Dear City of La Quinta:
I have a complaint and a question. The comp aint is a out t e noise a 1 nig t
long, every night, at the Von's Shopping Center, here at Washington and Highway
111.
The queStion is, what has the City of Indian Wells done about noise behind the
new Ralph's Shopping Center at Cook and Highway 111? What has the City of Rancho
Mirage done about the noise at the Von's Center at Bob Hope and Highway 111? And,
for that matter, does Palm Desert have anything about nights and noise?
You are aware of the mountain running behind the tract of homes here in the Shangri-
la Tract, which is 100% rock and which thu bounces off sounds. Our bedroom opens
to our rear yard, ptioIpool area, which backs up to the Point Happy Date Ranch.
Prior to the shopping center, we opened the sliding glass doors from the master
bedroom, onto the pool area, for fresh air and the coolness and serenity at night.
Now, Crash, Bang, Thud.' All night, most every night. As trucks grind in and out
the rear of the stores, banging and crashing their operations.
Plus there is a high-pitched whine, now and then. The other night I got up at
2:20 AM and drove over, to see what the Hell that noise was. I had heard this
many times prior, but could only think it was a cesspool or septic tank pumper.
Same sound.
Turns out it's M&M Sweeping Service. Sweeping the parking lots.
Now, all this many sound as though it is of little interest to many people and
So What?" Ladies and Gentlemen, if the trash pickups in the big dumpsters had
started to pick up the trash during the night tim hours, because, let's say they
don't want to work during the hot summer days. Let me assure you, City Hall
would be flooded with complaints about the banging and crashing and trucks going
and coming.
Ever hear your neighbor's cesspool being pumped sometime between midnight and
5:00 AM? I guarantee you'd hear it, like it were in your living room! Complaints?
You bet. Not allowed. Right?
Both the other Von's and Ralph's back up to expensive residential property. How
is this regulated? Or is it?

I see no reason why City Council cannot pass an ordinance prohibiting deliveries
or other outside activities between 10:00 PM and 6:00 AN.
This would not prevent the store employees working all night, as they do now, but
their deliveries must come prior to or after certain hours. I realize neat must
be cut, shelves stocked for the coming day.
I know this is and has been done at Nighborhood Centers and even in some cases,
Regional Centers such as the center Ernie Hahn is building in Palm Desert.
Of course, each center has problems which are unique unto that center or area.
I further realize that the restaurant will be open to 2:00 AN, however and again,
outside activity and deliveries can be made during daytime hours. The traffic
leaving the restaurant should not create any more noise than the normal flow of
traffic along Highway 111 and on Washington.
I would be interested in the two centers above mentioned and how those Cities
regulate the noise.

The acrpanying contract between the City of La Quinta and SCA Services, Inc. to
perform refuse collection services on an exclusive basis in the City of La Quinta
is now The contract covers the issues hich the CoLincil wishes to have
addressed. The proposed rates rnain at the current level for residential service
with increases for cc6rcial service as shown on the attachment. The City will
receive an 8% franchise fee, which of course involves a net reduction in revenue
to the contract coppany, which is offset by expected higher volume to be obtained
through mandatory service
Also, we have received a anmication from Coachella valley Disposal, Inc. releasing
and canceling their interest in contracted services within the City of La Quinta.
The City Attorney has reviewed the proposed contract and the letter fran Coachella
valley Disposal, Inc. and finds them in proper legal form.
It is w recaended that the CoLincil approve the exclusive contract to perform
refuse collection services with Services, Inc. for the stated term of 5 years,
encing July 1, 1983.

The Applicant is requesting approval of the final tract maps for phases one and two
of the Duria La Quinta Tract and acceptance of the irproverrient agreements and bonds.
These maps represent two of the seven phases for development of this project and
contain 23 of the total 80 approved condominium units. Approval of this request
will allows the Applicant to record these first two phases and to begin construction
on 23 dwellings.
The City Engineer has reviewed the final maps and has determined that they are
consistent with the inicipal Subdivision Ordinance and the conditions of approval.
The City Engineer has also approved the lmprovements plans for the drainage and streets,
including the widening of Avenue 50.
Coachella valley Water District has approved the water and sewer plans for the
development.
The City Attorney has reviewed the lmprovements agreements, the subdivision bonds and
the C.C. and R' 5 and has approved their form. The arounts stated in the bonds have
been approved by the City Engineer.

On June a, 1983 the City began the formal bid process for the purchase
of two 2) 1/2 ton light utility pickup truck.
Only one bid was received for the pickup trucks. That bidder was Bretz
Mazda. The bid was in the amount of *13,303 for the two vehicles. This bid
was less than the previous bid for the same vehicles a few months ago.
I have been informed that the vehicles are in stock and that, upon
your approval, they can be purchased and delivered immediately.
It is my recommendation that we purchase said vehicles as has been bid.

Subject: MONTHLY UPDATE JUNE 1983
Summer is finally upon us. The temperature is rising and school has
let cut for awhile. The Community Safety Department is moving ahead with
a variety of worthwhile programs and projects. These programs will help to
make La Quinta a better and safer place in which to work and live.
CRIME: In spite of a seasonal rise in the number of burglaries a
compared to April, May of 1983 saw a 10% decrease in burglaries over May
of 1982. Overall, crime was down 26% this May as Opposed to May 1982.
The RCSO apprehended several juvenile suspects for a burglary that occurred
at Lake Cahuilla in June. We continue to receive reports of narcotic
trafficing and have passed this data on to the Crime Specific Unit of the
RCSO. Our Crimestopper1s Program is just a few weeks away from becoming
operational. It appears that we will be merging with Indio on a tljoint!t
Crimestopper' 5 program.
ANIMAL CONTROL: No dog sweeps were held in June, however, two are
already scheduled for July. The RCSO captured two rattlesnakes off of
front lawns of some local residents and Code Enforcement Officer Maza
fabricated a couple snake snares for use in capturing these reptiles.
Doug Brown appeared on the Red Baron show to warn residents of the snake
danger, especially to young children. A rate adjustment of dog license
fees is being proposed to encourage their sale through the rest of the
fiscal year. We are looking forward to the addition of our own Animal
Control Officer in the near future.
TRAFFIC SAPETY: The Traffic Safety Committee has held two meetings
already and has had a training session sponsored by the Automobile Club
of Southern California. Standards known as warrants) are being set up
and priorities established for action by the committee. This department
has been active in monitoring traffic safety around the various construction
sites around town.
ABATENT PROGRAMS: In June the RCSO had five vehicles removed from
the public right-of-way. Thirty-five additional vehicles have been slated
for abatement from private property. The forms for the public nuisance
abatement program have been approved by the City Attorney and are being
printed. The public nuisance abatement program will be our biggest effort
to clean up La Quinta since it covers a wide range of topics. Primary for
that program will be weed abatement.

LITTER CONTROL. We have discovered an increase in roadside littering
in recent weeks. With funds in the next F! budget, we will continue to use
Mr. Felix to clean up the roadsides of La Quinta. Three situation have
been referred to the R.C. Health Department for action on garbage left in
and around homes in La Quinta. Action has also been taken against one
illegal dumper and no reoccurrences have been noted. Large commercial
dumpsters that have been placed in the public right-of-way are being
moved onto private property in a separate action.
PARAMDICS: The paramedic committee met on June 15 and reached the
conclusion that in all likelihood, paramedic services for La Quinta would
be provided by the fire agency. It was therefore suggested that the city
should explore including paramedic services with a master plan for fire
protection. Several consulting firms were contacted and $15OOO has been
budgeted for Buch a study in the near future.
FIRE PROTECTION: There have been a couple of structural fires during
June, one apparently due to arson and the other due to cooking. La Quinta
was spared during the rash of arson-caused vegetation fires which occurred on
June 22 in the Coachella Valley. Fire Marshal Jim Johnson has been quite
active on a variety of programs regarding fire prevention. The La Quinta
Volunteer fire department is looking for persons as volunteer firefighters
to fill vacancies created by people moving, illness, etc..
DISAER PREPAREDNESS: Plans are moving right along on a disaEter drill
that will be held in mid July. The drill will be a surprise drill to test
who will be available to respond and who will not. Communications will be
tested and we have been very fortunate in locating a bi-lingual English-
Spanish)" HAM radio operator here in La Quinta. His name is Mr. Hector Haro
and he will be assisting us for the disaster drill. Plans are already
underway for local operations during the disaster drill. Speial identi-
fication cards for Civil Defense have been issued to all staff and Council
members this past month.
A major undertaking this past month has been the preparation and bidding
process for vehicles and a radio communications system for the City. We were
quite pleased to find the low bidders for both the vehicles and the radio
system considerably under what we had originally budgeted for those items.
The Community Safety Department is also working with La Quinta Boy Scout
Troop #150 members who are working toward Eagle Scout awards. These scouts
will be performing several hours of community work for the city under our
direction.
We have persisted in staying on top of the P.U.C. hearing matter with
the Southern California Water Company and have been successful in getting
a fire hydrant maintenance program underway.

Subject Budget Fiscal Year 1983-1984
Through conservative fiscal management, the City of La Quinta has
been able to complete its first full fiscal year, assume municipal
services and establish a staff of seven persons, with an unexpended
surplus of $331,797 in the General Fund and a total of $487,484 in
all funds. This was accomplished without the necessity to borrow
funds from any other source, which is a unique accomplishment among
newly incorporated cities. This balance puts the City in an
excellent fiscal position to meet the needs of 1983-1984.
In Fiscal Year 1983-1984, General Fund revenue is estimated to be
$1,052,096, with expenditures to be $958,057, leaving a year-end
balance of $425,836. The estimated revenue in all funds is
$1,472,989, with expenditures of $1,237,518, and a year-end balance
of $722,955.
The budget provides funds for 4.5 additional positions: receptionist i
clerk; planning director, building inspector; animal control/street
maintenance worker; and a time bookkeeper. Funds are also
included for a UCR intern for the full academic year.
Recommendations regarding classifications and salaries of present
staff are being made. These should be discussed in personnel session.
The allocation for Sheriffs law enforcement services has been
increased to 1.5 patrol cars, beginning September 1, 1983.
Funds are included for a quarterly newsletter.
Capital equipment items included in the budget are. a four station
computer, two light utility pick-up trucks, Council Chamber sound
system and tape recorder, office equipment, and communication radios.
These and other items will be described in more detail in the study
session, Tuesday, June 28, 1983, at 3:00 p.m.

A RL-SCLLffiION OF THE CITY COLNCIL OF THE CITY
OF LA QINTA, CALIFORNIA, APPROVING A EUCLT
FOR FISCAL YEAR 1983-1984.
WHEREAS, a budget for the Fiscal Year 1983-1984 has been
prepared by the City Manager and the Director of Finance; and
WHEREAS, the City Council has examined said budget and
conferred with the City Manager and the Director of Finance; and
WHEREAS, the City Council desires to adopt a budget for the
fiscal year; and
WHEREAS, the City Council has, after due delihration no
consideration, niace such amendments in the proposed budget as it
considers desirable.
NOW, THEREFORE, HE IT RESOLVED by the City Council of the
City of La Quinta, as follows:
SECTION 1. The budget, a summary of which is attached hereto
and made a part hereof, is hereby approved.
SECTIO 2. The City Manager shall have authority to adjust
the amounts aDDroriated among Objects within each departmental
activity, and amon accounts within the objects, provided however,
that the total appropriations for each fund may not exceed the amounts
provided in this budget resolution or any amending resolution) Said
adjustments shall be made only upon written justification by the City
Manager, Director of Finance or department head(s) responsible for
the activity or ac-Livities involved.
SECTION 3. Transfer of cash or unappropriated fund balance
from one fund to another shall be made only upon resolution of the
City Council.
SECTION 4. That the prepayment of demands prior to audit by
the Finance Committee and the City Council may be made by the
Director of Finance in conformity with the authority provided by
Section 37208 of the Government Code of the State of California.
SECTION 5. The Director of Finance shall render a monthly
report to the City Council on the status of City operations as
relates to the approved budget and any amendments thereto. The
Director of Finance shall design a standard format for such reports,
to be approved by the Finance Committee.

OF THE LA QUINTA HLTNICIPAL COlE PROVIIING FO
COMPENSATION AND REIMBURSEMENT TO MEMBERS OF THE
CITY COUNCIL.
The city council of the City of La Quinta does ordain as follows:
SECTION 1. Section 2.04.050 of the La Quinta Municipal Code hereby is
amended to read as follow.
2.04.050 Compensation and reimbursement. Pursuant to Section 36516
of the Government Code of the State, compensation shall be paid to each
jvombo of the city council in the amount of one hundred fifty dollars
$150) per Tnonth. The prescribed herein is and shall be
exclusive of any amounts payable to each member of the council as
reimbursement for actual and necessary expenses incurred by him or her
in the performance of official duties for the City of La Quinta; and,
accordingly, each member of the council shall receive reimbursement for
such actual and necessary expenses incurred in the performance of
official duties for the city, pursuant to the provisions of Section
36514.5 of the Government Code.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force and
effect thirty 30) days after passage.
SECTION 3. POSTING. The city clerk shall within 15 days after the passage
of this ordinance, cause it to be posted in at least the 3 public places
designated by resolution of the city council; shall certify to the adoption and
posting of this ordinance; and shall cause this ordinance and its certification,
together with proof of posting, to be entered in the book of ordinances of this
City.
The foregoing ordinance was approved and adopted at a meeting of the city
council held this day of 1983, by the following vote:
