SUBJECT: FINAL TRACT MAP NO. 21381-3
LOCATION: West Side of PGA Boulevard, Approximately One-Half Mile
South of Avenue 54
APPLICANT: Sunrise Company
REQUEST: Approval to Record Phase 3 of Tract No. 21381
Tract Map No. 21381-3 represents approximately 20 acres of the
approximate 42-acre subdivision intended for 138 dwelling units. The
Phase 3 component consists of six lots for duplex home development.
Requirements for installation of street, drainage, water, sewer and
related improvements have been imposed on this map. A subdivision
agreement and letter of credit have been provided to guarantee the
required improvements. These documents are in satisfactory form.
The City Engineer has certified that Tract Map No. 21381-3 is in
substantial conformance with the tentative tract map approved by the
City Council on March 18, 1986. The map complies with all provisions
of the State Subdivision Map Act and the Municipal Land Division
Ordinance, and that the map is technically correct. It is the
opinion of Staff, that the items of concern on the part of the City
Engineer, being minor in nature, will not affect the approval process.
The conditions of approval associated with this map have been reviewed
and Staff has determined that the conditions have been satisfactorily
complied with.
The Phase 2 tract map, Tract No. 21381-2, will be presented for
Council consideration at a future date. Technical delays have
necessitated that the Tract No. 21381-3 map record prior to Tract
No. 21381-2.
STAFF RECOMMENDATION
The Community Development Department recommends that the City Council
approve Tract Map No. 21381-3 and authorize the recordation of the
map.

SUBJECT: Conference Attendance Chief Building Inspector
Pursuant to recently established policy, City Council approval is required
to approve out-of-state conference attendance.
The annual conference for ICBO International Conference of Building
Officials) is being held on September 14-19 in Phoenix, Arizona, This
conference is highlighted by the code change session review, discuss and
vote on future code changes) and by the education program inspection
techniques, special programs and productivity/staffing are planned this
year).
It is my judgment that the conference will give Tom Hartung an opportunity
to enhance his professionalleducational development. Furthermore, the
proximity of the out-of-state location will have lessor transportation
costs than many in-state locations. Overall, I believe the conference
will be beneficial to the operation of the City*s Building and Safety
funct ion.
Adequate funds for this conference are included in the FY 8*-87 Budget.
RECOMMENDATION
Community Development Director recommends that the City Council authorize
attendance of the Chief Building Inspector at the Annual ICBO Conference
in Phoenix, Arizona on September 14-19, 198G

Dear Mr. Kiedrowski:
Congratulations on your appointment to the office of
City Manager of the City of La Quinta. I know you will find
La Quinta a desirable place to work and we look forward to
drawing on your expertise when you become our City Manager.
This letter will set forth the terms and conditions of your
employment with the City as agreed to by the City Council.
Vl. Duties. Starting Date. Your employment as full-time
City Manager shall commence July 1, 1986. It is ex-
pected that during the month of July you will divide
your time, as Manager, between Show Low, Arizona and
La Quinta. During this period your salary will be
prorated on the basis of the number of days actually
serving La Quinta. The provisions relative to various
matters and functions of the office of City Manager,
including powers and duties, are set forth in Chapter
2.08 of the La Quinta Municipal Code, the terms of
which are incorporated herein by this reference. In
addition to the duties set forth in the Muncipal Code,
you shall perform other legally permissible duties and
functions as the Council shall from time to time
assign.
2. Salary. City shall pay you an annual salary of
$53,000.00, payable in installments at the same time
as other employees of the City are paid. City may
increase your salary and/or other benefits in such
amounts and to such extent as the Council, in its sole
descretion, may determine on the basis of an annual
performance evaluation and salary review made at the
same time as similar consideration is given other em-
ployees generally.

b 3. Employment Benefits. In addition to the annual sal-
ary, you shall receive the same employee benefits as
other employees of the City receive, as modified or
supplemented herein. Such benefits shall include
P.E.R.S. retirement system fully paid by City includ-
ing employee contributions; car allowance of $250.00
per month; medical and dental coverage for you and
dependents in accordance with a City selected plan;
term-life insurance of $15,000.00; annual vacation
leave to be accrued at the rate of three weeks per
year; annual administrative leave to be accrued at the
rate of ten days per year; sick leave and vacation
leave balances shall be deemed accrued at ten days
each upon commencement of employment; and City shall
sponsor and pay for memberships and annual confer-
ences for ICMA and California City Managers Associa-
tion.
4. Transition Assistance. City shall pay you rental
housing assistance of $300.00 per month for a maximum
of three months commencing with your start of employ-
ment. Additionally, City shall pay all actual and
reasonable moving expenses for household goods from
Show Low to La Quinta.
Vs. Performance Evaluation. Goals and Objectives. The
City Council shall review and evaluate your perform-
ance in or about January 1987 and annually thereafter
in advance of adoption of the annual operating budget.
Said review and evaluation shall be in accordance with
your initiation and pursuant to specific criteria de-
veloped jointly by yourself and the City Council.
Annually, at about the time of said performance eval-
uation, the City Council and yourself shall define
such goals and performance objectives which the
Council determines reasonably necessary for the proper
operation of the City and the attainment of the
Council's policy objectives.
6. Termination and Severance *. You will serve at the
pleasure of the City Council, which body shall have
the power to terminate you without cause, in accord-
ance with the provisions of this letter agreement and
the Municipal Code. In the event you are terminated
by the Council during such time that you are willing
and able to perform your duties as City Manager, then
in that event, City agrees to pay you a lump sum cash
payment equal to three months salary; provided, how-
ever, that in the event you are terminated for willful

Municipal Code, City shall have no obligation to pay
the severance pay designated above.

Subject: Liability Claims Administration
BACKGROUND
Since incorporation, the City has used CARL WARREN & CO., of
San Bernardino for all public liability claim adjustment and
administration. They have performed in a satisfactory and
professional manner.
The Coachella valley Joint Powers Insurance Authority CVJPIA) has
determined that each city, with the exception of Palm Springs,
must contract with an outside claim administrator if they are a
member of the CVJPIA Liability Program.
ANALYSIS
Services provided by an outside claim administrator include review
of each claim filed against the City, with a recommendation for
handling of the case; investigation services involving each
claim; and coordination with the public liability carrier
CVJPIA in our case) on each claim.
Staff believes the rate increases requested in the letter of
renewal are reasonable and justified.
RECOMMENDATION
It is respectfully recommended that the Council authorize the
City Manager to renew a service agreement between the City and
CARL WARREN & CO., of San Bernardino, beginning May 1, 1986,
through April 30, 1987, and authorize increases in the service
rates as requested in the attached *Exhibit A11.

Subject: Lease of Property for Expansion of City Hall
Facilities/purchase of Modular Unit
BACKGROUND
Prior to his departure July 1st, Frank Usher, former City Manager,
was engaged in negotiations to lease the 50 x 100' lot directly
east of City Hall for expansion of City Hall office facilities.
It was the City Manager's intent that this lot would be improved,
with sidewalk and rear parking/alley improvements, and modular
office(s) placed to house the expanded City Hall staff. The
facility would very much resemble the current Community Development
offices west of City Hall upon completion.
Staff is currently preparina several alternatives for modular
offices at this location, which would include either a double or
triple-wide modular structure. These alternatives would be
brought back to the Council for a final decision regarding placement
of staff in the new facility.
ANALYSIS
Discussions held prior to adoption of the FY 1986-87 budaet
indicated the need for several new staff positions, which were
confirmed by adoption of the budget. While some of the new
positions are on hold" pending the outcome of the management and
organization study being done by Ralph Anderson & Associates, current
staff housing needs necessitate our moving ahead with plans for the
additional facility. It is also desirous to move forward with lease
of the property to allow lead time for construction of on and off-site
improvements, sewer connection, etc.
Staff is currently preparing alternatives for utilization of space
at the new facility. It is anticipated that we will need either
a 24 x 60' or 36 x 60' modular. Costs will range between $25,000
$28,000 for a 24 x 60', or $38,000 $40,000 for a 36 x 60', plus
site improvements.
Richard Deman, legal owner of the property, has agreed to lease this
property to the City, at the rate of $200 per month, commencing
August 1, 1986, through November 30, 1987, with a one-year option to
renew.

It is respectfully recommended that the Council authorize the
City Manager to perform as follows:
1) To execute a lease agreement between the City and
Richard L. Deman1 for property located at 78-011 Calle
Estado, at the rate of $200 per month, for a period
beginning August 1, 1986, through November 30, 1987; and
2) To purchase modular office facilities as stated in the
memo, at a cost of approximately $25-28,000 for a 24 x 60',
plus site improvements, or $38-40,000 for a 36 x 60', plus
site improvements, for placement at the above location.

The City submitted for bid the trimming of the City's palm trees.
In all, there are 547 palm trees to trim, and the removal of
three dead palms adjacent to the park.
There was a total of 12 bid packets sent to various contractors,
of which two contractors submitted bids. They are as follows:
1. Accurate Maintenance of Palm Springs
$6,070.00
2. Lopez Tree Service
$6, 400.00
Accurate Maintenance has trimmed the palm trees before, and their
work was found very acceptable.
It is the Staff's recommendation to accept Accurate Maintenance's
bid.

Subject: Acceptance of Bid for One-Ton Dump Truck
The City has mailed out bid packets for a 1-ton flat bed dump
truck. The packet was sent to six local dealers, and was
advertised in the Daily News Newspaper.
The City of La Quinta received only one bid, which was
submitted from Plaza Motors of Palm Springs in the amount of
$17,107.73, including tax. This is a fair bid, and in line
with preliminary pricing that was done. Delivery would be in
the first week of November, due to the end of the current
production year.
Staff recommends acceptance of Plaza Motors bid.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA1 CALIFORNIA, APPROVING AND ADOPTING THE
REPORT PRESCRIBING THE CHARGES FOR RESIDENTIAL
PARCELS FOR CITY-FURNISHED REFUSE COLLECTION IN
1987 AND DIRECTING THAT SUCH CHARGES BE COLLECTED
ON THE TAX ROLL.
WHEREAS, the rates and charges for City-furnished garbage and
refuse collection and disposal services for residential parcels
within the City have been duly established by ordinance pursuant
to Section 5471 of the Health and Safety Code of California; and
WHEREAS, pursuant to Section 5473 of said Code, this City
Council has by such Ordinance, elected to have such charges for
the forthcoming year and for subsequent years collected on the tax
roll; and has caused a written report to be prepared and filed
with the City Clerk, which report contains a description of each
residential parcel within the City required to receive City-
furnished services as aforesaid and the amount of the charge for
each such parcel for the forthcoming year; and
WHEREAS, the City Clerk has caused a notice of the filing of
said report and of the time and place of a hearing thereon to be
published pursuant to Section 6066 of said Code; and
WHEREAS, at the time stated in the notice, to wit: August 5,
1966, at 7:34 p.m., this City Council conducted the hearing on said
report and on the adoption of this resolution and heard and
considered all objections or protests to the report;
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by
the City Council of the City of la Quinta, as follows:
SECTION 1. This City Council does hereby confirm the
written report, made by the City Manager, of the amounts of charges
for City-furnished garbage and refuse collection and disposal
services for the forthcoming year, itemized for each separate res-
idential parcel of land.
2. This City Council hereby finds that the collection of
such charges, together with general taxes, is in the best interests
of the users and the City of La Quinta.
3. The said refuse collection service charges for each parce
of land shall constitute a special assessment against that parcel a
shall constitute a lien against such parcel of land, in accordance
with Section 5473.5 of the Health and Safety Code of California.
SECTION 4. Pursuant to the prior election of this City
Council, said charges shall be collected on the tax roll in the sam
manner, by the same persons, and at the same time as, together
with and not separately from, the general taxes.

The City Council of the City of La Quinta does ordain as follows:
SECTION 1. Riverside County Ordinance No. 348 which was
adopted by reference by this City Council by Ordinance No. 5,
operative August 29, 1982) is further amended by adding the Special
Residential Single-Family" Zone in accordance with the text which is
attached to and made a part of this ordinance, and which attached
text is labeled Exhibit A".
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty 30) days after its adoption.
SECTION 3. POSTING. The City Clerk shall, within 15 days after
passage of this ordinance, cause it to be posted in at least three
public places designated by resolution of the City Council; shall
certify to the adoption and posting of this ordinance; and, shall
cause this ordinance and its certification, together with proof of
posting, to be entered into the Book of Ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of

9.03.010 PURPOSE: The SR Zoning District is generally appropriate
where a density of between four 4) and eight 8) units per
acre is provided for in the General Plan of the City. It
is intended to provide development standards for single-
family residential uses and to assure high quality
development especially in the Cove" area.
9.03.020 ALLOWABLE USES: The following uses shall be allowed in the
SR Zone subject to obtaining a Precise Plan approval as
provided by Section 9.03.040.A Precise Plan):
A. Single-Family Dwellings
B. Accessory buildings and uses incidental to the
use of the property as a single-family residence.
C. Home Occupations See Section 18.42)
D. Small and Large Family Daycare homes pursuant to
the State Health and Safety Code
E. Residential Care Facilities, where the number of
residents under care is six 6) or fewer, pursuant
to the State Welfare and Institutions Code
F. Temporary real estate tract offices located within
a subdivision, to be used only for and during the

9.03.021 CONDITIONAL USES: The following uses may be allowed in the
SR Zone subject to obtaining a Conditional Use Permit as
provided by Section 18.28 Conditional Use Permits):
A. Educational Institutions, not including trade or
vocational schools
B. Churches, Temples and other places of religious
worship
C. Second Unit or Granny Flat" within a single-family
house pursuant to Section 65852.2 of the California
Government Code
D. Residential Care Facilities, where the number of

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, AMEN*ING
THE M!*NICIPAL CODE RELATING TO CONSTRUCTION
SITE SECURITY AND DEBRIS.
The City Council of the City of La Quinta does ordain as follows:
SECTION 1. Section 8.01.070 of the La Quinta Municipal Code is
hereby amended to read as follows:
8.01.070 Construction site security & debris A. The
owner, contractor or responsible party constructing a new
building, addition, or alteration to an existing building
shall maintain security measures as deemed necessary or as
required by the building official to control vandalism,
fires, blowing dust, sand or debris.
B. The owner, contractor or responsible party con-
structing a new building, addition, or alteration to an
existing building, shall keep the construction site clean
by having an adequately sized debris box container placed
on the site for fhe depositing of trash and debris. As
used in this section, trash and debris shall include
papers, cartons, bottles, cans, garbage, roofing materials,
insulation, plaster, concrete, boards and other substance
that may be accumulated as a result of construction activities.
C. A trash container shall remain on the construction
site until the building inspector has completed the final
inspection. Said container shall be emptied of its contents
on a regular schedule or as ordered by the building inspec-
tor in order to avoid blowing debris or other public nui-
sances.
D. Disposal shall be by transportation to a legally
established dump site by the city's refuse contractor or
other person authorized by law to remove any container from
the location where the container was placed by the person
in charge for storage and collection.
E. Refusal to comply with the provisions of this
section shall be a misdemeanor and punishable as stipulated
in Section 205 of the Uniform Building Code; and/or be
sufficient cause for the revocation of the issued building
permit pending compliance.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty 30) days after passage.
SECTION 3. POSTING. The City Clerk shall within 15 days after
passage of this ordinance, cause it to be posted in at least the
three places designated by resolution of the City Council; shall
certify to the adoption and postina of this ordinance; and shall

The City Council of the City of La Quinta, California, does

SECTION 1. Chapter 3 Electrical Code) of Title 8 Building
and Construction) of the La Quinta Municipal Code is hereby amended
by adding thereto Section 8.03.040 which is to read as follows:
8.03.040. Telephone lacks and television cable outlets. The
following shall be added as a new article to Chapter 8 of the
National Electric Code:
840-1 Requirements. All new residences shall be pre-wired
for television cable outlets and telephone jacks according
to the following:

a dwelling unit. Exception: Dining area which is immediately
adjacent to a kitchen or living room.

11.88.010 Special event--Definition. Special event
sales" shall include garage sales, yard sales, patio sales
and other similar event sales in residential districts for
the purpose of offering for sale household or personal
goods of the occupant of the premises where such sale is
permitted and is not intended for commercial sale of goods
purchased elsewhere for such special event sales.
11.88.020 Permit required. Fee. No person shall
conduct a special event sale within a residential district
without having procured a permit from the city to do so
and paying a fee of ten dollars for each special event
sale.
11.88.030 Advertising by signs. Persons granted a
permit to conduct a special event sale shall comply with
the provisions of the municipal code and zoning ordinance,
regulating and controlling the use of signs, and failure
to comply shall result in the permit being revoked and
cause to deny future requests for a permit.
11.88.040 Terms of permit. Any permit granted under
this chapter shall be limited to seventy-two consecutive
hours and two such special event sales in any calendar
year.

SUBJECT: Manuals on Architectural and Landscape Standards for
Single-Family Houses.
Attached for your review and adoption are the resolution and design
manuals for single-family houses in the City. The manuals have been
revised to be consistent with the provisions of the Special
Residential single-Family'1 Zone which was approved for adoption by
the City Council on July 15, 1986.
No substantial changes have been made in the manual* from those
recommended by the Planning Commission at their May 13, 1986 hearing
on the related amendment to the Municipal Land Use Ordinance.
Staff is currently researching the following additional design
standards which will be presented at a later date to the Planning
Commission for their consideration for inclusion into the manuals:
* Recommended plant species, sizes, and spacing for
materials to be used in vegetation screens.
* Energy conservation methods for building and
landscape design.
STAFF RECOMMENDATION
Based upon the above findings, the Community Development Department
recommends adoption of the Manual on Architectural Standards and the
Manual on Landscape Standards, in accordance with the attached
Planning Commission resolution.

CERTIFICATE
I, ROBERT G. MORGAN, Registrar of Voters of the County of
Riverside, State of California, do hereby state as follows
concerning the Referendum against Resolution No.86-56 a
resolution of the City council of the City of La Quinta),
which was filed in the office of the City Clerk of said City
on July 16, 1986, and was received in my office on July 29,
1986, for the purpose of examination of signatures thereon:
That said referendum petition was found to contain a total of
375 signatures, of which 353 are signatures of registered
voters residing within the boundaries of said City of La Quinta;
That, pursuant to Section 4051 of the California Elections Code,
the number of signatures of qualified voters of the City of
La Quinta required for sufficiency of said petition is 302, that
number being not less than 10 per cent of the total number of
voters of said City, 3011, according to the last official report
of registration to the Secretary of State;
And, finally, that said referendum petition has therefore been
found to be sufficient.
