AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA AMENDING THE LA QUINTA MUNICIPAL CODE
RELATING TO REGULATION OF DOGS.
The City Council of the City of La Quinta, California, does
ordain as follows:
SECTION 1. Sections 10.04.040, 10.04.060, 10.20.090, and
10.24.040 of Title 10 of the La Quinta Municipal Code are hereby
amended to read as follows:
10.04.040. OWNER. Owner" means any person who is the
legal owner, keeper, harborer, possessor or the actual custodian of
any animal. Ownership is also established by a person registering as
the owner on a license or other legal document, or by a person
claiming ownership and taking possession of an animal.
10.04.060. VICIOUS OR DANGEROUS ANIMAL. The term vicious
animal" or * animal" means a dog which:
1. Has behaved in such a manner that the owner thereof knows or
should reasonably know that the dog has tendencies to attack or
bite human beings; or
2. Has twice within a forty-eight month period bitten, attacked,
or shown the disposition, tendency, or propensity to attack,
bite, or otherwise cause injury to a person engaged in lawful
activity; or
3. Has once attacked or bitten a person engaged in lawful
activity, causing death or substantial injury; or
4. Has been determined by a doctor of veterinary medicine, after
observation thereof, as posing a danger to humans or domestic
animals if not enclosed or muzzled; or
5. Has attacked, or behaved in such a manner that the owner
thereof knows or should reasonably know that the dog has
tendencies to attack domestic animals without provocation; or
6. Has been trained for fighting for or as an attack dog, except
such dogs which are employed by the Police Department of the City
or the County of Riverside.
Any dog which is outfitted with a training device for fighting or
attack, such as a weighted collar around the neck of the dog,
shall be presumed to be a dog trained as a fighting or attack dog.

10.20.090. CONTROL AND IMPOUNDMENT OF DANGEROUS OR
VICIOUS ANIMALS.
a. No person owning or harboring or having the care or custody
of a dangerous or vicious dog shall suffer or permit such dog to
go unconf med on the premises of such person. A vicious dog is
unconf med, as the term is used herein, if such dog is not
securely confined indoors or confined in a securely enclosed and
locked pen or a dog run area upon the premises of said person.
Such pen or dog run area must also have either sides six feet
high or a secure top. If the pen or structure has no bottom
secured to the sides, the sides must be imbedded into the ground
no less than one foot.
b. No person owning or harboring or having the care or custody
of a dangerous or vicious dog shall suffer or permit such dog to
go beyond the premises of such person unless such dog is securely
muzzled and restrained with a chain having a minimum tensile
strength of 300 pounds and not exceeding three feet in length.
c. No person shall own or harbor any dog for the purpose of dog
fighting; nor train, torment, badger, bait or use any dog for the
purpose of causing or encouraging said dog to unprovoked attacks
on human beings or domestic animals. Nor shall any person outfit
any dog with a training device for fighting or attack, such as a
weighted collar around the neck of the dog.
d. No person shall possess, with intent to sell, or offer for
sale, breed, or buy or attempt to buy within the City any vicious
or dangerous dog.
e. Any person owning or harboring or having the care of any
dangerous or vicious dog shall maintain a policy of insurance in
an amount not less than $50,000.00 insuring said person against
any claim, loss, damage, or injury to persons, domestic animals,
or property resulting from the acts, whether intentional or
unintentional, of the vicious dog. Such person shall produce
evidence of such insurance upon the request of a law enforcement
officer.
f. Whenever an animal suspected of being dangerous or vicious is
reported, the city manager or his agent may investigate the
circumstances, and if he finds that the animal, by reason of his
acts, propensities, or disposition, is a dangerous or vicious
animal as defined in this title, he may notify the owner or
harborer in writing stating the facts and circumstances.

The owner shall be entitled to an administrative hearing before
the city manager to determine whether said dog is vicious or
dangerous, and, if so, the nature and extent of orders to be
made. If, after said hearing, if requested, it is determined
that the dog is vicious or dangerous1 the city manager may
orderthe owner to keep the animal confined as provided in this
section and/or may make such other and further orders as are
reasonable under the circumstances. If restraint or confinement
is impracticable, the animal shall be impounded until the owner
or harborer is able to comply with the city manager's orders.
For any such impoundment, the owner or harborer shall be liable
to the city for payment of fees as prescribed pursuant to Section
10.20.080, and any animal not reclaimed within a reasonable time
after such impoundment shall be subject to destruction. In cases
where the animal is not impounded, and written notification has
been given as herein provided, if the owner or harborer fails to
provide adequate restraint or control of the animal as ordered by
the city manager within a reasonable time, or if he thereafter at
any time fails to maintain the adequate restraint or control, or
comply with other orders of the city manager, the owner or
harborer shall be guilty of a misdemeanor, and the animal shall
be subject to summary destruction.
10.24.040. MAXIMUM NUMBER OF DOGS. Except for licensed pet
shops and kennels, no persons shall own, keep or harbor, nor shall
the owner or occupant of any premises keep or permit on or in such
premises more than dogs of four months of age or older.
SECTION 2: Section 10.28.070 is hereby added to Title 10,
Chapter 10.28, to read as follows:
20.28.070. PUBLIC NUISANCE. The introduction, ownership,
possession or maintenance of any animal, or the allowing of any
animal to be, in contravention of this title, is, in addition to
being a violat*9r*,5*herAby declared to be a public nuisance. The
city * health officer, and peace officers are
hereby authorized, directed and empowered to summarily abate any
such public nuisance independently of any criminal prosecution or
the results thereof of any means reasonably necessary including
but not limited to the destruction of the animal or animals
involved, or by the imposition of specific reasonable conditions
and restrictions for the maintenance of the animal. Failure to
comply with such conditions and restrictions is a misdemeanor.
The owner shall reimburse the city for all costs incurred in
verifying compliance and enforcing the provisions of this
section. The city may also commence proceedings in accordance
with the provisions of Chapter 11.72 relative to abatement
procedures for public nuisances.

SECTION 3. If any section, subsection, sentence, clause or
phrase of this ordinance is for any reason held to be invalid, such
holding shall not affect the validity of the remaining portions of
this ordinance. The council declares that it would have passed this
ordinance and each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that any one or inore sections,
subsections, sentences, clauses or phrases be declared invalid.
SECTION 4. Any person violating any provision of this
ordinance shall be guilty of a misdemeanor, and upon conviction
thereof shall be punished by a fine of not more than $500.00 or by
imprisonment for a period of not more than six months, or by both
such fine and imprisonment.
SECTION 5. EFFECTIVE DATE. This Ordinance shall be in
full force and effect thirty 30) days after passage.
SECTION 6. POSTING. The City Clerk shall, within 15 days
after passage of this ordinance, cause it to be posted in at least
three public places designated by resolution of the City Council;
shall certify to the adoption and posting of this ordinance; and
shall cause this ordinance and its certification, together with proof
of posting, to be entered in the book of ordinances of the City.
The foregoing ordinance was approved and adopted at a meeting of
the City Council held on the day of

The City of Cathedral City recently published a Cathedral City
Calendar of Events 1987". This publication was put together
for them by the firm of Ted Gropher & Associates of Palm
Springs. Cathedral City's cost for 15,000 calendars was
$13,312.00, or approximately $0.89 each.
If the Council is interested in doing a similar type calendar
for 1988, please let me know. I will then discuss this with Mr.
Gropher and budget accordingly.

ment companies and the like."
Stiles said more and more Cities in the valley are willing to offer develop-
mental incentives such as tax breaks and waiving of certain fees, assistance on site
location and parcel assembly, as well as leads on local financing. Grisham added
that the county provides job training funds and salary subsidies for people in job
training, as well.
Although the pendulum on municipal policies is swinging away from opposition to
light industrial development, Oliphant emphasized that no one is likely to tolerate
a sudden stampede of large-scale industrial development here.
The vast majority of the local voting population is still predisposed toward
a resort environment," said Oliphant, but many are coming to understand the
increasingly critical need for a 12-month employment base."
Organizers of the two-day sy*oslum at the recently opened 892-room *
Desert Springs golf resort hope to attract 500 chief executive officers, site selec-
tion executives, commercial real estate specialists and investment counselors.
Palm Desert Town Center developer Ernest W. Hahn and Sunrise Company chairman
William Bone will deliver keynote speeches along with Grisham.
We hope to make this an annual affair," said Grisham. We think it can help
make very significant inroads into solving the problems especially in the area
of employment that the valley is facing at this stage in its gr**h."

Subject. Gatekeeper Program
This memo will serve as formal request to seek approval for the
Riverside County Office on Aging Amendment to the Title III contract
giving the La Quinta Senior Services Center funding for the Gatekeeper
Program.
A Gatekeeper is an individual in a varied and informal group who
comes in contact with a senior and is able to observe nchaflg*Y? in
his/her personal and daily habits. Gatekeepers may be mail carriers,
apartment managers, mobile home park managers, ministerial
groups, utility meter readers, etc. If a problem situation is
observed, a Gatekeeper i.e., Good Samaritan) can call and alert
the local Senior Center's outreach program. A trained outreach
worker will then make contact with the senior and attempt to resolve
his/her problem.
Purpose of the Gatekeeper Program is to provide temporary staff
assistance to each organization to help establish a Gatekeeper network
in the community served. This staff person will visit throughout the ar*
and identify and educate Gatekeepers so that they can readily refer
any senior.
The Gatekeeper program is funded by the California Department of Aging
through June 30, 1986 and will be administered by the Riverside
County Office on Aging through 6 sub-projects. The La Quinta Senior
Services Center has been identified to become a sub-probject
for the 1986-87 year.
Attached to this memo is literature giving further explanation for
the Gatekeeper Program.

Dear Mayor Hoyle and Council Members Sniff, Pena, Cox
and Bohnenberger:
We represent a group of residents, merchants and property
owners who have a common interest in seeing the downtown
area of La Quinta develop in an orderly way, taking full
advantage of its unique charm.
An immediate concern we have is that the Village' con-
cept, that so many people favor for the downtown, will be
spoiled by the widening and conversion to a main street,
of Avenida Bermudas between Calle Tampico and the Desert
Club of La Quinta. If this were to occur, the Walking
Village' would be adversely affected by a busy street
bisecting the area that most agree should be intact.
Heavy traffic through the Village would keep away the
very people we are trying to attract those coming to
the area to shop and experience a unique setting away from
traffic noise and congestion, as well as the higher speeds
a main street encourages.
An important factor to consider is the negative effect on
residential property owners along the west side of Bermud-
as, who would lose much of their front yards to a widening.
At least one property owner scrapped definite plans to build
a nice home when they jearried they would lose a large area
off their already small 5000 square foot lot. Another neg-
ative is that existing historical structures and mature,
beautiful Eucalyptus trees would require removal, creating
all the problems associated with Emirient Domain. Groups
*uch as Desert Beautiful and the Historical Society would
no doubt become involved. All in all, the negative factors
far outweigh any potential benefits.
Perhaps it would be a good start for some of us to meet
with you or the Planning Director at your earliest con-

Agreement signed by City Officials regarding future
Sphere of Influence and Annexation boundaries between
La Quinta and Indio.
30. September 2, 1986
Resolution No. 86-73 adopted by the La Quinta City Council
establishing future boundaries and a holding area for
planning purposes) between Coachella and La Quinta
Reciprocal Action).
31. March 17, 1987
Resolution NO. 87-14 adopted by the La Quinta City Council
declaring its intention to amend its Sphere of Influence to
include areas generally east of the City boundaries* west
of Monroe Street, north of 60th Avenue, and south of 52nd
Avenue. Note that this action executes agreements made
between La Quinta and Indio and La Quinta and Coachella.

SUBJECT: AUTHORIZATION TO ADVERTISE FOR BIDS
STREET IMPROVEMENTS
1. washington Street, Singing Palms to Whitewater
River
2. Avenida Montezuma, Calle Chihuahua to Calle
Durango
Pursuant to your direction, construction bid documents are being
prepared for the following construction projects:
a) Washington Street from Highway 111 to Whitewater River.
Resurfacing and street reconstruction.
b) Washington Street from Singing Palms Drive to Highway 111.
Street widening on the west side including curb/gutter and
sidewalk) and spot pavement repair.
c) Avenida Montezuma from Calle Chihuahua to Calle Durango.
Placement of aggregate rock base where necessary), grading
and placement of a dust controlling agent.
Due to the compressed design period, only rough budgetary cost
estimates are available at this time, and are as follows:
a) $50,000 Washington, N/O Highway 111
b) $45,000 Washington, 5/0 Highway 111
c) $25,000 Montezuma
$120,000 Total
Final cost figures will be developed for your review as soon as
possible. Per our discussion sufficient funds are available,
however, the appropriate fund transfer should be done no later than
when the City Council reviews the bids.
My tentative schedule is to have the bid opening on May 14, 1987,
with Council review/acceptance of the bid on May 19, 1987.
