CC Resolution 1999-015d_Xf RESOLUTION NO.99-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA; APPROVING THE APPLICATION FOR THE FISCAL YEAR 1998-1999 AND 1999-2000 BICYCLE LANE ACCOUNT GRANT PROGRAM FOR A CLASS I BIKELANE BRIDGE CROSSING FOR HIGHWAY 111 AT DEEP CANYON STORMWATER CHANNEL LOCATED ON THE BORDER OF THE CITY OF LA QUINTA AND THE CITY OF INDIAN WELLS WHEREAS, the people of the State of California enacted Senate Bill No.1095 adding Chapter 8 to the Streets and Highways Code which provides for nonmotorized transportation and to provide funds for the implementation of the nonmotorized transportation; and WHEREAS, the Department of Transportation shall make available not less than $1.78 million for fiscal years 1998-99 and 1999-00, which have been combined to make a larger amount of funds available, for the construction of nonmotorized transportation facilities to be used in conjunction with the state highway system; and WHEREAS, the City of La Quinta wishes to utilize these state funds to further the goals and objectives of its General Plan, the City's Bicycle Transportation Plan, the region's bicycle commuter needs, and the Coachella Valley Association of Governments' Proposed System of Non-Motorized Facilites regarding a bicycle network; and WHEREAS, the state will pay 90% of the project costs and the City of La Quinta/City of Indian Wells shall be responsible for 1 0% of the project construction costs; and WHEREAS, the City proposes to have the project reviewed pursuant to the California Environmental Quality Act, and file all necessary clearances pursuant to the requirements of this program. NOW, THEREFORE. BE IT RESOLVED BY THE CITY OF LA QUINTA AS FOLLOWS: SECTION 1. The City hereby approves the application for the Bicycle Lane Account program for a Class I bikelane bridge crossing for Highway 111. SECTION 2. The City certifies that adequate provisions for operation and maintenance of the project will be made. The City certifies that 10% of the total construction cost of the project will be provided. SECTION 4. The City appoints the City Manager to be the Administering Agency Representative as agent of the City of La Quinta to conduct all negotiations, execute and submit all documents, amendments, payment requests and other administrative duties which may be necessary during the course of the pIanning? design, construction, operation and maintenance of the aforementioned project.
