the City of La Quinta
in the event of any legal claim or litigation arising out of the City's approval of
this project. The City of La Quinta shall have the right to select its defense
counsel at its sole discretion.
4. The following shall be added to the *H0USlNG" section of the Oak Tree West
Specific Plan:

These standards apply to all residential units constructed within the Specific
Plan boundary.
