Subject: Assumption of Responsibility for La Quinta Park
I have met with Frank Guerrero, the District Manager of the Coachella
valley Recreation and Parks District regarding the assumption of
responsibility for La Quinta Park. He has indicated that he would
recommend favorably regarding the transfer of the park. He has
commented that if the City does not withdraw from the District,
the $59,843 grant funds which have been projected for the park will
be used here. We have determined that in fiscal year 1983-1984,
the amount of property taxes attributable to the District which were
collected in the City was $67844.77. Of this, $38,757.40 was
distributed to the Recreation and Park District. $29,087.37 was
held by the County of Riverside in the Special District Augmentation
Fund, which is a post-Proposition 13 financing structure for special
districts. A district-wide total of $87,000 in augmentation funds was
allocated to the District by the Board of Supervisors. Of this, 7.81%
or $6,795, was attributable to La Quinta. Therefore, a total of
$45,552 in revenue attributable to La Quinta was received by the
District.
In fiscal year 1985-1986, I would estimate that property tax revenue
attributable to La Quinta would be $40,300 and special district
augmentation funds attributable to La Quinta would be $7,800 for a
total of $48,100.
If the Council selects to assume responsibility for La Quinta Park,
I would recommend that the above amount be divided equally between
the City and the District. Mr. Guerrero has indicated that this
would seem equitable. However, an agreement would have to be approved
by his Board of Directors. Based upon my previously submitted budget
of $87,541, the difference of $63,491 would have to be taken from the
unallocated surplus of the general fund. In fiscal year 1984-1985,
this amount was $193,092.

Subject: Status of the La Quinta Flood Control Project
Mr. Weeks has indicated to me that he would be happy to have Tom
Levy or himself make a report to the City Council regarding the
status of the La Quinta Flood Control Project. However, he and
Tom will each be tied up in court next week, from Monday to Wednesday.
One of the cases involves clearing away the lawsuit which relates
to the La Quinta water reclamation facility below Lake Cahuilla.
Lowell has asked that the report be scheduled for the meeting of
October 16.
I am transmitting to the Council a copy of the preliminary plan for
the flood control channels. I need to stress that this is a
preliminary plan, and is subject to change.

Subject: Hillside Conservation Ordinance
This memorandum and the attached ordinance responds to the City Council's
recent direction to the city attorney to prepare an ordinance designed
to protect and control development on the cities' hillsides and
mountainsides. The important provisions of the enclosed ordinance,
referred to as the Hillside Conservation Ordinance, are as follows:
a. Findings, Purpose And Intent. The City Council makes findings
that mountainous and hilly areas within the City provide a
unique natural landmark in need of preservation for its
valuable scenic amenities and that potential development of
rocky mountainous slopes poses unique problems relating to
slope stability, drainage, erosion, visible scarring and
easily disturbed rock formations. Based upon these findings,
it is the purpose and intent of the ordinance to provide for
minimal disturbance of the natural terrain, to preserve the
beauty of the cities' landscape, to maximize retention of the
natural topographic features of mountain faces and ridge line
profiles, to assure that development will relate to surrounding
topography and not be conspicuous and obtrusive, and to protect
the hillside ecosystem and characteristics, including drainage
patterns, streams, slopes, rock outcroppings, vistas, and
natural vegetation.
b. Application Of The Ordinance And Permitted Uses. The
ordinance establishes a hillside conservation zone as an overlay
zone applicable to all parcels of land within the city with
topography with an average percent slope of 15% or more for the
entire parcel or which includes a grade of 25% or more on any

!)2 portion of the parcel. All parcels within the Hillside
Conservation Zone still retain the zoning designation and
standards of their original underlying zone, included the
uses permitted within the underlying zone.
C. Grading Control. No grading is permitted within the Hillside
Conservation Zone without approval of a grading permit by the
Planning Coriunission and City Council on appeal). The Commission
must consider certain specified criteria in determining
whether a permit may be issued. Land areas with 25% or greater
slope may not be graded in any manner except at the specific
discretion of the Commission where it can be shown that a
minimum amount of development is in the spirit of, and not
incompatible with, the purposes of the ordinance. All areas
designated as undevelopable within a hillside development
project may only be used for recreation for open space purposes
and must be offered, through dedication, to a public agency.
If the public agency does not accept the offer, the developer
must make provisions for the continued maintenance of the open
space.
d. Design Review. No permits may be issued for any grading,
building or structure in the HC zone until grading plans,
slope planning and irrigation plans and building elevations
are submitted for design review and approved by the Planning
Commission. The Commission may impose conditions on the
development so as to bring the development into conformity
with the intent and purpose of the ordinance.
This ordinance, in its present form, is now being submitted to the
City Council for conceptual approval. The City Manager and Planning
Director have reviewed the content of the ordinance and recommend its
approval, except for minor changes which may be made for such matters
as administrative ease of application. If the Council approves the
ordinance conceptually, it will be further reviewed by the City Staff
and eventually scheduled for a public hearing before the Planning
Commission and City Council.

At that meeting, the Indio Planning **ssion supported, on a split vote, the
issuance of a corx*iticnal Negative Declaration and the Zone Change which was condi-
tionally approved, but did not support the amed:ent to the General Plan for the
proposed recreational vehicle park. Staff appeared at the meeting and expressed
concern about the inadequate opportunity given our City to o*tu*t on the project
and in addition raised a number of other issues portinent to the project which are
set forth in the attached letter. For the most part, Indio Planning D*ar*t Staff
and the Indio Planrdng Cotniss ion had similar concerns. At this tiire, it a*ears the
continued effort working with the City of Indio will resslt in adequate responses to
the oatim*ts made. The Staff will continue its efforts to assure that the Indian
Springs Country Club project is *atible with projects existing and proposed in the
area within the City of La Quinta.

Subject: UNIFORM FIRE CODE CHANGES 1979 VS. 1982
BACKGROUND:
This report is in response to Council direction that staff provide a report
detailing the differences between the 1979 and 1982 Uniform Fire Code. A knowledge
of the 1979 and 1982 Uniform Fire Codes is very helpful in applying the contents of
this report.
As staff has previously indicated, the main purpose of the revisions in the 1982
U.F.C. vs. the 1979 U.F.C. are to clarify, reorganize, update and allow for techno-
logical changes.
The attached list is a complete analysis of revisions for the 1982 Uniform Fire
Code. The material comes from a booklet published by the I.C.B.O. entitled 1982
Analysis of Revisions". The booklet is 77 pages long and includes analysis of all
the uniform codes. The U.F.C. changes run from page 66 to page 77.
SUM**ARY:
The attached list is rather dry" technical reading and should be read in the
company of a copy of the 1982 Uniform Fire Code. Copies of those codes are available
from the Community Safety Coordinator.

Subject: LETTER OF COMMENDATION INFORMATIONAL)
This is to commend City employee Steve Kochell, Street Improvement Worker, for his
outstanding contribution in supervising the two highly successful Summer Youth
Employment Programs conducted in La Quinta this summer.
Steve was responsible, or involved in, the interviewing, hiring, documentation,
safety, transportation and work assignments of three 3) workers funded by the Job
Training Partnership Act Program of Riverside County and six 6) juvenile workers
funded by the City's own Summer Youth Employment Program.
Some of the projects completed through Steve and the workers included: roadside
litter clean up, roadside right-of-way maintenance, brush clearing, weed abatement,
street sign repair and maintenance, painting, road hazard repairs potholes and
shoulders), refurbishment or replacement of street name sign markers, vehicle
maintenance and repair work in general. Many tons of litter and debris were removed
from the City by these projects.
The amount of no cost labor provided through the County funded J.T.P.A. Program
amounted to 841 manhours. The amount of labor provided through the Summer Youth
Employment Program amounted to 400 manhours at a cost to the City of $1,400.00.
Steve Kochell was not hired as a supervisor but has functioned very well in that
capacity as evidenced by his diligent efforts supervising these two programs as well
as handling a variety of routine and priority incidents as a normal function of his
job.
The efforts of Steve resulted in La Quinta receiving the Fourth Supervisorial Dis-
trict of Riverside County1s Certification of Appreciation presented at the Board
of Supervisor's meeting of September 25, 1984 by Chairperson Larson. That certif-
icate is hereby presented to the La Quinta City Council for display at City Hall.

The City Engineer has prepared a preliminary cost estimate for the
subject drain, from the Whitewater Channel to the south boundary
of the plaza La Quinta shopping center at Washington Street.
The cost estimate of $275,000 includes:
a. outlet structure
b. protection barrier at outlet
c. 72'* reinforced concrete pipe mainline
d. 7211 RCP under Highway 111 jacked)
e. manholes
f. catch basins at four corners, junction structures and
connector pipes
g. 15% contingencies
h. 15% engineering cost and administration
The City Engineer believes that based upon final design, the actual
cost would be below the estimate.
Cost savings could be achieved through permission from Cal Trans
to cut a track rather than jack the pipe under Highway 111, direct
Cal Trans participation, and possible participation by Mr. Burnett.

Subject: School Mitigation Measures
Council Member Henderson and our Community Development Director have
brought to my attention that a significant development project in
the City of Indio, by Mr. Wayne Reeder, may be approved before the
adoption by that city of school infrastructure fees.
La Quinta and the other cities, as well as the County in the Desert
Sands Unified School District, have adopted fee requirements and
they are applying these requirements to current proDects. It seems
that approval of development projects in Indio, without the imposi-
tion of such fees, carries an unfair impact to the other jurisdictions.
Adoption of the accompanying resolution, requested by Council Member
Henderson, is respectfully recommended.
