Dear Mr. Usher;
Attached you will find a legal binding agree-
ment made between Mr. George Marzicola of 73-743
Highway 111, Palm Desert, California and Mr. Fred
J. Simon of Simon Motors, 78-611 Highway 111, La
Quinta, California, in which the parties agreed
to and affixed their signatures to the document
to change the name of Oreste Drive to Simon Boul-
evard within a period of one 1) year from the date
of November 12, 1983.
Mr. Marzicola came to me and asked if I would
delay for a period of time in asking this change be
acted upon, which I understand he also approached
you for the same purpose.
In discussing this matter with you on a per-
sonal line, I indicated this was no crisis on my
part to change immediately as long as done within
the specified time in our agreement. I so informed
Mr. Marzicola of my willingness to delay the effec-
tive date within the period specified in my letter
of November 12, 1983.
We have reviewed this matter with our legal
counsel and find that our position has obligated
Mr. Marzicola to comply with the letter as stated.
I now request that the City of La Quinta initiate
the change of name from Oreste Drive to Simon Ave-
nue, as it was suggested that Boulevard would be
inappropriate and that the City would accept the
change as Avenue.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, AUTHORIZING A

The city council of the City of La Quinta does ordain as
follows:
SECTION 1. That a Contract between the City Council of the
City of La Quinta and the Board of Administration, California
Public Employee's Retirement System is hereby authorized, a copy
of said Contract being attached hereto, marked Exhibit A", and
by such reference made a part hereof as though herein set Out in
full.
SECTION 2. The Mayor of the City of La Quinta is hereby
authorized, empowered, and directed to execute said Contract
for and on behalf of said Agency.
SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full
force and effect thirty 30) days after passage.
SECTION 4. POSTING. The City Clerk shall within 15 days after
the passage of this ordinance cause it to be posted in at least the
3 public places designated by resolution of the City Council; shall
certify to the adoption and posting of this ordinance; and shall
cause this ordinance and its certification, together with proof of
posting, to be entered in the book of ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting
of the City Council held on November 1 1983, by the following
vote:

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF LA QUINTA, CALIFORNIA
AMENDING SECTION 18.40 OF THE CITY'S
ZONING ORDINANCE RELATING TO LOCATION
AND HEIGHT OF WALLS AND FENCES.
The city council of the City of La Quinta, California, does
ordain as follows:
SECTION 1. Section 18.40 of the City of La Quinta Zoning
Ordinance Riverside County Ordinance No. 348 which was adopted by
reference by this City Council by Ordinance No. 5) hereby is
amended by amending subsection 0) thereof to read as follows:
c) Method of Height Measurement. The height of walls,
fences, hedges and landscaping, as permitted, shall
be measured from finish grade as defined in Chapter
70 of the Uniform Building Code. In cases where
finish grade varies from one face to the other of
a wall or fence, the height shall be measured from
the lowest point of finish grade. In the event that
practical difficulties and hardships result from the
strict enforcement of these regulations due to grade
problems of abutting street, slope of property, or
other site conditions, the applicant requesting a
buildin9 permit may apply for a variance as provided
for in Section 18.27 of this zoning ordinance.
SECTION 2. Said Section 18.40 hereby is further amended by
adding thereto subsection e) to read as follows:
e) As an exception to the provisions of c) above,
in cases of retaining walls on the boundaries of
lots, where the finish grade varies from one face
to the other of such wall, the height of such wall
may be increased so as to provide a wall height of
not more than forty-two 42) inches above the higher
point of finish grade, where necessary in order to
provide guardrail" protection as to the lot with
the higher finish grade.
SECTION 3. EFFECTIVE DATE. This ordinance shall be in full

CIATED STRUCTURES IN NEW CONSTRUCTION GENERALLY

The city council of the City of La Quinta, California, does ordain
as follows:
SECTION 1. The National Electrical Code, 1981, referred to as part
of the La Quinta Building Code in Section 8.04.020 of the La Quinta
Municipal Code, hereby is amended by adding a new Article to Chapter 1
of said Electrical Code, to be numbered Article 120" and reading as
follows:

Sections:
120-1 Declaration of cause, necessity.
120-2 Definitions.
120-3 prohibition.
120-4 Exceptions.
120-5 Initial obligation.
120-6 Waiver.
120-7 Appeals.
120-8 Nonconformance-Termination.
120-1 Declaration of cause, necessity. The city council finds that
the preservation and protection of the health, safety and general welfare
of the residents of this city, and the public at large, requires that all
poles, wires and associated structures, as defined in subsection B. of
Section 120-2 shall not be constructed, placed and installed above the
surface of the ground for the following reasons:
A. Poles, wires and associated structures which are constructed
above the surface of the ground are a hazard to the residents and general
public in the City of La Quinta because the city is located in seismic
zone #4 as defined by the Uniform Building Code. Because of the proximity
of the city to the San Andreas Fault, which is eight miles northeast of
La Quinta, and to lesser faults, the Banning Mission Creek and San Jacinto
Faults, the intensity of ground shaking is expected to be significantly
higher than for the general Southern California area.
The Riverside County Seismic Safety Element SSE) has delineated
portions of La Quinta as having a high potential for liquifaction, based
on a shallow ground water table generally less than thirty feet below the
ground surface, the presence of relatively young, poorly consolidated

WHEREAS, Section 1.0.050 of the La Quinta Muniipal Code
provides that certain officers and employees may be designated by
resolution of the City Council to exercise arrest and citation
authority as to specified violations of law;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of La Quinta that the following classifications of officers and
employees of the City of La Quinta hereby are designated to exercise
the arrest and citation authority prescribed in Section 1.08.050 of

2. This Amendment No. 3 executed October____ 1983 to the
above referenced lease, is as follows:
Lessor hereby leases to Lessee, and Lessee rents from Lessor

approximately 500 sq. ft. of floor space.
3. The term for the additional Suite A" shall be twenty
five 25) months commencing on the 1st day of November, 1983
and ending on the 30th day of November, 1985. The initial

## MEMORANDUM
CITY OF LA QUENTA
To: The Honorable Mayor and City Council Members
From: Douglas Brown, Community Safety Coordinator
Date: October 26, 1983
Subject: TERMINATION OF ROADSIDE IAINTENANCE CONTRACT WITH MR. FELIX
This is to advise you that we have decided to terminate our
contract for roadside maintenance with Mr. Sid Felix.
In lieu of Mr. Felixs services, the staff is currently
seeking bids for contractual services for the trimming and
maintenance of palm trees and all shrubbery located in and
encroaching upon the public right-of-way.
Additionally, we will be establishing a program with the
Riverside County Road Department for periodic grading and
maintenance of road shoulders along the public right-of-way.
Roadside litter will be periodically cleaned up by persons
who are required by the courts to perform community service work.
