Before and during the City Council Meeting of August 21, 1984 I was greatly
disturbed by the actions of Audrey Ostrowsky. She continually made a nui-
sance of herself by passing out campaigning literature, which I have attached
a copy of, and talking during the Council Meeting. Ibis greatly distracted
me and I am sure others on concentrating on the full intent of the City
Council Meeting.
I am sure that you and your City Council do not and should not condone actions
of this type during council meetings.
Thank you for your attention to this matter.

Subject; Public Comments at Council Meetings
Probably the most common complaints I hear about our Council
meetings is that the public may not comment on agenda items
during the meeting, except 1public hearing" items. I think
we are a small enough city,and our agendas are brief enough,
to open all items to public comment. It would please those
attending our meetings, provide us more input, and improve the
democratic process. I don't think there are ever more than
two or three items on an agenda which would draw public comments.
If we limit these to two minutes, it would really not be time-
consuming.
Furthermore, I think it would be helpful particularly if we
adopt this proposal) to have people sign up in advance for
public comments. This will provide the Mayor with informa-
tion for planning the timing of the meeting.
I hope you can support this recommendation. If so, we could
implement it at our first meeting in September.

Gn August 14, 1984, the Planning Cccmission conducted a public hearing on the
requested Change of Zone and unanijously with Chairman Thornburgh not participating
and Vice Chairrn** Salas absent) rec**ded approval of the zoning change. The
Planning Cccmission concrrred with the Staff rec**it*ded 2oning for the site see
attached report dated August 14, 1984) except that the asterisks **) denoting a
17-foot building height limit were deleted fr*n the R-2 zoned areas.
Major points discussed by the Planning **ssion relative to the Change of Zone
included:

It was the consensus of the *cnission that granting the Change of Zone would create
zoning consistent with the project design.

The project will be located on 360 acres of a 674-acre site. As shown on the
attached copy of the t*ographic map, appr*ima'tely 315 acres of the site are
the toes or slopes of nuuntains, **ile the r*riaining 360 acres are located on
the sandy alluvial fan. The eastern portion of the project site is currently
developed with citrus orchard and Burns Ranch buildings. The western portion
is sandy sloping ground with the pred*nant vegetation being creosote bush.
A sandy wash area is located in the southeasterly portion of the developeent
along the base of the x**untain.

Subject: ALTERNATE PLANS AND PRELIMINARY COST ESTIMATES FOR IMPROVEMENTS
TO DUNE PALMS ROAD AT WHITEWATER STORM CHANNEL CROSSING.
At the request of the City Council, the City Engineer has prepared four 4) alternate
plans with varying levels of road and drainage protection inprovements for the Dune
Pairns Road crossing. In addition, preliminary cost cstimates have been prepared for
each alternative with the cost being between $56,000 and $4,800,000.
In conjunction with Tentative Tract Nos. 19903 General Manageeent Corp.) and
20016 Ps*nas & Associates), the following condition related to the Dune Palms
crossing was 31tposed:
Provision shall be made to improve Dune Palms Road as
it crosses the *hitewater Storin Thannel. The an**imt of
contribution to and timing of the construction of these
inprovements shall be determined by the City Council.
a. Plan Preparation: Irrproveeent plan drawings and
cost estimates for these improvements shall be
prepared by the City Engineer.
b. *thod of Financing: Applicant shall contribute an
amunt to be determined for these improvements. In
conjunction with review of improvement drawings, the
method of financing shall be determined and may
include a per-unit fee, on u*front" contribution
for the entire project with reimbursement fr* other
affected developments, an assessment district, or
simllar financing techniques.
c. T*g of Inprovenents: U*on establishing a method
of financing these jitprovements, it shall be determined
when they are to be installed. The improvements may be
reguired with other road improvements at time of final
map recordation, may be tied to a percentage of occupancy
permits within the project, or may be related to some
other time criteria.
d. Final Map: If requirements set forth in a., b. and c.
above are not corpleted prior to map recordation, the
Applicant shall enter into an agreement with the City
and provide appropriate performance guarantees to assure
copliance with this condition.

any City Council consideration of these requir*r*nts
As a result, it is now necessary to evaluate the alternative plans and determine
which is the appropriate level of improvement so that the City Engineer can prepare
the jirprovement plan drawings and so that the financing method and timing factors
subconditions IIb.Iv and c. * can be established. It is Staff'S understanding that
both of these tracts will be processed fairly soon.
Of the suggested alternatives, it seems that Alternatives C and D are not feasible
due to their high cost and the limited use that will occur in the forseeable future.
Alternative A is a fairly minimum inprovement and is intended solely to protect the
road frem flood damage, but not to make it passable during flooding. Given the
present condition of the road, it would not seem appropriate to expend this until
the road is washed out. Alternative B provides a n*re sophisticated damage protection
system for the road, but at a much higher cost than Alternative A.
*iile Staff is inclined tewards Alternative B, there is concern that this rather
large expenditure for a Dune Palms crossing is premature and would not yield benefits
in reasonable proportion to the costs. Frankly, it appeared that a significant
u*front" contribution i.e., $75,000 per project) to a future bridge on Jefferson
beteeen *staard Ho and Highway 111 would provide a much u**re valuable benefit to
this area and to the City in general. Based on use and foreseeable need, Jefferson
should be the higher priority.
As a result, Staff rec*r*mends that the conditions regarding the Dune Palms crossing
for *entative Tracts Nos. 19903, 20016 and 19987 where the condition differs frcm
the other two) be scheduled for reconsideration.
In the event that the Council does not favor reconsideration, then one of the alternate
plans needs to be selected to allow necessary work to be started.
