A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, ACCEPTING THE DEED
TO THE DESERT CLUB PROPERTY FROM THE
FRITZ BURNS FOUNDATION.
WHEREAS, the La Quinta Desert Club which is owned by
the Fritz Burns Foundation has been an historical and
significant part of the community since the 1930's; and
WHEREAS, the Fritz Burns Foundation, which are
substantial land holders in La Quinta believe that they should
make contributions to the communities in which they do business
in; and
WHEREAS, the Fritz Burns Foundation, of which William
Hannon is the Chairman of the Board has determined that it is in
the best interest of the Desert Club property to become a
permanent part of the City of La Quinta; and
WHEREAS, the Fritz Burns Foundation, on December 29,
1988, presented the deed to the Desert Club property to the City
of La Quinta with the stipulation that a majority of the
property be retained for park purposes and that the Fritz Burns
Foundation be memorialized for said contribution.
NOW, THEREFORE, BE IT RESOLVED, the City Council of
the City of La Quinta, California, that the deed to the La
Quinta Desert Club Property be accepted from the Fritz Burns
Foundation and FURTHER, that the City Council agrees to retain a
majority of the property as a park to be named the 11Fritz B.
Burns Park".

The purpose of this hearing is to provide the Council the opportunity to
hear and consider all public objections and protests if any, to the report
filed with the Council containing a description of each real property parcel
cleared or cleaned by the City of La Quinta.
Notices of tonight's public hearing were sent to the property owner,
advising him of the hearing date. No written communications have been
received regarding this matter.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA ASSESSING LIEN AND
PROVIDING FOR COLLECTION ON TAX ROLLS ON
CERTAIN PROPERTY FOR COSTS OF ABATEMENT
OF PUBLIC NUISANCE
WHEREAS, Chapter 11.72 of the La Quinta Municipal Code provides
for the declaration arid determination of certain conditions of
property to be a public nuisance and further provides for the
abatement of said nuisance by certain procedures including abatement
by the City and collection of the cost of said abatement on the tax
rolls; and
WHEREAS, in accordance with said abatement procedures, the
Community Safety Director of the City of La Quinta, as agent of the
City Manager, has determined that a public nuisance exists on the
following described premises, and has given the notice required by
law, and the owner thereof has failed to appeal said determination
and has failed to abate said nuisance as required in said notice; and
WHEREAS, in accordance with said abatement procedure, the
Community Safety Director has, by contract, provided for the
abatement of said public nuisance on said properties and has filed a
report thereon with the City Council and the City Council has
conducted a hearing on said report and the assessment of said costs
against said properties.
NOW, THEREFORE, the City Council of the City of La Quinta does
hereby RESOLVE as follows:
1. The City Council hereby finds, determines, and declares that the
City has abated a public nuisance on each of the following
described premises and has conducted a hearing on assessment
of the costs of said abatement in the time and manner as required
by law and further determines that there were no objections or
protests to assessments of said costs by any interested party.
2. The City Council hereby finds, determines, and orders that the
report of the Community Safety Director relative to assessment
of costs is hereby approved and the City Council hereby orders
that the following costs are hereby assessed as liens against the
following properties and the amount of said assessment shall be
collected at the time and in the manner of ordinary property
taxes:

RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA DECLARING THE INTENT OF THE
CITY OF LA QUINTA TO ORDER THE CONSTRUCTION
OF CERTAIN IMPROVEMENTS AND TO FORM
ASSESSMENT DISTRICT NO. 88-1 AND MAKING
CERTAIN FINDINGS AND DETERMINATIONS IN
CONNECTION THEREWITH
WHEREAS, this City Council wishes to consider ordering
the construction of certain improvements and the formation of
an assessment district to pay the costs thereof under and
pursuant to the provisions of the Municipal Improvement Act of
1913 the Act"); and
WHEREAS, the proposed assessment district, if it is
formed, is to be known and designated as Assessment District
No. 88-1 the Assessment District"); and
WHEREAS, the proposed boundaries of the Assessment
District are shown on a map thereof, which indicates by a
boundary line the extent of the territory proposed to be
included in the Assessment District, which map is designated
Proposed Boundaries of Assessment District No. 88-1" the
Map"), and which has been presented to the City Council for
approval; and
WHEREAS, before ordering the proposed improvements,
the City Council is required, under the Act, to adopt a
resolution declaring its intention to do so;
NOW, THEREFORE, the City Council of the City of La
Quinta DOES HEREBY FIND, DETERMINE, RESOLVE, AND ORDER as
follows:
SECTION 1. The above recitals, and each of them,
are true and correct.
SECTION 2. This City Council intends to comply
with the requirements of the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 by proceeding under
Part 7.5 thereof.
SECTION 3. The Map is hereby approved, adopted and
declared to describe the proposed boundaries of the Assessment
District; and it shall govern for all details as to the extent
of the Assessment District. The City Clerk is hereby
authorized and directed to endorse on the original and on one
copy of the Map her certificate, evidencing the date and

in her office and the copy in the office of the County Recorder
of Riverside County, all in the manner and form provided for in
Section 3111 of the Streets and Highways Code.
SECTION 4. The improvements which the City Council
intends to construct the Improvements") generally include the
following:
Storm Drain System. The system shall consist of
reinforced concrete pipe varying in size from 18
inch diameter to 66 inch diameter, various manholes
and catch basins to be constructed in Calle Colima,
Avenida Mendoza and Calle Madrid.
Street System. The street system shall be
reconstructed within all of the boundaries of the
district described as lying southerly of the
northerly line of parcels having frontage on Calle
Madrid.
The construction as proposed consists of
installation of curb, gutter, paving of roadway
section with a minimum of 3 inch of A.C. paving on
native material on local streets, 3 inch of A.C.
paving over 4 inch of Class 2 Base material on
collectors, and 4 inch of A.C. paving over 6 inch of
Class 2 Base material on Eisenhower.
It includes construction of concrete driveway
approaches and reconstruction of existing driveways
as may be required to meet grade.
It includes removal or relocation of any facilities
located now in the area of proposed construction,
which if left in place would interfere with the
intent of the project.
These facilities include but are not limited to the
removal or relocation of landscaping, mailboxes,
sprinkler systems, trees and shrubs.
Water System Improvement. The project proposes to
install new and/or replace substandard existing
water system in the area south of Calle Madrid. The
system to be constructed consists of 18, 12, 8, and
6 inch diameter mains, 1 and 1-1/2 inch services,
and fire hydrant assemblies. Connections to the
existing system which will remain in place are part
of the project.

WHEREAS, by Resolution No. in the proceedings for the
formation of Assessment District No. 88-1 this City Council
ordered a Report prepared by the Engineer of Work under and
pursuant to the provisions of the Municipal Improvement Act of
1913, and, in particular, Section 10204 of the California
Streets and Highways Code; and
WHEREAS, the Engineer of Work has prepared said Report and
filed the same with the City Clerk, and said City Clerk has
presented said Report to this City Council for consideration;
and
NOW, THEREFORE, the City Council of the City of La Quinta
DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. Said Report be and the same is approved, and
the City Clerk is directed to endorse the fact and date of such
approval on said Report and to file said Report in the office
of said City Clerk.
SECTION 2. February 14, 1988, at 7:30 p.m. at the
Community Center, 77861 Avenida Montezuma, La Quinta,
California 92253, are hereby fixed as the time and place of
bearing protests and objections to the said Report.
SECTION 3. Said City Clerk shall cause a notice of the
passing of said Resolution No. the filing of said Report
and the setting of the time and place for hearing protests to
be posted conspicuously on all the open streets within the
proposed assessment district in time, form and manner required
by Sections 10302 of the California Streets and Highways Code.
Said City Clerk shall also cause a notice similar in substance
to the notice described in said Section 10303 to be published

Tentative Tract *21555 received approval from the City subject

ANALYSIS:
1. In the recent past, conditions of approval for tentative
tracts along major arterials have been granted temporary
median breaks for home sales which is eliminated within a
given time frame. The access then becomes a permanent
right-in, right-out access.
2. The Applicants request was transmitted to the Public
Works Department for comment. The Department supports a

9 Riverside County Ordinance No. 348 adopted by reference by

Section 9.42.060 concerning the installation of rain gutters
for certain SR Zone dwellings, and a new Section 9.156.185 to

SUBJECT: APPEAL BY BEN URMSTON FROM THE DECISION OF THE FIRE
MARSHALL
Benjamin Urmston, architect, has appealed on behalf of his client,
Warren Johnson, the decision of the Fire Marshall to require
sprinklers in the building proposed for the corner of Calle Cadiz
and Avenida Bermudas. Pursuant to Municipal Code Section 8.08.050,
the decision of the Fire Marshall Fire Chief) in the interpretation
of the Uniform Fire Code is appealable to the City Council, sitting
as a Board of Appeals".
In addition to leasable areas, the areas under the roof line which
are being used for parking and for pedestrian walkways were added to
the gross floor areas to determine whether the building exceeded
5,000 square foot area, which would mandate a sprinkler system.
This method of calculating floor area is consistent with the U.B.C.
and the U.F.C.
The appeal involves the R-3 efficiency unit) located on the second
floor of the structure. The ordinance adopted by the City does not
include R-3 occupancies. The applicant would like the square
footage of the efficiency unit to be excluded from the gross floor
area and thus reducing the area to under 5,000 square feet and as a
consequence eliminate the sprinkler requirement. Although an R-3
occupancy is not listed in the ordinance, I believe its omission was
intended to exclude single family detached dwellings and duplexes
from being sprinklered and not dwelling units within a commercial
building.
RECOMMENDATION
Uphold the decision of the Fire Marshal.

for special events/occasions.
REQUESTS
The referenced request has been received from the Landmark Land
Company, Inc., in application for numerous information
directional signs along major streets. The signs will be installed
on January 19th and removed January 23, 1989.
DISCUSSION
1. The proposed signs will be located within City
right-of-way and on private property.
2. The Public Works Department has reviewed the sign
locations and noted that the signs should be located so
as not to create a traffic hazard.
CITY COUNCIL FINDINGS/ACTION
Section 5.64.020 provides, in part, that permits are to be
issued for special purposes, 11...and not on a continuing basis
for permanent advertising or identification purposes"; and,
further, that each permit shall be issued for a specified
period of time subject to renewal for good cause shown."

10K Race This was our 3rd race, well attended, but a
little short of last year. The race was changed to
December to alleviate a crowded Chamber Schedule in
the Spring. It will continue to be a December
offering, which pleases the runners as well as the
Chamber volunteers who organize the program. Some
thought is being given to relocating the course for
next year.
Tournament Golf) The golf tournament continues to be a
favorite each year, and provides $3,000 to $5,000 to
the Chamber general fund due to the generosity of La
Quinta Hotel in offering the course and carts for the

As a result of the City Council's directive, a survey was included in
the December Newsletter to determine the need for child care facilities
in the City.
Between December 1st and December 16th nine surveys were returned.
Copies are attached.

SUBJECT: Tentative Tract 24026
Analysis of Proposed Development Agreement
The following analysis pertains to the various lettered conditions
set forth in Attachment C-i to the above proposed Development
Agreement:
A. The City9 agrees to delete any requirement for participation
and/or construction of any signalization."
Fiscal Impact: Developer figured $12,000. City's estimate is
$25,000 for 1/4 the cost of a 4-way signal at Westward Ho and
Dune Palms Road.
Comment: While no precedent yet has been set for actual
participation in signalization by a single family residential
development, several recent tracts have been conditioned to do
so. The rationale has been that these developments will create
the need for and benefit from the signalization, in which case
general fund expenditures would be difficult to justify. The
only thing that makes this situation unique is that one quadrant
is already developed and a second quadrant is in Indio. Current
planning for the third quadrant involves a golf driving range
and school.
B. The City' agrees that a Low Flow' crossing will be required
as per Attachment C-2; that no other requirement will be
requested."
Fiscal Impact:Developer figured $13,000. City's estimate is
$41,000; however, CVWD will determine what will be allowed when
hydrology studies are made, and the cost could be different.
comment: In subsequent discussions with the developer's
representative some consideration may be given to the inclusion
of this improvement in an assessment district referred to in Item
C. below.
C. The City' will assist and provide the necessary vehicle to allow
the requirement by Coachella Valley Water District to the flood
control channel to be constructed by means of a 1) Assessment
District, 2) Mello/Ross District and/or 3) redevelopment
funds.
The City' will further assist in gaining approval from CVWD)
for the necessary improvements and provide assurance to
that the subdivision will be allowed to be
developed prior to any channel improvements."

Fiscal Impact: Developer figured $123,480. City's estimate
is $280,000 based upon the property's frontage and CVWD'g
estimated unit cost of $200 per lineal foot for lining.
Developer seems to have information from CVWD that less than
the entire frontage will have to be lined.
Comment: None.
D. The City' to process a General Plan Amendment' at their cost
and allow the project to proceed without any delays within the
time period as required by Paragraph E of this Attachment."

E. The City' agrees to process and approve the tentative map known
as Tentative Tract within 45 days of submittal to
the Planning Department, providing that the owner's agent has
met the requirements of the City of La Quinta Subdivision
Ordinance for filing a tentative subdivision map."

F. The City' shall waive all fees for the filing, processing, and
approval of a Tentative Map, Final Map, all Improvement Plans
and Building Plans as required by the Subdivision Ordinance and
and Building & Safety Ordinance, City of La Quinta."

Comments:
It is my understanding that the City cannot waive the fringe-
toed lizard fee. It also should be noted that in all likelihood
the plan checks in engineering would be farmed out to a private
firm; therefore, the associated costs would be out-of-pocket.
G. The City' agrees to process and approve a Final Map(s) and all
Improvement Plans as required by the Subdivision Ordinance, City
of La Quinta within 45 days of submittal to the City of La Quinta
Public Works and City Clerk, providing that the owner's agent has
met the requirement of the City of La Quinta Subdivision
Ordinance and Public Works requirement."
Fiscal Impact: None
Comments: It's not enough to say that the requirements must
be met, they must be met in a timely manner. If the final map
