SUBJECT: Rumble, Rumble....What To Do Now???
Much has been said and written about the potential 0+ a major,
devastating earthquake in the riot-to-distant +uture. It appears
that we are in a location likely to su++er the most. We hear
about all the plans being made at the County and other
orcianization*......but. let's +ace it, we're riot prepared locally
should this disaster happen soon.
I respect+ully suggest that the Cit>' 0+ La *uinta prepare itsel+
+or such disaster and keep the people 0+ our community in+ormed.
Let's charge the Community Sa+ety Coordinator, through the City
Manacer, to develop a plan. I think we would want the +ol lowing
nc 1 uded:
I. * headquar*ers and an evacuation center. Let's identi+y some
place where people can go +or +ood and shelter i+ their home
becomes un i rihabi table. The Desert Club would seem a I ogi cal
choice. Whichever it is, let's prepare the place with
emergency supplies to carry us through a +ew days.
2. Iderit i +y volunteers around the community whci could assist
time 0+ disaster and assume leadership in their neighborhoods.
Provide a good training program +or them. Give them some
symbol 0+ authority to +unction at time 0+ disaster, such as a
badge. J
3. Obtain materials 0+ 1) what people should do to be prepared
and 2) how to behave i+ the the event happens. I think all
that is available now +rom some sources. Let's get it into
every home in La Quinta. Let's also use the newsletter as a
constant source 0+ dissemination.
The above seem like logical actions to be prepared. Certainly
there are other actions needed which the **experts" can recommend.

I suggest we receive the plan at our second meeting in December
and start implementation right at the +irst 0+ the year.... and

Cn October 22, 1985, the Planning C*t[flission conducted a public hearing on the
proposed vacation and unanimously determined, pLirsuant to the attached Planning
Cci*ssion Resolution, that the vacation is consistent with the * Quinta General
Plan. Furtherrore, the acloission unanimously reccuttends the attached conditions be
inposed on the vacation. Revised Conclusions" and 1'Findings", based on the Planning
Ccu*ssion action, have also been prepared and are attached.
Primary issues discussed by the Planning Ca*ssion relative to the vacation included:
o The need to include the entire Golf Estates area, including the
cul*e-sacs, with the project
o *eptability of reduced parkway and wall setbacks in this area
due to constraints on other design alternatives and existence of
other walls without setbacks in the area
o Retention of lasdscaped center median/turning lanes along most of
affected frontage will reasonably conform to primary image corridor"
concept
o Elimination of parking/breakdown lanes on Eisenhower is acceptable
for a short stretch like this
o **educed roadway width can still acociredate functional puppose of
Eisenhower Drive i.e., 4-lane traffic capacity)
It was the consensus of the Planning *oission that the project could reasonably
satisfy General Plan and other City Standards.
The following persons appeared in support of the *licant' 5 reguest:
a * Ward, Association President, noted the previous history of the
project and stated that there is now near-unanimous surport for this
proposal within the Association. He stated there would be no cost to
the public and that approv4 would resolve many problems in the area.

On October 22, 1985, the Planning C*rinission conducted a public hearing on the
frontage road/perirreter wall request and unaniusly reccirrr*nded approval of the
project subject to the revised findings, conclusion and conditions *hich are attached.
Prirary issues discussed by the Planning Ocirmission relative to the Plot Plan include:
Adequacy of 24' wide frontage road without on-street parking since
this loss is a trade-off for the project b*iefits i.e., wall, etc.)
o Adequacy of cul-de-sac design even though below City and Fire Marshal
standards due to short length and ert**gency gate at terminus
o Necessity to not chaage Club La Quinta access without their approval
o Need to redesign Avenida Fernando South) entrance
o ***rtance of including cul-de-sac area in fenced area since it reduces
seven street accesses to one gate access and since it unites within one
wall the entire subdivision
o No need to make Avenida Fernando a main entry in the future due to
existing gatehouse area on Coachella Drive
It was the consensus of the Corrmission that with very minor changes, the project as
submitted was appropriate to approve.

19. Applicant shall establish within the CC&R' 5 site design
standards appropriate to estate lots, including but not
limited to, front, side and rear yard setbacks, lot
coverage, etc. Standards should maximize building
separation, enhance the overall streetscape and minmize
the appearance of bulk. Any such standards shall be
reviewed by the C*trunity Development De*nent as part
of its review of the CC&R's, but shall be no less restrictive
than R-2 Zone standards."

On O*tober 22, 1985 the Planning a*rinission conducted a public hearing on
the proposed amendrt*nt and unamously reo*rxended approval of a change to
Village *rcial as set forth in the attached Staff Report.
Discussion art*ng the Planning O*tmission focused on the following:
o consistency of proposal with new General Plan, including
* urban design policies
o differences since original denial of six-acre request
o need to foster developeent in the area
It was the consensus of the O*xnission to approve the request but to change
the requested land use designation fran General *ercial to Village *rcial.
The Cc*trflission also noted the importance of acting on this matter after the new
General Plan.
Bruce Cathcart and Skip Fonnen, representatives of the prospective owners, spoke
in support of the recat*rendation after providing brief background of their
involvement and intentions.

ZONING MAP FOR THE CITY, BY REZONING CERTAIN
PROPERTY REFERRED TO IN CHANGE OF ZONE NO. 85-016.
The City Council of the City of La Quinta does ordain as follows:
SECTION 1. Section 4.10 of Riverside County Ordinance No. 348
which was adopted by reference by this City Council by Ordinance No. 5,
operative August 29, 1982) and Lower Coachella Valley District Official
Zoning Plan Map No. 41, as amended, are further amended by rezoning from
A-i-b, w-2-20, N-A, R-l-l, R-1-12,000 and R-l-l0,000 to R-2, R-5 and C-T,
those certain parcels sho*ni and depicted for such rezonings on the map
which is attached to and made a part of this ordinance, and which attached
map is labeled Exhibit 1", Change of Zone No. 85-016.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty 30) days after its adoption.
SECTION 3. POSTING. The City Clerk shall, within 15 days after
passage of this ordinance, cause it to be posted in at least three public
places designated by resolution of the City Council; shall certify to the
adoption and posting of this ordinance; and, shall cause this ordinance
and its> certification, together with proof of posting, to be entered into
the Book of Ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of the
City Council held on this 5th day of November 1985, by the following
vote:

hereby is amended by amending the second paragraph of Section 3.1
thereof PRESIDING OFFICER), to read as follows:
In accordance with Government Code Section 36801, the
Council shall meet, after each general municipal election,
on the Tuesday at which the resolution declaring the
election's results is adopted, and choose one of its number
as mayor and one as mayor pro tem. Each selection shall be
by three or more affirmative votes, and a failure to achieve
such total of affirmative votes, shall be deemed a selection
of the incumbent(s) to remain in office. Each person so
selected shall serve until a successor is chosen at any
time) by three or more affirmative votes, provided, that at
the second regular meeting in November of each odd numbered

Cn Septeeber 17, 1985, the Council concurred with the rec*rrr**dation of DPAC to
select the Peridian Group to prepare an architectural design manual to be part of
the Downtown Plan. This project was budgeted at $10,000 and the proposal was for
that anu'unt. However, the consultant suggested that additional work should also
be part of the project and the Council authorized Staff to r[eet further and negotiate
with the Peridian ian Group on this matter.
The Peridian Group proposes to prepare what is equivalent to a Specific Plan for the
downtown area. **ile it is difficult to clearly distinguish between the tasks to be
performed under the City's original PFP and the additional tasks suggested by Peridian,
I have underlined in the proposal those tasks which are additional".
As you are aware, I had planned to perform the additional" tasks with our City Staff
so it should be evident that they are tasks which are needed to have an adequate,
realistic Downtown Plan. The primary factors to consider in detenruning how to proceed
with this project are as follows:
Cost Additional funds of $18,000 would have to be budgeted to use
the consultant. If the tasks were performed by Staff, the
existing budget is adequate.)
o Time to Cccplete The consultant would likely be able to *lete
the project more quickly than Staff.)

a unique identification to this area of La Quinta, with the idea of encouraging
business developeent in the area, I would suggest that the area which has been
known as Downtown be designated the village at La Quinta.
As the Council is aware, the staff is currently working on directional signs,
scoe of which will provide notice to the public regarding where business and
governrrental services are provided in La QQinta. so that these signs may be
properly prepared, I am requesting that the Cooncil make this designation, and
that it will appear appropriately in the signs. I would *cp* that such a
designation will assist all of those peeple who may be involved in developeent
of this area of the city in developing unique and attractive concepts for such
grotth and that it would give a special recognition to this business area.

Auto Accident of December 6, 1984
Enclosed herewith is an application to present a late claim against
the City relative to an auto accident that occurred December 6, 1984.
Pursuant to state law, a claimant against a City must file a claim
within 100 days from the date of the occurrence. This was not done
by Mr. Gomsi for the reasons stated. Mr. Gomsi, through his attorneys
Klinedinst and Meiser, now make application to present a late claim
pursuant to the government code procedure. The grounds for the appli-
cation is that the failure to present the claim in a timely matter
was through a mistake, inadvertence, surprise or excusable neglect
and the City was not prejudiced by the failure to present the claim
within the 100 day period.
I have reviewed the application to present the late claim and it is
my opinion that the facts and arguments stated do not provide appro-
priate grounds for relief pursuant to mistake, inadvertence, surprise
or excusable neglect. Thus, it is my recommendation that the appli-
cation to file a late claim be denied. This will be accomplished by
adoption of the attached resolution.
