Dear Mayor and City Council,
My name is Nikki Shriner and I am 1 5 years old and
will be a sophomore at La Quinta High School next year. I will be
having a baby in 9 more days from the date that is on this
letter. My reasoning for this letter is we now have a brand new
high school and a need for a day care program like at some of
the other high schools. We already have girls at are school that
have delivered and some that will be delivering in the next
months to come. If we don't get this program many of the girls
will not be able to continue in school, they will have to be in
home studies which is ok for a short while but you really get
tuned out of school1 plus we need classroom teachers to really
be able to learn. We don't have any funds to support this program
which is a real need. If there is any way possible you can help
us out or any way you know of a way to get some one to sponsor
this program it would greatly be appreciated. Please get back to
me as soon as possible.

RECOMMENDATION:
Approve Change Order No.1, adding Additive Alternatives #2 and #3 of the Palm Royale Park improvements
to the Fritz Burns Park/Palm Royale Park Project No.95-02.
FISCAL IMPLICATIONS:
The costs for Additive Alternates #2 and #3 are $15,200 each, for a total of $30,400. These costs include
inspections, testing and administrative costs as well as construction costs. The addition of Additive Alternatives
#2 and #3 would increase the project costs by $30,400, to $1,074,643. The funding for this increase would be
provided for through a loan from the Infrastructure Fund to the Quimby Fund. Therefore, funding from the
Infrastructure Fund would increase $30,400 to S62,013.
BACKGROUND AND OVERVIEW:
At the June20, 1995 City Council Meeting, staff recommended the award of a contract for construction of the
Fritz Burns Park/Palm Royale Park, Project No. 95-02 to James T. Dunphy Construction. Jn its
recommendation, staff also included recommendations to include Additive Alternatives #1,#2 and #4 of the Fritz
Burns Park improvements and Additive Alternatives #1, #2, #3, #,4 and #5 of the Palm Royale Park. The City
Council awarded the contract as recommended by staff with the exception of Additive Alternatives #2 and #3 of
the Palm Royale Park improvements. The Council requested more information regarding these two 2) Additive
Alternatives before awarding and directed staff to present this information at the July 5, 1995 City Council
meeting.
Description of Additive Alternatives #2 and #3
The following briefly describes Additive Alternates #2 and #3 of the Palm Royale Park Improvements:
Additive Alternative #2, Mee-Fogging System Install complete, Mee-Fogging System, to include, but not be
limited to, providing all electrical service and conduits to pumping unit, and providing all equipment for the
complete operation of a fogging system, including the construction of the boUards for the fogging system. Please
refer to Attachment 1 for location and Attachment 2 for details). System to be time activated can be temperature

FISCAL IMPLICATIONS:
Expenditure of $50,000 from the City Contract Services Fund.
BACKGROUND AND OVERVIEW:
The La Quinta Arts Foundation is requesting $50,000 to continue to provide the service contract to the City for
Festival activities and advertising. The $50,000 represents the same budget figure used for the past two fiscal
years. Attached is a packet of information provided by the Arts Foundation which includes the proposed
1995/96 Service Contract, the 1994/95 Final Report, clipping file and documentation regarding the past season
of activities and programs Attachment 1).
FINDINGS AND ALTERNATIVES:
Options available to the Council:
1. Approve the funding request not to exceed to $50,000 and direct staff to draft an Agreement for FY
1995/96;
2. Approve an alternate funding amount;
3. Deny the La Quinta Arts Foundation funding request.

RECOMMENDATION:
Adopt the Subcommittee recommendation for FY 1995/96 Chamber of Commerce funding of $153,000.
FISCAL IMPLICATIONS:
Expenditure of $153,000 from the City Contract Services Fund.
BACKGROUND AND OVERVIEW:
The Subcommittee of the Council, consisting of Mayor Pefia and Council Member Sniff meet with the Chamber
of Commerce Executive Committee on May 26th. The group discussed the following items:
1. The contract format does not need to be changed Attachment 1).
2. The Mainstreet Market Place is costing the Chamber more money than anticipated. The activity should
remain because it is a viable community event. Chamber is requesting an additional $9,500 to maintain
the activity.
3. The Chamber staff is overworked and would like to convert a part-time employee to a full time. This would
cost an additional $6,000.
4. The City population increase requires the Newsletter publications to be increased from 7,000 to 8,000. No
change to the number of months 10) published. This would require an additional $5,500.
5. The Chamber also discussed their proposal to establish a satellite facility at the La Quinta Plaza Shopping
Center. No City funding for this facility was requested.

zone, located on the north side of Highway 111, midway
between Washington Street and Adams Street within the One
Eleven La Quinta Shopping Center. Applicant: Caal Theatres
Corporation
RECOMMENDATION:
Accept the action taken by the Planning Commission.

BACKGROUND AND OVERVIEW:
General
The subject property is an irregularly-shaped parcel which is a part of the One Eleven La Quinta
Shopping Center. The site is near the back of the center, approximately midway between
Washington Street and Adams Street and will align with the Albertsons/Wal-mart row of stores.
The extension of Simon Drive, from the south, borders the property on the east.
The proposed project consists of a eight-screen movie theater in one structure. Each theater will
be a separate auditorium connected by a main corridor, centralized concession stand, and restroom
facility located near the front entrance on the south side of the building. The theater complex was
approved as an alternate use in the shopping center when Specific Plan 89-014 was approved in
1990.
Adequate parking for the theater complex currently exists in the shopping center parking lot
through reciprocal parking agreements.
The structure will contain approximately 30,000 sq. ft. of floor space and is designed in a manner
which is architecturally compatible with the Albertsons portion of the shopping center.
Architectural features? colors and materials will match those utilized in that portion of the shopping
center.

RECOMMENDATION:
Approve the changes as requested.
FISCAL IMPLICATIONS: None
BACKGROUND AND OVERVIEW:
On May 16th the Joint Powers Agreement Executive Committee for the Palm Springs Desert Resorts and
Convention and Visitors Bureau approved a request to place on the Agency Members Agenda for consideration,
an amendment to the Governing Agreement and Bylaws to allow the County of Riverside's Senior Staff designee
to have voting privileges as an alternate on the JPA Executive Committee.
This change now combines the Business Community and Attraction Community members which would reflect that
there are seven members from the BusinesslAttraction Community category rather than separating these two
categories.

RECOMMENDATION:
1. Take up Ordinance No. by title and number only and waive further reading.

FISCAL IMPLICATIONS None
BACKGROUND AND OVERVIEW:
The Investment Advisory Board Ordinance was established in June of 1993. Section 2.70.030 of the
Municipal Code relates to the Board Functions. The Investment Advisory Board at their June 14,
1995 meeting discussed the Board functions. The Investment Advisory Board has reviewed the
Ordinance and would like to provide clarifying language to Section 2.70.030 Board Functions as
follows:
2.70.030
The Board will annually elect a Chairperson and Vice-Chairperson at the first meeting held
after each June 30.
The following are functions of the Board that are to be addressed at each meeting: 1) review
account statements and verifications to ensure accurate reporting as they relate to an investment
activity; ii) monitor compliance with existing Investment policy and procedures; and iii) review and
make investment contracts, and investment consultants.
The Board will report to City Council after each meeting either in person or through
correspondence at a regular City Council meeting.

ThE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SE?ON I. That Tide 2, Chapter 2.70, Section 2.70.010(13) of the La
Quinta Municipal Code is hereby amended to read as follows:
The investment advisory board the board") is a standing board composed of
seven members from the public that are appointed by city council. La Quinta residency is
preferred, but not a requirement for board members. Recruitment for members may be
advertised outside of the city"
SE?ON U. EFFECIWE DATh: This Ordinance shall be in full force
and effect thirty 30) days after its adoption.
SE?ON m. POSTING: The City Clerk shall within fifteen 15) days
after passage of this Ordinance, cause it to be posted in at least three 3) public places designated

RECOMMENDATION:
Adopt City Council Resolution designating the Riverside County Department of Environmental
Health as the Unified Program Agency for the City of La Quinta.
FISCAL IMPLICATIONS:
There is no cost to the City. The CUPA is authorized to charge regulated businesses to recover
expenses.
BACKGROUND AND OVERVIEW:
In 1993, the California legislature passed Senate Bill 1082 to reduce the regulatory burden on the
business community by consolidating duplicative regulatory programs. SB 1082 established the
Unified Hazardous Waste and Materials programs to be managed by a single local agency
designated as a Certified Unified Program Agency. The agency is to consolidate six regulatory
areas:
1. Hazardous waste generators and on-site treatment.
2. Underground storage tank operation.
3. Hazardous materials inventories and release response plan.
3. Acutely hazardous materials handling.
4. Hazardous materials management plans and inventories
5. Aboveground storage tank spill prevention control and countermeasure plans.
The Riverside County Department of Environmental Health currently has a consolidated program
for hazardous waste/materials handling and related emergency planning. The program is applicable
to all incorporated cities as well as unincorporated areas in the County except Riverside, Corona,
and Banning which individually administer programs( listed above as 3, 4, and 5) locally.

Sunrise Company is making an effort to close out the Subdivision Improvement Agreements for its 30 +
residential tracts at PGA West. In May, the City Council approved final acceptance of five tracts. AL this
time, seven more are complete and ready for City Council consideration for final acceptance. The locations
of the tracts are shown on Attachment 1.
The Public Works Department has determined that improvements at the listed tracts comply with the City S
minimum standards for final acceptance. The alternatives available to the Council are:
1. Approve acceptance of the listed tracts and authorize the release of security as outlined in Attachment 2;
2. Deny acceptance of one or more of the tracts on a finding that obligations of the Subdivision Improvement
Agreement(s) have not been satisfied.

BACKGROUND AND OVERVIEW:
On June 20, 1995, the City Council introduced Ordinance No.268 expanding the Investment
Advisory Board from five to seven members. The second reading of that ordinance is scheduled
for July 5th with an effective date of August 4th.
That action resulted in the terms of Irwin, Lewis, Osborne and Rodriquez being effective at the
effective date of the ordinance August 4th, while Robert Frame's term was effective
immediately since he was appointed to fill the vacancy created by Helen Gilreath's resignation.
It is being recommended that the terms of Irwin and Lewis be effective July 1st since they were
the incumbents. This action will allow them to participate in the July meeting of the Investment
Advisory Board.

BACKGROUND & OVERVIEW:
The proposed changes are a result of the Meet and Confer process with the La Quinta City
Employees' Association LQCEA). The Memorandum of Understanding with LQCEA outlines these
changes and was approved by the City Council on June 20,1995. The Resolution incorporates the
changes into the City's existing Personnel Rules. The changes were reviewed and approved by the
City Attorney's Office.
Generally, the changes are as follows:
* Rule XIV Section 7.1 and 7.2, Family illness leave and Bereavement leave respectively are
amended to include grandchildren" in the definition of immediate family.
* Rule X Section 5, Vacation is amended to include the buy back provisions as contained in
the M.O.U.
* The position of Building and Safety Manager is added to the list of exempt employees that
receive 40 hours of administrative leave.
* Replace title of Assistant to the City Manager with Senior Management Assistant in exempt
position list.
* Replace title of Assistant Director of Building & Safety with Community Safety Manager in
exempt position list.
* Add Planning Manager to list of exempt employees that receive 40 hours of administrative
leave.

BACKGROUND AND OVERVIEW?.
On May 16, 1995, the City Council directed staff to discuss annual operational and maintenance costs of the
Fritz Burns pool with Coachella Valley Recreation and Parks District CVRPD) and the YMCA. The City
Council also directed staff to review potential changes to the current design of the Fritz Burns pool and
aquatic facility with each agency. On May 25,1995 and May 26,1995, staff met with Coachella Valley
Recreation and Parks District CVRPD) and the YMCA respectively to discuss the operational and
maintenance costs of a pool at the Fritz Burns Park. At the conclusion of each meeting, CVRPD and the
YMCA were requested to develop additional information pertinent to the development of a cooperative
agreement with the City that provides for a pool program at Fritz Burns Park. Specifically, each agency was
asked to address minimum facilities required, services to be provided and the estimated annual costs to the
City. Plans and specification of the currently approved pool were provided to CVRPD and the YMCA as
resource material.
CVRPD Discussions
Since May 25, 1995, staff has met with CVRPD staff on numerous occasions to discuss operational,
maintenance and design issues related to the Fritz Burns pool. Based upon those discussions and the
direction given May 25,1995, the following summarizes CVRPD's response to the City's request.

BACKGROUND AND OVERVIEW:
At the conclusion of the May 16,1995 Public Hearing for the Landscape and Lighting Assessment
District 89-1, the City Council directed staff to determine available funding in the Landscape and
Lighting Assessment District Fund that could be used for landscape median improvements. The
City Council also directed staff to provide a list of potential landscape median improvements the
available Landscape and Lighting Assessment District Funds could be used for.
Available Funding
There are two areas in the Landscape and Lighting Assessment District Fund that may provide
funding for capital expenditures related to landscape medians improvements. The first area involves
available Fund reserves. Currently, there is approximately $119,000 in reserve in the Landscape
and Lighfing Assessment District Fund. The reserve was established for the following two reasons:
Replacement Expenses As the inventory of park and landscape facilities begin to
age, replacement expenses will begin to increase. Replacement expenses cannot be
budgeted for on a year to year basis because it is very difficult to estimate when the
replacement is needed. Also, replacement expense are generally very large and
cannot be funded from a single year's assessments without impacting the assessment
rate.

Manager, Address Management Systems to discuss the realignment of the ZIP code boundaries. At that meeting Mr.
Quenga explained the procedural changes the Post Office would have to go through to effectuate the necessary
boundary changes.
To effectively change the boundaries the Postal Service is requesting assistance from the City in the following areas:
1. The existing Post Office is inadequate to support the relocation of additional carriers and sortation equipment.
The Postal Service is therefore requesting the City provide a trailer for temporary placement in the rear parking
lot of the Post Office, to accommodate the additional operational floor space needs. A standard air conditioned
trailer with the dimensions of twelve 2) feet by sixty 60) feet would be adequate. They are asking that the
fees for permits and any costs related to trailer placement be absorbed by the City. Subsequent to this the Post
Office has stated they would provide their own trailer.)
2. The proposed location of the trailer requires the relocation of postal vehicle/employee parking. Therefore, they
are requesting alternative parking on the vacant lot adjacent to the south of) the Post Office behind the La
Quinta Chamber of Commerce building. This would require appropriate grading, paving, provided by the Post
Office) lighting, and fencing to secure the abovementioned vehicles provided by the City). The Post Office
will be responsible for both the grading and paving costs. The lot dimensions are approximately 50-60-feet
frontage and extend to the rear of the lot. Two sides of this lot are presently fenced.

BACKGROUND AND OVERVIEW:
This item was continued from the Council meeting of June 20, 1995, to provide staff and applicant
time to research alternative cell site locations and the lighting issues at the Sports Complex. At the
request of all parties involved, staff facilitated a meeting with Council Members Perkins and Cathcart,
the applicant and adjacent property owners on June 27, 1995.
In response to Mr. Guralnick's letter of June 20, 1995 Attachment 1), that was distributed to
Council at the June 20th meeting, staff reviewed the seven suggested alternative cell site locations
in terms of land use issues, including existing and future land use, setback requirements, General Plan
designation restrictions, and workable locations for the AirTouch system. Of the seven proposed
sites, six were eliminated for various reasons. The last alternative site was determined to be
potentially workable, pending additional information concerning radio frequency propagation. The
preferred alternative site is the vicinity of Dune Palms Road and Avenue 48, in the Mixed Regional
Commercial designated area on the new Desert Sands Unified School District administration center
site. AirTouch engineering staff will conduct computer modeling and on-site testing to determine if
this site or area near Avenue 48 and Dune Palms Road will work.
In order to allow time for the alternative site to be studied, and for the results to be reviewed by all
the parties involved, it was determined that additional time was needed. A second meeting was
scheduled for July 7, 1995, at 10:00 a.m. Therefore, it is recommended that this issue be continued
to July 18, 1995.

elimination of a part of the northern parking lot of the La
Quinta Resort Club, and Plot Plan approval to allow
construction of a 37,000 sq. ft. building addition, which
includes a ballroom, supplemental facilities, and
subterranean garage parking in the R-3 Zone on part of a
17.8 acre site located on the south side of Avenida
Fernando, 1,000 ft. west of Eisenhower Drive. Applicant:
KSL La Quinta Hotel Corporation
RECOMMENDATION:
1 Adopt Council Resolution certifying the Mitigated Negative Declaration of Environmental
Impact,
2. Adopt Council Resolution approving Amendment #3 to Specific Plan 121-E, Revised), and
3. Accept the action of the Planning Commission on Plot Plan 95-555, or modity as Council
desires.

BACKGROUND AND OVERVIEW:
ProectHistory
The La Quinta Hotel was developed in the 1920's. In 1975, the hotel complex was allowed to be
expanded to 637 condominium units, 496 hotel rooms, 27-hole golf course and other supplemental
facilities on 619 acres by the County of Riverside Attachment 1). In 1982, the La Quinta City
Council allowed an additional expansion request that allowed 279 additional condominium units
and 146 hotel rooms Attachment 2). Since this time, additional modifications have been made.
A summary of this process is attached in the original Planning Commission report Attachment 3).
