BACKGROUND:
In 1984, a proposed Tentative Tract, No. 19987, which created a
162-unit, single-family, planned-residential development, was
approved by the City Council on June 5, 1984. The approval has
subsequently expired.
In 1985, the property was designated High Density Residential
8-16 d.u.Iac.) with the adoption of the General Plan.

i^ =Z The subject application, therefore, is a proposal to make the
property zoning consistent with the General Plan. The R-3 zoning
is the only district inherited from the County by City adoption
of the County's Land Use Ordinance) which is available to
implement the General Plan designation.
PROPOSED DEVELOPMENT:
The redesignation of the site to R-3 will permit the Applicant to
proceed with development of the property. A plot plan
application has been submitted requesting approval to construct
472 apartment units. The formal plot plan review will be
conducted at a Director's Hearing, which will be held after the
effective date of the Change of Zone.
Included with this report are reduced copies of the conceptual
development plan for Commission information.
ANALYSIS:
1. The proposed change from R-1 to R-3 will bring the
Applicant's property into conformance with the General Plan
Land Use Map designation of High Density Residential.
2. The R-3 zoning designation is the most appropriate zone
currently available for the High Density Land Use
designation.
3. The environmental impacts have been addressed by the Master
Environmental Report adopted for the General Plan and the
current environmental review conducted.
4. Development of the site can be accomplished in conformance
with the standards of the La Quinta Municipal Code.
5. Property development will be reviewed in depth at a
Director's Hearing to be conducted after the effective date
of the Change of Zone.
PLANNING COMMISSION ACTION/RECOMMENDATION
On August 25, 1987, the City Planning Commission conducted a Public
Hearing to consider its recommendation regarding the subject Change
of Zone and environmental assessment.
One member of the audience, a resident on the north side of Westward
Ho, testified before the Commission questioning the appropriateness
of the rezoning. In testimony, this person advised that he was aware
of the original proposal to develop the property with 162
single-family dwellings, but was not aware of the 1985 General Plan
designation for High Density Multi-Family Residential use.

The City Council of the City of La Quinta does ordain as follows:
SECTION 1. The La Quinta District Official Zoning Plan Map No.
14, as amended adopted by City Council Ordinance No. 5, operative
August 29, 1982), is further amended by rezoning from R-1 to R-3
those certain parcels shown and depicted for such rezoning on the map
which is attached to and made a part of this ordinance, which
attached map is labeled Exhibit A11 change of Zone 87-026.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty 30) days after its adoption.
SECTION 3. POSTING. The City Clerk shall, within 15 days after
passage of this ordinance, cause it to be posted in at least three
public places designated by resolution of the City Council; shall
certify to the adoption and posting of this ordinance; and, shall
cause this ordinance and its certification, together with proof of
posting, to be entered into the DOQk of Ordinances of this city.
The foregoing ordinance was approved and adopted at a meeting of
the city Council held on this 1st day of September, 1987, by the

RELATING TO BUILDING AND CONSTRUCTION CODES:
SPECIFICALLY, ADOPTION OF THE 1985 MODEL CODES AND THE
1987 ELECTRICAL CODE, WITH CERTAIN OTHER AMENDMENTS.
BACKGROUND/DISCUSSION
Periodically, uniform or model" building and construction codes are
revised and updated. Title 8 of the Municipal Code, Buildings and
Construction", locally adopts these codes by reference. The proposal
before the City Council is an ordinance which would incorporate the
latest version of various uniform codes into the City's regulations
for building practices.
Additionally, the draft ordinance contains one other housekeeping"
item which involves the separation of City reviewing boards which
handle the subjects of alternative material use, and that of general
appeals. The first activity is primarily a technical function,
whereas the second is more concerned with administrative practices.
The alternative materials appeal board membership would, essentially,
be composed of trades" people. The City Council, as found in most
small to medium size communities, is named as the appeal board for
the Housing Code and related matters.
RECOMMENDATION

The City Council of the City of La Quinta, California does
ordain as follows:
SECTION 1. ADOPTION OF ThE 1985-87 EDITION OF VARIOUS UNIFORM
CODES. The following editions of the various uniform codes are
adopted by reference in place of their respective codes which are
currently in effect. Title 8 shall be revised to show the adoption
of the following uniform codes:
The Uniform Administrative Code, 1985 Edition, published by the
International Conference of Building Officials; the Uniform
Building Code, 1985 Edition, including certain specified
appendices and the Uniform Building Code Standards, published by
the International Conference of Building Officials; the National
Electric Code, 1987 Edition, published by the National Fire
Protection Association; the Uniform Plumbing Code, 1985 Edition,
including all appendices and the installation standards,
published by the International Association of Plumbing and
Mechanical Officials; the Uniform Mechanical Code, 1985 Edition,
published by the International Association of Plumbing and
Mechanical Officials; the Uniform Swimming Pool, Spa and Hot Tub
Code, 1985 Edition, published by the International Association
of Plumbing and Mechanical Officials; the Uniform Sign Code,
1985 Edition, published by the International Conference of
Building Officials; the Uniform Housing Code, 1985 Edition,

SECTION 2. OTHER REVISIONS TO TITLE 8. Section 8.01.030 of
the La Quinta Municipal Code is amended to read as follows:
8.01.030 Establishment of Board of Appeals. In order to
conduct hearings to determine the suitability of alternate
materials and methods of installation, a Board of Appeals
is hereby established.
1) Membership. The Board of Appeals shall consist
of five 5) members, one 1) of whom shall be a
general contractor, two 2) of whom shall be
structural engineers or architects, one 1) of
whom shall be a speciality contractor, all of whom
shall be qualified by experience and training, and
one 1) of whom shall be a member of the public

The Change of Zone application is requested to bring the zoning
into conformance with the existing General Plan land use
designation. The entire Village area will eventually be re-zoned
to an appropriate City zone designation, which will be developed
based upon the Village. Commercial land use category and
standards which may evolve from the Village Specific Plan.
B. VARIANCE REQUEST *87-004
The Applicant requested relief from Section 9.160.040(L) of the
La Quinta Municipal Code LQMC) in order to provide 9 permanent
on-site parking spaces instead of the required 13 parking
spaces, and to eliminate the provision of Section 9.160.030(E)
LQMC, which requires a masonry wall to buffer commercial parking
areas from adjoining residentially-zoned property.
1. Parking: The Applicant requested that 4 of the required 13
parking spaces be located off-site, along the north side of
the alley right-of-way refer to Attachment *1) on property
which is not owned by the Applicant. A lease agreement was
proposed to allow the Applicant the right to use the four
spaces for a given time. The Zoning Ordinance permits
permanent off-site parking spaces to be located across an
alley if they are within 300 feet of the use which they are
intended to serve Sec. 9.160.020(B) LQMC). In this case,
the parking spaces could not be guaranteed for the life of
the development.
2. Deletion of Wall Requirement: Section 9.160.030(E) LQMC
requires that any commercial parking area be walled as
follows:
All paved parking areas, other than those required for
residential uses, which adjoins property zoned R-1,
R-1A, R-2, R-2A, R-3, R-A, R-T, or R-T-A, shall have a
six-foot high solid masonry wall installed in such
manner as to preclude a view of the parking area from
such adjoining property, except that any walls within
10 feet of any street or alley shall be 30 inches high."
The Applicant requested relief from this requirement, based
on the following considerations:
o The adjoining easterly property, although it is
currently R-1 zoned, is designated as village
Commercial on the General Plan Land Use Map. The
property will have to be re-zoned in the future for
consistency with the General Plan, which would
eliminate the wall requirement
o Owner of said R-1 property has an existing five-foot
wall, with oleander screening which would serve as an
adequate buffer during the property's tenure under R-1
zoning.

AMENDMENT TO THE LA QUINTA GENERAL PLAN
CIRCULATION PLAN TO UPGRADE MILES AVENUE FROM
A SECONDARY ARTERIAL TO A PRIMARY ARTERIAL.
PROJECT LOCATION: MILES AVENUE ALIGNMENT BETWEEN JEFFERSON
STREET AND WASHINGTON STREET.
BACKGROUND:
On July 15, 1986, City Council unanimously approved Lewis Homes Tract
No. 21433, which also included establishing Miles Avenue as a Primary
Arterial with a 100-foot width. This street upgrade decision was the
result of a traffic study prepared June 30, 1986 for the North La
Quinta area which incorporated a build-out scenario justifying
increased capacity on Miles Avenue refer to Exhibit 11D:, original
traffic study). This General Plan Amendment request therefore
formalizes the direction of City Council.
General Plan Amendment No. 86-014 was also initiated to review all
major streets in the North La Quinta area relative to adequacy of
their current General Plan circulation classifications. Referring to
Policy No. 7.5.8 of the General Plan Infrastructure Element, it is
noted that a study should be undertaken to determine whether Dune
Palms Road and/or Adams Street should be reclassified. At the
direction of the Planning Commission, the City contracted with BSI
Consultants to prepare an updated study of the North la Quinta area,
incorporating two other General Plan Amendment cases: J.C.C.
Enterprises No. 86-012, and C.W. Meisterlin No. 86-016 refer to
Exhibit C", North La Quinta Traffic Study, dated March 31, 1987).
ENVIRONMENTAL CONSIDERATIONS:
Environmental Assessment No. 86-064 was prepared pursuant to the
requirements of the California Environmental Quality Act CEQA). The
assessment indicated that the project could not have a significant
effect on the environment. Based upon the traffic study completed
for the North La Quinta area, the proposed upgrade to Miles Avenue
would provide adequate circulation capacity at the density ranges
provided in the General Plan Land Use Map at build-out.

In essence, the most recent traffic study concludes that, excepting
for Miles Avenue, all other North La Quinta area streets are adequate
for the projected build-out capacity, including Dune Palms Road,
Westward Ho Drive, and Adams Street. This study also concludes that
Miles Avenue, upgraded to a Primary Arterial would provide for
adequate circulation capacity given the broad spectrum of density
scenarios offered in the General Plan Land Use Map. However, it also
indicated that, with the inclusion of an Intensive Transportation
System Management" program for Miles Avenue, under normal and
mid-range density build-out forecasts, Miles Avenue could be
maintained as a Secondary Arterial. Intensive Transportation Systems
Management is a method of enhancing traffic capacity including raised
median islands with restricted left turn movements, spot widening
intersections, and separate bicycle lanes described in more detail
on page 4 of the March 31, 1987 traffic study). Therefore, the study
still leaves a question of what technically is an appropriate
circulation classification for Miles Avenue. There are obvious
trade-offs to providing for the local community circulation needs and
the regional needs of the Eastern Coachella Valley.
In a regional context that of viewing Miles Avenue as a bypass to
Highway 111 and Fred Waring Drive) the upgrade would provide for
adequate localize circulation at an extreme build-out scenario for La
Quinta as well as potentially reduce traffic congestion on Highway
111 and Fred Waring Drive. Since a major portion of the City1s
medium and high density land use designations are within the North La
Quinta area, an argument may be made that there will be a greater
tendency to develop moderate income housing such as apartments and
townhouses at the extreme density ranges density bonus
considerations). In this case, an upgrade to Miles Avenue may be
necessary to provide for adequate traffic capacity.
The City of Indio designates Miles Avenue east of Jefferson Street
as a planned Arterial with 110 feet of ultimate right-of-way. This
expanded version of Miles Avenue, according to the City of Indio
Public Works Department, should adequately accommodate high volumes
of traffic generated from projects such as the Royal Dunes Resort".

between Miles Avenue and Fred Waring Drive.)
In contrast, it is apparent that Miles Avenue does not play a
significant role in the regional circulation system in the Valley as
it is not discussed in the CVATS Southern California Association of
Governments Coachella Valley Area Transportation Study, March,
1987). Lending credence to this position are Indian Wells tentative
plans to eventually close Miles Avenue to through traffic discussion
with Paul Kaneko, Indian Wells Planning Director, June 30, 1987).
This would limit Miles Avenue to function as an effective regional
bypass to Highway 111 through La Quinta. However, the recently
adopted Indian Wells General Plan maintains Miles Avenue through to
Highway 111 as a Collector 50-foot right-of-way).

The most important aspect of the Annual Conference is the central Business Session at
which time the membership takes action on conference resolutions. It is important for
California cities to take the initiative in developing positive programs for the
future. Annual Conference resolutions will guide cities and the League in our efforts
to improve the quality, responsiveness and vitality of local government within this
state. All cities should be represented at the Business Session on Tuesday afternoon,
October 6, at 2:00 p.m. in San Francisco's *cone Center*
To expedite the conduct of business at this important policy-making meeting, each City
Council should designate a voting representative and an alternate who will be present
at the Business Session. The League Constitution provides that each city is entitled
to one vote in matters affecting municipal or League policy. A voting card will be
given to the city official designated by the City Council on the enclosed voting
delegate form." If the Mayor or a member of the City Council is in attendance at the
Conference, it is expected that one of these officials will be designated as the voting

The fees are based upon the actual hourly cost to process the various

fee $90.00) when combined with the initial application fee $80.00)

ASSESSMENT: Environmental Assessment No. 84-020 was
prepared and a Negative Declaration was
adopted in conjunction with the original
tentative tract map approval.
PROJECT DESCRIPTION:
On July 17, 1984, the City Council approved the original
Tentative Tract No. 20016. The first time extension was granted
on July 1, 1986, by the City Council.
The Applicant is requesting a second time extension to record the
final map. If approved, the new expiration date would be July
18, 1988.
Tentative Tract Map No. 20016 proposes a 130-unit statutory
airspace) condominium project on 33 acres see Exhibit A). The
units are arranged in clusters around a collector loop street
36-feet wide) which has smaller cul-de-sacs and loop streets
24-feet wide) extending off it. The units are detached,
single-family houses and have the following minimum setbacks from
the property boundaries: Miles Avenue 20 feet; Dune Palms Road
22 feet; north and west boundaries 20 feet. The perimeter
wall along the public streets has staggered setbacks with 0 to 20
foot setbacks along Dune Palms Road and 5 feet or greater along
Miles Avenue. The main entrance will be on Miles Avenue, with a

conditions of approval make minor modifications to these
standards.
There will be one large central recreation area with six tennis
courts and a large swimming pool. Three smaller recreation
areas, each with a swimming pool, will be dispersed on the site.
Existing conditions require review of a recreation plan by the
Planning and Development Department.
Three house designs are proposed see Attachments *2-*4). Plan
A" is a two-bedroom/two-bath unit with 1,175 square feet
gross); Plan B" is a two-bedroom/two-bath unit with 1,450
square feet gross; Plan C" is a three-bedroom/two-bath unit
with 1,450 square feet gross). All the units have attached,
two-car garages. All the dwellings are one story in height
19'-20') and Spanish-style. The exterior walls have stucco
siding and the roof is covered with Spanish tile. The unit mix
is as follows: 39 A" units, 39 B" units, and 52 C" units.
No final map activity has taken place since the original approval.
ANALYSIS:
Consistency with the General Plan: The State Subdivision Map
Act Section 66473.5) requires that a tentative map, including
provisions for its design and improvements, be consistent with
the adopted General Plan. Since the conditions of approval for
the first extension of time brought the existing approval into
compliance with the General Plan, no amendments to the General
Plan have been approved which would substantially change the
existing conditions. Some minor additional conditions relative
to landscaping and infrastructure fees are proposed; however,
staff proposes no major additions or amendments to the existing
conditions, other than revising their format to reflect only
those which still apply to the project.
PLANNING COMMISSION ACTION:
The subject Application was considered by the Planning Commission
at their meeting of August 25, 1987. The Commission unanimously
voted to recommend that the City Council approve the second
one-year time extension for Tentative Tract No. 20016, subject
to conditions.
RECOMME*DATION:
Adopt City Council Resolution No. 87-5* granting the second
one-year time extension for Tentative Tract 20016, subject to
conditions.

Subjeci: ENGINEERING SERVICES FOR WASHINGTON STREET IMPROVEMENTS
The 1987-1988 Capital Improvements Budget includes the
widening of Washington Street from Avenue 50 to Highland
Palms Drive. In order that we will be in a position to get
construction underway in the Spring, it is necessary that we
arrange for engineering services to perform the necessary
field work and design and to produce construction plans and
specifications.
We have requested and received a proposal from BSI
Consultants, Inc. to do this work. We selected BSI in order
to have these services performed in the most cost-effective
manner. They have a definite advantage over other
engineering firms who might be considered due to the
substantial amount of preliminary work they have done in the
past for the City along Washington Street. Any other firm
would have to do some of that work over again and could not
be competitive.
BSI proposes to do the necessary work on a time and materials
basis with a total fee not to exceed $41,000. On the basis
of an estimated $450,000 construction project, this maximum
falls under the amount shown on the ASCE curve B. This is of
particular importance because BSI was instructed to prepare
its proposal on the basis that the widening undertaken on
this project must be compatible with the future widening of
Washington to its ultimate width. This will involve
surveying and design layouts over and above what would be
required were this year's widening project the only widening
that Washington will experience.

AGREEMENT FOR CODE ENFORCEMENT SERVICES
THIS AGREEMENT is entered into this 15th day of September,
1987, by and between the CITY OF LA QUINTA hereinafter referred to
as CITY) and JOHN M. CARROLL, an individual, Hereinafter referred to
as CARROLL).
WITNESSED
WHEREAS, the CITY has authorized the engagement of a Code
Enforcement Officer, on a contractual services basis, for a period
not to exceed one 1) year; and
WHEREAS, John M. Carroll possesses the special expertise
required of a Municipal Code Enforcement Officer; and
WHEREAS, the CITY now desires to engage CARROLL to render
services and assistance as a Code Enforcement Officer for CITY.
NOW THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS:
1. SCOPE OF SERVICES
CARROLL agrees to render Code Enforcement services to CITY as
follows:
Under general supervision of the Community Safety Coordinator,
enforces various provisions of the La Quinta Municipal Code and
California Vehicle Code, inspects property and structures for
violations and determines compliance with City Ordinances;
issues warnings and citations and performs related work as
required.
Examples of Work Performed:
Inspects property to determine compliance with property
maintenance standards and City Ordinances.
Inspects property relative to home occupancy business license
applications and makes recommendations for approval or denial.
Performs inspections relating to abandoned and/or inoperative
vehicles.
Issues citations relating to parking, abandoned/inoperative
vehicles, property maintenance violations, animal control, and
other violations of the Municipal Code and Vehicle Code, as
necessary.
Prepares necessary reports and documentation for
administrative or court action.

AGREEMENT FOR PROFESSIONAL SERVICES
ThIS AGREEMENT is entered into this 16th day of September,
1987, by and between the CITY OF LA QUINTA herein referred to as
CITY) and HE*RY HARVEY a professional Finance Director, herein
referred to as HARVEY).
WITNESSED
WHEREAS, CITY desires to engage the services of a professional
Finance Director on a contract basis to act as the Director of
Finance, Personnel and General Services for CITY; and
WHEREAS, HARVEY is a professional Director of Finance and is
ready, willing and able to undertake said position, on a contract
basis, for CITY.
NOW, Therefore, ThE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS:
1. Scope of Services. HARVEY agrees to render professional
services to CITY as its Director of Finance, Personnel and General
Services under general direction of the City Manager. HARVEY shall
perform the duties set forth in La Quinta Municipal Code, Section
2.12.030 and any other reasonable duties assigned by the City Manager.
2. Starting Date Term. This agreement shall commence and HARVEY
shall undertake and perform said services for the City commencing
September 15th, 1987 and continuing through September 15, 1990. On
approximately July 1, and annually hereafter, the City Manager of
CITY shall conduct a review of the performance and ade*uacy of the
professional services rendered by HARVEY and, based upon said
evaluation, CITY shall render it's decision relative to extension of
this agreement for a period of one year, which decision shall be made
approximately August 1, annually. Provided, however, that either
party may terminate this agreement at any time by giving ninety days
advance written notice thereof to the other party.
3. Compensation. HARVEY shall be compensated for services
performed pursuant to this agreement in the amount of Range 70E plus
25%, which percent is in lieu of benefits and prerequisites paid to
employees of CITY. Said annual retainer shall be payable in
bi-weekly installments. CITY nay increase said compensation in
such amounts and to such extent as CITY, in it's sole discretion, may
determine on the basis of performance evaluation of HARVEY's
services and/or by across the board salary increases amended to the
City's Employees. In addition to the above compensation, CITY shall
pay to HARVEY all actual and reasonable Inoving expenses for household
good to La Quinta, California to a maximum of $2,000.00. All
reasonable and necessary expenses and travel shall be provided by
CITY for out-of-town travel which is required in the performance of
HARVEY's services and shall be reimbursed according to CITY's
rules.

i^ =Zg4. Office Space and Hours. All office space and facilities,
secretarial help, and necessary supplies will be provided by HARVEY
at CITY's offices, at City Hall, La Quinta, for use in connection
with the services to be rendered hereunder. HARVEY shall receive
time of f at same standard as other department heads.
5. No Employer/Employee Relationship. Nothing contained in this
agreement shall be deemed or construed by the parties hereto or by
any third person to create the relationship of employer/employee,
principal/agent, or of partnership or of joint venture or other
association between the parties hereto. It is understood and agreed
that HARVEY shall act only as an independent contractor to CITY.
Although CITY shall furnish office space, secretarial help, and other
services and supplies, there shall be no employer/employee
relationship between HARVEY and CITY. Accordingly, CITY shall not
make the usual deductions income tax, retirement system, insurance,
etc.) from compensation of HARVEY and HARVEY shall be completely and
solely responsible for payment of income tax and any and all other
taxes or assessments in connection with payment of compensation.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed as of the day and year herein first above
written.
