RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA REGARDING CONDITIONAL APPROVAL OF FINAL MAPS
AND PARCEL MAPS AND THE SECURING OF INCOMPLETE
SUBDIVISION IMPROVEMENT PLANS
WHEREAS, the City desires to facilitate the development of residential and
commercial subdivisions; and
WHEREAS, developer financing for design and improvement of subdivisions is
often dependent on the existence of a recorded final map or parcel map; and
WHEREAS, Section 66458(b) of the Subdivision Map Act grants the City Council
broad authority to authorize time extensions regarding final map approval, or
disapproval, upon receiving the map for consideration; and
WHEREAS, the City Council relies on professional city staff to review all required
items for conformance with requirements and it is therefore appropriate for the City
Council to approve a final map subject to review and confirmation of the required items
by professional city staff within a reasonable period of time specified by the City
Council; and
WHEREAS, the City Council has adopted Section 13.20.110 and 13.24.040 of
the La Quinta Municipal Code LQMC) which permit the establishment, by resolution,
of procedures for conditional approval of subdivision maps and for accepting security
in lieu of completed subdivision improvement plans, both of which are intended to
facilitate the timely recordation of final maps;
NOW, THEREFORE, the City Council of the City of La Quinta, California, resolves
as follows:
Section 1: Applicability
The procedures and rules herein prescribed shall apply to subdivision maps and
the securing of incomplete subdivision improvement plans related thereto;

Section 2. Conditional Approval of Subdivision Maps
A subdivider may apply for conditional approval of a subdivision map pending
completion of a portion of the map approval requirements specified in Section
13.20.110 of the LQMC. Applications for conditional approval shall be submitted to
the City Engineer and will be considered only if the subdivider has submitted a signed,
notarized subdivision improvement agreement, the subdivision map has completed at
least one round of map checking and requires only minimal revisions, and the City
Engineer determines that:
1 It is likely that all other map filing requirements will be satisfied within 30
days of conditional approval, and
2. The request will not adversely impact other work commitments of city staff.
If the above requirements are met, the City Engineer shall prepare a resolution of
conditional map appro*l for consideration by the City Council.
Section 3: Security in Lieu of Completed Improvement Plans
A subdivider may furnish security in lieu of completed improvement plans.
Performance and labor and materials security shall be for 100% of the estimated cost
of the design and plan preparation and shall conform with the requirements for
improvement security as specified in Chapter 1 3.28, LQMC.
Section 4: Improvement Security Contingency for Incomplete Improvement Plans
If improvement plans are secured and are not sufficiently complete for accurate
estimates of improvement costs, subdivision improvement security shall be increased
by a contingency percentage as follows:
* Unchecked plans or written scope of work: 35%
* Plans which have completed first-round check: 30%
* Plans which have completed second-round checking: 25%
* Approved plans: 10%

Upon receipt of completed improvement plans, the City Engineer may authorize
the release of improvement plan security and, if warranted, a reduction in the
improvement security contingency.
