Gentlemen
This letter is a formal complaint against Danovan Horn, dba Palm Desert
Development Co., his contractors and sub-contractors regarding three
building sites on Avenida Diaz at Calle Chihuahua in the City of
La Quinta.
These building sites have been raised from 2 to 5 feet above the
original natural grade of the properties where they adjoin my property.
The great amount of fill added to these sites contains slabs of broken
asphalt, roots and branches of trees, aluminum cans and sand of talcum
powder consistency.
In addition to the invasion of this fine sand blowing into my house and
drifting and falling into my yard from these construction sites, I also
complain to you about the trash and litter the workers are throwing and
allowing to accumulate on the sites, but specifically in the ditch they
have created against my fence. I also cite a dozen violations of
La Quinta Municipal Code 6.08.050 within a period of less than two weeks
as further complaint against Dan Horn, et al. My calls to the Sheriff
curtail their noise mornings after Ive already been awakened, but the
next day another violation occurs. Weekends and holidays also prove
disregard by these builders for the law or consideration for their
fellow man. This building site has also been the cause of a permanent
traffic hazard on Avenida Diaz where a large mound of cement has been
allowed to harden on the pavement.
These matters should concern the City of La Quinta, the County of
Riverside and the Farmers Home Administration regarding litter, off-
hour construction noise, damage to roadways and illegal, unmoistened
and infringing land fill. I should appreciate a written response re-
garding the violations referred to herein.

Dear Sirs'
As a homeowner in La Quinta, I am asking your assistance in
handling a problem I have been having with Coachella Valley
Television. Several timeE per week the cable goes out, making
the television useless. On each occasion, I have tried to call
the company and report the disruption in service. If I am able
to get through without a busy sign-al, I am treated@" to a tape
recording which states that there is trouble in Ta Quirta. It
then OoThtLrues, statg that if your problem does not concern
La Cuita, stay on the line and a service representative will
soon be on tO help you. Thore have been times that I have tele-
phon.d for over forty-five minutes bo- ore someone answered the
ringing phone.
Once I finally got in touch with a r.)rsOn, I reported the
problem anlLe m naFe and' addrE?Lc and the time the cable
nt out. I have be en told by th representative that my bill
would be pro-rated, since they obviously knew-> when service in
La Quinta is out when they put on that tape. To date, T have
not rEceivod ny proration on y bill. I get the run around
every time I call. On two occasions I was told the supervisor
would call e to discus the problems with service. No one
called.
Since the Coachella Valley Television Company has a mono-
p)ly on television service in La Quinta, they have no competition
to contend with. I can't go to another company, so I continue
to get substandard service. Coachella Valley Television is not
providing the service 1 am paying for.
Wflat recourse do I have to insure that I receive either
full service or a refund?
hat steps is the Coachella Valley Television Company ta1ng
to correct the constant interruptions in service. I find it
hard to understand why La Quinta's service is so poor compared
to other sections of the valley.

Dear Mayor Bajer and Members of the City Council:
The Executie Committee of the Coachella Valley Association of Governments met
on July 26, 1983 and took a specific action directing that each of the CVAG member
agencies be asked the extent to which staff support could be available to CVAG
for the accomplishment of various projects in the CVAG Work Program for FY 1982-83.
For the last nine and a half years CVAG has operated with a staff of three
individuals: 1) an Executive Director; 2) an Assistant; and 3) an Administrative
Secretary. In June of 1983, the incumbent assistant left CVAG in a career
advancement move and the position is presently vacant. On June 27, 1983, the
CVAG Executive Committee directed that the position not be refilled and that
during a five month period, through November 29, 1983, CVAG would operate with
a staff of two: 1) an Executive Director; and 2) an Administrative Secretary.
The CVAG Executive Committee was anxious to save financial resources and wanted
to test the premise that an adequate level of service could be provided with
less CVAG staff commitment.
At the July 26, 1983 meeting, the CVAG Executive Committee was confronted with
a recommendation from the Technical Advisory Committee and the Technical Planning
Subcommittee suggesting that the Assistant position be filled as soon as possible
in order that the CVAG Work Program goals and objectives might be more adequately
fulfilled. The CVAG Executive Committee discussed the concept of shared staff
and decided to study the feasibility of various member agency professional staff
being loaned to CVAG for the accomplishment of some of the planning and research
projects associated with the objectives of the Work Program. If a sufficient
commitment would be made by the CVAG member agencies, then the Executive Committee
may feel confident in not refilling the Assistant position.
The adopted CVAG Budget for FY 1983-84 provides sufficient financial resources
for the filling of the Assistant position. If the position is not filled, the
financial savings will be carried over into the next fiscal year and have a
beneficial impact on the requirement for dues assessment in FY 1984-85. The
CVAG Executive Committee would ask your specific response as to the extent of
professional staff commitment your agency can make by way of providing loaned
staff to CVAG on a project-by-project or as needed basis. We would appreciate
your response prior to the middle of September 1983 so that this matter can be
rescheduled for review by the CVAG Executive Committee at their next meeting
which is scheduled for Tuesday, September 27, 1983. Thank you for responding
to this inquiry of the CVAG Executive Committee.

i appreciate the time you have taken to make me and others aware of your
concern with respect to your sphere of influence. As you are aware, the
City of Coachella's sphere was established by the Local Agency Formation
Commission LAFCO) in 1974. As provided in state law, LAFCO initiated a
study of all desert cities' spheres in 1978. Coachella did not elect,
at that time, to respond or comment on the Commission's review of its
sphere of influence. Although no change was recommended in Coachellas
sphere, staff concluded that the sphere probably is larger than warranted
in view of the city's growth pattern." The Commission, at that time,
directed LAFCO staff to follow development of the city closely to deter-
mine if the matter should be brought to the Commission's attention before
the next periodic review of spheres. St
With respect to this latter issue periodic review of spheres), the third
paragraph of your July 8 correspondence is misleading and needs certification-
tion. Specifically, there are no 1existing policies which emphasize that
an annexation may take place only if it is within the sphere of the
annexing city." On the contrary, state law requires the Commission to
periodically review and update" adopted spheres G.C. 54774). The law
further states that spheres are to be used as CL factor in the Commission's
decision-making process rather than the factor). As a result, the
Riverside Local Agency Formation Commission has historically considered
all factors relating to a specific proposal. Each case is evaluated on
its own merit; and, based upon local circumstances, annexations have been
approved which may or may not coincide with a jurisdiction's adopted
sphere of influence.

Subject: Report from the City Manager regarding plot plan review of
single-family residences.
The City Council has recently discussed the procedure establishing
requirements for development of residences in the R-1 zone. If
review of construction of individual single-family homes is to be
continued, it will be necessary to adopt the accompanying ordinance
which provides for continued Planning Commission review.
Since the current ordinance was adopted on November 16, 1982, a total
of 19 houses have been considered in this process, or an average of
2.4 houses per month.
The Council may wish to consider the number of houses processed in
this period in determining whether it is necessary to continue
such review. If review is to be continued, I would recommend Council
direction for the preparation of an ordinance which includes a set
of development criteria similar to the type previously approved by
the Council, as listed in my memo of September 21, 1982, a copy of
which is attached.
I would also recommend that a permanent ordinance provide for staff
determination regarding whether or not the criteria is met, rather
than continuing to utilize Planning Commission time for this purpose.
This will minimize delay in processing single-family residence
construction permits.

ANI.L COTOL. Two dog seeps were conducted in July which re-
sulted in two dogs being captured and thirteen citations being issued.
The number of loose and stray dogs flniates greatly, as we still get
rany cOmplaint of loose dogs yet we ust can't find theii during the
dog sweeps. An analysis of costs for contract services for &animal control
for Jar. 83 to June 33 i attached to this report for your reference.
TFFIC &ATY: The Traffic Safety Comittee took a tour of the
City this past inonth to observe first hand" as a group some of the more
serious traffic problems in La Quinta. The Institute of Tr%Srortation

up Calle Tampico and Avenue 50 in recent weeks. He is presently working
on clearing weeds from the traffic islands on Calle Estdo and Avenide
La Fonda. We are presently researching a contract agreement for street
sweeping for ALL of La Quinta which would include bi-weekly sweeping of
all streets in town. A proposal indicates that we can get all streets
wept by private contractor for less money than the current minimal
weep1ng provided by the County of Biverside Road department.

disaster drill was conducted to test the response and co-cs-
tions. The drill went very well. We are continuing to develop our local
disaster p+an but progress has been slow due to other obligations.

being conducted to get an idea of what frequencies are available for our
use. W are planning on receiving FCC permission to utilize a highway

position we have found a need for a City Yard facility. We were ve-
lucky in obtaining a site adjacent to La Quinta Park at a very economic
rental rate. This area is being improved to facilitate our needs. We
are also busy ordering equipment and supplies which were provided for in
this years budget. These supplies and items of equipment will enable us
to prode better service ore efficiently.
