CC Resolution 1999-026d_X RESOLUTION NO.99-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL ASSESSMENT 98-365 PREPARED FOR PROPOSED TENTATIVE TRACT MAP 28964 ENVIRONMENTAL ASSESSMENT 98-365 WHEREAS, the City Council of the City of La Quinta, California did on the 1 5th day of December, 1 998, and the 2nd day of February, 1 999, hold a duly noticed Public Hearing to consider approving Environmental Assessment 98-365, prepared for proposed Tentative Tract Map 28964; and, WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 26th day of January, 1 999, hold a duly noticed Public Hearing to consider recommendations on Environmental Assessment 98-365, prepared for proposed Tentative Tract Map 28964 generally located on the north side of 50th Avenue, 1 600 feet west of Jefferson Street, and more particularly described as: ASSESSOR PARCEL NUMBER 649-100-015 A PORTION OF THE SE 1/4 OF SECTION 32, T5S, R7E, SBBM RIVERSIDE COUNTY WHEREAS, said application has complied with the requirements of The Rules to Implement the California Environmental Quality Act of 1 970" as amended; Resolution 83-68 adopted by the La Ouinta City Council) in that the Community Development Department has prepared an Initial Study EA 98-365); and, WHEREAS, the Community Development Director has determined that said application could have a significant adverse effect for some environmental issues, however, mitigation has been identified that, when implemented, will reduce the level of impacts to less than significant, and that a Mitigated Negative Declaration of Environmental Impact should be filed; and BIB] 03-17-1999-U01 02:40:57PM-U01 ADMIN-U01 CCRES-U02 99-U02 26-U02 d_XResolution 99-26 EA 98-365 February 9.1999 Page 2 WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, the City Council did find the following facts, findings, and reasons to justify certifying said Environmental Assessment: 1. The proposed tentative tract map will not be detrimental to the health, safety, or general welfare of the community, either indirectly or directly, in that no significant impacts have been identified for this issue. 2. The proposed subdivision will not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number of rare or endangered plants or animals, but will eliminate important examples of the major periods of California history or prehistory, unless 1 00% archaeological data recovery is completed for the two archaeological sites determined potentially significant under federal and State criteria, followed by archaeological monitoring of grubbing, grading, and trenching of the entire project site, according to the Phase II Testing Report and the Phase Ill Data Recovery Plan. 3. The proposed tentative tract map will not have the potential to achieve short- term environmental goals, to the disadvantage of long-term environmental goals, with the implementation of specific mitigation measures. 4. The proposed tentative tract map will have impacts which are individually limited or cumulatively considerable when considering planned or proposed development in the immediate vicinity, unless mitigation measures identified for the proposed project are implemented. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California as follows: 1. That the recitations are true and correct and constitute the findings of the City Council for this Environmental Assessment. 2. That it does hereby certify Environmental Assessment 98-365 for the reasons set forth in this Resolution and as stated in the Environmental Assessment Checklist and Addendum, on file in the Community Development Department.
