MINUTES
January 31, 1989
Adjourned meeting of the La Quinta City Council was called to order
at the hour of 7:30 P.M., Mayor Pena presiding, followed by the
Pledge of Allegiance.
PRESENT: Council Members Bohnenberger, Rushworth, Sniff, Mayor Pena
ABSENT: Council Member Bosworth
MOTION It was moved by Council Member Bohnenberger, seconded by
Council Member Sniff that Council Member Bosworth be excused. Motion
carried unanimously.

ANNOUNCEMENTS
BUSINESS SESSION
1. CONSIDERATION OF ASSESSMENT SUBSIDY PROGRAM FOR ASSESSMENT
DISTRICT NO. 88-1.
Mr. Kiedrowski, City Manager advised that on January 17th, staff
presented a proposal that called for the Redevelopment Agency to
subsidize assessment district payments for Assessment District
No. 88-1 from the Agency's low to moderate income housing
set-aside funds. This program would be made available to persons
and households in the low to moderate income categories. The
program's purpose is to improve and increase the supply of
affordable very low, low and moderate income housing while
providing necessary infrastructure improvements utilizing
assessment district funding.
At the conclusion of the reports, he recommended that the
Assessment Subsidy Program be approved and that he be directed to
move forward and institute the activities necessary for
implementation. Final approval of this program will take place
through the adoption of resolutions by both the Council and the
Redevelopment Agency at a future date.
FRANK SPEVACEK, representing Rosenow, Spevacek Group, advised
that if the Council/Agency approves this program, the material
included in staff's report to Council will be mailed out to the
property owners within Phase I of the Assessment District to
inform them of the availability of this program. The goal is to
qualify and achieve funding for all qualified families by March
13th, which is the end of the cash payment period. After that
date, qualification would be on-going for the duration of the
program.

In response to Council Member Bohnenberger, Mr. Spevacek advised
that in the case of rental property, both the owner and renter
would have to apply and the renter would have to submit income
statements and the owner would have to agree to have a covenant
recorded against his property to guarantee affordable rental
rates for the life of the project.
Council Member Bohnenberger felt the total allowable assets
should be increased from $25,000 to $100,000 if it can be done
legally. Mr. Spevacek advised that there is no legal basis for
the amount the Council/Agency can make that determination.
Mr. Kiedrowski noted that an individual who owns more than one
parcel can use the subsidy program for only one parcel.
Council Member Sniff stated that he wished to proceed with the
program and favored raising the asset limit to $100,000. He
questioned how this program would be administered and Mr.
Spevacek proceeded to detail the process.
In answer to further questions by Council Member Sniff, Mr.
Kiedrowski advised that the program is justified in the same
manner in which the Redevelopment Agency was formed. The plan
adopted several years ago says that the area is prone to
flooding, that it lacks street improvements, that it lacks
adequate water in places and lacks sewers all of these affect
housing conditions.
Regarding the amount of money this pool will have in it, Mr.
Specevak advised that 88/89 it will have an estimated $292,000;
in 89/90 $493,000; and in 91/92 $705,000.
In response to Council Member Sniff, Mr. Spevacek and Mr.
Kiedrowski advised that g" under eligibility can be removed
regarding right-of-way dedication.
Discussion ensued regarding rental properties with Council and
Consultant concurring on sending out two application forms one
for owner/occupied units and one for renter/occupied units.
Regarding confidentiality of files, Mr. Spevacek advised that a
limited number of people will have access to the files.
Mayor Pena asked if an individual would have to continue
qualifying each year, and Mr. Spevacek advised that part of
the program has not yet been work out.
Mr. Kiedrowski then reviewed the qualifying income categories.
Regarding the determination of assets, Mr. Spevacek advised that
other than using IRS forms, there is no other way to verify total
assets.

With regard the on-going administration of the program, Mr.
Kiedrowski advised that there may need to be a full time person
assigned to it either by the consultants or City staff, which
can be paid for through the Assessment District.
MOTION It was moved by Council Member Bohnenberger, seconded by
Council Member Sniff that the City Manager be directed to move
forward and institute the activities necessary for implementation
of this subsidy program and that two forms be sent out one for
renters and one for owners and that Item g be removed from
eligibility and that the net assets under Item d be changed from
$25,000 to $100,000 Motion carried unanimously. MINUTE ORDER
NO. 89-12.
2. CONSIDERATION OF REQUEST BY BERMUDA DUNES PROPERTY OWNERS TO
ANNEX TO CITY OF LA QUINTA.
Mr. Kiedrowski advised that the Council has received petitions
signed by approximately 65 property owners north of Fred Waring
requesting annexation. Additionally, staff and Council have
received calls inquiring about annexation procedures. The
procedure is to first ask LAFCO to establish a Sphere of
Influence for the City of La Quinta to the north. Then, if
property owners were willing, annexation could proceed.
Two years ago, based on an agreement with Coachella, we asked
LAFCO to establish a Sphere of Influence to the south and east
which has been completed. About the same time, we signed an
agreement with the City of India regarding a Sphere of Influence
to the north. We have never asked LAFCO to make a determination
based on that agreement. If the Council wishes to go forward, we
should first do a survey to see how many people north of Fred
Waring want to be a part of La Quinta. If the vast majority do
not wish to annex, then the proceedings would cease.
Council Member Sniff felt that we should proceed with a survey to
get the opinion of the people. He then questioned the boundaries
being discussed.
Mr. Kiedrowski advised that the boundaries are generally Fred
Waring an the South; Avenue 38 to the north; and Jefferson on the
east. There are approximately 1,500 to 2,000 residents in the
area.
At this time, the Mayor called on people who wished to speak.
ROBERT CARIAN, 79-158 Buff Bay, Bermuda Dunes, felt that the
petition represents too small a number of people to warrant an
annexation study. La Quinta has enough vacant land for at least
20 years. He felt the property owners should go slow and examine
other possibilities than annexation.

DALE PENCE, 79-860 Ryan Way, Bermuda Dunes, Vice President of the
Community Association and member of the newly formed Security
Association believed that a majority of the members of the
Community Assoc. would oppose annexation at this time. He
expressed concern about the City allowing a tract to go in south
of Fred Waring with lot sizes 7,500 to 8,000 whereas the lot
sizes in Bermuda Dunes range from about 10,000 to 20,000.
STUART CASE, 79-021 Starlight, Bermuda Dunes, President of
Bermuda Dunes Country Club, advised that they are working on
incorporation of the Bermuda Dunes area, east and west of
Washington from Fred Waring and across Interstate 10. They don't
wish to be a part of Indio or La Quinta, they wish to have their
own incorporated community. He expressed dismay at the way in
which the City's sewer system is being handled.
BOB PHILLIPS, 78-805 Starlight, Bermuda Dunes, President of
Bermuda Dunes Community Association stated that he was unaware of
this annexation move until he received a call from a local
newspaper. He believed that those who are in favor of this
annexation are those in private interest.
GEORGE CROSIER, 79-134 Starlight, Bermuda Dunes, Chairman of the
Architectural Control Committee and new President of the Security
Association expressed surprise that La Quinta is looking to go
forward with an annexation with so few signatures. He felt that
La Quinta should resolve some of their problems before annexing
further.
ERNIE DUNLEVIE, 42-555 Stardust, Bermuda Dunes, questioned where
the proponents of this proposal are. Mr. Rick Johnson claims to
own 240 acres in Bermuda Dunes; however, his review of the
ownership records do not show this it must be more like 24
acres. He questioned who the Property Owners Association" are.
He also questioned whether Mr. Johnson was solicited by the City
to obtain these signatures.
Mayor Pena advised that the Council is simply responding to a
request by people to put this on the agenda, the City is not
actively soliciting any annexation.
CHRIS DESALVA, 52-670 Avenida Villa, stated that he read in the
paper that the City would pay the costs of annexation and
consultants and felt this is wrong if an area wishes to annex,
they should pay the fees. He felt that the City has enough
problems right now without adding to them.
Council Member Bohnenberger stated that the beauty of our
democracy is that one person can come before their local
government, submit their ideas and be heard. Seven people have
just been heard from expressing their point of view just as the
65 other people did. Petitions have been received from 65
people stating they have an interest in annexation to the City of

La Quinta the City didn't initiate these petitions, the Council
is only responding to a request. When the City's problems are
talked about, it should be recognized that the City has made a
fair amount of progress during the past six years as a City.
What the City is considering at this time, is the only democratic
thing to do and that is to send out a survey to all the property
owners and get a fair representation.
Council Member Sniff supported Council Member Bohnenberger's
comments, but was disappointed that none of the proponents are
represented here. He supported the idea of a survey, which can
be responded to by all the property owners.
In response to Council Member Rushworth, Mr. Kiedrowski advised
that the only cost in doing a survey is postage and staff time in
sending it out and tabulating the results. He added that the
people he has talked to were unaware of an active movement to
incorporate. If there is a process, then perhaps the Council
should receive these petitions and wait a few months to see if
that move materializes and if it doesn't, then we can send out a
survey.
Mayor Pena believed that if they are interested in forming their
own City, then perhaps we should sit down and talk to them about
it, and get some cost estimates, pointing out that it isn't the
City's intent to push anything on the people. However, he felt
that the City has some kind of responsibility to the people who
submitted the petitions. Without further information, he felt
the Council should receive the petitions and continue the matter.
ERNIE DUNLEVIE advised that there is a definite incorporation
move in Bermuda Dunes. He felt that it would be a good idea for
the City to wait until that has a chance to materialize.
MOTION It was moved by Council Member Rushworth, seconded by
Council Member Bohnenberger to table this discussion for six
months.
Council Member Sniff suggested that the Mayor and City Manager
communicate with the leadership of that area to get the pulse
during these next six months.

MOTION It was moved by Council Member Bohnenberger, seconded by
Council Member Sniff that Consent Item No. 1 be approved by
