CC Resolution 1998-042^"S8 RESOLUTION 98-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUENTA, CALIFORNIA, CERTIFYING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT, ENVIRONMENTAL ASSESSMENT 91-193-ADDENDUM 1 FOR TENTATIVE TRACT MAP 26718- FIRST TIME EXTENSION, LOCATED ON THE EAST SIDE OF JEFFERSON STREET APPROXIMATELY 1650 FEET SOUTH OF 501H AVENUE. ENVIRONMENTAL ASSESSMENT 91-193-ADDENDUM 1 WALTER HANSCH WHEREAS, the City Council of the City of La Quinta, California, did, on the 1 9th day of May, 1 998, hold a duly-noticed Public Hearing as requested by Walter Hansch on Environmental Assessment 91-193-Addendum 1, addressing noise and cultural resources for Tentative Tract 2671 8- First Time Extension, generally located on the east side of Jefferson Street, approximately 1 650 feet south of 50th Avenue, more particularly described as follows: A PORTION OF THE NW 1/4 OF SECTION 4, TOWNSHIP 6 SOUTH, RANGE 7 EAST, SAN BERNARDINO BASE AND MERIDIAN. WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 1 4th day of April, 1 998, hold a duly-noticed Public Hearing on Environmental Assessment 91-193 Addendum 1, addressing noise and cultural resources for Tentative Tract 26718 First Time Extension, whereby a recommendation for certification was forwarded to the City Council; and, WHEREAS, a Mitigated Negative Declaration of Environmental Impact for Environmental Assessment 91-193 was certified by the City Council on January 5, 1 993, by Resolution 93-2; and, WHEREAS, said Amended Environmental Assessment has complied with the requirements of The Rules to Implement the California Environmental Quality Act of 1 970" as amended, Resolution 83-63, in that the Community Development Director has conducted an Initial Study, and has determined that although the proposed tract amendment could have a significant adverse impact on the environment, there would not be a significant effect in this case because appropriate mitigation measures were made conditions of approval for Environmental Assessment 91-193-Addendum 1, and a Mitigated Negative Declaration of Environmental Impact should be filed; and, F:\CITYCLRK\couNcIL\PLANNING\Res 98-42.wpd BIB] 09-16-1998-U01 03:25:22PM-U01 ADMIN-U01 CCRES-U02 98-U02 42-U02 ^"S8 I Resolution 98-42 Page 2 WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said City Council did make the following findings to justify the certification of said Amended Environmental Assessment: 1. The design of Tentative Tract 26718 will not cause adverse environmental impacts to cultural resources or from noise impacts as these resources have been investigated, and mitigation measures included in the Conditions of Approval that will reduce the impacts to a level less than significant. 2. Proposed Tentative Tract 26718 is not likely to cause public health problems as the project has been reviewed by the Fire Department and the Building & Safety Department for those specific issues. 3. The design of Tentative Tract 2671 8 will not conflict with existing public easements, as the project has been designed around, and with consideration for, these easements. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: 1. That the above recitations are true and correct and constitutes the findings of the City Council in this case; 2. That it does hereby concur with the environmental determination and certifies Environmental Assessment 91 1 93 Addendum 1, for the proposed Tentative Tract 26718- First Time Extension.
