Subject: PROPOSED AMENDMENT TO THE MUNICIPAL LAND USE ORDINANCE NO. 348
RELATING TO MINIMUM DWELLING IZES FOR PLANNED RESIDENTIAL
DEVELOPMENTS
BACKGROUND
The attached proposed ordinance amendment establishes criteria for the
minimum dwelling size of units within planned residential developments.
The amendment will apply to all future proposed residential developments
located within all residential zones throughout the city.
This DroDosed amendment has been prepared at the request of the City
Council and Planning Commission. The reasons for establishing separate
requirements for the size of dwellings in Dlanned residential developments
include the following:
o Unlike a freestanding house, the size of the individual dwellings
in a condominium building is not discernible.
o In attached or row housing, different size units can be located
within the same building without appearing incompatible because
of their common exterior design.
o Since a substantial number of condominiums are purchased as second
homes, the buyers often desire dwellings smaller than 1,200 square
feet.
o The smaller unit size recognizes the demand for one-bedroom dwellings.
o In a planned residential development, the construction of smaller
units does not adversely affect the property values of adjacent
larger dwellings since their size is not discernible and their
design is compatible.
As discussed in the attached staff report, four other local cities have
established separate dwelling size requirements for planned residential
developments. The minimum sizes proposed in the La Quinta ordinance are
comparable to those enforced in other cities in the area.
La Quinta will be the first city in this area to regulate either the

An environmental assessment was prepared by staff and it was determined
that the proposed ordinance amendment would have no significant impact
on the environment. A negative declaration has been prepared for adop-
tion.
Additional Comment
A concern raised by a Commissioner at the August 9, 1983 hearing was
that while Section 5(d) of the proposed ordinance provided needed flexi-
bilIty, the section dId not establish clear standards stating when
exceptions could be granted by the City Council for specific projects.
Since that hearing, staff has reworded this section in order to establish
a more clear set of standards. If the City Council chooses to approve
this proposed ordinance with the following change, or variation thereof,
it may have the first reading and refer the change back to the Planning
Commission for its review prior to the adoption of the ordinance.
Staff recommends that Section 5(d) read as follows:
5(d) The number of units having living area less than
1,000 square feet may be increased for a specific
project if the City Council makes the findin9s,
including but not limited to:
1. The location and appearance of the units are
compatible with the area in which the develop-
ment is located.
2. The amount of usable open area substantially
exceeds the 40 percent of net area as required
by Section 18.5(2).
3. The dwellings having less than 1,000 square feet
of liveable area are evenly distributed through-
out the entire project.
FINDINGS
1. The proposed amendment will provide for a wider range of dwelling
types and sizes than currently exist in the community particularly
one-bedroom condominiums.
2. The proposed ordinance will provide both private developers and city
decision makers and staff with clear minimum development standards
for dwellings in planned residential developments.
3. The proposed standards are compatible with existing residential
development in La Quinta.

RECOMMENDATION
Based upon the above findings, the Planning Commission recommends to
the City Council the adoption of the proposed amendment to Sections
18.5(5) and 18.11 of the Municipal Land se Ordinance No. 348; and the
adoption of the negative declaration prepared for the environmental
assessment.

The accompanying Agreement provides that the City shall provide
necessary staff and other required services to the Redevelopment
Agency in the administration of redevelopment matters. It
enables the City to bill the Agency for administrative services,
and provides for the possible advance of funds to the Redevelopment
Agency and establishes obligation on the part of the Agency to
repay loaned funds to the City with simple interest at 10% per
annum

Subject: Street Sweeping Services
The City of La Quinta is currently utilizing street sweeping services
provided by the County of Riverside Road Department. The services
being provided are limited in several ways: 1) the County is able to
provide only one sweeping per month; 2) they are limited to sweeping
only streets having curb and gutter; and 3) costs are prohibitive,
particularly in comparison to services provided by independent
contractors
After initially contacting the County to provide street sweeping
services for areas in La Quinta having curb and gutter, staff has
been seeking an appropriate means for the sweeping of all City streets,
including the Cove area bounded by Calle Tampico on the north,
Avenida Montezuma on the west, Calle Tecate on the south and Avenida
Bermudas on the east. We have met with representatives of Palm Desert
Disposal, Inc. SCA Services) and have received a proposal to provide
street sweeping services on all public streets in La Quinta at a cost
of $36.10 per hour.
Palm Desert Disposal, Inc. formerly Houston's Country Club Sweeping)
currently serves as the street sweeping contractor for the cities of
Cathedral City, Rancho Mirage, Palm Desert and Indian Wells, with
hourly rates ranging from $33.75 per hour to $35.57 per hour, depending
upon condition of streets, amount of curb and gutter, etc. The cost
for these services being provided by the County is $35.00 per hour for
equipment, and $17.2575 per hour for labor.
Palm Desert Disposal is proposing to sweep all public streets in La
Quinta once per week during the initial 60-day clean-up period. After
that time, they have recommended that all curb and guttered streets be
swept on a weekly basis, along with the intersection of Highway 111 and
Washington Street. Problem intersections in the Cove, any uncurbed
streets that are creating a traffic hazard and special requests will
be handled on a bi-monthly basis. In their estimation, this will be
approximately 24 hours of sweeping per month.

After the initial 60-day clean-up period, the City will be discussing
a service agreement for street sweeping services between the contractor
and the City. The clean-up period will allow the City to better
assess street sweeping needs and the effectiveness of the proposed
schedule, after which time we will decide the areas to be swept on a
permanent basis, and look towards the possibility of a service agreement
between the contractor and the City on a more permanent basis.
It is respectfully recommended that the Council approve a proposal for
street sweeping services by Palm Desert Disposal, Inc., for a 60 day
period, at an hourly cost of $36.10 per hour, to begin September 1,
1983.

Subject: Redevelopment Project Area Committee
The California Community Redevelopment Law requires
that a project area committee be formed if a substantial
number of low- and moderate income families will be
displaced by a redevelopment project The law also
requires, if there will be no such displacement, that
the Agency consult with and obtain advice of residents
and community organizations. here will not be such
displacement because our preliminary plan deletes the
power of eminent domain over residential property
for sale or disposition to private developers. Therefor,
a project area committee is not required.
The accompanying resolution determines that a project
area committee shall not be formed, and it directs the
establishment of public meetings with residents and
community organizations regarding the proposed redevelop-
ment plan.

Subject: Financial Assistance
The accompanying agreement provides for the advance of
funds to the Redevelopment Agency to provide for the
necessary start-up costs in establishing our redevelopment
project for flood control. A total of $50,000 will be
advanced to the Agency, half from LML Developrnent Corp.
of California Landmark Land Company), and half from
The Desert Gardens J. V. Ridgway Ltd., the Managing
Venturer) These funds will be a loan to the Agency,
to be repaid upon adoption of the redevelopment plan
and sale of bonds or other financial instruments, with
a 10% rate of simple interest. The City and Agency agree
to use their best efforts to take such actions as deemed
appropriate by the City and Agency to complete all steps
leading to adoption and approval of the redevelopment
plan prior to December 31, 1983.
A motion to approve the agreement is respectfully recommended.
