north of the Park). The Planning Commission considered the
Amendments on September 12, 1989, and recommended approval.

GENERAL PLAN AMENDMENT AND OTHER ASSOCIATED AMENDMENTS:
Attached is a complete package of the public General Plan
Amendments and the other associated Amendments including:
1. General Plan Text Amendments one through four;
2. General Plan Revision of the Housing Element Text
Amendment No. 5);
3. Map Amendments A & B;
4. Map Amendments C, a revision to the Circulation Plan;
5. The Amendment to the Village at La Quinta Specific Plan
to incorporate Area 5 into the Village Plan.
6. The Amendment to the Village Commercial Zoning Text to
incorporate Area 5 into the Village Zoning Text;
7. The Change of Zone for Area 5 from R-3 to Village
Commercial Subzone C-V-T Tampico).
PUBLIC HEARING
The advertised date for the public General Plan Amendments and
other associated Amendments was October 3, 1989. However,
several of the private General Plan Amendments have been
delayed to October 17, 1989. All of the General Plan
Amendments must be adopted at the same time. Therefore, the
Public Hearing on the public General Plan Amendments can be
opened on October 3rd and continued to October 17th.
A supplemental memo will be provided on October 17th containing
the Environmental Resolution and the Resolutions and Ordinance
for adoption of all parts of the package.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, ADOPTING THE
NEGATIVE DECLARATION ENVIRONMENTAL
ASSESSMENT NO. 89-132) ASSOCIATED WITH THE
GENERAL PLAN AMENDMENTS GPA NO. 89-025),
THE AMENDMENT TO THE VILLAGE AT LA QUINTA
SPECIFIC PLAN SPA NO 87-009, Z2), THE
AMENDMENT TO THE VILLAGE COMMERCIAL ZONING
TEXT ZOA *89-040), AND THE CHANGE OF ZONE
FOR AREA 5 FROM R-3 TO VILLAGE COMMERCIAL
SUBZONE C-V-T TAMPICO) CZ *89-007).
WHEREAS, the City Council of the City of La Quinta,
California, did on the 17th day of October, 1989, hold a
duly-noticed public meeting to consider the environmental
analysis; and,
WHEREAS, said Amendments environmental review has
complied with the requirements of The Rules to Implement the
California Environmental Quality Act of 1970" County of
Riverside, Resolution No. 82-213, adopted by reference in City
of La Quinta Ordinance No. 5), in that the Planning Director
has determined after initial study Environmental Assessment
No. 89-132) that the project will not have a significant
adverse impact on the environment and that a Negative
Declaration should be filed; and,
WHEREAS, at said public meeting, upon hearing and
considering all testimony and arguments, if any, of all
interested persons desiring to be heard, said City Council did
find the following facts to justify the adoption of the
Negative Declaration:
1. That the General Plan Amendments are consistent with the
remainder of the General Plan.
2. That the general impacts from the proposed Amendments
were considered within the MEA prepared and adopted in
conjunction with the La Quinta General Plan, and were
more specifically addressed by Environmental Assessment
No. 89-132 prepared in conjunction with the General Plan
Amendments, the Amendment to he Village at La Quinta
Specific Plan, the Amendments to the Village Zoning Text
and the Change of Zone from R-3 to C-V-T.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of La Quinta, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
and

SUBJECT: OUTDOOR LIGHT CONTROL DARK SKY") ORDINANCE
BACKGROUND
The following draft Outdoor Light Control Ordinance was adopted
from a model ordinance made available by the two major
astronomical observatories in Arizona.The basic idea is that
different sources of light have different profiles in the
frequency range. Low and high pressure sodium lights can be
filtered out. Mercury vapor light is too broad in its frequency
distribution and cannot be filtered out.
It was found in Arizona that the professional observation of the
stars amounted to a multi-million dollar industry. The same is
probably true for California as well. However, the ordinance is
not just for professional astronomers. Amateur astronomy is a
large and growing hobby group, especially in the desert. The
desert night sky should be preserved for observation by anyone.
Because of La Quinta's Cove having high mountains around most of
its perimeter, La Quinta has a better opportunity to preserve
the darkness of the night sky than many other nearby communities.
A question has been raised about the provision for allowing
mercury vapor lights to be installed with shields) for a year
after the effective date of the chapter. This is for a period
of education, and to allow in-town hardware stores to sell off
their stock. In the year following adoption, probably few
mercury vapor lights would be installed compared to the many
thousands which could be installed from this point forward to
the buildout of the community.
The Planning Commission heard this Ordinance on September 12th
and recommends its adoption.

On September 12, 1989, the Planning Commission conducted a
Public Hearing on the subject applications.
The Planning Commission, at the conclusion of the Hearing,
recommended that the City Council approve the Change of Zone
R-1-12,000/PD to R-1), and further, that the Tentative Tract
Map be approved, subject to conditions.
Condition No. 40 was altered to read as follows Note: Phrases

within previously approved Tract 21642, which subdivided a
larger area of PGA West into lots for land sales to Sunrise.
Some of these lots have been sold to Sunrise and are now being
proposed for development through the establishment of this
tentative tract. Refer to Planning Commission Staff Report for
detailed project description and analysis.)
PLANNING COMMISSION ACTION:
On September 26, 1989, the Planning Commission conducted a
Public Hearing on Tentative Tract No. 24801. Subsequent to the
hearing, the Planning Commission adopted Planning Commission
Resolution No. 89-058, recommending approval of Tentative Tract
No 24801, subject to the conditions as proposed by Staff, but
with the following changes:
1. Deletion of Condition #15 relating to improvement
requirements for 58th Avenue.
2. Modification of Condition #25 now #24) which requires
disclosure to prospective unit owners that there is an
existing Sheriff's shooting practice range on the north
side of Lake Cahuilla, proximate to this tract.
CITY COUNCIL ACTION:
The Planning Commission recommends that the City Council adopt
City Council Resolution No. 89- confirming the
Environmental Determination of the Planning Director and

for six months to give the residents an opportunity to pursue incorpor-
ation. The Council has recently received letters from some of the property
owners advising that it appears that they are not moving towards incorpora-
tion. Therefore, they are requesting consideration of their original
requests for annexation.

I am an Owner and Developer of real property in the area
North of Fred Waring Dr., East of Jefferson St., West of
Washington St., bounded on the North by Avenue 38.
On or about January of this year, I signed a petition to
Incorporate the above stated property to the City of La
Zuinta. I understand the City enacted a six 6) month
moratorium to see if there were any efforts to Incorporate
Bermuda Dunes as a City. It has been over nine 9) months
since the moratorium was issued and it appears that Bermuda
Dunes is not moving towards Incorporation.
I still support La Quinta Incorporating the real property
and wish to offer our further support in anyway possible
regarding this issue. P1 ease advise us as to the next course
of action to be taken by the City.

DISORDERLY CONDUCT, TO THE LA QUINTA MUNICIPAL CODE.
WHEREAS, the regulation of public drinking and liquor
possession in the park and recreation areas within the City of
La Quinta will promote the health, safety and welfare of the
community; and
WHEREAS, it is deemed necessary and desirable to provide
standards to determine when the production of noise c<)nstitutes
disorderly conduct.
NOW, THEREFORE, the City Council of the City of La Quinta,
California, does hereby ordain as follows:
Section 1. That Section 11.08.005 of Chapter 11.08 be
amended to read as follows:
11.08.005 Public Drinking and Liquor Possession.
A. A person shall not consume or possess any alcoholic
beverage, as defined in Section 23004 of the California
Business and Professions Code, upon any public street,
sidewalk, highway, road, lane, alley or upon any other publicly
owned property which is open to the public, including all park
and recreational areas which are located within the City
limits. Possession shall include any alcoholic beverage
contained in any bottle, can, or other receptacle which i) has
been opened, ii) has a seal broken, or iii) the contents of
which have been partially removed.
B. A person shall not commit any act prohibited in
Subsection A of this Section when such person is upon privately
owned property which is open to the use or patronage of the
general public at the time, unless the person committing the
act has the express or implied permission or invitation to do
so from the owner or lessee or person in charge of the private
property or business premises involved.
C. Subsection A of this Section shall not apply to
consumption or possession of alcoholic beverages within the
City limits if a permit, entitlement or permission has been
issued by the City Manager or City Council in connection with a
special event located on the premises where the consumption or
possession would otherwise be prohibited. Subsection A shall
not apply with respect to public property owned and controlled
by a public entity other than the City if the other public

d_c]entity has given its express permission or invitation allowing
use of the premises for purposes otherwise prohibited in
Subsection A of this Section.
Section 2. That Section 11.08.040 of Chapter 11.08 be
amended to read as follows:
11.08.040 Noise.
No person shall willfully make any unreasonably loud noise
to the extent that it disturbs the peace and quiet of any
neighborhood or imposes upon the privacy and rights of others.
The standards which may be considered in determining whether a
violation of this Section exists, may include, but is not
limited to, the following:
a) The level of noise;
b) The nature of the area within which the noise
emanates;
c) The density of the inhabitation of the area
within which the noise emanates;
d) The time of day or night:
e) The duration of the noise;
f) Whether the noise is recurrent, intermittent or
constant; or
g) Whether the noise is produced by a commercial or
noncommercial activity.
Section 3. That a Section 11.08.090 be added to Chapter
11.08 and be titled as follows:
11.08.090 Violation.
Any violation of Chapter 11.08 shall constitute an
infraction pursuant to Section 1.01.200 of this Code.
Section 4. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause the same to be
posted in three public places in the City of La Quinta, and the
same shall be in full force and effect immediately after its
adoption.

The City Council of the City of La Quinta does
ordain as follows:
SECTION 1. Title 9 of the Municipal Code is hereby
amended by adding two chapters: 9.145 Hillside Conservation
and 9.146 Transfer of Development Rights, attached hereto as
ZOA No. 89-008 and ZOA No. 89-010.
SECTION 2. All land designated in the General Plan
as Open Space is hereby rezoned from various zones to Hillside
Conservation as depicted in the General Plan and on the map
attached hereto as CZ No. 89-043.
SECTION 3. EFFECTIVE DATE. This Ordinance shall be
in full force and effect thirty 30) days after its adoption.
SECTION 4. POSTING. The City Clerk shall, within
15 days after passage of this Ordinance, cause it to be posted
in at least the three 3) public places designated by
resolution of the City Council; shall certify to the adoption
and posting of this Ordinance; and shall cause this Ordinance
and it's certification, together with proof of posting, to be
entered in the Book of Ordinances of this City.
The foregoing ordinance was approved and adopted at a
meeting of the City Council held on the day of

The Planning Commission approved Plot Plan No. 89-422 at their
September 26, 1989 meeting after holding the required Public
Hearing. Plot Plan No. 89-422 is. proposed with a General Plan
Amendment and Specific Plan Amendment for Oak Tree West, for an
increase in clubhouse area from 25,000 square feet to 40,160 square
feet1 deletion of hotel and related commercial uses, and change in
clubhouse building design. Environmental Assessment No. 89-139 was
prepared for the amendments, and its scope included consideration of
any impacts generated by development of Plot Plan No. 89-422.

conditions as recommended in their Staff report on the
subject. The approval is final unless the City Council chooses
to refer the matter back to the Planning Commission for further
consideration as directed by the Council.
CITY COUNCIL ACTION:

SUBJECT: 78-720 Avenida La Fonda Request for Variance of
Finish Floor Elevation
The owner of the subject property has requested that he be allowed to
build at an elevation lower than that prescribed by the Flood
Insurance Rate Map FIRM). According to the FIRM, his property is in
the A3 flood zone, which would require a 3 foot pad.
The FIRM under which we are operating does not take into account the
new flood control facilities which have been constructed in the upper
Cove. CVWD officials state that it will be at least six months
before a new FIRM is published which will account for the change
which has been made.
The City Engineer, as the Floodplain Administrator, is not empowered
under the floodplain management ordinance to grant variances. The
City Council, however, acts as an Appeal Board and may grant
variances.
In Zection 8.11.060, Variance Procedures, in the Municipal Code it is
stated that generally variances may be issued for new construction
and substantial improvements to be erected on a lot one-half acre or
less in size contiguous to and surrounded by lots with existing
structures constructed below the base flood level. The request for a
variance submitted by Mr. Michael Yeomans meets those criteria.
Therefore, it is recommended that the City Council grant the
requested variance. However, the Municipal Code also states as
follows:
Any applicant to whom a variance is granted shall be given
written notice that the structure will be permitted to be built with
a lowest floor elevation below the regulatory flood elevation and
that the cost of flood insurance will be commensurate with the
increased risk resulting from the reduced lowest floor elevation. A
copy of such notice shall be recorded by the floodplain board in the
office of the Riverside County Recorder and shall be recorded in a
manner so that it appears in the chain of title of the affected
parcel of land."

Dear Mr. Kiedrowski:
On Zeptember 12, 1989, the Board of Supervisors approved agenda item 3.19
consolidating the Local Solid Waste Management Enforcement Agency LEA)
within the health Department of the County of Riverside. A copy of the Board
of Supervisors submittal and accompanying Resolution No. 89-471 is provided
for your information.
The consolidation of the LEA within the Health Department was recommended
at the July 29, 1989 meeting of the LEA and is supported by the County's Waste
Management Department.
The Government Code, Section 66796 a) 1) requires approval of the Board
of Supervisors5 action by a majority of the cities within the county which
contain a majority of the population of the incorporated area of the county...1'
This letter is our formal request for your city to approve the redesignation
of the LEA within the Health Department. A sample resolution is provided
that can be used for this purpose.
It is requested that your council approve the resolution and return it to the
Health Department for forwarding to the California Waste Management Board
no later than November 15, 1989. The resolution should be mailed to the

DESERT AIDS PROJECT AND SENIOR HOME REPAIR PROGRAM
BACKGROUND
The Supplemental Agreement with Riverside County Economic and
Community Development Department ECD) are for the 14th Year
Desert AIDS project) and the 15th Year Senior Home Repair
Program through the County Housing Authority.
The Senior Center Construction Program has not been approved
yet, because of our difficulties in finalizing the Civic Center
site plan.
RECOMMENDATION
Adopt the Supplemental Agreement for Desert AIDS and Senior
Home Repair on your Consent Calendar.
Three copies of the Agreement must be signed by the Mayor
attested by the City Clerk, and all three copies must then be
returned to ECD along with the Minute Order by which the
Agreement was considered and approved.
When approved by the Board of Supervisors, a fully executed
Agreement will be returned to us along with authorization to
expend funds on these two programs.

SUBJECT: 15TH YEAR 1989-90) SUPPLEMENTAL AGREEMENT
It is our understanding that the completion of the Civic Center site plan,
which is prerequisite to procuring architectural services for the design of
the senior center, has been indefinitely delayed for reasons beyond the City's
control; and that therefore, the City is as yet unable to provide a timetable
implementation schedule for the design and construction of the senior center.
Hithout a timetable implementation schedule, I am unable to draw up a
Supplemental Agreement relating to that project. I have therefore drawn up a
Supplemental Agreement for the City's two pending Community Development Block
Grant projects which are unrelated to the senior center the Desert AIDS
project 14th Year) and the Senior Home Repair project 15th Year). You will
recall that the 14th Year monies were not made the subject of a Supplemental
Agreement because the City's 14th Year Entitlement Funds Application remained
incomplete.)
I can hold the 14th and 15th Year funds, allocated to the senior center, in
abeyance for six months from the date of this letter. However, I must ask the
City to provide, within six months1 either a realistic implementation schedule
for the senior center project or an explanation of why an implementation
schedule cannot be made available. The explanation can be written in a
letter to this Department) or oral to the Community Development Coordinating
Committee), at the City's option.
Enclosed are three copies of the 15th Year 1989-90) Supplemental Agreement
for the use of Community Development Block Grant CDBG) funds for your 14th
and 15th Year activities, Desert AIDS" and Senior Home Repair".
Please have the agreements approved by your City Council, executed by your
Mayor, and attested by the City Clerk. Please return all three copies to this
office along with a copy of the minute order by which the agreement was
considered and approved.
