CC Resolution 1998-096^ U RESOLUTION 98-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL ASSESSMENT 98-359 FOR SPECIFIC PLAN 98-032 AND CONDITIONAL USE PERMIT 98-040, TO ALLOW RECREATIONAL AND RESORT RESIDENTIAL USES AT THE RETREAT AT THE QUARRY. ENVIRONMENTAL ASSESSMENT 98-359 APPLICANT: LA QUINTA GOLF PROPERTIES WHEREAS, the City Council of the City of La Quinta, California, did on the 18** day of August, 1998, hold a duly-noticed Public Hearing to consider the request of La Quinta Golf Properties on the Environmental Analysis for Specific Plan 98-032 and Conditional Use Permit 98-040, located at the northeast corner of Tom Fazio Lane North and Quarry Lane in The Quarry at La Quinta; and, WHEREAS, the Planning Commission of the City of La Quinta, California, did, on the 28* day of July, 1998, hold a fuly-noticed Public hearing to consider the request of La Quinta Golf Properties on the Environmental Analysis for Specific Plan 98- 032 and Conditional Use Permit 98-040, and did recommend Certification of a Mitigated Declaration of Environmental Impact, by adoption of Resolution 98-059; and, WHEREAS, said Environmental Assessment complies with the requirements of *The Rules t0 Implement the California Environmental Quality Act of 1970" as amended, Resolution 83*3), in that the Community Development Director has conducted an Initial Study Environmental Assessment 98-359) and has determined that although the proposed specific plan and conditional use permit could have a significant adverse impact on the environment, there would not be a significant effect in this case because appropriate mitigation measures are to be made conditions of approval for Environmental Assessment 98-359, ad a Mitigated Negative Declaration of Environmental Impact should be filed; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said City Council did make findings to justify the certification of said Environmental Assessment; and, WHEREAS, at the Public Hearing, said recommendation for certification was based on findings and subject to certain mitigation measures; and, WHEREAS, the La Quinta City Council on the 18* day of August, 1998, did find the following facts to justify certification of said Environmental Assessment: BIB] 09-29-1998-U01 09:37:46AM-U01 ADMIN-U01 CCRES-U02 98-U02 96-U02 ^ UResolution 98-96 Page 2 1. The proposed Specific Plan and Conditional Use Permit will not have the potential to degrade the quality of the environment, with the implementation of mitigation measures. 2. The proposed Specific Plan and Conditional Use Permit will not have the potential to achieve short term goals to the disadvantage of long-term goals, with the successful implementation of mitigation measures. 3. The proposed Specific Plan and Conditional Use Permit will not have impacts which are individually limited but cumulatively considerable when considering planned for and proposed development in the immediate vicinity. 4. The proposed Specific Plan and Conditional Use Permit will not have environmental effects that will adversely affect humans, either directly or indirectly, with the implementation of mitigation measures. NOW THEREFORE, BE IT RESOLVED by the City Council for the City of La Quinta, California, as follows: 1. That the above recitations are true and correct and constitutes the findings of the City Council in this case 2. That it does hereby concur with the environmental determination and Certification of Environmental Assessment 98-359 for the proposed Specific Plan 98-032 and Conditional Use Permit 98-040.
