PROTEST PALMER'
Rancho Mirage.......The Rancho Mirage City Council unanimously passed a resolution urging
Rancho Mirage residents, and asking that other city Councils urge their residents, to Protest
Palmer.'
The Resolution suggests that Customer! reduce revenues to Palmer Cablevision by terminating
all pay movie channel services as a way to declare their dissatisfaction with Palmer's deceptive
approach to mask the fZll extent of its most recent rate hike, the approximate 32% total increase
in rates from January 1989 to January 1991, poor picture quality and erratic Customer service,
Protest Palmer' is aiZZed at making Palmer Cablevision understand that it cannot act with im-
punity despite its essential monopoly hold on customer's television viewing capacity. Since it is
unreasonable to expect viewer! to protest by terminating basic cable service, the termination of
pay movie chanzieZ and the requirement for Palmer to pick up and exchange the boxes and lose
the revenue is deemed as an excellent way to send a clear message to Palmer,
Mayor Jeff Illeiman said, TO use the coined phrase, Palmer needs to know that we are mad as
hell and won't take it any more.'
Palmer's most recent raise throughout the Coachella Valley was made to appet' smaller than it
actually was by breaking out as a separate line item the historically existing Franchise Fee cot-
leeted by cities. The franchise fee was always part of the total charge levied by Palmer but by

Dear Mr. Kiedrowski:
Thank you for the opportunity to submit a proposal to perform the
necessary landscape architectural services for the La Quinta
Native Plant Park along the Bear Creek Channel in La Quinta.
This letter outlines our scope of work and the related fees.
Our services would include the following:
BASE DATA
1. Coordination with you and the City's consultants.
2. Preparation of a base sheet at an appropriate scale from
information supplied by City engineers and consultants for
use in our preliminary and working drawings. Information
provided to us would include street frontage, curbs, easement
lines, drainage channel1 bike path, topography, etc.
3. Site visits as necessary to review existing conditions, plant
materials, and other conditions that may impact our work.
Logging of existing materials for incorporation into the
final design.
SCHEMATIC STUDIES
4. Coordination with you and the City Planning Department as
necessary for any public input and to establish design
parameters.
5. Preparation of overlay study plans for your review,
indicating design concept and plant palette. Conceptual
studies will include hardscape development such as paving
patterns, furniture, shade elements, and possible other
amenities; trees and major shrub and groundcover masses.
6. Meetings with you to review these studies with intent to
finalize direction of the Preliminary Plan.

7. Preparation of a color-rendered Preliminary Plan for
submittal to the City of La Quinta. This plan will include
the items listed above and a proposed plant palette list

Upon acceptance of the Preliminary Plan, we would proceed with

Dear Ron:
The format, without a change in substance, of the proposed
amendment to the SunLine joint powers agreement, a copy of
which was previously sent to your city, was changed, resulting
in a document with a different look."
As long as the format was being changed, two changes of
substance were made. They were negotiated essentially between
Palm Springs and the taxi committee. The subject had to do
with termination of the taxi provisions and whether one of the
parties could opt out. An agreement was reached such that the
taxi regulations by SunLine will remain in effect for a
minimum of one year without any party being able to opt out
and that thereafter, a party may opt out upon 60 days notice.
Also, one of the cities wanted it clearly stated that these
regulations would not affect any city's dial-a-ride service.
I understand that the agreement is an item on a future
agenda item for your city council but I nevertheless wanted to
get you a hard copy of the revised document. Two of them are
enclosed and I would appreciate it if, after approval, you
could have one of the counterparts executed and returned to

TRANSPORTATION AGENCY AGREEMENT
THIS AMENDMENT TO AGREEMENT this Amendment") is made and
entered into by and between the County of Riverside and the
Coachella Valley cities which are parties to this Amendment and
other public agencies which subsequently become parties to this
Amendment. This Amendment is an amendment to the SunLine Joint
Powers Transportation Agency Agreement the JPA Agreement")
entered into on or about May 20, 1977. This Amendment is made and
entered into with reference to the following background facts and
circumstances.
RECITALS
SunLine is a joint powers agency established pursuant to the
provisions of the JPA Agreement.
The County of Riverside and the Coachella Valley cities and
public agencies which are parties to this Amendment Cities") have
a mutual interest in regulating, licensing and franchising the
business of operating taxicabs and other forms of ground
transportation available to the public on a for-hire basis
Alternative Transportation"). Government Code section 53075.5
requires every city and county to provide a policy for entry into
the business of providing taxicab services. Specifically,
Government Code section 53075.5 requires every city and county to
establish or require the registration of rates for the provision of

3 a bus owned by DESERT SANDS UNIFIED SCHOOL DISTRICT and 1rZven
4 by MARY NAVA ANDERSON.
5 Claimant herein alleges that the accident all ed in
6 plaintiff's Complaint was caused by the agents and employees
7 of the County of Riverside and City of La Quinta, WhO negligently
8 supervised, controlled, and maintained the intersection and
9 traffic lights and therefore proximately caused and contributed
10 to the incident alleged in plaintiff's Complaint, attached hereto
Z as Exhibit A". The defendants were served on August 2, 1990.
12 The names of the employees of the County of Riverside
13 and City of La Quinta, causing or contributing to said injuries
14 are presently unknown.
15 This claim is being presented within six months of
18 the date of service of the Complaint on claimant as required
17 by California Code Section 901. Service was on August 2, 1990.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA RECOGNIZING THE RIVERSIDE COUNTY
LAW ENFORCEMENT MUSEUM AS AN AUTHORIZED REPOSITORY
FOR RIVERSIDE COUNTY HISTORICAL MATERIALS
RELATED TO LAW ENFORCEMENT AND PUBLIC SAFETY
WHEREAS, law enforcement in Riverside County will
celebrate one hundred years of public service in 1993 and
that the Riverside County Law Enforcement Museum has been
formed and is dedicated to the preservation of municipal and
county law enforcement and public safety memorabilia,
historical documents and archives; and
WHEREAS, law enforcement and public safety in
Riverside County includes municipal police, fire, sheriff,
coroner, district attorney, public defender, judiciary and
allied public safety disciplines; and
WHEREAS, the museum is dedicated to public and
youth education, the education and training of present and
future police officers and enforcement practitioners serving
the citizens of the City of La Quinta and entire County of
Riverside and the preservation and safeguarding of law
enforcement and public safety records, artifacts and the
contributions of individuals to the public welfare; now,
therefore,
BE IT RESOLVED AND ORDERED by the City Council of
the City of La Quinta in regular session assembled on
February 19, 1991, that the Riverside County Law Enforcement
Museum is recognized as an authorized repository for
Riverside County historical materials related to law
enforcement and public safety and authorize the loan of
artifacts, memorabilia, goods and records to the museum.

BACKGROUND:
Municipal Code Chapter 5.64, Special Advertising Devices",
provides for a permit to be issued by the City Council for
advertising devices other than the usual and customary
permanent business identification signs and includes signage
for special events/occasions.
REQUESTS:
The La Quinta Arts Foundation requests the following special
advertising devices for the La Quinta Arts Festival to be held
March 14, 15, 16 & 17, 1991, at the La Quinta Community Park
see Attachment #1, 2 & 3). All signs unless identified
otherwise have been used in previous years.
1. Two professionally manufactured 3-feet by 15-feet blue
banners to be hung from the palm trees at the east point
and at the west point of the park that say Arts Festival
this Weekend".
2. A portable sign supplied by Naegele Outdoor at the
intersection of Washington and Highway 111 on the
southeast corner directing the public to the park.
3. A number of directional/information signs along major
streets see Attachment #2 & 3).
4. A new directional/information sign on Highway 111 near
the golf shop at Plaza La Quinta.
All signs will be set in place on March 11 and removed
by March 18, 1991.

d_;IDISCUSSION:
1. The proposed signs will be located within City
right-of-way, on private property, and at the Community
Park.
2. The Public Works Department has reviewed the sign
locations and requires that the signs should be located
so as not to create a traffic hazard.
3. Signs 1 and 2 see Attachment #2) are located in
Riverside County. Permission for these signs must be
obtained from that jurisdiction.
CITY COUNCIL FINDINGS/ACTION:
Section 5.64.020 provides, in part, that permits are to be
issued for special purposes, and not on a continuing basis
for permanent advertising or identification purposes'1; and
further, that, 11Each permit shall be issued for a specified
period of time subject to renewal for good cause shown."
In taking action on a permit, the Council must find that the
special advertising device applied for would not:
o Constitute a traffic hazard or nuisance to
adjacent or surrounding properties or to the public
at large; or,
o Be detrimental to the public convenience or
welfare; or,
o Be inconsistent with the various elements and
objectives of the General Plan and all other
officially adopted policies and regulations of the
City.
Conditions may be assigned to any permit granted, in order to
harmonize it with the public purposes expressed in this chapter
of the Municipal Code.
COUNCIL ACTION:
Action of the Council may be taken by Minute Motion to approve
or deny the request.
SUGGESTED CONDITIONS IF THE REQUEST IS APPROVED:
1. Signs located along streets without curbs must maintain a
six-foot setback between the sign edge and the edge of
the pavement.

ADDRESSING IMPACTS OF SENATE BILL 2557 MADDY)
WHEREAS, State deliberations toward adoption of the 1990-91
budget were exceptionally arduous due to a projected revenue
shortfall of 3.6 billion dollars; and
WHEREAS, the 1990-91 state budget was not adopted until July
31, 1990, a record-setting 31 days past the constitutional deadline
of June 30; and
WHEREAS, funding for County-operated, State-mandated programs
was reduced by more than 700 million dollars; and
WHEREAS, the State Legislature was reticent to make such
severe reductions in vital programs without providing sorne
potential for counties to generate new revenue; therefore, Senate
Bill 2557 was enacted during the final hours of budget
deliberations without customary review and analysis; and
WHEREAS, Senate Bill 2557 has fueled significant intense and
divisive debate among local governments as to the appropriateness
of counties exercising the revenue-generating authority provided in
Senate Bill 2557; and
WHEREAS, numerous counties have reluctantly imposed the new
fees and taxes to partially offset state budget reductions so that
essential health, welfare, and justice programs could be provided;
and
WHEREAS, schools, cities, counties, and special districts all
need dependable sources of revenue to provide an adequate level of
services to a growing population and simple redistribution of these
revenues is not an adequate solution; and
WHEREAS, resolution of local government fiscal issues, like
state fiscal issues, requires thoughtful consideration with direct
involvement of the affected parties; now, therefore,
BE IT RESOLVED that the City of La Quinta, in regular session
assembled on February 19, 1991, does hereby join with schools,
cities, and special districts in Riverside County to express
concern about Senate Bill 2557 and its divisive effect on local
governments1; ability to work cooperatively to meet the collective
needs of all County residents; and
BE IT FURTHER RESOLVED that the City of La Quinta urges repeal
of Senate Bill 2557 with the enactment of an acceptable, adequate
and dependable replacement revenue source; and

VII. OTHER
A. Preliminary review and discussion of proposed modification to office
buildinZ at northeast corner of Calle Cadiz and Avenida Bermudas.
1. Planning Director Jerry Herman presented the information
contained in the Staff report, a copy of which is on file in the
Planning and Development Department.
2. Commissioner Ladner inquired if Staff knew what the ratio of
parking spaces for the new addition would be. Planning Director
Jerry Herman stated that when the present building was
approved, the Applicant was required to pay in-lieu of parking
fees because there were not enough parking spaces provided.
Commissioner Ladner asked Staff to explain the fee in-lieu
process. Planning Director Jerry Herman explained the process
for the Commissioners and further stated that at present the City
had granted two variances for fee in-lieu of parking.
Commissioner Ladner expressed her concern of establishing a
precedent for future developers and eventually not having
enough parking for the downtown area.
3. Commissioner Dowd stated her concern about parking spaces
being provided without depending on future City parking lots.
4. Commissioner Barrows asked Staff to identify where the City
owns lots close to the Applicant's property. Planning Director
Jerry Herman stated the City owns the property the Chamber of
Commerce was located on as well as the two lots immediately to the
west.
5. Commissioner Mosher agreed with the Commissioners regarding
the need for parking and inquired how far the City parking lots
would be from the project. Planning Director Jerry Herman
stated that the City owns lots directly across the street from the
project.
Commissioner Ladner asked if Staff was keeping tract of how
many spaces they will need to supply. Planning Director Jerry
Herman stated that at present only the variance granted for this
project is active and yet Staff is keeping tract.
7. Mr. Ben Urmstrom, architect for the owners, addressed the
Commission and explained the proposed project. He further
stated that the issue of parking was of great importance to the
owners and they were considering alternatives such as paying
the City to have parking lot constructed while the project
expansion was being constructed.
