Property Tax Roll 1/7/86)
The purpose of this hearing is to provide the Council the opportunity to hear
and consider all public objections and protests, if any, to the report filed
*ith the Council containing a description of each real property parcel cleared
or cleaned by the City of La Quinta.
Notices of tonight's public hearing were sent to each property owner, advising
them of the hearing date. No written communications have been received regarding
this matter.
Following public comment and close of the public hearing, it is respectfully
recommended that the Council take the following action:
1. Adopt the proposed Resolution approving and adopting the
Resolution to place the cost of cleaning said lots on the
1986/87 property tax roll.

That the City Council adopt a Resolution establishing regulations for Vesting
*tative Maps for Residential slidivisions.
A**LYSIS
State Senate Bill 1660, approved by the Go*ernor in 1984, amended the State Subdivision
Map Act to establish a new form of tentative nap for subdivisions in California, known
as the Vesting *ntative Map". *esent law provides for the subdivision of land, and
guarantees subdividers oetain rights to divide land if they neet the oonditions of
approval. They have not, * been protected against changes in zoning laws or
develo*xt*nt s*ards or prDcedures. The new law specifies that *en the City approves
or cor*tionally approves a vesting tentative map, suci approval confers upon the su*
divider a vested right to proceed with his developeent in ocopliance with the zoning
codes, and develo*zt*nt starx3ards in effect at the ture of approval of the vesting map.
A co** of the Bill is attached. *te one of the stated objectives of the Bill is that:
The private sector should be able to rely upon an approved vesting
tentative nap prior to eeeending resources and incrring liabilities
without the risk of having the pro]ect frustrated by subseguent action
by the approving local agenny...."
Another stated objective is to:
ennure that loaal agencies have maxirrum discretion... in
the **osition of conditions on any approvals occurring subsequent
to the approval or oonditic*al approval of the vesting map so long
as that discretion is not *ercised in a manner *&di precludes a
subdivider fr*n proceeding with the proposed subdivision."
The Bill has other provisions regarding tiire limits, *ctensions, and so forth, and
re*uires that all local agencies adopt proce&ures, either by Ordinance or Resolution,
to irplerent the law, by January 1, 1986. The attached Resolution is for that r**xpose.

o *n recordation of all or any part of the vesting map, the
develo*zr*nt rights within that map last for a min of 18 months
after recordation, and may be extended, upon request, for another
year.

Staff has net with Staff of the City of Indio to evaluate traffic concerns at this
intersection in response to a mnr*er of traffic accidents. The north half of Miles
Avenue is in a Quinta, *hile the *uth half is in Inajo.
It is Staff's judgeent that the prirary concern at the intersection relates to sight
distance for eastbound traffic on Miles Avenue. *ile the current sight distance of
t300 feet x*eets mininun standards, accident history indicates that the ninixtum standard
nay not be acceptable.
It a*:*ears that two alternatives are aaailable for consideration, including:
o * traffic controls i.e., stop sign or signal) at the
intersection.
o * the road grade to increase sight distance.
The Staff of both cities has evaluated these alternatives and believe the second
is preferable. Even though a traffic warrant study was not * it is doL*tful
that the rec*riried *arrants for either a stop sign or signal can be satisfied.
Even if it was otherrise determined that a stop sign should be installed, the sight
distance concerns *uld pro*ly dictate the installation of a beacon-type flasher in
ad*Tance of the intersection. Given the high speed and cther factors, a stop sign
without an advanoe beacon **ou1d only c*ange the type of accident **lile creating an
additional liability epposure especially if *arrants were not ret). Indio Staff
surveyed the existing road profile and a preliminary design sketch to alter the grade
to increase safety was made. The sight distance can be increased to appr*imately
1000 feet by lowering the road west of the interstction a maxinum of 4 feet. Preliminary
costs of the available alternatives include:
o Traffic Signal $60,000-$80,000
o *top Sign with Advance Flashing Beacon $25,000
o * *ons**on $40,000-$50,000
Both Staffs prefer the road reconstrujon alternative. Thdio is willing to act as
lead agency for the project with a 50-50 split on costs, although we nay assu're a
slightly higher share if Indio has to shoulder the administrative costs. This matter
is scheduled to be reviewed by the Irdio City Council on January 15.

Due to the increasing number of large trucks parking in the downtown and other
commercial areas of the City, the attached revised ordinance is needed to improve
the image of the above areas by prohibiting the parking of these vehicles.
Staff recommends adoption of this parking ordinance.
