Consideration of a report of action taken by Planning Commission PUBLIC HEARING:
for Conditional Use Permit 95-019 to install a 100-foot monopole
with antennas and sports lighting with equipment building at the
Sports Complex. Applicant: AirTouch Cellular
RECOMMENDATION:
Accept the decision of the Planning Commission denying Conditional Use Permit 95-019, noting that the Applicant
has the right to appeal.
FISCAL IMPLICATIONS:
None.
BACKGROUND AND OVERVIEW:
AirTouch Cellular has applied for approval of a Conditional Use Permit to install a 100-foot tall monopole that will
support cellular array antennas, three microwave dish antennas, and the existing sports field lighting. In addition,
an equipment building is being proposed to house computerized equipment that controls and monitors the proposed
antennas.
Staff reviewed the application, transmitted it for review and comment to City departments and responsible agencies.
Responses were received from lTD, CVWD, DSUSD, Fire Department, Building & Safety Department, Sheriff's
Department, and the County Airport Land Use Commission. Based upon this information, the compliance with
current zoning regulations and the General Plan, staff recommended approval of the project subject to conditions.
These comment letters and recommended conditions are contained in the attached Planning Commission staff report
Attachment 1)
Staff prepared an initial study Environmental Assessment 95-297) for the proposed project. The monopole will
support three microwave dish antennas which will not produce any harmful emissions, and cellular array antennas
which also do not create any hazardous emissions. The 100-foot tall monopole will replace an existing 75-foot high
light standard that has sports lighting attached to it. The existing lighting fixtures will be attached to the monopole
in order to maintain the current level of sports field night lighting. No additional lighting will be installed. The
lighting is required to be installed at the same intensity, height, and angles as it is now.
The applicant has prepared simulated photographs of what the monopole will look like if it is installed. In these
photographs, the proposed monopole appears to blend well with the existing light standards at the school campus.

RECOMMENDATION:
Approve the appropriation of $20,000 from the Art in Public Places Fund for artwork to be located at the
northwest corner of Calle Tampico and Washington Street within the La Quinta Village Shopping Center
Retention Basin and permit the APP to prepare and distribute a Request for Proposal RPP) Attachment 1).
FISCAL IMPLICATIONS:
The appropriation is from fees collected from the developer of the project paid into the Art in Public Places Fund
Account 70?-000-255-000) in the amount of not to exceed $20,000.
BACKGROUND AND OVERVIEW:
In March, 1995, the APP met with Mr. John Koenig and Mr. Mike Horton to review a proposal for artwork to be
installed at the Village Shopping Center. Following that meeting, it was apparent that the Committee and the
developer could not agree on the proposed artwork. The developer decided to continue with his plans to install a
fountain in conjunction with the restaurant to be built just north of the retention basin. Mr. Koenig was asked to
review three proposals the APP had submitted for the retention basin. Mr. Koenig stated he was unable to wait, and
would continue with his original plans to build the fountain at the restaurant site thereby allowing the APP to
determine the artwork for the corner in the future.
APP fees have been collected from the Shopping Center. It is anticipated that the total fees collected will equal
$13,000. This is an estimate because fees are determined at the time building permits are issued. In order to
determine what artwork should be placed where, the APP Committee was established to determine the importance
of the site and recommend artwork accordingly. Therefore, the fees collected for the site may not be equal to the
amount needed. The APP Committee determined that the corner warranted additional finds to create a more
appropriate piece of artwork because of its entrance into the Village. Therefore, the Committee recommends
spending more than the amount of anticipated revenues.

Approve the relocation of the artwork and the appropriation of $21,000.
FISCAL IMPLICATIONS:

000-255-000) in the amount of $21,000. This fund is generated by building permits and its sole purpose is for the
construction and administration of the Art in Public Places program.
BACKGROUND AND OVERVIEW:
On June 21, 1994, the City Council authorized the City Manager to sign a contract with Mr. Alber DeMatteis and
Ms. Kim Emerson for an amount not to exceed $30,000 for artwork to be installed in conjunction with the
construction of the pool at the Fritz Bums Park. With the additional appropriation of $21,000, the total appropriation
for this project will be $51,000. The contract Attachment 1) consisted of three mosaic spray towers to be installed
within the children's pool area; a mosaic sidewalk consisting of desert wild life and landscape of the La Quinta area
to be located in the sidewalk immediately in front of the entrance to the Aquatic Building; and an entry gate of forged
steel in a desert flora and fauna design. The location of the gate was to be located at the east facade of the Aquatic
Building and serve as an entrance to the swimming pool area.
Since it is unknown at this time when the construction of the pool and Aquatic Building may occur, the APP asked
the artists to submit an alternative proposal to the original locations and the costs involved. The artists submitted
an amendment to the contract Attachment 2). In the original contract, the building contractor was to construct the
towers and the artists would apply the artwork to them. The amendment shall require the artists to construct the
entire tower all four) and apply the artwork mosaic design and the copper shade design).
As the status of the pool is unknown, the Committee thought that a fourth tower would provide a unique water
feature to the park and increase the attractiveness of the artwork as well as provide a source of relief from the heat
for the youth. During the construction contract a drain, water line, and electricity will be provided to the area
selected for the towers.

Government Program certification for the City of La Quinta
Historical Preservation Commission
RECOMMENDATION:
Authorize the Community Development Director to sign the Certification Agreement as requested by the State
Historic Preservation Office.
FISCAL IMPLICATIONS:
Potential grant funds will be available to the City in the future.
BACKGROUND AND OVERVIEW:
On April 26, 1995, staff received a letter Attachment 1) from the Office of Historic Preservation OHP) stating that
the City's application for certification in the Certified Local Government CLG) Program had been accepted. The
City's application was reviewed by the OHP and the National Park Service. The certification is a result of two years
of staff work toward meeting the certification requirements. The benefits of certification in the CLG Program are
primarily access to grant funds, historic preservation-related projects, access to technical advice, training and
educational assistance, participation in local, State, and national decision-making on historic preservation issues,
and status. City of La Quinta will be the only CLO in the Coachella Valley. The OHP has forwarded a Certification
Agreement for signature by the authorized representative by the City Attachment 2). The resolution adopted by the
Council prior to submittal of the application package, specified that the Community Development Director is the
authorized representative for the City.
The certification is at the threshold level in the CLG Program, which means that there are basic requirements that
the City must meet. These consist of: enforcement of appropriate State and local legislation for the designation and
protection of historic properties; establishment of an adequate and qualified historic preservation review commission
by local law; maintaining a system for the survey and inventory of historic properties; providing for adequate public
participation in the local historic preservation program; and satisfactorily performing the responsibilities delegated
to it by the State.
Certification is based upon the current composition of the Historic Preservation Commission and the amended
Historic Preservation Ordinance. Certain expertise must be met by the Commissioners or provided by staff or
advisors. The City's Historic Preservation Commission has met all requirements except for expertise in
Architectural History. This requirement will be met by Lauren Weiss Bricker, Ph.D., Miss Bricker meets the

currently being prepared for the Washington Street/Highway 111 project in the
amount of $5,900.
* Award a design contract to Korve Engineering, of San Bernardino, to prepare plans for
an interim signal project in the amount of $9,950.
FISCAL IMPLICATIONS:
Funds for the design and redesign work are available in the capital improvement budget
account for the Washington Street Widening project.
BACKGROUND AND OVERVIEW:
The Washington Street/Highway 111 intersection is the busiest intersection in the City and
is operating at a Level of Service F, resulting in long delays. In recent years, there have been
several improvement concepts and timing schedules proposed with regard to widening
Washington Street through the intersection. However, in each instance, the Washington
Street project was tied to other improvement projects that either have not, or did not,
advance quickly enough to bring congestion relief. Currently, Washington Street is
scheduled to be widened in 1 996 in conjunction with the Highway 111 widening project.
Optimistically, this project will be completed approximately eighteen 18) months from now.

Consideration of Approval to Subsidize PUBLIC REARING:
the YMCA for the Summer Aquatics Program at
the La Quinta High School Pool
RECOMMENDATION:
Approve the financial support for the YMCA to operate a summer aquatics program at the La Quinta High
School LQHS) pool.
FISCAL IMPLICATIONS:
No new appropriations are required at this time. Authorization is requested to utilize excess funds from the
Parks and Recreation Director's salary account in the amount of $6,500. Of those funds $1 200 is a Facility
Use Fee for use of the pool based on a fee of $2.82 an hour as determined by Desert Sands Unified School
District to defer the cost of maintenance. It is anticipated that a maximum of $5,300 is needed to subsidize the
open swim program which will be provided to the public. The actual subsidy for the open swim program will be
determined by calculating the difference between the cost of staff/lifeguards $100 per day on weekdays and
$175 per day on Saturday) and revenue generated by admission charges $1.00 per person). The program will
operate from 1:30-4:00 p.m. Monday through Friday, and 1:00-5:00 p.m. Saturday, starting June 19,1995, and
lasting 8-10 weeks depending on the level of participation.
BACKGROUND AND OVERVIEW:
Per Council direction, staff has met with the YMCA. As a result of that meeting the YMCA has agreed to
operate a full service summer aquatics program at the LQHS pool Attachment 1). Operations will include
hours for swim lessons and open swim. The YMCA is requesting the City to subsidize the open swim program
only to the extent that revenues do not cover the expense of YMCA staff and lifeguards. In addition to this
expense, DSUSD is requiring a Facility Use Fee estimated at $1,200.
FINDINGS AND ALTERNATIVES:
1. Approve the use of funds from the Parks & Recreation Director's salary account to subsidize the YMCA
Summer Aquatics Program; or
2. Deny the use of funds to subsidize the YMCA Summer Aquatics Program.

RECOMMENDATION:

FISCAL IMPLICATIONS:
None.
BACKGROUND AND OVERVIEW:
Outdoor burning is currently addressed under Municipal Code, Section 11.72.030. The Code
indicates that outdoor burning of any material or structure unless authorized by the City Fire
Department or authorized representative by issuance of a permit is considered a public nuisance.
Provided as Attachment 1 is the applicable section of the Municipal Code.
Even with the restrictions imposed by the Municipal Code regarding open burning, strong
objections have been noted from La Quinta citizens contending that the smoke and ash from the
burning, greatly aggravates the health problems of people with respiratory illnesses.
Therefore, staff is proposing an Amendment to the Municipal Code which will allow open burning
only in conjunction with a Fire Department training exercise or when used as a cooking or comfort
fire contained in a fire proof container no larger than 4) feet in diameter.
The City Attorney has reviewed and approved the proposed Amendment.

In developing PGA West residential areas, Sunrise Company concentrated its resources on developing new tracts
rather than closing out tracts as they were built out. In the past two years, staff has been working with Sunrise
to complete tract improvements so they may be accepted by the City.
Sunrise has made a good-faith effort to complete improvements on all tracts and has conducted costly
rehabilitation of deteriorated improvements. The tracts listed above and shown on Attachment 1 are the first to
comply with the City's standards for final acceptance of improvements.

This tract is located on the northeast corner of the Washington/Miles intersection Attachment 1). On March 1,
1994, the City accepted related improvements. Though most of the improvement security was released, the City
retained sufficient security to pay for deferred improvements including a portion of a future retention basin/park,
the Washington Street median, and a traffic signal at Washington Street and Miles Avenue.
The Washington/Miles traffic signal has been constructed by Riverside County using state funds. Participatory
funds will not be needed from adjacent developments.
The traffic signal is complete and paid for with state funds.
The alternatives available to the Council are:
1. Approve the release of deferred security for traffic signals.
2. Retain the traffic signal security based on a finding that the existing traffic signal is insufficient to mitigate
the Washington/Miles intersection traffic loadings caused by this dev?opment and additional traffic signal

Approve a reduction in security for Tract 23995-1 in accordance with the staff report.

This tract is located at the southwest corner of the Miles/Adams intersection Attachment 1). The developer has
completed a majority of the required improvements and has asked for an interim reduction in security.
The perimeter wall and landscaping are complete, on- and off-site streets are 90% complete, and storm drainage
is 85% complete. CVWD has authorized a 90% reduction in water and sewer security. lID and GTE report that
power and telephone transmission lines are complete.
The City Code allows up to three interim reductions in security for each tract. The developer has completed
many required improvements and has made substantial progress on the remainder.
The alternatives available to the Council are:
1. Approve a reduction of security based on the current level of completion of improvements and direct staff
to release the security as outlined in Attachment 2.
2. Den a reduction in security on a finding that the developer is not in compliance with the City's

Powers Agreement
Adopt a Resolution of the City Council of the City of La Quinta approving SunLine Services Group Joint
Powers Agreement.
Once the City becomes a member of the SunLine Services Group Joint Powers Agreement, the City
becomes eligible to receive Colmac Alternative Fuel Vehicle Grant Funds to retrofit two City vehicles
in this year's grant cycle.
On May 2, 1995, the City Council reviewed a study session report from staff Attachment 1) regarding
the SunLine Services Group Joint Powers Agreement SSG-JPA) Attachment 2). The purpose of SSG-
JPA is to provide compressed natural gas CNG) services to its members and to create a mechanism to
regulate the taxi industry on a regional basis in the Coachella Valley. Upon conclusion of the study
session, the City Council directed staff to prepare the necessary documents required to execute the Joint
Powers Agreement with SunLine Services Group on behalf of the City. The previously referenced
resolution approves the City of La Quinta's participation in the SSG-JPA and authorizes the Mayor to
execute the SSG-JPA on behalf of the City. Once the agreement has been executed, an implementation
agreement will be prepared outlining the services to be provided specifically to the City of La Quinta
under the terms of the SSG-JPA and will be presented to the City Council for consideration. SunLine
has indicated that the implementation agreements will not be ready for consideration before July 1,1995.
There are essentially two alternatives available to the City Council at this time.
The first alternative is to adopt the Resolution, approving the SSG-JPA and authorizing the Mayor to
execute the agreement on behalf of the City. Once the City becomes a member of SSG-JPA, the City
will become eligible to receive Colmac Alternative Fuel Vehicle grant funds, as well as begin the process
of transferring the state mandated requirements to regulate the taxi industry in the City to SunLine.

A. Art Selection for the La 1ulnta Shon?n? Center.
1. Presentation by Ron Pekar. Mr. Pekar gave background on his qualifications. He
stated he had talked with Mike Horton, the landscape architect for the project,
regarding the site and had felt the area incorporated three essential ideas:
a. Landscape forms steel mountainous shapes similar to the mountains
surrounding La Quinta. Steel shapes fixed and set on top of native boulders
set into the site that would provide a sculpture panorama. Various colors of
violets and earth tones.
b. Cast concrete forms utilizing mountain textures with strata in a profile of
the mountains.
c. Geyser like forms, using colors and forms spouting out of rock forms placed
strategically to be seen from the street as well as from the bank and
restaurant buildings. It would be viewed from all around. In the day-light
hours the water would be seen and at a time the water would take on colors
of red, yellow and blue. The artisUc concept would be landscape forms with
a feeling of day and night.

This plot plan request was originally approved by the Planning Commission on May 11, 1993, and
accepted by the City Council on May 18, 1993. The approved plans allow a three story medical office
building, additional retail/office buildings, and a multiJevel parking structure.
Planning Commission Approval
On May 24, 1994, the Planning Commission conducted a public hearing on the request for a one
year extension of time Attachment 1). Modifications to the original Conditions of Approval were
made. The changes were necessary because the Washington Street dedication had not been made
by the applicant(s). The Planning Commission determined that the one year extension should be
allowed based on the State's current economic environment. The Planning Commission voted 3-1
Commissioner Adolph voted no) to approve the applicant's submittal pursuant to amended
Conditions of Approval Attachment 2). The Planning Commission minutes from the meeting are
attached Attachment 3).
AppealRequest
The applicant is not appealing the one year time extension approval, but is requesting that the City
Council reconsider seven of the Planning Commission's amended Conditions Conditions 2, 38, 39,

Adopt a Resolution of the City Council of the City of La Quinta confirming the diagram and assessment
for Landscape and Lighting District 89-1, Fiscal Year 1995-1996, pursuant to the Engineer's Report.
Implementation of the recommendation outlined in this report will generate approximately $1,014,900
in revenue from Landscape and Lighting District assessments for Fiscal Year 1995-1996, offsetting
estimated Landscape and Lighting District expenditures of $1,014,900 for the same period of time.
On March 21, 1995, the City Council approved the Preliminary Engineer's Report for Landscape and
Lighting Assessment District 89-1, Fiscal Year 1995-1996. The Engineer's Report identified a total
budget of approximately $1,014,900 to be spread onto 23,522 Equivalent Dwelling Units EDU's) within
the City limits. Attachment 1 provides a summary of the proposed assessments for Fiscal Year 1995/96.
The Engineer's Report also incorporated Council approved recommendations outlined in the Landscape
and Lighting District Feasibility Report, as outlined in Attachment 2.
With the approval of the Preliminary Engineer's Report, the City Council scheduled a required Public
Meeting and Public Hearing for April 18, 1995 and May 16,1995 respectively. The Public Meeting and
Hearing dates, along with the proposed changes to the Engineer's Report, were advertised in the Desert
Sun on March 30, April 5, and April 11, 1995, in the manner prescribed by Landscape and Lighting Act
of 72. In addition, individual notices unofficial) were sent to all La Quinta property owners on April
5,1995, inviting them to attend both meetings. At the April 18,1995, Public Meeting conducted before
the City Council, seven residents had questions related to the Engineer's Report and the proposed
assessment levels for Fiscal Year 1995/96. Staff addressed these questions at the Public Meeting.
Through May 10, 1995, the City received two letters of protest against the proposed increase in
assessments for Fiscal Year 1995/96.

vacant parcel into 14 single family lots and one common lot on the west
side of Interlachen, north of 58th Avenue within PGA West.
Applicant: KSL Recreation Corporation
RECOMMENDATION:
Adopt City Council Resolution approving the resubdivision of a condominium lot within Tentative Tract 28150,
subject to conditions or refer the project back to the Planning Commission per the request of the applicant.

BACKGROUND AND OVERVIEW:
General
The subject property is a portion of PGA West near the southern boundary adjacent to 58th Avenue. The
property in question consists of 3.6 + acres and was originally created by Tract 25499 Phase 3 in 1990). At
that time, the property was proposed to be developed with air-space condominium units. The previously
approved plans called for a total of 4 condominium units on the subject property Attachment 1).
The vacant properties to the south are outside of the PGA West project. To the east side of this tract, the
property is developed with Trophy condominium units built by the Sunrise Company in 1992. The existing
Nicholas private golf course is located west of this site. Street Improvements along Interlachen have been
installed by the previous subdivider.
Project Proposal
The 4 residential lots are approximately 70-feet by 148-feet or 10,360 square feet Attachment 2). The
proposed lots will be developed with single family detached units.
