TO: onorable Mayor and Members of the City Council FRO?: Frank M. sher, City Manager DATE: July 29, 1982 SUBJECT: Use of Federal Revenue Sharing Funds Fiscal Year 1982-1983 On Tuesday, July 27, 1982, I held a public hearing regarding the proposed uses of General Revenue Sharing funds expected to be received in Fiscal Year 1982-1983. No persons appeared at the hearing, nor did any persons submit written comment. The amount of revenue sharing funds expected to be received is $73,500. It is proposed that a total of $22,700 of revenue sharing funds be used for capital expenditures, including office and the purchase of equipment. This amount may be changed during the Fiscal Year 1982 83 pu?suant to appropriation changes by the City Council or City anager Adoption of the accompanying General Rev@ni]e Sharing budget is respectfully requested. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING THE G?GENERAL REVENUE SHARING BUDGET FOR FISCAL YEAR 1982-19B3. WHeREAS, the General Revenue Sharing budget for Fiscal Year 19B2-1983 has been prepared by the City Manager and the Director of Finance; and WHEREAS, the City Council has examined said budget and conferred with the City Manager and the Director of Finance; and WHEREAS, the City Council desires to adopt a final General Revenue Sharing budget for the fiscal year; and WHEREAS, the City Council has, after due deliberation and consideration- tion, made such amendments in the proposed final General Revenue Sharing budget as it considered desirable. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, as follows: SECTION 1. The General Revenue Sharing budget, a summary of which is attached hereto and made a part hereof, is hereby approved. SECTION 2. The City Manager shall have authority to adjust the amounts appropriated among objects within each departmental activity, and among accounts within the objects, provided, however, that the total appropriations for each fund may not exceed the amounts provided in this budget resolution or any amending resolution). Said adjust- ments shall be made only upon written justification by the City Manager, Director of Finance or department head(s) responsible for t?e activity or activities involved. SECTION 3. Transfer of cash or unappropriated fund balance from one fund to another shall be made only upon resolution of the City Council. SECTION 4. That the prepayment of demands prior to audit by the Finance Committee and the City Council may be made by the Director of Finance in conformity with the authority provided by Section 37208 of the Government Code of the State of California. SECTION 5. The Director of Finance shall render a monthly report to the City Council on the status of City operations as relates to the approved General Revenue Sharing budget and any amendments thereto. The city council of the City of La Quinta does ordain as follows SECTION 1. Section 2.O?.O5O of the La Quinta Municipal Code hereby is amended to read as follows: 2.04.050 Compensation and reimbursement. Pursuant to Section 36516 of the Government Code of the State, compensa- tIon shall be paid to each member of the city council in the amount of one hundred dollars per month. The compensation prescribed herein is and shall be exclusive of any amounts payable to each member of the council as reimbursement for actual and necessary expenses incurred by him or her in the performance of official duties for the City of La Quinta; and, accordingly, each m?mber of the council shall receive reimbursement for such actual and necessary expenses incurred in the performance of official duties for the city, pursuant to the provisions of Section 36514.5 of the Government Code. SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty 30) days after passage. SECTION 3. POSTING. The city clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the city council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. BIB] 07-23-1996-U01 10:09:00AM-U01 CC-U02 08-U02 03-U02 1982-U02 ORLINANCE NO. 12 AN ORDINANCE OF THE CITY CODNCIL OF THE CITY OF LA ADOPTING AS AN URGENCY MEASURE, CERTAIN REGULATIONS PROHIBITING DEVELOPMENT OF NEW RESI- DENTIAL PRO3ECTS WHICH MAY BE IN CONFLICT WITH A CONTEMPLATED ZONING PROPOSAL AND DEVELOPMENT CONTROL PROPOSAL, SAID REGULATIONS TO BE IN EFFECT ON AN INTERIM STUDY BASIS PURSUANT TO GOVERNMENT CODE SECTION 65858. The city council of the City of La Quinta does ordain as follows.' SECTION 1 From and after the effective date of this Ordinance, and for the period during which this Ordinance remains in effect, and notwithstanding any other ordinance, resolution or regulation of the City or the County of Riverside to the contrary, no officer, employee or department administering City business shall accept or process any application for a building permit for or related to development of any new residential project or single-family house, in any P-i zone of the City unless and until the Planning Commission has granted a plot plan approval for such project or house, utilizing in general the procedures and criteria set forth in Section 8.30 of the City?s zoning ordinance and in particular making findings that: a) the a?chitectural aspec?s of the development will be compatible with, and not detrimental to, the surrounding neighborhood; and b) the landscaping for the development will be compatible with the surrounding neighborhood and will be suitably maintained as represented, after completion of the project; and c) that there is adequate justification and need for the development to proceed at the time applied for, so that it will not foreseeably and probably give rise to a blighted or nujsance situation. SECTION 2. Section 1 of this Ordinance shall not apply to: a) the addition to Or of existing buildings; and b) projects implementing in whole or in part a plan of development which had been revie?ed and approved by the Planning Commission upon a finding that such project will probably conform to and comply with the new zoning proposal and development control proposal mentioned in Section 3 of this Ordinance. SECTION 3. URGENCY. This Ordinance is adopted as an urgency measure pursuant to the authority of Section 65858 of the Government Code of the State of California, for the immed]ate preservation and protection of the public safety, health and welfare, and shall take effect immediately upon its adoption and passage by at loast a four-fifths vote of the City Council. The declaration of the facts constituting the urgency is as follows. Because the City of La Qi]inta has just repent] y boon iocorporated? n-nd because a very high number of constructed but unoccupied houses in the P-i zones of the City have caused undue amounts of public nu?sann.e, vandalism and crime problems within said areas, the public interest now requires a systematic review and comare- hensive analysis of a General Plan as well as the ordinances designed to impl?ment that plan. SECTION 4. EFFECTIVE PERIOD OF O?DINANCE. This Ordinance shall remain in effect for a four-month period pursuant to Section 65858 of the Government Code of the State of California, unless sooner repealed or otherwise modified, and subject to any extension of the effective period duly enacted pursuant to and in accordance with said Section 65858. SECTION 5. POSTING. The La Quinta City Council FROM: The Task Force for Animal Control 2 Co-Chairmen, Marilyn Knecht and Jack Edwards The Task Force for Animal Control met recently to disc?ss control of the stray and annoyance problems in the City of La Quinta. We have formulated two plans: PLAN 1: To solve the immediate problem of abandoned and stray dogs and those running in packs, we suggest the purchase by La Quinta of three Havahart" dog traps to humanely secure these animals. It is also recommended that the City purchase at least one Havahart" trap for cats. The traps would be requested by residents with animal p:?oblem.? through the City Hall, and would be delivered with instruction. regarding their proper use. The resident would report a trapi:> animal immediately to City Hall or the Animal Shelter) for einptying. Since La Quinta is still under contract with the Animal Shelte? the County would transport any caged animal to the Shelter at no cost to the City. The Animal Shelter will empty a trap the day of notification into a ventilated, air conditioned truck for transport of the animal. A dog will be held at the sheltc,t for five days for claiming by its owner after which time it will be put up for adoption. PLAN 2. To solve future problems of abandoned or stray animals or animals creating a disturbance, we suggest that the City arrange to deputize an adult either a volunteer or one paid by the City) who will be qualified to give warnings to anirnal owners or to capture and imnound animals. This rson to be uniformed and insured by the City of La Quinta and employed during those hours designated by the City. The COU.2t will train this individual at no cost to the City. IN CONJUNCTION WITH THESE TWO FOR??ULATED PLANS, it is suggested that: A. The organizations Lend a Paw" and Animal Samaritans" be contacted when animals are transported from La Quinta to the Animal Shelter. Water flows by gravity from reservoirs through water lines. WH?T IS THE QUALITY OF THE WATER WE RECEIVE IN OUR HOMES? Water quality is measured in terms of allowable levels of bacteria, total dissolved solids salts) hardness, flouride ni- trates and trace elements Weekly laboratory tests are required and reported to the public health department. However, if water lines permit entrance of contaminated sur- face water due to lack of pressure), substandard water may reach individual homes. NOTE. An old system does not necessarily mean the system is poor. Proper maintenance and equipment replacement are essential to all systems. HOW CAN I VERIFY THE QUALITY OF THE WATER IN MY HOME? At present, all irrigation water is supplied from the Colorado River, with no changes in that supply anticipated from that source. Consider water purity, possible contamination during delivery, condition and adequacy of reservoirs, sufficient volume as it relates to pressure at the tap and fire flow. NOTE: It is p05- sible for a system to meet PUC standards and still have dissatisfied customers. **** AT IS THE CONDITION OF THE TWO WATER SYSTEMS IN LA QUINTA? CVWD seems to be adequate. SCWC purchased the Santa Carmelita Mutual Water Company in 1978, and at that time, it was said that the system needed major upgrading. Some 2" lines still exist in La Quinta according to SCWC, but old and/or inad@.?uate lines are being replaced gradually. An in- crease in the numoer of customers places a greater burden on the system. Being request?d for the next ficsal year for SCWC are a new booster station for the top of the cove and nearly 10,000 feet of pipe. HOW CAN A WATER SUPPLY TO A NEW AREA BE FINANCED? An assessment to the individual can be made, based upon the length of line to be installed, or a special assessment district can be established to assess all new customers equitably. Fire flow refers to the availability of water through hydrants for use by the fire department to extinguish fires. Program At the community meetings and at other occasions, citizens of La Quinta and City Council members have identified public safety as a principal priority for the City, with particular emphasis on burglary prevention. A task force for crime prevention has presented a report to the City Council which includes recommendations toward this goal. The purpose of this report is to request Council approval of various elements of these recommendations. The establishment of a Community Safety Departrnent is recommended, consisting of a Community Safety Coordinator and a Code Enforcement Officer. The responsibilities of the Community Safety Coordinator ould include the following: administer all contracts with agencies providing law enforcement, fire protection, public health, animal control and other activities related to community safety; evaluate all services received from public safety contract agencies; establish and maintain communications with citizens relative to their perceived needs in community safety; process complaints and inquiries about community safety services; act as liaison between the City and manage ment personnel of public safety contract agencies; coordinate neighborhood watch programs; coordinate a volunteer, non-interfering neighborhood observation patrol; supervise the activity of a Code Enforcement Officer; develop comprehensive disaster and emergency plans for the City. The responsibilities of the Code Enforc?m?nt Officer would include the following: enforcement of parking regulations; enforcement of property maintenance regulations; enforcement of other code regulations, excluding the penal code, fire code, health code and building codes. The City is establishing a crimestoppers reward" fund, and will include elements in its building code effective in deterring crime.
