Lago units, which number 72, would not be taxed
because we had our separate contract with them.
The tax bills have been received and they show
a levy for this service. Under our contract the
monthly amount is less than your taxed amount.
Please advise us as to what action you will take
concerning this tax.

I want to tell you what a great iinprov*Tnent the b].ack
topping and markings on La Fonda has made. I thank whoever
was responsible.
It is a lovely street, really a boulevard? but it is
unfortunately bordered by the most unsightly lots literally
dumps. Cans, bottles, even piles of hardened cement.' Trulv
a disgrace.'
Five years ago when I bought this property and built
a really lovely building I had visualized that in the near
future the street would be lined with attractive shops and
office buildings. Certainly not refuse. Also, when I bought
the property there was an attractive building on the corner
of Desert Club Drive and La Fonda. It was built with a
permit for a group of offices. It is now a noisy arcade,
largely the source of the cans and bottles I find in my
flowers and lawn almost every day.
*Then I first saw La Quinta many years ago, I was com-
pletely charmed. The roads were lined with eucalyptus and
palm trees long since dead). There was a crew of two or
three men and an old truck. They kept the little town clean
and the trees watered.
So my response to your request for suggestions on how
to spend the money part of the $200,000. a year), I will
start with the suggestion that we improve what we have. It
is naturally the most beautiful place in the desert but
also, the most neglected.
FIRST Let's have the water in the islands turned on.
SECOND Plant the islands with low shrubs and trees.
THIRD That all places selling beer, etc. have trash con-
tainers by their doors.
AND ABOVE ALL HAVE THE LOTS THAT ACTUALLY ARE DUMPS CLEANED
UP.

the owners the bill. If they ignore that there is nothing
else to do but put a lien on their property.
The following are some remarks I heard recently. A
real estate sales woman said: I just hate to bring a client
to La Quinta. It1s such a mess.' And when r mentioned build-
ing a smaller place when this building sold she asked: Why
La Quinta? It's going to be years before it gets presentable
looking.

Now that the courts have rendered a decision on the
Cove Communities plan +or paramedic services, and since
new state legislation does not prohibit it, I suggest
we look into buying a used ambulance as a +jrst step to
provide 4ul 1 paramedic services eventually.
1+ we can obtain one at a reasonable price, the city
can provide this service at a cost which would be
within the *financial ability 0+ all our citizens. The
rates presently charged by the private company which
has a monopoly in this area are outrageous. I think we
have an obligation to provide some rel ie+ +or those in
our community who need to go to a hospital by
ambulance.
Initially, the +irst aid skills 0+ personnel at the
+irestation should be adequate. *fter +urther study, I
hope we can provide +ull paramedic services.
I have no idea what a used ambulance costs. I would
recommend we direct the city manager to obtain some
prices;
then the Council can decide when and how to act.

There was general discussion concerning building height ljrnitations, *

the Ccx*ssion that these matters would be best resolved with the SPeci*ic Plan.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, AMENDING
THE OFFICIAL ZONING MAP FOR THE CITY, BY
REZONING CERTAIN PROPERTY REFERRED TO IN
CHANGE OF ZONE CASE NO. 84-012.
The City Council of the City of La Quinta does ordain as follows:
SECTION 1. Section 4.10 of Riverside County Ordinance No. 34*
which was adopted by reference by this City Council by Ordinance No. 5,
operative August 29, 1982) and La Quinta District Official Zoning Plan
Map No. 14, as amended, are further amended by rezoning from R*l*,
R*3**4000 and N*A* to R*l*++*l0,000, R*2**20,000 and N*A*, those certain
parcels shown and depicted for such rezonings on the map which is attached
to and made a part of this ordinance, and which attached map is labeled
I*Exhibit *1, Change of Zone Case No. 84-012".
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty 30) days after its adoption.
SECTION 3. POSTING. The City Clerk shall, within 15 days after
passage of this ordinance, cause it to be posted in at least three
public places designated by resolution of the City Council; shall
certify to the adoption and posting of this ordinance; and, shall
cause this ordinance and its certification, together with proof of
posting, to be entered into the book of ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of
the City Council held on this day of 1964, by

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE LA QUINTA
MUNICIPAL CODE, PROHIBITING PARKING OF CERTAIN
COMMERCIAL VEHICLES IN RESIDENTIAL AREAS.
The city council of the City of La Quinta, California, does
ordain as follows:
SECTION 1. Sections 12.32.110 and 12.32.120 are hereby added to
Chapter 12.32 of the La Quinta Municipal Code, to read as follows:
12.32.110 Certain Commercial Vehicles Prohibited from Parking
on Private Property. No commercial vehicle exceeding eight fee* in
height or twenty feet in combined total length, or towed commercial
equipment, shall park overnight on private property in residential
areas, unless the vehicle or vehicles are screened from public view
and adjacent properties. This prohibition shall not apply to
construction sites during a construction process, to vehicles in
the process of making a delivery or pickup, or emergency service
vehicles.
12.32.120 Certain Commercial Vehicles Prohibited from Parking
on the Public Rights-of-way. No commercial vehicle exceeding eight
feet in height or twenty feet in combined total length, or towed
commercial equipment, shall park overnight on public rights-of-way
in residential areas.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force

Subject: School Impaction Fee Resolution 84-14). Application of
provisions to building permits for residential construction
in the Cove area.
Resolution 84-14, adopted March 6, 1984, provides for mitigation of
local school impaction by requiring fee payments as a condition of
new residential development. The resolution provides, among other
things, that no building permit shall be issued for new development
of any residential unit... unless or until the applicant for such
permit provides evidence of payment to the Desert Sands Unified School
District...t1 Another section of the same resolution also provides
that all tentative tract maps shall be conditioned to require
payment of the school impaction fee at the time of building perinit
issuance.
It is my opinion that the provisions of Resolution 84-14 require the
payment of a school impaction fee at the time of issuance of a building
permit for all residential units, including permits for unimproved
lots within the Cove area, with the following exception, to wit:
the fee shall not be imposed on building permits wherein tentative
maps were approved between incorporation and the date of the mitigation
resolution and wherein the condition was not imposed as part of the
tentative map approval. The reason for the exception is that
California law now requires that all conditions be imposed at the time
of tentative map approval and prohibits the imposition of additional
conditions at a future date or event. One exception to this exception
is the case where a developer requests a time extension for the filing
of a final map and agrees to additional exactions as a condition of
approval of the time extension.

RECOMMENDATION:
Based on our meetings and research I would like to recommend to
the City Council that the City of La Quinta enter into a contractual
agreement with the Riverside County Fire Department and Cathedral City
for the purpose of establishing a half-time position of fire marshal
in La Quinta the other half going for Cathedral City).
There are several ways to implement such a contract with several
options. Costs for such a contract fluctuate depending on which
options we decide on.
We can have either a Schedule A fire marshal or a Scedule C
fire marshal. Schedule A means they are a State of California
employee. Schedule C means they are a County employee. The Schedule
C employee costs less than a Schedule A employee since they are not
considered a safety" position. If we go with Schedule A we can have
either a Ranger I Battalion Chief) rank fire marshal or we can go with
a Captain rank fire marshal. NOTE: Cove Communities presently have
a Scheulde A Ranger I fire marshal, whereas, we presently are served
by a Schedule A Captain fire marshal.)
Cost-wise we are looking at a fifty-fifty split with Cathedral
City for all costs for this position. A Schedule A Captain fire
marshal position would cost about $55,000 a year. This includes
salary about $32,000 a year), a 37% benefits package, a $380 a year
uniform allowance, a 10.9% administrative charge, about $3000 a year
for a vehicle, about $2000 for overtime, and about $1000 for training.
Our share on an annual basis would be one-half of the $55,000 figure
or roughly $27,500 per year.
Exact figures could be obtained if this position is approved
conceptually and assuming Cathedral City also agrees to enter into
such an agreement.
There are two potentially fatal actions that would kill this
proposal. They are: 1. The CDF is awaiting notification from the
State Budget and Finance office that may order them to eliminate their
Schedule A program. The results on this matter will be known by early
December. 2. Proposition 36, which if it passes will most likely put
any city expenditures on hold1' pending fiscal/legal analysis.
Attached is a job description of what this position is all about.
We do need this position as soon as possible based on current work loads
and projected increases in development. I would recommend an annual
contract for one 1) year commencing on or shortly thereafter January
1, 1985. At the end of that one year period we will have time to examine
the program and gauge its results.

Subject: REQUEST TO PURCHASE WATER TRUCK
BACKGROUND:
Since incorporation the City of La Quinta has sought to become
the provider of its own services in the area of public works. A position
was created to provide some form of *`localT* ability to cope with the
over 65 miles of streets and roads that belong to La Quinta and which
are our responsibility to maintain.
Presently the City contracts for two services that this proposal
will seek to reduce substantially. The first is street sweeping in the
11cove areat1. presently Houston1s Country Club Sweeping a division of
SCA services) provides once a month sweeping of the cove area. Due to
the lack of curbs and gutters, this activity is frequently a source of
citizen complaint and criticism since the conventional street sweeping
equipment generates alot of dust and often leaves trails of dirt and
gravel in its wake.
The second service that this proposal seeks to eliminate entirely
is that of bi-weekly watering of the oleanders and other vegetation in
the public right-of-way during the summer months. Presently this ser-
vice is contracted out.
This fiscal year the bill for each of the services is budgeted at
a total of $10,500. This may be slightly off, since the August 1984
bill for street sweeping alone was $866.40. That amount(time5 twelve
months)would rack up a street sweeping bill of over $10,000 by itself!
Granted, I do recommend the continued contract for street sweeping of
those areas of the city with curbs and gutters since a conventional
street sweeper does perform fairly well under those circumstances.
In exploring ways of improving the removal of sand and gravel
from cove streets, city staff experimented using a water truck to
flush the debris from the road with water. The results were very
impressive. No dust and clean streets. The dusty right-of-way areas
comprising the road shoulders was also wet down, further reducing dust.
As far as watering city shrubbery, the water truck we are asking
to purchase is the same one which was used for that purpose this past
summer. That same vehicle is now for sale and at a reasonable price.

Subject: STOP SIGN PROJECT UPDATE)
I am pleased to report that the stop sign project for the cove
area has been completed under our contract with Safety Striping Service.
The contractor started the project on October 15, 1984 and had the job
completed on October 30, 1984.
Originally there was $25,000 budgeted for this project. The bid
from Safety Striping Service came in at $22,705. The actual cost due to
some city specified changes will come to $23,085. This represents a
cost of $95 for each of 243 stop signs and posts installed.
Since the bid came in under budget, the question of pavement markings
in the form of stop bars and stop legends was discussed between myself
and the City Manager. The decision was made to authorize Safety Striping
Service to proceed with the pavement markings since they could do so
under the mandatory formal bid amount and since they could complete this
additional project to coincide with the final installation of the stop
signs.
There were 218 stop bars limit lines) painted, 42 stop bars with
the legend STOP painted at T" intersection streets and two 2) STOP
AHEAD legends required on Avenida Bermudas. These were all obtained at
a total cost of $1963.00.
Total cost for the entire project should run to $25,048.00 for a
total budget over-run of only $48.00, but with the bonus of all the
pavement marking included at that price.
The stop signs for the remainder*of the city will be installed by
city staff upon arrival of the materials.
The public's reaction to the stop signs seems to be very positive.
while installing the four-way stop at Avenida Bermudas and Avenue 52
we had over 20 positive comments by citizens and only 2 negative
reactions to that intersection. For what it is worth, since October
15 when the project began until now the sherif f's department has
reported six accidents in the city NONE of those have been in the
cove area! It's a little too early to tell, but, it appears as if the
stop signs are working.

Subject: REQUEST FOR EXTENSION PARAMEDIC STUDY
Due to the seating of two or three new City Council members
at the next City Council meeting, following the results of today's
election, I respectfully request that an extension of time be given
to the paramedic study so that all of the new council members and
the council as a whole may receive the information at one time.
On a positive note, I have attached a copy of a recent court
ruling regarding local ambulance contracts which was the result of
the Cove Communities Public Safety Commission and Springs Ambulance
lawsuit which was resolved in favor of the cities.
The impact of that court ruling will be discussed at length in
my paramedic report.

Subject: Refuse collection fee refunds Information)
In placing delinquent refuse collection fees from the period 7/1/83
through 6/30/84 on the current tax bill, some errors were anticipated.
At the public hearing, I indicated that if errors were found in which
payments were previously made, we would advise the property owners to
pay the tax bill with the delinquency fee, but that the fee would be
reimbursed by City checks.
It is my intention that this should be done as property owners bring
such matters to us, even in advance of actual payment of taxes, so
that the property owners will not have to advance funds and than wait
for repayment.
At this time only one property owner has brouqht this issue to us
I intend to process a reimbursement checks with the demands at the
next Council meeting.
