pJ) ORDINANCE NO. 85-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE MUNICIPAL
CODE RELATIVE TO SWIMMING POOL FENCING REQUIREMENTS.
The City Council of the City of La Quinta does ordain as
follows:
SECTION 1. Section 8.06.040 of the La Quinta Municipal
Code is amended to read as follows:
Section 320 Fencing.
a) Public and Semi-Public Swimming Pools Minimum fencing
requirements shall be those set forth in Chapter 2-90 of
Title 24 of the California Administrative Code. These
requirements are to be enforced by the Riverside County
Health Department.
b) Private Swimming Pools The following fencing require-
ments shall apply to private swimming pools:
1) Pools located on individual residential lots not
within the boundaries of a country club or similar
walled residential development project. Every person
who owns or who is in possession of land upon which a
swimming pool that exceeds 18-inches in depth is located
shall construct and maintain in good condition, completely
surrounding such parcel of land or the swimming pool it-
self, an enclosure not less than five 5) feet in height,
consisting of a fence, wall, buildings or a combination
thereof. The enclosure shall be constructed of chain-
link fencing of not less than 14-gauge and 2-inch mesh,
or concrete, wood, wrought iron, or other substantial
material, with openings of not greater than four 4)
inches, designed to withstand 15 pounds per square foot
of uniform horizontal load and shall be constructed so
as to discourage climbing by small children. The space
between the bottom of the enclosure and the ground shall
not exceed two 2) inches. All gates or doors through
the enclosure shall be equipped with a self-latching
device not less than five 5) feet from the ground that
keeps such gate or door securely closed, or shall be
securely locked at all times when the pool is not in
use.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full
force and effect 30 days after adoption.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE MUNICIPAL
CODE RELATIVE TO SWIMMING POOL FENCING REQUIREMENTS.
The City Council of the City of La Quinta does ordain as
follows:
SECTION 1. Section 8.06.040(b) of the La Quinta Municipal
Code is amended to add the following:
2) Pools located within the boundaries of a country club
or similar walled residential development project. Exempt.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full
force and effect 30 days after adoption.
SECTION 3. POSTING. The City Clerk shall, within 15 days
after passage of this Ordinance, cause it to be posted in at least
three public places designated by resolution of the City Council;
shall certify to the adoption and posting of this Ordinance; and
shall cause this Ordinance and its certification, together with
proof of posting, to be entered in the book of ordinances of this
City.
The foregoing Ordinance was approved and adopted at a meeting
of the City Council held on this day of 1985, by
the following vote:

Subject: Neighborhood Watch Seminar
This Neighborhood Watch Seminar would be very instrumental in revitalizing
the Neighborhood Watch Program. In order for the program to get off the
ground again, we have to instill interest in the community.
Our crime prevention officer Deputy Bill Walker tried to get something going
this spring and early summer, and in spite of good programs, failed to get any
participation in the programs.
Staff, along with Deputy Walker would like to select five or six private
citizens to form a nucleus for the Neighborhood Watch Program. The citizens
selected would attend the above named seminar October 3 & 4, 1985, in Ontario,
California. The City would most likely have to pick up the expenses. Expenses
would average $165.00 per person. There would also be mileage for 3 cars
amounting to $165.00 total.
It Is staffs recommendation to fund this seminar in order to get this program
off to a good start.
Team selection should include:
1. Elected official or representative
2. One law enforcement officer
3. 4 or 5 citizen volunteers.
The total expense for this seminar should not exceed $1300.00.

Subject: Status Report Community Services Office
Several council members have indicated an interest in receiving a monthly
status report regarding services currently being provided to senior citizens
at the La Quinta Community Services Office. It will therefore be my intent
to provide this infomation monthly.
The Riverside County Office on Aging is funding our Center primarily for
the purpose of providing information and referral services to elderly and
frail elderly senior citizens. However, Lenelle Reade, Program Director,
is' also currently providing services such as monthly health screenings,
blood pressure clinics weekly), and food assistance to needy families. The
number of persons receiving these services in July and August, 1985, are as
follows:

As can be seen from the above numbers, the Community Services Office has been
a hit since its opening. The number of senior citizens and needy persons
utilizing necessary services continues to increase, and we anticipate a much
greater demand for services with the coming of Fall.
The office is in need of food commodities, and a list of food donati9ns which
are being sought will be circulated in the October/November Newsletter. Of
special need are high-protein food items such as powdered milk, dry beans,
peanut butter, canned stews and soups, etc.
Mrs. Reade is currently in the process of expanding the nature of services
offered, and I have enclosed a copy of their Calendar of Events for September.

Subject: Closed Session of September 3, 1985 Pending Litigation).
Reasons and Legal Authority.
This rri**randum is provided to you as required by California Open Maeting
Law.
The closed session held Septenber 3, 1985 is authorized by Coverr*ment
Code Section 54956.9(c). The closed session is and was for the purpose
of reviewing certain existing facts and circumstances and determining
whether the City should initiate litigation due to the circumstances
described below.
Please refer to the mEt*randum dated August 8, 1985 relative to the
closed session of August 6. The factual ba*ground of said neeorandum
is incorporated herein. At the closed session of Septebeer 4, the City
Attorney discussed with the City Council the proposed petition for Writ
of Mandate against the school district and the City of Coachella for
violations of CEQA; together with a conplaint for a prelilunary and
peitanent injunction for declaratory relief for General Plan inconsist-
encies, and for violation of the Mello-Roos C*trnunity Facilities Act.
Following discussion, the City Council authorized the filing and service
of said lawsuit.
Discussion of the above matters in public session would prejudice the
City's position in this matter. Based on the foregoing, it was and is
the City Attorney' 5 rec*uendation that the matter be discussed in closed
session.
This *randum shall be exe*t from public disclosure pursuant to
Coverr*nent Code Section 6254.1.
