CALL TO ORDER
A. Mayor Baier called upon Father Brennan to administer the Invocation.
B. The flag salute was led by Council Member Allen.
2. ROLL CALL
Present: Council Members Allen, Cox, Wolff and Mayor Baier.
Absent: Council Member Henderson.
Moved by Council Member Cox, seconded by Council Member Allen, to excuse Council
Member Henderson. Unanimously adopted.
3. PUBLIC COMMENT
The Mayor indicated that this time was set aside for citizens to address the City
Council on matters relating to City business, and explained that a three minute
time limit on comments would be enforced. Comment was heard from the following
citizens:
A. John Bund, 54-865 Avenida Alvarado, addressed the Council regarding the proposed
amendment to the Municipal Land Use Ordinance No. 348 relative to height and
setback requirements for walls and fences. The City Manager explained that Mr.
Bund's comments should be made during the Public Hearing portion of the agenda
reserved for this issue.
4. WRITTEN COMMUNICATIONS
A. The City Manager explained a communication from Kay Wolff regarding the direct
election of the mayor. Mayor Beier reported that it was the concensus of the
Council to appoint Council Members Allen and Cox to a committee to study the
matter and report back with a recommendation to the City Council.
5. COMMENT BY COUNCIL MEMBERS
A. Council Member Allen expressed enthusiasm relative to the excellent turn -out
at the La Quints. Park, and stated his hope that more parks will become reality
in the fairly near future. He further reported that the Chamber of Commerce is
working on obtaining a fair-sized park at the upper end of the Cove. He also
thanked the C.V. Parks and Recreation for the excellent work they did on the
refurbishing at La Quinta Park.
B. Council Member Wolff reported that the La Quinta Report now has a firm time
slot. It will be aired on Saturdays at 4:00 p.m, on Channel 10. He also
reported that he would be abstaining from voting on any matters pertaining to
the Desert Club because he had accepted a membership, which was subsequently
returned. He further stated that he had been advised by the City Attorney that
acceptance of such a gift prohibited his voting on any matter which might involve
the Desert Club.

C. Mayor Baier reported that Desert Beautiful and the La Quints property Owners
Association have initiated a newspaper recycling center. Newspapers may be
deposited at the La Quinta Fire Station, on the east side of the building.
All proceeds will go to Desert Beautiful. Mayor Baier also commended the Sports
and Youth Association on the work done for opening day of baseball season.
6. HEARINGS
A. The City Manager introduced a continued public hearing regarding a proposed
amendment to the Municipal Land Use Ordinance No. 348, regarding height and
setback requirements for walls and fences; and explained that the Council has
received written reports from the Planning Commission and Planning Department
staff. He reported that the Planning Commission is recommending the Ordinance
as presented, which would provide for a maximum six-foot high fence, wall or
hedge along all property lines on residentially zoned property, excepting corner
lots, for which the fence height would be subject to Council determination. He
further reported that Planning staff is recommending approval of Section 18.40,
with changes based on findings as listed in the Staff Report dated April 19, 1983.
The Mayor opened the hearing to public comment. Comment was heard from the
following citizens:
A. John Bund, 54-865 Avenida Madero, La Quinta, presented drawings of existing
conditions for Council consideration, and spoke in favor of allowing people
to place a 6 foot high fence on their property line.
B. Paul Morway, 77-395 Calle Durango, La Quinta, stated that this ordinance
represents an "overabundance" of rules, regulations and ordinances which
are unnecessary at this time, and that the Planning Commission might better
regulate fence height during Planning Commission review of new home
construction.
C. Janet Diemer, 52-215 Ave. Madero, La Quinta, spoke against the proposed
ordinance, citing protection of small children and safety primarily.
D. Angela Morway, 77-395 Calle Durango, La Quinta, asked the Council to make
a decision considering recommendation and comments made, but not allow
further delay in the decision making process.
There being no further comments, Mayor Baier closed the public hearing. The
City Manager responded to public comment, citing various reasons for the staff
recommendations. Mayor Baier then opened the hearing to discussion between
Council and staff.
After discussion, it was moved by Council Member Wolff, seconded by Council
Member Cox, to refer the proposed ordinance to the Planning Commission for a
report with the following proposed changes:
1. Fences shall be set back five (5) feet from the front property line, with
the setback area landscaped.
2.The ordinance shall not apply to the height of vegetation or landscaping.
3. On corner lots, no fence over 3' feet in height shall be permitted within
the 20 -foot corner cutback area.
4. The height of the fences shall be measured from the level of the natural
grade.

B. The City Manager introduced a public hearing regarding Tentative Tract
Map No. 19203, Amendment No. 1, the Desert Club of La Quinta, Applicant.
The City Manager reported that the Planning Commission had considered this
application at their meeting of May 10, 1983, and continued it to an
adjourned regular meeting to be held May 24, 1983. He therefore recommended
that the Council continue the public hearing to the City Council meeting of
June 7, 1983.
Moved by Council Member Cox, seconded by Council Member Allen, to continue
the public hearing regarding Tentative Tract Map No. 19203, Amendment No. 1,
to Tuesday, June 7, 1983, at or about 7:30 p.m., in the Council Chamber.
Unanimously adopted.
C. The City Manager introduced a public hearing regarding the proposed aban-
donment of Avenida Bermudas, between the La Quints, Stormwater Channel and
Avenue 50, Landmark Land Company, Applicant, and reported that adoption of
the negative declaration regarding environmental impact and approval of the
abandonment of that portion of Avenida Bermudas, between the La Quints.
Stormwater Channel and Avenue, had been recommended by the Planning
Commission at their meeting of May 10, 1983.
Mayor Bader opened the hearing to public comment. Comment was heard from
the following persons:
A. Kevin Manning, P.O. Box 1000, La Quinta, explained the purpose of
the proposed street abandonment, which is to record the first phase
of Tentative Tract 18767, a 23 -unit portion of the entire 80 -82 -unit
tract. He explained that Landmark Land Company anticipates beginning
construction by June 15, 1983.
There being no further public comment, the Mayor closed the public hearing.
Moved by Council Member Cox, seconded by Council Member Wolff, to adopt
the following resolution:
RESOLUTION NO. 83-26. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, ORDERING
VACATION OF A PORTION OF THE RIGHT-OF-WAY EASEMENT FOR AVENIDA BERMUDAS,
BETWEEN AVENUE 50 AND THE SOUTHERLY SIDE OF THE LA QUINTA STORMWATER CHANNEL,
WHICH PORTION OF RIGHT-OF-WAY HAS BEEN UNUSED AND IMPASSABLE.
Unanimously adopted.
7. CONSENT CALENDAR
Moved by Council Member Cox, seconded by Council Member Allen, to approve the
Consent Calendar. Unanimously adopted by roll call vote.
A. The Minutes of the City Council meeting of May 3, 1983, were approved as
submitted.
B. RESOLUTION NO. 83-27. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, APPROVING
DEMANDS.

8. BUSINESS SESSION
A. The City Manager presented a report regarding a proposed ordinance relative
to the habitation of recreational vehicles in residential zones. He explained
that this ordinance was referred to the Planning Commission for a report in
which the Council had requested a change providing that the maximum period of
45 days in any 12 -month period may be utilized for the habitation of a
recreational vehicle in a residential zone. He stated that the Planning
Commission was in concurrence with this recommendation, and recommended
adoption of the following proposed Ordinance:
ORDINANCE NO. 30. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, AMENDING THE CITY'S
ZONING ORDINANCE BY ADDING THERETO REGULATIONS RELATING TO HABITATION OF
RECREATIONAL VEHICLES IN RESIDENTIAL ZONES.
Moved by Council Member Cox, seconded by Council Member Wolff, to waive
further reading and adopt the proposed Ordinance.

AYES: Council Members Allen, Cox, Wolff and Mayor Baier.
NOES: None.
ABSENT: Council Member Henderson.
B. The City Manager presented a report regarding selection of four (4) community
members to the Traffic.Safety Committee, and stated that six resumes had been
received. He reported that the Traffic Safety Committee will consist of nine
members: four members from the community, one Council member, two City staff
members, one member from the Riverside County Sheriff's Department and one
member from the Riverside County Road Department.
Moved by Council Member Cox, seconded by Council Member Allen, to appoint
Martin Beck, John Bund, John J. Burns and Alfred R. Cablay to the La Quinta
Traffic Safety Committee.
Roll Call Vote:
AYES: Council Members Allen, Cox, Wolff and Mayor Baier.
NOES: None.
ABSENT: Council Member Henderson.
The City Manager explained that the Council should now appoint the
Council Member to serve on the Traffic Safety Committee, as designated
in Resolution No. 83-20.
Moved by Council Member Wolff, seconded by Council Member Cox, to appoint
Council Member L. Allen as the City Council Member designated to serve on
the La Quinta Traffic Safety Committee. Unanimously adopted.
C. The City Manager presented a report regarding an amended Business License
Ordinance, and explained the reduction in fees, confidentiality guarantees
and established license schedule.

Moved by Council Member Allen, seconded by Council Member Cox, to waive
further reading and introduce the proposed ordinance, and to direct City
staff to refund any monies due to persons who overpaid under the prior
Ordinance No. 16. Unanimously adopted.
D. The City Manager presented a report regarding establishment of a Human
Relations Committee.
Moved by Council Member Wolff, seconded by Council Member Cox, to direct
the City Attorney to prepare appropriate documents for the establishment
of a Human Relations Committee as described in the Staff Report dated
May 13, 1983, and to direct the City Manager to seek applicants for
membership on the Committee. Unanimously adopted.
E. MINUTE RESOLUTION. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, CONGRATULATING
THE LA QUINTA SPORTS AND YOUTH ASSOCIATION ON THE OCCASION OF THE SIXTH
ANNUAL LA QUINTA SPORTS AND YOUTH DAY.
Moved by Council Member Cox, seconded by Council Member Allen, to adopt
the Minute Resolution. Unanimously adopted.
F. MINUTE RESOLUTION. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, EXPRESSING
APPRECIATION TO STANLEY SNIFF FOR PERSONAL EFFORT TOWARDS THE IMPROVEMENT
OF WATER SERVICES IN LA QUINTA.
Moved by Council Member Cox, seconded by Council Member Allen, to adopt
the Minute Resolution. Unanimously adopted.
G. The City Manager presented a recommendation from the La Quinta Planning
Commission to approve a third one-year extension of time in which to file
a final map for Tentative Tract Map No. 14496 to May 20, 1984, Anden
Corporation, Applicant.
Moved by Council Member Cox, seconded by Council Member Wolff, to approve
a one-year extension of time in which to file the final map for Tentative
Tract Map No. 14496 to May 20, 1984. Unanimously adopted.
