BACKGROUND & OVERVIEW:
RCTC awarded the City of La Quinta $25,000 for sidewalk projects for the year ended
June30, 1998. RCTC's auditor Ernst & Young, LLP has completed the audit report
which is included as Attachment No.1. The auditors report on compliance did not
report any audit comments or exceptions.

BACKGROUND AND OVERVIEW:
The Friends of the La Quinta Senior Center" have been actively researching this project
since December 11, 1 997, for the purpose of donating a putting green to the City of La
Quinta Senior Center. Board Members contracted with OnePutt Greens to install a custom
designed, nine hole putting green at the Senior Center. The putting green is approximately
1 O00 square feet and consists of the revolutionary, synthetic T-TeK System, for a cost of
$7,000.
FINDINGS AND ALTERNATIVES:
The alternatives available to the City Council are:
1. Adopt a Resolution accepting the donation;
2. Do not adopt a Resolution accepting the donation;

The Catellus Residential Group held a ground breaking ceremony on January 27, 1 999 at the
Miraflores project site which is a result of a public-private partnership between the CityZs
Redevelopment Agency and Catellus. The project will be marketed to moderate income
families and seniors. At that ground breaking ceremony, Catellus made a donation of funds
in the amount of $500 to the La Quinta Senior Center Attachment 1 Z.
FINDINGS AND ALTERNATIVES:
The alternatives available to the City Council are:

BACKGROUND AND OVERVIEW:
On December 1, 1 998, City Council conditionally approved Specific Plan 90-01 5 SP
90-01 5) Amendment #1. Located adjacent to the north side of Airport Boulevard
between Madison Street and Monroe Street, SR 90-01 5 is proposed as a golf course
and residential resort community Attachment 2).
As a result of its adjacency to three primary arterial streets, SR 90-015 was
conditioned by the City Council to construct its share of the adjacent offsite street
improvements, perimeter improvements, and traffic signals. The offsite improvements
are phased such that prior to the first development approval or permit, the developer
is required to secure the estimated construction costs. Construction will occur prior
to the opening of any permanent access drive into the SR 90-01 5 area.
The developer has submitted improvement plans for the mass grading of SR 90-015
in order to complete construction of the golf course in time to open for play by Fall of
1999. It is their intention to begin this construction by mid-February 1999. In order
to facilitate the issuance of a construction permit to the developer for mass grading
of SR 90-01 5, staff has prepared an Improvement Agreement to secure the estimated
construction costs of the offsite improvements required of SR 90-01 5, pursuant to its
Conditions of Approval.

Infrastructure Fund.
FISCAL IMPLICATIONS:
Based upon an estimated construction cost of $176,798, the following budget would
be required to install the Avenue 50 Median Island Landscaping improvements:
Construction: $176,798.00
Design Update): $4,500.00
Inspection: $12,500.00
Administration: $8,840.00
Contingency: $20,264.00
TOTAL: $222,902.00
It should also be noted that annual maintenance will be required and is estimated to
be approximately $7,000.00 per year. Currently, the City has a commitment to pay
a portion $3,500.00) for maintenance of the landscaping on these median islands for
a period of two years. This commitment is from an outside source, KSL Development
Corporation Attachment 1). No other funding source/s other than General Fund
Reserve Account No.101000-300-290) have been identified for future maintenance
of these median islands beyond the one year that will be included within the
construction contract.

discussed during the Fiscal Year 1998/99 CIP but not appropriated. Therefore,
adequate funding is available in the infrastructure fund account #225-000-300-290
to support construction of this project.
BACKGROUND AND OVERVIEW:
On October 1, 1 996, the City Council authorized staff to advertise and receive bids
for the Various Citywide Landscape Improvements, Project No.96-04. The Avenue
50 median island landscape improvements were included as an Add Alternate Bid
Area.
On April 8, 1 997, the City Clerk opened sealed bids for Project No.96-04. There were
two 2) bids received. The bidders were: Mark Logan Landscaping, Inc. of Palm
Springs, California and Valley Crest Landscape, Inc. of Santa Ana, California. Their
total bids were:
Mark Logan Landscaping $1,108,010
Valley Crest Landscape $1,249,798
The bids were structured in a manner so as to give the City Council an opportunity to
award a contract that would optimize the available funding. Subsequently, on May 6,
1 997, the City Council chose to award a contract to Mark Logan Landscaping, Inc. to
construct the Various Citywide Landscape Improvements without the Avenue 50
improvements. The following bids were received for the Avenue 50 median island
landscape improvements:
Mark Logan Landscaping $176,797.71
Valley Crest Landscape $1 92,646,35
After reviewing the bids received and considering the costs of other recently installed
landscape improvements, staff believes the bid amount originally received from Mark
Logan Landscaping in the amount of $176,797.71 is accurate enough to use for
budgetary purposes.
In order to prepare the project for bid and construction, it will be necessary to update
the previously prepared plans and specifications for the Avenue 50 Median Island
Landscape Improvements.

Tract 28912 is located within the Rancho La Quinta development, adjacent to Avenue
50, Attachment 1). This final map will complete development of the first Rancho La
Quinta golf course creating 81 new residential lots Attachment 2).
The developer has requested the City Council's conditional approval of the final tract
map, which will allow them 30 days to complete its processing. As of January 26,
1 999, City staff has not received final approval of the tract map from the City's Acting
Surveyor; however, it is expected that a technically correct map will be available
within the time allowed with its conditional approval. The developer has executed a
subdivision improvement agreement to guarantee construction of subdivision
improvements with an estimated cost of $1,486,298; however, associated securities
have not been received.
As a result, staff has prepared the attached resolution which provides for conditional
approval of the final map and subdivision improvement agreement. The approval is
contingent upon receipt, within 30 days March 4, 1 999), of a technically correct final
map suitable for recording by the County Recorder with all required signatures except
for the City Clerk, and that the appropriate securities have been submitted as required
by the subdivision improvement agreement.

Based Financing Districts
RECOMMENDATION:
Adoption of the Resolution approving the revised policy, and application process for
Formation of Land Based Financing Districts Mello-Roos Community Facilities Act of
1982 Improvement Act of 1911 or the Municipal Improvement Act of 1913, and the
Improvement Bond Act of 1915) which will supercede Resolution No.96-75.
FISCAL IMPLICATIONS:
None No current costs for the formation will be incurred by the City). No change in
the $25,000 application process deposit is proposed.
BACKGROUND & OVERVIEW:
This policy was originally adopted by the Council in January 1991 and updated in
October 1996.
The purpose of Land Based Financing Districts is to allow developers to construct
public facilities or amenities of a residential development or commercial development
that provide a public benefit.
This item was first presented to the City on December 1, 1 998 at which time it was
referred back to staff to meet with the Building Industry Association BIA) for their
review and comment. The item was then presented to the City Council at the
December 1 5, 1 998 meeting. It was again referred back to staff to respond to a
counter-proposal from Century Crowell Communities and comments from other
building community representatives.

Districts and has been red-lined to indicate proposed changes Attachment No.1). The
Policy clearly identifies what information must be provided by the applicant to the City,
which duties each party must adhere to, and what are the expenses associated with
the formation of the District. These policies will provide the City with a better
mechanism to evaluate requests for Land Based Financing Districts, which will include
not only Mello-Roos Districts but Assessment Districts as well.
The following changes are identified in the Attached formation policies as they relate
to developer driven districts:
December 1 and December 1 5. 1 998 Staff Report:
* 1 00% concurrence of other property owners included in the proposed district
* Minimum amount of requested financing to be two million 2,000,000) dollars
net bond proceeds
* Minimum of 50% of the public improvements must be dedicated to the City
Developers, residential and commercial alike, may pursue such financing vehicles as
a means to keep direct capital costs down. For example, the sale of tax exempt bonds
for certain improvements may provide a less expensive financing vehicle for those
improvements than traditional mortgage financing. These savings, however, can be
off-set or eliminated by overhead, cost and risk associated with district formation and
maintenance.
As the Council may be aware, bonds sold on behalf of such districts ultimately affect
the City's bond rating. Accordingly, the City has a vested interest in assuring that
such districts are sound and consistent with City objectives. Recent experience with
proposed land based financing districts has given cause for City staff to consider
possible revisions to the City's policies for such districts' creation. Specific issues
giving cause to these revisions include:
* Possible controversy and opposition to proposed districts by minority property
owners addressed by requirement for 1 00% concurrence of property owners
on developer initiated districts; the City would still have the option to initiate
districts when in the public interest);
* Disproportionate overhead to improvement ratio addressed by an increase in
minimum financing amount of $2,000,000);
* Justification for Municipal participation addressed by requirement that at least
50% of the financed improvements being dedicated to the City).
The Policy and Application Process has been reviewed by the bond counsel.

Staff has had two subsequent meetings with the BIA and their representatives on
January 6th and 22nd to respond to the Century Crowell Communities counter-proposal
Attachment No.2). Briefly the counterproposal to the proposed staff changes were
as follows:
1. 1 00% concurrence of other property owners included in the proposed districts
2. Definition of public improvements expanded to include internal streets and other
improvements
3. Minimum amount of requesting financing to be one million two hundred fifty
thousand $1,250,000) dollars net bond proceeds
4. Minimum of 50% of the public improvements must be dedicated to the City
City Administrative fee increased
5. Appeal Process
6. Process time limits
7. Value to lien ratio
Staff is in agreement with the Items 1, 31, 42, 5, 73, and 8. Items 2 & 6 are
addressed as follows:
Item 2 Homebuilders believe that public streets and other facilities interior
to the tract should be included. Staff believes that only Z
facilities should be included that are of benefit to the entire
community thereby justifying their overall benefit, time, and
efforts in processing and administration.
Item 6 Homebuilders believe that there should be a process for appeal to
the City Council. Although a process could be implemented into
the policy, staff believes that an appeal process already is in place
by virtue the developer can process a letter to the City Council
regarding its concerns at which time, if the City Council so
desired, could agendize the matter. The implementation of a
formal change to be policy may be burdensome because the
Council may then be required to go through a appeal process
thereby expending more time and effort in regard to the
application.
Provided as Attachment 3 and 4 are the Pre-Application, and Application for Land
Based Financing Districts, respectively.

In each of the City Council meetings and meetings with the BIA/Developers, staff has
made it perfectly clear that the approval of any Land Based Financing District
Assessment District or Mellow Roos District) is at the sole discretion of the City
Council regardless of the Policy in place. It is important to understand that this is a
financing tool for the City Council to utilize when Ai deems appropriate.
There are a number of issues regarding assessment districts that are important during
the City Council's consideration of this item:
1) All such assessment districts could effect the Citys bond rating. Therefore due
diligence analysis has been added to the policy for the purpose of identifying the
need for any assessment financing as well as the credit viability of applicants
and the financial viability of the project. If any concerns are raised regarding the
applicant or the financial structure or viability of the project the City's bond
rating should not be put at risk.
2) All proposals should and will be analyzed for potential alternatives to
assessment districts such as the infusion of Low-Moderate income housing
funding and other economic/financing tools.
3) The assessment districts recently proposed should be considered by the City
Council as an economic development tool. All economic development tools are
important to a City, however, there is a time and place for the application of
such tools. Currently the City of La Quinta has been excelling in the arena of
residential housing without the use of Assessment District financing as
exemplified by the building permit valuations during the past few years,
including the single highest year in the City's history 1 998 which the valuation
was 181 million). Staff believes this economic development tool is not needed
for residential housing at this time but may be appropriate for commercial
development. Therefore the City Council may chose to limit the policy
applicability only to commercial development at this time as suggested by the
BIA at one time). Staff suggests this may be the most reasonable alternative
and alleviate any confusion to the development industry. Alternately, the
Council may choose the Policy to remain applicable to both residential and
commercial, and at the time of the application review determine on a case by
case basis if a residential development should be permitted. Under any
circumstance, by adoption of a policy, the economic development tool would
be available for use at anytime and the policy may be amended at any time.
4) The final important fact to understand is that the foreclosure proceedings are
always a difficult process technically, emotionally and politically. Pursuant to
Bond Document requirements, the City is required to commence at an earlier
date then the County foreclosure proceedings. Additionally legal Council has
conveyed to staff that only the interest portion of an assessment district
payment is legally tax deductible.

BACKGROUND AND OVERVIEW:
The Living for Your 90's" Senior Inspiration Award provides an opportunity to recognize
and honor outstanding seniors throughout the Coachella Valley.
The City Council is asked to select one outstanding senior recipient who meets the
following criteria: the honoree should be at least 75 years old; reside in the City of La
Quinta; been involved in community affairs for a lengthy period of time; and personify a
healthy, active, and contributing attitude and lifestyle.
Staff has provided for your consideration, two candidates who meet the criteria for the
award. A brief synopsis for each candidate is attached Attachment 1). The Living for
Your 90's" Senior Inspiration Awards Luncheon will be held on Monday, April 5, 1999
at the Marriott's Rancho Las Palmas Resort.

FISCAL IMPLICATIONS:

BACKGROUND AND OVERVIEW:
On January 1 9, 1 999, City Council directed staff to prepare photo-enhanced pictures
of the Duna La Quinta perimeter wall showing the existing and future improvement
scenarios for City Council's consideration. Staff has prepared four digitally-enhanced
pictures to give the City Council a fair representation of how CIP 98-09 will impact
the immediate area Attachment 1). In addition to these photos, two cross-sections
have been prepared which show the varying height of the retaining wall as you
proceed from Avenue 50 to the La Quinta Evacuation Channel Attachment 2).
Information is available regarding proposed future development of the vacant property
immediately adjacent to the west side of Washington Street, north of the bridge,
which allows for a determination of how the proposed retaining wall will impact future
development uses. Century Crowell Communities has submitted a conceptual layout
for an 81 unit development of the Duna Fairways. In this layout, the developer is
showing extension of the frontage street adjacent to Washington Street and a

ing -> 14proposed community pool immediately adjacent to the proposed retaining wall where
it has a maximum height of 20 feet 14 feet of retaining wall with 6 feet of perimeter
wall), at the La Quinta Evacuation Channel Attachment 3).
The final issue associated with CIP 98-09 requires City Council direction on various
aesthetic issues related to the bridge construction: the finish color of the decorative
bridge railing, the finish color of the decorative concrete bridge barriers, and the
treatment to the bridge median Attachment 4). Landscaping is not recommended
within the bridge median in order to avoid installation of irrigation lines which can lead
to maintenance problems on the bridge deck. As a consequence, it is recommended
that median improvements be limited to decorative concrete, river rock, or boulders
and soil.
FINDINGS AND ALTERNATIVES
The alternatives available to the City Council are:
1. Approve appropriate mitigation measures to relieve view impacts associated

the Downtown Commercial District, Phase V-A

BACKGROUND AND OVERVIEW:
On December 1 5, 1 998, the City Council awarded a contract to the firm of Korve
Engineering to provide professional engineering services for design and development
of assessment districts within the Phase V area and also included a task to design and
develop a Downtown Village Commercial Prototypical Street' theme.
The theme will be consistent with the THE VILLAGE AT LA QUINTA: DESIGN
GUIDELINES" as adopted by the City Council at the July 7, 1 998 meeting.
In order to maintain an open channel of communication with the City Council and the
public, staff has directed the consultant Korve) to provide a proposed, step-by-step
plan to obtain public input for the Village Development Plan.
City Council may desire to review the proposed plan and concepts to provide input and
direction prior to implementation of the proposed plan.

an information gathering workshop. The questions will be developed to
stimulate ideas and interest among the property and business owners.
Should the City Council approve of this process the first meeting is
tentatively scheduled for February 9, 1 999. A meeting will be held with
the Chamber of Commerce, property owners and business owners. The
meeting results will be presented to the City Council for review. The
consultant will tabulate the results of the questionnaire and information
gathered during the meeting with affected constituents and the Chamber
of Commerce.
Step 3: Based upon the information received, the consultant will then prepare the
proposed plan with several alternatives and the Traffic Calming Study.
This process will take approximately four weeks. During this time, the
consultant will have progress drawings available at their new office
location on Calle Estado for comment and discussion at any time during
business hours, as well as by appointment.
Step 4: The consultant will then schedule future meetings with affected
constituents, the general public and the Chamber of Commerce for
presentation of the proposed plan. These meetings will take place in late
March 1 999 to early April 1 999 with changes and modifications
occurring as a result of the meetings. Frequent reviews will be presented
to staff to keep everyone informed as best possible.
Step 5: Presentation to the Design Review Committee, Planning Commission and
the City Council will be made during April 1999. If necessary,
modifications will be made and presented for approval. Upon approval,
construction plans, specifications and Engineer's Estimate will be
completed for Calle Estado.
It is the intent of the consultant and his project development team, as well as City
staff to have this process as open as possible. The Plan' should be something the
majority of constituents are able to identify with, and have a feeling of ownership.

and expenditure account to track the financial activity.
FISCAL IMPLICATIONS:
Currently $8.50 per ton is collected by the City's collection and recycling franchise hauler,
Waste Management of the Desert, for commercial accounts and collected from the tax rolls
for residential accounts. This policy change does not increase or decrease the refuse rates
BACKGROUND AND OVERVIEW:
On July 2,1996, the City Council adopted a policy to utilize the $8.50 per ton landfill tip
reduction to fund solid waste programs that were being reduced or eliminated by Riverside
County Waste Management Resources District and join the regional program to be
managed by CVAG on an interim basis until a joint powers authority was formed for a
regional transfer station. The allocation of the $8.50 was for the following four programs:
1. Regional AB939 programs
2. Transfer station development program
3. Prelevelization of haul costs
4. Household hazardous waste programs
The Riverside County Waste Management Agency still provides AB939 regional programs
and Household hazardous waste programs. The transfer station and prelevelization of
haul costs never materialized because the joint powers authority was never created.

transportation cost associated with Edom Hill Landfill. In addition, a small portion of the
transportation cost is collected as part of the refuse rates. The incremental transportation
cost to Edom Hill Landfill is provided for in the Franchise Agreement with Waste
Management not to exceed $79,677 per year), as additional costs when the Coachella
Landfill closed. The City's current Collection and Recycling Franchise provides for the
collection of a limited amount of monies through refuse rates for reconciliation and
additional costs to transport the City's waste to Edom Hill. In order to keep the rates as low
as possible, the City anticipated subsidizing these two items with the $8.50 per ton
account.
The request before the Council is not to eliminate the regional programs, but to modify the
policy by creating one account for the $8.50 per ton to be used for regional waste
programs, local recycling programs, and franchise implementation of the City's collection
and recycling programs.
FINDINGS AND ALTERNATIVES
The options available to the Agency are as follows:

Adopt City Council Resolution adopting the Cultural Resources Consultant Qualifications
as recommended by the Historic Preservation Commission.
FISCAL IMPLICATIONS:
None.
BACKGROUND:
As part of development review process for both public and private projects, cultural
resources reports are required at the time of application submittal for compliance with the
requirements of California Environmental Quality Act CEQA) and/or National
Environmental Protection Act NEPA). The City's Historic Preservation Commission H PC)
reviews and provides its recommendations on each of the studies to the Planning
Commission and/or City Council as appropriate.
This Commission, recognized by the State Historic Preservation Office SHPO) as a
Certified Local Government CLG), is entrusted with upholding the Secretary of Interior
Standards and Guidelines for Archaeology and Historic Preservation created through the
National Historic Preservation Act.
The Secretary of the Interior's Standards include a section pertainin9 to Professional
Qualification Standards. The professional qualifications are designed as a tool to help
recognize the minimum expertise generally necessary for performing professionally
credible historic preservation work. They outline the minimum education and experience,
and products that together provide an assurance that the applicant, employee, consultant,
or advisor will be able to perform competently on the job.
The Historic Preservation Commission is recommending the City use the qualifications
taken from the Secretary of the Interior's Standards and Guidelines for Archaeology and
Historic Preservation for Archaeological Principal Investigators. Additionally, the

In order to have a complete complement of participants in archaeological investigations,
the Historic Preservation Commission is recommending the City adopt the City of San
Diego's requirements for Archaeological Monitors and Traditional Cultural Property
Expertise. The City of San Diego is also a CLG and has a very active program of cultural
resource management.
Historic Preservation Commission Action:
At the January 20,1999, Historic Preservation Commission meeting, the Commission
unanimously approved a recommendation to the City Council for approval of the proposed
professional qualifications. The minutes of that meeting are included as Attachment 2.

The City retained the Sedway Group in October, 1998 to analyze and report on
market demand conditions in La Quinta. The Sedway Group reviewed a variety of
demographic and market source materials, and conducted interviews with City staff,
Chamber of Commerce representatives, and business and community leaders.
The Sedway Group's report, enclosed as Attachment 1, includes an examination of
market potential for the following land uses in the Coachella Valley and La Quinta:
* Retail Market
* Commercial Recreation/Entertainment Market
* Lodging and Resort Market
* Golf Course Market
* Office Market
* Industrial/Business Park Market
* Live-Work Loft Market
Sedway's comparative summary of these alternative land uses is contained within the
report as Exhibit A, page 3. This summary indicates that the five to seven year
market demand is Strong-Moderate" for Lodging/Resort and Sub-Regional Retail.
Moderate" market demand is reported for Neighborhood Retail, Entertainment,
Restaurant and Golf uses.

RECOMMENDATION:
It is recommended the City Council:
1. Approve an increase in Estimated Revenues for Project Area No.1 and
2 as outlined in Attachment No.1 of the report totaling $1 86,872.
2. Approve the New Appropriations as outlined in Attachment No.1 of this
report totaling $279,850 from the General Fund and a reduction of
$490,362 in RDA Project No.1 and 2.
3. Approve the transfer of $51 1,509 from the Debt Service Project Area
No.1 Fund to the Capital Projects Area No.1 Fund.
4. Approve the transfer of $742,609 from Debt Service Project Area No.2
to the Capital Projects Area No.2 Fund.
5. Receive and File the Mid-Year Budget Report.
BACKGROUND & OVERVIEW:
A comprehensive report is prepared annually at Mid-Year to inform the City Council as
to the financial position of the City and expenditures to date as compared to the
Budget as established by the City Council.
The Mid-Year Report involves a financial assessment of City operations presented to
the Council during the fiscal year. This report provides information on General Fund
and RDA revenues, operations, capital projects and requests for budget transfers
and/or new appropriations.

ing -> 14This analysis provides the Council the opportunity to monitor year-to-date revenues
and expenditures and make mid-course adjustments necessary as the result of
modified program requirements.
ANALYSIS & FISCAL IMPLICATIONS:
For the most part, expenditures are distributed evenly throughout the fiscal year. At
Mid-Year December 31, 1998, it is expected that about 39% of the funds budgeted
will have been expended. Revenues, for a variety of reasons such as Sales Tax
reporting lag and seasonal Transient Occupancy Tax), tend to be received unevenly
throughout the year.
In order to provide a more accurate comparison of revenues and expenditures at Mid-
Year, selected revenues have been accrued to reflect the month they were earned.
For some of these revenues, the estimate for the remainder of the year was completed
by utilizing a weighted average analysis. If revenues were received in the month they
were earned, the earned figure reflects how much would have been collected in the
first six months. Major expenditures such as legal, law enforcement, and utilities,
have been accrued to reflect a six month cost.

Based on the accrued revenues and expenditures, at Mid-Year the General Fund
revenue is showing signs of exceeding the budget estimate at year end by
approximately $1.95 million; however, it is important to recognize the General Fund's
improvement is primarily due to substantial activity in local construction license and
permits of $1.1 million, sales tax of $100,000 and a one time distribution of
$750,000 in miscellaneous revenue. Additionally, the General Fund's anticipated

$220,000. Staff is recommending a continued conservative approach to expenditures
during the second half of this fiscal year.
With Mid-Year adjustments, including new general fund appropriations in the amount
of $279,850 detail provided on Attachment 1), it is projected that the General Fund's
revenue will exceed expenditures by approximately $475,000 at the end of the fiscal
year.
REVENUE
General Fund Revenue
As indicated in the chart below, the General Fund actual revenues are at 59% for Mid-
Year. Earned or accrued revenues are approximately 64%, as identified on the chart
on the previous page. Since the City's revenue is seasonal i.e.- Transient
Occupancy Tax) and we receive approximately 60% of our revenue in the second half
of the year, the year end estimate exceeds the budget by 1 9%. Provided as part of
Attachment 2 is the December 31, 1 998 General Fund Revenue Detail for the City.

Many municipal revenues are not collected evenly over a 12-month period. Property
taxes and other revenues such as State subventions) are often subject to distribution
schedules that are not on a month-to-month basis. Even revenue that is collected
more uniformly may also be subject to seasonal highs and lows such as Transient
Occupancy Tax) that would impact year-to-date benchmark percentages.
Taxes
Overall, general fund tax revenues are at 38.4% of the budget estimate. The majority
of Property Taxes are received from the County in January and May, and therefore, are
shown as minor receipts at Mid-Year. However, the 38.4% figure compares favorably

Fund, Sales Tax, Transient Occupancy Tax, Document Transfer Tax, Motor Vehicle
In-Lieu Tax, and Franchise Tax) are consistent with projected revenues with an
exception of an increase of $100,000 anticipated in sales tax revenue from original
projections.
Licenses. Fees & Permits
Development activity has been higher than the budget estimate. Revenue, in the
License and Fee category and Permit category, is approximately 1 27% and 11 3%
respectively of the budget estimate, as of December 31, 1998. It is anticipated that
the City will receive approximately $1.1 million over the budget estimate of $1.8
million by the year end for these two categories.
EXPENDITURES
GENERAL FUND EXPENDITURES
The General Fund expenditures are summarized in the chart below. City-wide General
Fund expenditures are at 39% of budget. Included as part of Attachment 2 is the
December 31, 1 998 General Fund Expenditure Summary. Expenditures are 2% lower
then 97/98 mid year, the year-end estimate for 98/99 reflects expenditures to be
approximately $220,000 less than budgeted.

The Mid-Year Personnel Expenditures are at 44.46%, and it is projected that year-end
expenditures will be approximately 92% of the budget estimate. These savings are
accounted for by salary savings in the organization.
Total operating services/supply expenses for the City are at 41 %. The primary reason
for this reduced amount is due to City wide reduced expenditures in the first half of
the fiscal year. It is anticipated that the second half January to June) expenditures
will be less conservative and operating expenses will be closer to budgeted levels.

The Infrastructure Fund revenue is approximately 213% of the Budgeted Amount.
This increase in revenue is attributable to the increase in building activity and is
consistent with the increases in building permit revenue received. Interest is more
than estimated because the first half July to December) infrastructure cash balances
are higher than anticipated.

REDEVELOPMENT AGENCY
Tax increment revenue for the Redevelopment Agency RDA) is received from the
County in January and May; therefore, actual tax increment revenues have not been
received to date. The earned tax increment approximates the 50% benchmark.

Adopt a Resolution of the City Council approving the placement of cost of cleaning lots
listed in the Resolution on the 1999/2000 Property Tax Roll.

BACKGROUND AND OVERVIEW:
The purpose of this public hearing is to provide the City Council with the opportunity to
hear and consider all public objections and protests, if any, to adoption of the proposed
Resolution. The Resolution contains a description of each real property parcel cleared
or cleaned by the City of La Quinta along with the associated cost to be placed on the
tax roll.
Notices of tonight's public hearing were sent to the property owners advising them of
the hearing date. At the time of this writing, no written communications have been
received regarding this matter.
All of the listed property owners have been notified of the costs associated with the
abatement and have been given approximately 30 days in which to reimburse the City.

Adopt City Council Resolutions, certifying a Mitigated Negative Declaration FA 98-
365) and approving Tentative Tract Map 28964, subject to Findings and Conditions.

BACKGROUND AND OVERVIEW:
On December 1 5, 1 998, the City Council, by unanimous vote, continued discussion
on this request to February 2, 1 999, permitting the applicant additional time to
complete the archaeological assessment for the development and allowing time for
recommendation by the Planning Commission.
The vacant site is located on the north side of 501h Avenue approximately 1 600 feet
west of Jefferson Street Attachment 1) and immediately south and east of Rancho
La Quinta Country Club. Vacant residentially zoned properties surround the remainder
of the Site. The site consists of sand dunes and native vegetation and has topographic
relief changes in excess of 1 5 feet. Overhead utility lines exist along 50Zh Avenue.
Proiect Request
The applicant is requesting approval of a 78-lot custom single family subdivision with
lots ranging in size from 1 5,000 square feet to over 22,500 square feet on 40-foot
wide curb face to curb face) private streets Attachment 2). Pertinent Tract

ing -> 149A. Access to the Tract will be from two gated entrances Z 501h Avenue, with the
westerly access to be signalized when warranted. The costs are to be shared
with Rancho La Quinta.
B. Retention basins Lots G" and H") are located outside of the 20-foot wide
landscape setback on 50th Avenue, and a Coachella Valley Water District well
site is planned for the southeast corner of the project Lot K") along with a
sewage pump station i.e., a portion of Lot J").
C. A conceptual landscape plan has been prepared for the common areas adjacent
to 50th Avenue including improvements with trees, shrubs and groundcover
planted in the parkway and in the on-site retention basins. To mitigate roadway
noise, a six-foot high serpentine privacy wall with pilasters is proposed on the
south side of Lots 1-5, H" and K" facing 50th Avenue.
D. Architectural guidelines submitted by the developer prescribe the house designs
permitted for this custom home development. A copy is on file with the
Community Development Department.
Public Notice: This request was advertised in the Desert Sun newspaper on November
21, 1998, and mailed to all property owners within 500 feet of the Tract boundaries.
No written correspondence has been received. Any comments received will be handed
out at the meeting.
Public Agency Review: The applicant's development request was sent on August 6,
1 998, and any pertinent comments received have been incorporated into the
Conditions of Approval.
Planning Commission Action
The Planning Commission considered this request at its meeting of January 1 2, 1 999,
and by a 3-0 vote Commissioners Butler and Kirk absent) recommended to the City
Council approval by adoption of Resolutions 99-001 EA) and 99-002 TTM), subject
to Findings and Conditions of Approval. Conditions modified by the Commission were
Numbers 23A, 61 and 85 pertaining to archaeology requirements and signalization
costs. A copy of the Minutes is attached Attachment 6).
Historic Preservation Commission Action ZHPC)
On October 1 5, 1 998, the HPC adopted Minute Motion 98-008, accepting the
Paleontogical Report for the project as prepared by L & L Environmental, Incorporated.
A copy of the HPC Minutes is attached Attachment 3).
On November 1 9, 1 998, the HPC reviewed and accepted the developer's Phase II
Archaeological Resources Assessment Interim Report) by adoption of Minute Motion
98-010. Because of the variety and volume of cultural material demonstrating that a

sites per National Register of Historic Places criteria were identified. A copy of the
HPC Minutes is attached Attachment 4). A Phase III mitigation program was
recommended.
On December 1 7, 1 998, the HPC reviewed the Phase Ill report in the form of data
recovery excavation) program. The HPC, on a 4-0 vote, adopted Minute Motion 98-
013 determining that the feasibility assessment for Phase III Alternatives) was
acceptable, provided specific excavation measures were employed, additional analysis
is performed on the bone fragments, and additional information is supplied to the City
Attachment 5).
FINDINGS AND ALTERNATIVES:
Findings necessary to approve this request can be made and are contained in the
attached Resolutions.
Alternatives available to the City Council are:
1. Certify a Mitigated Negative Declaration EA 98-365) and approve Tentative
Tract Map 28964, subject to the Findings and Conditions of Approval as
contained in the attached Resolutions; or
2. Deny the request; or
3. Continue the request and provide staff with direction.
