SUBJECT: WEED ABATEMENT/LOT CLEANING ASSESSMENTS FOR
PLACEMENT ON 1989/90 PROPERTY TAX ROLL
The purpose of this hearing is to provide the Council the
opportunity to hear and consider all public objections and
protests, if any, to the report filed with the Council containing
a description of each real property parcel cleared or cleaned by
the City of La Quinta.
Notices of tonight's public hearing were sent to the property
owner, advising him of the hearing date. No written
communications have been received regarding this matter.
Following public comment and close of the public hearing, it is
respectfully recommended that the Council take the following
action:
1. Adopt the proposed Resolution, approving
and adopting the Resolution to place the
cost of cleaning said lots on the 1989/90
property tax rolls.

SUBJECT: CITY-WIDE ANALYSIS OF MEDIUM AND HIGH DENSITY
LAND USES
BACKGROUND
On April 5, 1988, a transmittal memo conveyed to the City
Council results to date) of Staff work on the requested
City-wide analysis of the General Plan allocation of Medium and
High Density Residential Land Uses. Parts 1 and 2 of the Study
were presented:
Part 1: An analysis of General Plan density and its
policy implications; and
Part 2: A more detailed look at specific high density
areas designated or implied by the General Plan.
While these first two parts introduced the issues and explored,
in a general way, the possible direction of a resolution of
noted issues, the analysis performed to that date was not
sufficient to provide a firm basis to contemplate a General
Plan Amendment.
On April 19, 1988 a recommendation was made and direction given
to pursue five additional analytic tasks. The first three of
those five tasks are the subject of the attached report:
Part 3: A more in-depth analysis of the seven high
density residential areas designated in the General Plan,
with respect to two technical considerations:
a.) Traffic analysis and the effect of high
density at each location on the planned road system
and a second analysis presuming a medium density
designation); and
b.) Market absorption for high and medium density
residential units over time to determine whether
the General Plan designated land inventory is

i^!L sufficient, deficient, or excessive for high and
medium densities.
Part 3 was conducted by consultants retained to
accomplish the technical data manipulation and
interpretation necessary to confirm or refine the earlier
general Staff analysis in Part 2.
Part 4: Reviewing all work, especially the results of
Part 3 technical consultant input on traffic and market,
Staff would prepare:
a.) A comparative summary table of the seven
designated high density residential areas,
characterizing them across all the variables in a
brief, succinct way;
b.) A set of concrete recommendations on how to
treat each of the designated areas leading to any
necessary General Plan Amendments;
c.) A set of general recommendations on how to
treat the residential potential of the Mixed
Commercial Land Use in the Highway ill Corridor,
leading to either a General Plan Amendment or a
policy directive for the Specific Plan;
d.) An analysis of the implications of the above
recommendations for the medium density residential
category if, for instance, some high density were
recommended to be amended to medium density);
e.) A revised Residential Land Use Profile of the
City similar to that found in Part 1), based on
the recommendations in the report, to demonstrate
the implications of any recommended land use
re-designations.
Part 5: An in-depth City Council consideration of the
Staff analysis and recommendations, resulting in a set of
directives to Staff as to which recommendations would be
most favorably considered.
The remaining tasks, Part 6, Staff refinement of
recommendations and preparation of the General Plan Amendments;
and Part 7, Environmental Analysis and related considerations,
will follow Council's consideration of the attached material
and directives to Staff.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF LA QUINTA, CALIFORNIA,
AMENDING THE OFFICIAL ZONING MAP FOR
THE CITY, BY REZONING CERTAIN PROPERTY
REFERRED To IN CHANGE OF ZONE No. 88-031
LANDMARK LAND COMPANY, INC.)
The City Council of the City of La Quinta does ordain as
follows:
SECTION 1. The La Quinta District Official Zoning Plan
a) Map No. 14, as amended adopted by City Council Ordinance No.
Ii) 5, operative August 29, 1982), is further amended by rezoning
from R-1 to R*3*, those certain parcels shown and depicted for
such rezoning on the map which is attached to and made a part
of this ordinance, which attached map is labeled Exhibit A"
Change of Zone 88-031.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in
full force and effect thirty 30) days after its adoption.
SECTION 3. POSTING. The City Clerk shall1 within 15
days after passage of this ordinance, cause it to be posted in
at least three public places designated by resolution of the
City Council; shall certify to the adoption and posting of this
ordinance; and, shall cause this ordinance and its
certification, together with proof of posting, to be entered
into the Book of Ordinances of this City.
The foregoing ordinance was approved and adopted at a
meeting of the City Council held on this day of
1988, by the following vote:

Requests for Proposals for engineering services in connection
with the above pro*ect were sent to six firms, and four proposals
were received. We requested that the firms break their quotations
into three phases: Phase I would involve the preliminary
surveying and soils investigation work; Phase II would be for
design and the production of contract documents; and Phase III
would involve construction staking and compaction tests. We
wanted the proposals to be made in this manner so that if we
so chose, we could award Phase I and III separately and
perform the design work in-house.
The quotes received for Phase II ranged from $10,800 to $30,400,
which resulted in a range for the total of all three phases from
$22,795 to $51,050. The low quote for Phase I and III only was
$11,900 from Charles Haver and Associates of Palm Desert.
In view of our limited budget for this project, it is recommended
that we be authorized to enter into an agreement for engineering
services with the Haver firm for Phases I and III, and we will
do the design work in our Engineering Division. This may mean
that additional plan checking will have to be farmed out to
consultants, but their costs are being reimbursed to the City
by developers.
Subsequent to receiving propos*1s, we looked into the possibility
of having the area flown so that we can work from aerial
photographs. Haver has given us a quote of $4,000*00 to do this
work, and we find that to be acceptable. Therefore, we are
recommending that our proposed contract with Haver be increased
from $11,900.00 to $15,900.00 for the Phase I and Phase III work.

BACKGROUND
The attached agreement with Riverside County Office on Aging is
for the Title Ill-B Program which is our outreach program'1 at
the Senior Center. The City will be receiving an estimated
$4,250 during fiscal year 1988/89 under this program. The
purpose of the program is to provide funding to assist in
identifying and locating individuals older persons) and to
provide information and encouragement about existing services
and benefits.
RECOMMENDATION ON
That the Mayor be authorized to execute said agreement in behalf
of the City.

to process all papers necessary to conclude purchase.
2. That City Manager be authorized to transfer $29,000 plus

BACKGROUND
Earlier this summer Staff, at the request of the City Council,
brought forward a discussion of lot grading and pad heights

within the Cove area of the City. As a continuation of that
discussion and in response to questions and suggestions which
were initially advanced, the following is offered:
MISCELLANEOUS DRAINAGE FEATURES
Swale materials The lining material of the drainage swales
themselves do not seem to present a problem at this time.
Concrete lined swales would be the most durable material, but
would not necessarily present an aesthetically pleasing
appearance. The dirt and/or grass lined swales have been
effective, especially in conjunction with masonry retaining
walls.
Roof Gutters the use of gutters and down spouts to direct
the flow of rain water may have some limited benefit for
accommodating site water, but it could not with any reliability
be used as a factor in calculating a reduction in grading
requirements.
ENGINEERED DRAINAGE/PAD HEIGHT CERTIFICATION
Several local engineering firms were contacted regarding fees
charged for the design of grading plans, as well as
certification of pad height once grading had been completed.
These fees ranged from $550 William Fitch) to $2,500
J.F.Davidson). Filso Engineering charges a midrange fee of
$1,010 for the package.

General Pad Height Provision The previous discussion
included the subject of setting performance standards which
establish a maximum pad height. This may be accomplished by a
simple insertion in Municipal Code Chapter 9.156 Zoning
Ordinance, General Use Regulations) as follows:
9.156.185. Maximum Building Pad Hei*ht Residential
Structures. The maximum building pad height and
resultant lot grading for residential districts shall be
no higher than necessary to achieve: a 1% gradient from
the rear of the lot to the lowest street frontage); or,
a 1% gradient from the pad to any other approved drainage
way.
Comprehensive Ordinance Amendment The Special Residential
Zone Municipal Code Chapter 9.42), may be addressed in a more
definitive approach to require a number of actions and features
for construction in the Cove area of the City.
A draft ordinance text has been provided with this memorandum,
for purposes of discussion. The features of this draft provide
for Planning Commission review of plans involving significant
alteration of existing contours. The review is to occur at a
noticed hearing before the Commission; surrounding property
owners would be alerted to the proposal. Grading plans would
be required to be prepared by a registered civil engineer. The
Commission would be able to condition approval related to a
number of items including: alternate building or foundation
designs; requirement for easements or special drainage
features; mitigation of visual impacts; and, other elements of
the site design.
The draft amendment is provided primarily for illustrative
purposes, to indicate the subjects and manner in which
regulations may be initiated. Depending on the desire and
direction of the Council, an amendment could be prepared and
circulated for formal review and comment.
COUNCIL DIRECTION
Staff is prepared to respond to any further direction the
Council may have regarding this matter. At a minimum, it is
suggested Council direct Staff to process the Maximum Building
Pad Height" Amendment to the Zoning Ordinance.

BACKGROUND
On August 2, 1988, the City Council in Study Session, received
material relating to the extent and status of La Quinta
hillside development policies. Copies of pertinent General
Plan policies were transmitted, along with an initial draft of
a Hillside Conservation Zone ordinance first view by Council in
October of 1984.
SUBSEQUENT EFFORTS
Since receiving Council direction, Staff has obtained a
compendium of local government hillside regulations from the
Governor's Office of Planning and Research, reviewed Coachella
Valley cities' hillside ordinances, and has taken the previous
draft text and revised it in the following manner:
Prepared the text in legislative format
Reordered some of the contents
Referenced to appropriate Titles/Chapters of the
Municipal Code
Conformed standards to General Plan provisions
Provided minor procedure revisions
Additionally, Staff has researched hillside property ownership
within the City.
FUTURE CONSIDERATION
At the discretion of the City Council, the matter is now in
order to begin Planning Commission deliberation of the subject;

SUBJECT: Code Enforcement Proposals
The following are proposals for code enforcement, as directed by
Council.
1. Code Enforcement map:
The code enforcement officers have completed a map of
the cove area. It shows the well kept properties as well
as properties that need improvement. It should turn out
to be a valuable tool for enforcement.
Staff believes that the cove should be broken down
into smaller areas for enforcement. Presently, each code
enforcement officer has approximately one half of the
cove to enforce. With that large of an area, it becomes
somewhat of hit and miss procedure and evolves into
basically a reactive mode. I would prefer to concentrate
on smaller areas for a more thorough cleanup.
It may take a little longer to cover the entire cove,
but the cleanup will be more thorough.
The map is small and as a result is hard to read. It
will be available for review in my office. The following
is a breakdown of the map survey:

Possible violations which indicate the ratings for
the dwellings:
A Questionable vehicles
B Weeds and brush
C Debris around dwellings

2. Cleaning of Public Right-of-Way:
There are two ways cleaning of right-of ways could be
accomplished.
a. We could have our City crew do it, but the
City should purchase a chipper machine for the
handling of brush, tumble weeds and small branches
from trees, as this would eliminate the need of
making frequent trips to the dumpster in the City
yard. The above items do not compress well, so many
trips to the dumpster are necessary.
The clipper could be used for other uses
besides right-of-way clean up, particularly by the
Parks Department in conjunction with the trimming of
trees. The cost of a chipper suitable for our needs
is approximately $5,200.00
b. The other alternative would be to contract
with a private contractor for the needed work.
There are about 100 miles of right-of-way in the
cove area. I have a bid from our current contractor
who cleans our abated lots. The contractors price
for cleaning all the right-of-ways is $11,500.00 and
could be completed in approximately 45 calendar days.
The cleaning of the right-of-way will be done using
two methods. The more efficient method would utilize a
tractor with a bush hog attachment. Due to the rocky
nature of the upper cove, there will be a lot of hand
cutting of the brush and weeds. Much more time consuming.
I would like to take $5,000.00 out of the concrete pad
removal fund and possibly transfer $7,000.00 from the
contingency fund to accomplish the right-of-way cleaning.
3. Authorization for Overtime for Code Enforcement:
As a means of becoming more productive in regards to
residents who are doing mechanical work on vehicles that
are not their own and the storage of commercial vehicles
on weekends, I believe it would be beneficial to the
whole community if the Council would authorize 128 hours
of overtime. It would go a long way in eliminating this
kind of problem as this activity usually occurs on the
weekends.
The 128 hours would provide four hours of enforcement
every other weekend through this fiscal year. The total
cost for overtime would be $2,241.28.

Quinta, should look into the mid-Valley water reclamation
plant #4 because a negative declaration was not prepared
for his project pursant to the provision of CEQA by the
Coachella Valley water District, I also recommend that no
more sewage should be aloud to inter to this plant, I
will give the City of la Quinta a 10 day notice to settle
