MINUTES
Special meeting of the La Quinta City Council was called to
order at the hour of 12:00 Noon, Mayor Pena presiding.
PRESENT: Council Members Bohnenberger, Bosworth, Rushworth,
Sniff, Mayor Pena
ABSENT: None
BUSINESS SESSION
1. ADOPTION OF RESOLUTION DETERMINING UNPAID ASSESSMENTS, THE
MANNER OF PAYMENT THEREFOR, LISTING THE BONDS TO BE ISSUED ON
THE SECURITY THEREFOR, AUTHORIZING THE FILING OF AN ADDENDUM
TO THE NOTICE OF ASSESSMENT AND DETERMINING THE ASSESSMENT
FOR ADMINISTRATION COSTS.
Mrs. Juhola, City Clerk, advised that the aggregate amount of
unpaid assessments is $855,984.36.
Mr. Genovese, Asst. City Manager, advised that prepaids were
just under $300,000 representing about 20%.
RESOLUTION NO. 89-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, DETERMINING UNPAID ASSESSMENTS, THE MANNER OF
PAYMENT THEREOF, LISTING THE BONDS TO BE ISSUED ON THE
SECURITY THEREFOR, AUTHORIZING THE FILING OF AN ADDENDUM TO

ADMINISTRATION COSTS.
It was moved by Council Member Bosworth, seconded by Council
Member Bohnenberger that Resolution No. 89-41 be adopted.
Motion carried by the following vote:
AYES: Council Members Bohnenberger, Bosworth, Rushworth,
Sniff, Mayor Pena
NOES: None
ABSTAIN: None
ABSENT: None
2. ADOPTION OF RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF
LIMITED OBLIGATION IMPROVEMENT BONDS OF SAID CITY, IN AN
AGGREGATE PRINCIPAL AMOUNT OF $855,984.3E.
RESOLUTION NO. 89-42
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, PROVIDING FOR THE ISSUANCE AND SALE OF LIMITED
OBLIGATION IMPROVEMENT BONDS OF SAID CITY, IN AN AGGREGATE

It was moved by Council Member Sniff, seconded by Council
Member Bosworth that Resolution No. 89-42 be adopted. Passed
by the following vote:
AYES: Council Members Bohnenberger, Bosworth, Rushworth,
Sniff, Mayor Pena
NOES: None
ABSTAIN: None
ABSENT: None
3. DISCUSSION REGARDING INCLUSION OF NATURAL GAS IN PHASE II OF
COVE IMPROVEMENT PROJECT.
Mr. Kiedrowski stated that staff needs to have direction from
the Council as to whether or not to include natural gas lines
in Phase II engineering.
Council Member Rushworth asked if anyone in Phase II has
expressed an interest one way or another and Mr. Kiedrowski
advised that notices have not yet been sent out. We have
heard from some people in Phase I say they're disappointed
that gas was not included on the other hand, many did not
want gas.
Mayor Pena commented that if it is included in the
engineering and does not go forward, the City will be out
between $20,OOO-$30,OOC.
Council Member Bohnenberger stated that he has heard from
many people who were disappointed that gas didn't proceed so
he wished to see it included again.
Mayor Pena stated that he was opposed to it in Phase I, but
felt that it should be included again so the people can voice
their wishes.
Council Member Rushworth stated that he voted for it last
time, but felt that we would be foolish to include it again,
if the Council will feel the same next time and vote it down.
MOTION It was moved by Council Member Bohnenberger,
seconded by Council Member Rushworth that natural gas lines
be included in Phase II of the Cove Improvement Project.
Council Member Sniff stated that he was opposed to including
gas as people he has talked to were grateful that it wasn't
included in Phase I.
Council Member Bosworth felt that the people should have the
opportunity to voice their opinion.
MOTION CARRIED with Council Member Sniff voting NO. MINUTE

4. CONSIDERATION OF INTRODUCTION OF ORDINANCE REGULATING GARAGE
SALES AND OTHER SPECIAL SALES EVENTS.
Mr. Kiedrowskj advised that the Council has been presented a
draft ordinance for consideration which regulates garage
sales to the extent that an individual would be limited to
two per year and includes a permit fee of $10.00 for each
event.
Council Member Sniff didn?t feel that the City has a major
problem with garage sales and noted that he previously
proposed a bulletin board which garage sale signs could be
placed on.
Discussion ensued with Council Member Bohnenberger suggesting
that a permit be required, and during the phase-in period
that the Code Enforcement Officer, when driving around, write
a permit at the site, but that there be no fee.
Mayor Pena felt that they should be limited to three each
year, and added that he had a problem with a City-maintained
billboard.
MOTION It was moved by Council Member Bohnenberger,
seconded by Council Member Bosworth that Ordinance No. 136 be
taken up by title and number only. Motion carried
unanimously.
ORDINANCE NO. 136
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, AMENDING THE MUNICIPAL CODE RELATING TO
REGULATION OF SPECIAL SALES EVENTS.
It was moved by Council Member Bohnenberger, seconded by
Council Member Bosworth that Ordinance No. 136 be introduced
as amended that the permit fee be deleted and that Section
11.80.040 be amended to read... No more than 3 special sales
events may be held at any residence within any 12 month
period". Motion carried by the following vote:
AYES: Council Members Bohnenberger, Bosworth, Rushworth,
Mayor Pena
NOES: Council Member Sniff
ABSTAIN: None
ABSENT: None
