Subject: Planning Commission Appointments
Effective June 30, 1987, two 2) seats on the La Quinta Planning
Commission will become vacant. These seats are currently held
by:
Thomas A. Thornburgh Appointed: 08-23-82
Reappointed: 07-10-84
John walling Appointed: 07-10-84
Additionally, on June 1, 1987, the City received the resignation
of Commissioner Kimberly Brandt, effective June 23, 1987. Ms.
Brandt was appointed June 10, 1985, for a three year term of
office, ending July 1, 1988. I would recommend that the seat
held by Ms. Brandt be considered concurrently with the other two
seats listed above.
Two appointments will be for a term of office of three years,
effective July 1, 1987. One appointment will be made to fill
Commissioner Brandt's unexpired term, effective July 1, 1987,
through July 1, 1988.
The City published the notice inviting applications in the
May/June, 1987, City newsletter, and a notice was posted on the
bulletin board at La Quinta Post Office. As of the June 10,
1987, filing deadline, nine 9) applications and one 1) letter
requesting reappointment were received:

As you are aware, Section 2.06.010, General rules regarding
appointments, terms, vacancies attached), prohibits appointment
to a City board or commission of more than two full consecutive
terms. Section 2.06.010 further states that any person who has
served substantially two full consecutive terms shall not be
reappointed to the same board or commission until at least the
time equal to one full term has elapsed. This rule effectively
prohibits Corrinissioner Thornburgh's reappointrnent to the
Planning Commission at this time.
RECOMME*DATION
It would be Staffts recommendation that the City Council select
two 2) persons for reappointment and/or appointment to the La
Quinta Planning Commission, for three year terms of office
beginning July 1, 1987, and ending June 30, 1990, and appoint
one person to fill the unexpired term of Kimberly Brandt,
effective July 1, 1987, and ending June 30, 1988. Council's
pleasure.

Commissioner Cameron Barrows, effective immediately. Due to the
fact that a Commission quorum comprises four persons, it would
be my recommendation that the seat held by Mr. Barrows remain
vacant and be considered for appointment concurrently with the
other two seats listed above.
Two appointments will be for three year terms of office,
effective July 1, 1987, through June 30, 1990. One appointment
will be made to fill Commissioner Barrow' s unexpired term,
effective July 1, 1987, through June 30, 1989.

A RESOLUTION OF ThE CITy COUNCIL OF ThE
CI* OF LA QUINTA, CALIFORNIA, DECLARING
ITS INTENTION TO CONDUCT A PUBLIC HEARING
TO CONSIDER A REQUEST TO VACATE A PORTION
OF AVENUE 46 RIGHT-OF-WAY.
WHEREAS, the Public Streets, Highways and Service Easements
Vacation Law Part 3, Division of the California Streets and Highways
Code) provides an alternative system of proceeding for vacating
streets in cities; and
WHEREAS, it has been proposed that certain interest in the land
hereinafter described in this Resolution, which have heretofore been
dedicated for street purposes, may no longer be required for said
purposes.
NOW, THEREFORE, the City Council of the City of La Quinta does
resolve as follows:
1. The City Council hereby declares its intention to conduct a
public hearing to consider a request to vacate and abandon a
portion of Avenue 46, between the easterly right-of-way of
State Highway 111 and the westerly limits of the Whitewater
River Storm Water Channel. Said property is particularly
described in Exhibit A", attached hereto and incorporated
herein by this reference. A map designating the portion of
said street to be considered for vacation is attached hereto
as Exhibit B: and incorporated herein by this reference.
2. The public hearing with regard to this vacation and
abandonment shall be held before the City Council on the 4th
day of August, 1987, at 7:30 p.rn., in the Council Chambers
at City Hall, located at 78-105 Calle Estado, La Quinta,
California.
3. The City Council hereby elects to proceed With this proposed
request for the vacation and abandonment pursuant to the
Public Streets, Highways and Service Easements Vacation Law
Part 3, Division 9, of the California Streets and Highways
Code).
4. Said portions of the street proposed to be vacated are
designated on a map or plan on file in the office of the
City Clerk, to which reference is hereby made for further
particulars as to the proposed vacation.
5. The City Clerk is hereby authorized and directed to publish
a copy of this Resolution for at least two successive weeks
prior to the hearing in the Indio Daily News, a newspaper of
general circulation, circulated in the City and to further
cause notices of the proposed street vacation at least two

LEASE AGREEMENT NO. 5
1. Reference is made to Lease dated July 7, 1982, and Lease
amendment Nos 1,2,3 and 4 between M.D. Brennan & Albert
Wild, Lessor, and CITY OF LA QUINTA, Lessee, regarding lease
of office space in Lessor owned building at 78-105 Calle
Estado, La Quinta, California.
2. This Amendment No. 5, executed June 20, 1987, to the above
referenced Lease, is as follows:
The Lessors are Georg and Katherine Fenady, current owners
of the building located at 76-105 Calle Estado, La Quinta,
California
Lessors hereby lease to Lessee, and Lessee rents from Lessor,
six 6) office suites, namely A-F comprising approximately
3,020 sq. ft. of floor space, for additional two-year period
commencing Dec. 1, 1987 and ending Nov. 30, 1989.
3. The total monthly rental payments for Suites A-F shall be
adjusted as follows:
Commencing Dec. 1, 1987, the total sum of $2,635.38.
4. The total rent of the above referenced Lease Amendment No. 5
is hereby adjusted to $63,249.12.
5. Lessee shall pay the utility charges on electric meters A-F.
6. Lessee shall be given the option to renew this lease for two 2)
additional years, exercisable by giving Lessors written notice
of intentions to renew at least six 6) months prior to November
30, 1989.
7. All other provisions of the referenced Lease and Amendments
shall apply.
