CC Resolution 1998-048^ S RESOLUTION 96-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING AN INITIAL STUDYIEIR ADDENDUM FOR ENVIRONMENTAL ASSESSMENT 97-349 PREPARED FOR GENERAL PLAN AMENDMENT 97-055, SPECIFIC PLAN 97-031, TENTATIVE TRACT 28601 AND SITE DEVELOPMENT PERMIT 97-618 ENVIRONMENTAL ASSESSMENT 97-349 LA QUINTA REDEVELOPMENT AGENCY CATELLUS RESIDENTIAL GROUP WHEREAS, the City Council of the City of La Quinta, California, did on the 1 9th day of May, 1 998, hold a duly noticed Public Hearing to consider Environmental Assessment 97-349, as prepared for General Plan Amendment 97-055, Specific Plan 97-031, Tentative Tract 28601 and Site Development Permit 97-618; and, WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 1 21h day of May, 1 998, hold a duly noticed Public Hearing to consider Environmental Assessment 97-349, as prepared for General Plan Amendment 97-055, Specific Plan 97-031, Tentative Tract 28601 and Site Development Permit 97-618; and, WHEREAS, said application has complied with the requirements of *`The Rules to Implement the California Environmental Quality Act of 1 970" as amended; Resolution 83-68 adopted by the La Quinta City Council) in that the Community Development Department has prepared an Initial Study EA 97-349); and, WHEREAS, it is the determination of the Community Development Director that the proposed applications serve to implement the La Quinta Redevelopment Plan for Project Area #2, for which an EIR was certified by the City Council SCH #88041111) on May 16, 1 989, and that pursuant to Public Resources Code 21 090, actions taken to implement a redevelopment plan are deemed a single project, and no further environmental review is necessary beyond analysis of project- specific impacts. The Community Development Department has prepared Environmental Assessment 97-349 as an addendum to the EIR. No changed circumstances or conditions exist which require preparation of a subsequent EIR, pursuant to Public Resources Code 21166; and, F:\cITYCLRK\COUNcIL\PLANNING\Res 96-48.wpd BIB] 09-21-1998-U01 09:10:13AM-U01 ADMIN-U01 CCRES-U02 98-U02 48-U02 ^ SResolution 98-48 Page 2 WHEREAS, the City Council has considered the EIR for Redevelopment Area #2 and Addendum thereto; and, WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts, findings, and reasons to justify certification of said Environmental Assessment: 1. The proposed Specific Plan and related applications will not have the potential to degrade the quality of the environment, as the project in question will not be developed in any manner inconsistent with the General Plan and other current City standards, in conjunction with the proposed General Plan Amendment to street width requirements. The project does not have the potential to eliminate an important example of California prehistory, as extensive archaeological investigations of the site have been conducted as part of the project to implement appropriate mitigation alternatives. The applicant has agreed to implementing the necessary mitigation prior to site development activities and is in concurrence with project conditions relating to this. 2. The proposed Specific Plan and related applications will not have the potential to achieve short term goals, to the disadvantage of long term environmental goals, as the proposed project will serve to implement the La Quinta Redevelopment Plan for Project Area #2. 3. The proposed Specific Plan and related applications will not have impacts which are individually limited but cumulatively considerable when considering planned or proposed development in the immediate vicinity, in that the proposed project is undertaken pursuant to a redevelopment plan for which a final EIR has been certified, and no changes in conditions and circumstances, as outlined in Public Resources Code Section 21166, are applicable. 4. The proposed Specific Plan and related applications will not have environmental effects that will adversely affect humans, either directly or indirectly, as the project contemplates uses at a substantially reduced density than those already assessed under ultimate development of the La Quinta General Plan, and which were previously addressed in the EIR certified for the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California as follows: 1. That the recitations are true and correct and constitute the findings of the City Council for this Environmental Assessment. That it does hereby certify Environmental Assessment 97-349 for the reasons set forth in this Resolution and as stated in the Environmental Assessment Checklist and Addendum on file in the Community Development Department.
