1982 09 07 CC Minutes% MINUTES CITY COUNCIL CITY CF LA QUINTA A regular meeting held at the La Quinta Community Center, 77-861 Avenida Montezuma, La Quinta, California. September 7, 1982 7:?5 p.m. 1. CALL TO ORDER A. The flag salute was led by John Ryan. 2. ROLL CALL Present. Council Members Abbott, Baier, Cox, Henderson and Mayor Wolff. Absent. None. 3. PUBLIC COMMENT WRITTEN COMMUNICATIONS A. A communication was received from the Riverside City and County Public Library explaining County-wide library services and inviting Council appointment of a council member or designated representative to serve on the County Free Library Advisory Committee. This matter will remain open pending selection of a representative to serve on this advisory Committee. 5. COMMENT BY COUNCIL MEMBERS A. Council Member Cox discussed recent meetings held relative to baseball field lighting and improvements at La Quinta Park. B. Mayor Wolff expressed appreciation to various agencies and invidivudals who provided prompt response and assistance during flooding conditions in certain areas of La Quinta, with particular appreciation to those responding to the Avenue 50 storm channel crossing. Mayor Wolff reported that task force recommendations will be reviewed during a Council study session to be held September 8th. A report on Council response to these recommendations will be communicated at the Town Hall meeting of September 22, 1982. The Mayor reported that his recent tour of duty with a Riverside County Sheriff?s Department deputy was a very worthwhile experience. The Mayor opened a public hearing regarding revision of Specific Plan No. 121-B, Landmark Land Company, Applicant. Jeff Mann, Supervising Planner, Riverside County Planning Department, presented a staff report relative to Specific Plan 121-B which recommended adoption of the negative declaration for EA#15626 and adoption of the County Planning Commissions resolution recommending approval of revised Specific Plan No. 121-B. Mr. Mann answered Council questions pertaining to a site/ location for a permanent sewer treatment plant, sewer capacity, water and traffic signalization. The Mayor invited comment from the applicant, Landmark Land Company. John Cante, J.F. Davidson Associates, addressed the Council and concurred with the County Planning staff recommendations, and discussed public service issues including se?er services, water and traffic circulation/signalization relating to the proposed development. The Mayor opened the hearing for public comment. Comments were heard from the following individuals. 1. Lawrence 0. Allen, regarding keeping of horses in the Cit? 3-781 Avenida Herrera La Quinta 2. William Lord, regarding fire protection services. Battalion Chief Riverside County Fire Department After discussion, it was the consensus of the Council to continue the public hearing to the September 21, 1982, Council meeting in order to gather additional information relating to particular items of Council concern. Moved by Council Member Cox, seconded by Council Member Baier, to continue the public hearing relative to Revised Specific Plan No. 121-B to the September 21, 1982, Council meeting. Unanimously adopted. B. The Mayor opened a public hearing regarding Change of Zone, Case No. 3491, Landmark Land Company, Applicant. Jeff Mann, Supervising Planner, Riverside County Planning Department, advised the Council that this matter could not be acted upon until Revised Specific Plan No. 121-B had been adopted. There being no comment by Applicant or the public, it was the consensus of the Council to continue the public hearing to the next City Council meeting. CONSENT CALENDAR Moved by Council Member Cox, seconded by Council Member Bajer, to approve the Consent Calendar. Unanimously adopted. A. The Minutes of the regular meeting of August 3, 1982, were approved as submitted. B. RESOLUTION NO. 82-44. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING DEMANDS. 8. BUSINESS SESSION A. Jeff Mann, Supervising Planner, Riverside County Planning Department, presented an East Area Planning Council report relative to second extension of time, Tract Map No. 14496 EA No. 11569), J.F. Davidson Associates/Anden Corp., Applicant, and recommended Council approval of the second extension of time, which would expire May 20, 1983. Moved by Council Member Cox, seconded by Council Member Henderson, to approve the second extension of time for Tract Map No. 14496, to expire May 20, 1983. Unanimously adopted. B. The City Manager read the title of a proposed ordinance, as follows: ORDINANCE NO. 13. AN ORDINANCE OF THE CITY COUNCIL OF HE CITY OF LA QUINTA, CALI- FORNIA, AMENDING PROVISIONS OF THE CITY?S ZONING ORDINANCE AND SUBDIVISION ORDINANCE RELATING TO THE TIME AND MANNER OF GIVING NOTICES OF PUBLIC HEARINGS REGARDING REZONINGS, AMENDMENTS TO THE ZONING ORDINANCE, VARIANCES, CONDITIONAL USE PERMITS, PUBLIC USE PERMITS AND SUBDIVISION TENTATIVE MAPS. Moved by Council Member Henderson, seconded by Council Member Baier, to waive further reading and adopt the proposed ordinance. Unanimously adopted. C. The City Manager presented a report regarding fire flow requirements and read the title of a proposed ordinance, as follows: PROPOSED ORDINANCE. AN ORDINANCE OF THE CITY COUNCIL OF TH:E CITY OF LA QUINTA, CALI- FORNIA, AMENDING SECTION 10.301(c) OF THE UNIFORM FIRE CODE RELATING TO REQUIRED FIRE FLOWS IN NEW DEVELOPMENTS. Unanimously adopted. D. The City Manager presented a report regarding a needs- basis grant application relative to baseball field lighting at La Quinta Park, RESOLUTION NC. 82-45. A RESOLUTICN CF THE CITY COUNCIL CF THE CITY OF LA UINTA, CALl- FORNIA, ENDORSING THE COACHELLA VALLEY RECREATION AND PARK DISTRICT APPLICATION FOR GRANT FUNDS UNDER THE RCBERTI-Z BERG URBAN OPEN-SPACE AND RECREATION PROGRAM FOR LA QUINTA PARK BALLFIELD LIGHTING. Moved by Council Member Cox, seconded by Council Member Bajer, to adopt the proposed resolution. Unanimously adopted. E. The City Manager presented a report regarding Planning Commission recommendations relative to proposed require- ments for development of residences in the R-1 zone. He reminded Council members that a tentative joint study session between the Council and Planning Commission is scheduled for September 4, 1982, to review broad-range planning matters. F. The City Manager explained the proposed resolution regarding deposit and withdrawal of City funds in the State Local Agency Investment Fund. RESOLUTION NO. 82-46. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, COUNTY OF RIVERSIDE, STATE CF CALIFORNIA, AUTHORIZING DEPOSIT AND WITHDRAWAL IN THE STATE LOCAL AGENCY INVEST?ENT FUND. Moved by Council Member Cox, seconded by Council Member Henderson, to adopt the proposed resolution. Unanimously adopted. G. The City Manager presented a report from the Mayor regarding business license regulations, and recommended Council review and further Study pending future discussion. H. The City Manager presented a report relative to business license regulations and recommended that the Council review this report for future discussion. I. A motion to retain the law firm of Best, Best & Kneger for City representation in matters relating to property tax distribution was presentedby the City Manager. Moved by Council Member Cox, seconded by Council Member Baier, to retain Best, Best & Kneger to represent the City of La Quinta in matters relative to the distribution of real property tax.
