A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA; APPROVING AND ADOPTING A MEMORANDUM OF
UNDERSTANDING WITH THE COACHELLA VALLEY ASSOCIATION OF
GOVERNMENTS CVAG) FOR THE PURPOSE OF AGGREGATING THE
FUNDS NECESSARY TO PURCHASE A THERMAL IMAGING SYSTEM TO
BE DONATED ON BEHALF OF CVAG AND ITS MEMBER JURISDICTIONS
TO BE PLACED INTO SERVICE AND MAINTAINED BY THE CALIFORNIA
HIGHWAY PATROL FOR USE IN THE COACHELLA VALLEY
WHEREAS, The City of La Quinta, a political subdivision of the State of
California is committed to the public safety of its residents and community members;
and
WHEREAS, The California Highway Patrol currently provides airborne law
enforcement support through the use of a Bell 206L4 helicopter currently stationed at
Thermal Airport at no direct cost to the City of La Quinta; and
WHEREAS, A Thermal Imaging System is an aircraft mounted heat sensitive
tracking device with recordation capability found by law enforcement personnel to be
beneficial in a variety of situations including, but not limited to, vehicle pursuits, traffic
stops, civil disturbances and search and rescue operations; and
WHEREAS, While a Thermal Imaging System would be valuable to the Coachella
Valley but has not been funded by the State Legislature and the City of La Quinta
would significantly benefit from its use; and
WHEREAS, This device has a cost of between $140,000 and $1 85,000 and the
Coachella Valley Narcotics Task Force has appropriated up to $75,000 as a match for
funding generated through CVAG member jurisdiction contributions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF LA QUINTA AS
FOLLOWS:
Section 1: Authorize the Mayor and/or his or her designee to enter into a Memorandum
of Understanding with the Coachella Valley Association of Governments Exhibit A")
for the purposes of contributing funding for a Thermal Imaging System to be donated
on behalf of CVAG and its member jurisdictions to the California Highway Patrol for
use on the Bell 206L4 helicopter currently stationed at Thermal Airport.

Section 2: Authorize the expenditure of $15,000 from the City of La Quinta to the
Coachella Valley Association of Governments to be combined with funds contributed
from other member jurisdictions and the Coachella Valley Narcotics Task Force as
reflected in the Memorandum of Understanding.

MEMORANDUM OF UNDERSTANDING
THERMAL IMAGING SYSTEM
This Memorandum of Understanding the MOU") made and entered into this 3RD day
of March, 1 998, by and between the Coachella Valley Association of Governments
and the City of La Quinta the Contributing Organization") is to confirm the
contribution of $15,000 for the purpose of purchasing a Thermal imaging System to
be mounted on the California Highway Patrol Helicopter located at the Thermal Airport.
1. Purpose
Funding contributed under this MOU will be combined with funding received from other
contributing organizations for the purpose of purchasing a Thermal Imaging System to
be mounted on the California Highway Patrol helicopter located at Thermal Airport.
2. Role of CVAG
The role CVAG will be limited to assisting in the collection of funds from the
contributing organizations and acting as a Banker" for the disbursement of funds to
a lead agency
3. Lead Agencv
The California Highway Patrol will be the lead agency for the technical portion of the
procurement process and a lead city, for the purposes of procurement, will be
designated at a date prior to the collection of any funds related to this MOU.
4. Benefit
It is so stated that the purchase of the above described equipment is of benefit to the
Contributing Organization in providing necessary advan*ed technology law
enforcement services.
5. funding
If funding contributions are not sufficient to purchase the stated equipment by June
30, 1 998; contributed funds will be returned to the Contributing Organization within
60 days. If funding received is in excess of the required amount, excess funds will be
returned to the Contributing Organization on a pro-rata basis within 90 days of the
equipment purchase and placing into service. Funds received under this MOU are
designated as restricted and therefore may only be used for their intended purpose.

^#ROAdditionally, interest accrued as a result of holding specified funds for this purpose will
be the property of CVAG for use to benefit the member jurisdictions consistent with
the goals and objectives of CVAG.
6. Terms
This MOU shall commence as of the day and year first above shown and shall remain
in full force and effect unless terminated by either party pursuant to Section 3 as
stated above.

8. Indemnification
Contributing Organization agrees to indemnify, defend upon request by CVAG) and
save harmless CVAG, its appointed officials, officers, agents and employees from and
against any liability, expense, including defense costs and legal fees, and claims for
damages of any nature whatsoever.
9. Entire Agreement
This Agreement constitutes the entire understanding and agreement of the parties.
