PLANNING COMMISSION ACTION:
On January 9, 1990, the Planning Commission conducted a Public
Hearing on the subject application.
The Planning Commission, at the conclusion of the Hearing,
recommended that the City Council approve Tentative Tract 25389
subject to conditions. Conditions #4b(1), 4b(3), 4b(4), 6, 7
and 8 were altered to read as follows Note: Phrases added to
the condition are underlined):
4.b.(l). Full street improvements along Calle Tampico from
Washington Street to Calle Rondo, as part of Phase One
development improvements. No further improvements to
this section of Calle Tampico shall be required of this
Tract nor Oak Tree West Specific Plan 85-006.

IMPROVEMENTS HAVE BEEN INSTALLED AS PART OF
DEVELOPMENT OF TRACT 20717 CURB, GUTTER,
PAVEMENT, SEWER, WATER, ETC.).
DESCRIPTION OF PROJECT:
Tentative Tract 25397 proposes to re-subdivide a portion of
Tract 20717-2A. The project area encompasses three condominium
lots and a portion of one private street lot, Cherry Hills
Drive see Attachment #3). The 17.5 acres within this tract
also includes two lake areas, one existing and one proposed.
The number of condominium units plotted for this area is
currently 51; the tract proposes 31 single family lots for
custom homes, of similar size to the existing 19 on the
southerly boundary of the tract.
PLANNING COMMISSION ACTION:
At their meeting of January 9, 1990, the La Quinta Planning
Commission adopted Planning Commission Resolution No. 90-001,
recommending approval of Tentative Tract 25397 to the City
Council, subject to the conditions as recommended by Staff but
revising Condition #7 relative to grading requirements prior to
final map approval, as the 20717 map already met those grading
requirements for recordation of that map. Additionally, the
Planning Commission deleted reference to the need for fire
hydrants since they have already been installed.
FINDINGS:
Recommended findings and conditions for Tract 25397 can be
found in the attached City Council Resolution #90-
RECOMMENDATION:
Move to adopt City Council Resolution #90- concurring with
the environmental determination and approving Tentative Tract
25397, subject to conditions as recommended by the Planning
Commission.

I know there are many facets to the overall planning of a new school.
One such item to consider is what the official name of that new, very
important addition in the Community will be. It is with the earnest
desire to commemorate the memory of one of our most dedicated and
self-sacrificing public servants that I submit the name of the late
ROGER M. HARLOW.
Mr. Harlow contributed heavily to the development of our city, while
serving four consecutive terms as an elected official in the City of
Indio; andZ during his work in both the Coachella Valley and Desert
Sands educational system for over 30 years, cared deeply about the
healthy development of our youth; surroundings in which they lived;
and, the importance of active participation in local government.
If you would consider including this matter on your Agenda I will be
pleased to appear before your Board and present my reguest in person.

AN OPEN SPACE POLICY ZOR LA QUINTA"

The Znv i ronmental Conservation Comm ttee strongly commends
the City Counci +or its unanimouZ comm tmerit to the
preservation 0+ La Quinta's open space areas, as
demonstrated by passing the stronZest hillside protection
ordinance in the Coachel la Valley, and subsequently creatinZ
this Committee to explore +urther means 0+ protecting the
mounta nous areas +rom development.
These actions are in direct response to the +01 lowing
General Plan statement:
La Quinta's natural setting has mandated a major land use commitment to
open space. Over 40 percent 0+ the cityZs area consists 0+ steep
hillsides plus several water courses and other essential +lood control
+acilities. This land must be kept in primarZ undeZeloped condition due
to its topographical characteristics, access constrairZ, lack 0+
in4rastructure and similar inherent I imitations."

currently privately-owned parcels in the open space area
to public ownership, at no loss o4 value to the private
owners.
Let that be the long-range goal 0+ the City 0+ La Ouinta.
3. The Committee consequently recommends the +01 owing
program:
3.1. The City Council shall declare a ONE YEZR
moratorium on all development, public or private,
in the areas desiqnated open space" in the City's
General Plan.

THIS AGREEMENT, made and entered into this day of________
1990, by and between the CITY OF LA QUINTA, County of Riverside, California,
hereinafter referred to as the OWNER" and GRUEN ASSOCIATES, hereinafter referred
to as the ARCIIITECT."
wIZESSETH:
That WHEREAS the OWNER desires to have constructed an initial phase of the
Civic Center Complex, narnely a City Hall, Council Chambers and appurtenances; and
WHEREAS, preliminary work in Programming, Master Planning and a portion of
the Schematic Design Phase of the PROJECT had been undertaken by another
architectural frrm; and
WHEREAS, the OWNER wishes to retain the services of an ARCHITECT
experienced in the work called for in the PROJECT; and
WHEREAS, the proposal for architectural services submitted by ARCHITECT dated
September 15, 1989 indicates an understanding of the general scope of the PROJECT; and
WHEREAS, ARCHITECT 1) has reviewed the documents ftirnished by the
OWNER pertinent to the PROJECT; 2) has field observed the PROJECT site; and 3)
is willing to accept responsibility for performing the services set forth in this Agreement for
the compensation and in accordance with the terms and conditions herein specified.
NOW, THEREFORE, in consideration of the previous and the mutual benefits
which will result to the parties herein in carvying out the terms of this Agreement, it is
agreed as follows:
1. PROJECT:
The PROJECT involves the development of that portion of the Civic Center Master Plan
which includes the City administrative offices and City Council chambers. The Project also
involves site development of the Civic Center site and establishing locations for future
facilities such as a Library, Senior Center, Fire Station and Police facilities. See Exhibit A,
Scope of Services."
2. BASIC SERVICES:
The ARCHITECT agrees he will perform all necessary professional services in connection
with the various phases of the PROJECT as they are set forth in Section 1 above, including,
but not limited to those enumerated:

b) Attend required consultations and conferences with authorized representatives
of the OWNER to review floor plans and address special user requirements.
c) Prepare schematic drawings and site utilization plans incorporating the
aesthetic and flinctional requirements of the OWNER.
d) Prepare preliminary drawings in accordance with the approved outline
schematic drawings, to include plans, sections, elevations, schematic model, outline
specifications and preliminary estiniate of probable construction cost based upon the
scheduled bid date. The preliminary drawings shall form the basis for the Design
Development Phase.
The ARCHITECT shall furnish two complete sets of schematic designs to the
OWNER for approval, one set of which shall be returned to the ARCHITECT with
corrections noted.
e) Prepare complete construction drawings and complete specifications in such
detail as may be required to obtain by competitive bidding in a responsible lump sum bid
with reasonable pricing alternatives. All drawings and specifications are to be in full
compliance with applicable building codes, ordinances or other lawful regulatory authority
to the best of the ARCHITECT's knowledge, and shall be developed in such form and
condition including any necessarv revisions thereof) as will enable the Contractor to comply
with the construction of the PROJECT from local and County building departments and/or
other Federal, State and local agencies having jurisdiction.
f) Carry adequate valuable papers insurance on all drawings and specifications
as may be required to protect the OWNER in the amount of its full equity in said drawings
and specifications.
g) The ARCHITECT shall employ properly trained and competent
subconsultants to perform the above-selected services who shall be acceptable both to the
ARCHITECT and the OWNER. ARCHITECT shall provide the OWNER in writing, the

SUBJECT: Well Ordinance
In 1986, the state legislature amended Water Code Section 13801
requiring the State Water Resources Control Board to adopt a model
water well ordinance effective January 1, 1990. This model well
ordinance would set a minimum role for local government in the
construction of water wells. If a local government fails to adopt
its own well ordinance, the model ordinance adopted by the state
board would take effect on February 15, 1990.
In response to this mandate, Riverside County revised its well
ordinances to conform to state criteria.
Both state and county ordinances oversee the administration of all
public and private well drilling activities within the jurisdiction
of their respective departments of health.
The Coachella Valley Water District has worked closely with the
county in the preparation of its ordinance and feels it accomplishes
the intent of the state legislation to protect our groundwater basin,
and allows them to work with local, as opposed to distant? officials
in its interpretation and implementation.
The District recommends that the City Council adopt this county
ordinance, by reference, and stipulate that the county health
department will be responsible for its enforcement and implementation
within our jurisdiction. This should be done prior to February 15 to
meet the requirements of the legislation. Staff concurs with the
District' 5 recommendation.

LA QUINTA, CALIFORNIA, ADOPTING RIVERSIDE COUNTY'S
ORDINANCE NO. 682 REGARDING PUBLIC AND PRIVATE
WELL DRILLING ACTIVITIES BY REFERENCE.
The City Council of the City of La Quinta, California,
does hereby ordain as follows:
SECTION 1. That Title 16, Section 16.02.010 of the La
Quinta is hereby amended to read as follows:
SECTION 16.02.010 INCORPORATION BY REFERENCE. The
Ordinances of the County of Riverside listed in this section,
three copies of each of which are on file in the office of the
City Clerk, including any and all amendments thereto in effect
as of February 3, 1982, except as modified after the adoption of
the ordinance provisions codified in this section, have been
adopted as ordinances of the city by reference except Ordinances
348 and 460 which are set out in this code in full, and shall
remain in effect until appropriately repealed, amended or
suspended by the City Council:

BACKGROUND:
The Applicant intends to construct a single family residence on
a 100-foot by 100-foot property probably at the southwest
corner of Avenida Juarez and Calle Arroba. The Applicant has
verbally indicated that they are considering an alternative
site at the southeast corner of Avenida Madera and Calle
Potrero. As a part of the construction the Applicant wishes to
construct an attached 11Granny Flat", consisting of a bedroom,
bath, and kitchen with a cooktop with approximately 325 square
feet of floor area. Granny Flats" are a dwelling unit to be
constructed or attached to, a primary residence if the second
dwelling unit is intended for the sole occupancy of one or two
adult persons who are 60 years of age or older and the floor
space doesn't exceed 640 square feet. The Applicant has
submitted a letter indicating that the unit would be frequently
occupied by her husband's mother see attachment).
The Municipal Code requires a Conditional Use Permit for this
use in the SR Zone. The filing fee is $1,695 which the
Applicant feels is too much money for us to pay for a
variation which involves household use". Therefore, she is
asking that this fee be waived.
RECOMMENDATION:
That the City Council review the request and determine whether
to waive the filing fee.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF LA QUINTA, CALIFORNIA,
PREZONING CERTAIN PROPERTY ADJACENT TO
THE CITY AS DESCRIBED IN CHANGE OF
ZONE CASE NO. 89-051, PURSUANT TO
SECTION 65859 OF THE STATE GOVERNMENT
CODE.

The City Council of the City of La Quinta,
California does ordain as follows:
SECTION 1. Section 4.10 of Riverside County
Ordinance No. 348 which was adopted by reference by the City
Council Ordinance No. 5, operative August 29, 1982) and Lower
Coachella valley District Official Zoning Plan Map No. 41, as
amended, are further amended by prezoning that certain
unincorporated territory adjoining the City and depicted for
such prezoning on the map which is attached and made a part of
this Ordinance, and which attached map is labeled t1Exhibit A
Change of Zone Case No. 89-051". Said prezoning is adopted
pursuant to Section 65859 of the State Government Code and will
apply to such property in the event of, and at the time of,
subsequent annexation to the City.
SECTION 2. ENVIRONMENTAL. The Change of Zone
has complied with the requirements of 11The Rules to Implement
the California Environmental Quality Act of 1970" County of
Riverside, Resolution No. 82-213, adopted by reference in City
of La Quinta Ordinance No. 5), in that the Planning Director
conducted an initial study and has determined that the proposed
change of zone will not have a significant adverse impact on
the environment and that a Negative Declaration is adopted for
this application.
SECTION 3. EFFECTIVE DATE. This ordinance shall be in
full force and effect thirty 30) days after its adoption.
SECTION 4. POSTING. The City Clerk shall, within 15
days after passage of this ordinance, cause it to be posted in
at least three public places designated by resolution of the
City Council; shall certify to the adGption and posting of this
ordinance; and, shall cause this ordinance and its
certification, together with proof of posting, to be entered
ntc the Book of Ordinances of this City.
THE FOREGOING ORDINANCE WAS APPROVED AND ADOPTED AT A
MEETING OF THE CITY COUNCIL HELD ON THIS DAY OF

SUBJECT: Street Sweeping
It is requested that we be authorized to call for bids for street
sweeping services.
The present arrangement with Kaylor Sweeping was made by the previous
Finance Director in the Spring of 1987 and presumably was a
three-year period, although a formal contract was not entered into.
The service being performed has not always been satisfactory, but
aside from that, the curb miles to be swept are increasing
dramatically with the Cove improvements and conventional subdivision
developments having public streets. The original arrangement with
Kaylor was based upon a curb mileage of almost 12 miles, and Phase I
of the Cove project alone will doublethat.
It is recommended therefore that we call for bids and set up the
specifications in such a way that a) some flexibility is provided so
that additional curb miles can be accounted for, b) the bidders
include proposals as to how they plan to handle the sweeper dumps,
and C) how they plan to provide water for the sweepers. We would
also plan to provide for once-a-week sweeping but with a provision
for bi-weekly sweeping if that appears to be desirable.

SUBJECT: CONSIDERATION OF EQUESTRIAN ZONING AT GREEN VALLEY
RANCHES
BACKGROUND:
letter requesting the City to add provision far equestrian
zoning for Green Valley Ranches has been submitted by a Ms. Dee
Dee Poizin.
The Green Valley Ranches area is within our East Annexation
Z5. The preannexation zoning for the area is R-l-20,000.
Within the R-l zoning the noncommercial keeping of horses may
be permitted on lots not less than 20,000 square feet provided
they are kept not less than one hundred feet from any street
and 20-feet from any property line. A maximum of two horses
per 20,000 square feet of property is permitted, with a maximum
of 4 horses on any lot.
Upon annexation of the area, existing uses approved by the
County) will be grandfathered'Z, meaning permitted to remain,
but not expanded if in conflict with City zoning.
One way to achieve the request is by creating an equestrian
over-lay zone which could be applicable to various zones within
the City. The concerns identified by the attached letter would
be considered by the Commission.
RECOMMENDATION:
By minute motion refer the request to the Planning Commission
to process the necessary zoning ordinance and amendments.
