Congratulations on your appointment as City Manager of the City
of La Quinta. I look forward to meeting you and working with

As you may know, public 1 library services are provided to the
City of La Quinta by the Riverside City and County Public Li-
brary. Library service to unincorporated areas and to eleven
incorporated cities, including La Quinta, is provided by the
County Free Library which is operated jointly with the Riverside
Public Library under a contractual agreement between the City
of Riverside and the County. The County Free Library is a special
district governed by the Board of Supervisors. All funding for
the County Free Library is provided by property taxes including
the Special District Augmentation Fund.
La Quinta is served by the Coachella Valley Mobile Library CVML)
which has several stops in the City. A current schedule of the
Mobile Library stops is enclosed. La Quinta is also served by
the Regional Library for the desert area, the Max T. McCandless
Library located at 200 Civic Center Mall in Indio. Other branch
libraries in the area which are easily accessible to La Quinta
residents are:

3Library System to the eleven other public libraries in Inyo,
San Bernardino, and Riverside Counties. Palm Springs Public
Library, as a member of the Inland Library System, is thus open
to your residents.
There is a County Free Library Advisory Committee which advises
the Board of Supervisors about County Library services. It has
representatives from each Supervisorial District and from each
incorporated city which is part of the County Library. La Quinta
is eligible to appoint a member, however, you may wish to follow
the pattern established by Rancho Mirage, the only other incor-
porated city which we serve which does not have a branch library
located within the City limits. Rancho Mirage has chosen not
to appoint a member to the County Free Library Advisory Committee
since the branches its residents use, Cathedral City and Palm
Desert, are already represented by members on the Committee and
the CVML is already represented by the Fourth District repre-
sentative. Rancho Mirage communicates any concerns about library
service which come to the Citys attention directly to me through
the City Manager. Whichever choice you make, to appoint a rep-
representative or to adopt the Rancho Mirage pattern, I would appre-
ciate your notifying me in writing.
If you have any questions or concerns about library service,

BACKGROUND:
The original Specific Plan #121-E in conjunction with EIR #41 for the La Quinta
Hotel and related condominium developments was approved by the Board of Supervisors
in April, 1975. A revised Specific Plan was submitted because of the addition of
19.23! Acres and a desire to make changes in the land use plan previously approved.
A total of 279 additional condominium units and 146 additional hotel rooms would
be permitted by the revised specific plan as proposed.
The following is a summary and comparison of the changes proposed by the Revised
Specific Plan #121-E.

LA QUINTA, CALIFORNIA, AMENDING PROVISIONS OF THE
CITY?S ZONING ORDINANCE? AND SUBDIVISION ORDINANCE
RELATING TO THE TIME AND MANNER OF GIVING NOTICES
OF PUBLIC HEARINGS REGARDING REZONINGS, AMENDMENTS
TO THE ZONING ORDINANCE, VARIANCES, CONDITIONAL
USE PERMITS, PUBLIC USE PERMITS AND SUBDIVISION
TENTATIVE MAPS.
The city council of the City of La Quinta, California, does ordain as follows:
SECTION 1. The first two sentences of subsection 1) of Section 20.3 of
Riverside County Ordinance No. 348 which was adopted by reference by this City
Council by Ordinance No. 5 operative August 29, 1982) relating to notices of
public hearings regarding rezonings and amendments to the zoning ordinance,
hereby are amended to read as follows:
1) The Planning Commission shall hold a public bearing on the
proposed amendment. Notice of the time and place of the
hearing? including a general description of the area and
explanation of the matter to be considered, shall be given
at least 10 calendar days before the hearing, by publica-
tion or posting, pursuant to Section 65854 of the California
planning and Zoning Law.
SECTION 2. The second sentence of subsection 3) of Section 18.26 of
Riverside County Ordinance No. 348 which was adopted by reference by this
City Council by Ordinance No. 5 operative August 29, 1982) relating to notices
of public hearings regarding variances, conditional use permits and public use
permits, hereby is amended to read as follows:
Notice of the time and place of the public hearing shall also be
posted in at least three public places in the city, at least 10
days before the hearing.
SECTION 3. The second sentence of subsection A. of Section 6.5 of Riverside
County Ordinance No. 460 which was adopted by reference by this City Council by
Ordinance No. 5 operative August 29, 1982) relating to notices of public hearings
regarding subdivision tentative maps, hereby is amended to read as follows:
Notice of the hearing shall be given at least 10 days before the
hearing by U.S. mail, postage prepaid, to owners of real property
located within 300 feet of the exterior boundaries of the property
to be considered, as shown on the last equalized assessment roll of
the county and any update issued by the County Assessor and by
publication once in a newspaper of general circulation printed and
published in the county and circulated in the City.
SECTION 4. EFFECTIVE DATE. This Ordinance shall be in full force and
effect thirty 30) days after passage.
SECTION 5. POSTING. The City Clerk shall within 15 days after the passage
of this ordinance, cause it to be posted in at least the 3 public places desig-
nated by resolution of the City Council; shall certify to the adoption and

MEMORANDUM
CITY OF LA QUINTA
To: Honorable Mayor and Members of the City Council
From: Frank M. Usher, City Manager
Date: September 7, 1982
Subjeci: Fire Flow Requirements
Because the City Council has adopted by reference the Uniform Fire Code,
a City-wide fire flow requirement of 1,500 gpm is now in existence. We
have been informed that because of the size of the water pipes and
facilities in the Cove area, this flow cannot be achieved without recon-
struction of the water distribution system. The County Fire Department
recommends that the fire flow requirement which previously existed of
500 gpm is adequate for fire suppression needs in the Cove. mhe
informa?i.on which T have received indicates that the higher fire flow
standard may be achieved in areas of new, large scale development through
the installation of new infrastructure. However, all development would
cease in the Cove without reconstruction of the water system.
The acco;?panying Ordinance would allow development with the lower fire
flow requirement in any situation where a t?act map would not be required

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, AMENDING SECTION
10.301(c) OF THE UNIFORM FIRE CODE RELATING
TO REQUIRED FIRE FLOWS IN NEW DEVELOPMENTS.
The city council of the City of La Quinta, California, does
ordain as follows:
SECTION 1. The Uniform Fire Code adopted by Ordinance No. 7
and by Section 11.02.010 of the La Quinta Municipal Code is hereby
amended as follows:
Amend the second ara?ra?h of Subsection 1O.?O1(c)
Water supply may consist of reservoirs, pressure tanks,
elevator tanks, water mains or other fixed system
capable of supplying their required fire flow. In
setting the requirements for fire flow in connection
with new developments involving industrial or
commercial projects, or involving residential sub-
divisions whereby five or more lots or parcels of
land are created, the chief may be guided by the
current standard published by the Insurance Services
Office, Guide for Determination of Required Fire Flow.?'
In setting such requirements in connection with other
new residential developments in which less than five
parcels of land or dwelling units are created, the
chief may be guided by the 1972 edition of the said
Guide for Determination of Required Fire Flow."
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full
force and effect thirty 30) days after passage.
SECTION 3. POSTING. The city clerk shall within 15 days
after the passage of this ordinance, cause it to be posted in at
least the 3 public places designated by resolution of the city
council; shall certify to the adoption and posting of this ordinance;
and shall cause this ordinance and its certification, together with
proof of posting, to be entered in the book of ordinances of this
City.

Several meetings have been held involving Council Member Cox and myself regarding
the possibility of obtaining new baseball field lighting at La Quinta Park. Funds
are available through the State Department of Parks and Recreation for this type
of purpose. The funds must be obtained through a competitive needs-basis grant
under the Roberti-z'berg Urban Open Space and Recreation Program. This is not a
guaranteed allocation of funds but it is hoped that through a joint application
between the Coachella Valley Park and Recreation District and the city of
La Quinta, that eligibility will be strengthened and that the funds would be
obtained
The accompanying resolution approves the filing of an application for funding.

LA QUINTA, CALIFORNIA, ENDORSING THE COACHELLA
VALLEY RECREATION AND PARK DISTRICT APPLICATION
FOR GRANT FUNDS UNDER THE ROBERTI-Z'BERG URBAN
OPEN-SPACE AND RECREATION PROGRAM FOR LA QUINTA
PARK BALLFIELD LIGHTING.
WHEREAS, the legislature of the State of California has enacted the
Roberti-z?Berg Urban Open-Space and Recreation Program, which provides
funds to certain political subdivisions of the State of California for
acquiring lands and for developing facilities to meet urban recreation
needs; and
WHEREAS, the State Department Qf Parks and Recreation has been delegated
the responsibility for the administration of the program, setting up necessary
procedures governing application by local agencies under the program; and
WHEREAS, said procedures established by the State Department of Parks
and Recreation require the applicant to certify by resolution the approval
of applications prior to submission of said applicationS to th? State, and
WHEREAS, said applications contain a certification that the applicant will
comply with all federal, state, and local environmental, public health, reloca-
tion, affirmative action, and clearinghouse requirements and all other
appropriate codes, laws and regulations prior to the expenditure of the grant
funds; and
WHEREAS, the project applied for under this program must be of a high
priority and satisfy the most urgent park and recreation needs with emphasis
on unmet needs in the most heavily populated areas.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
La Quinta, California, hereby fully endorse?, supports and approves the
Coachella Valley Recreation and Park District filing of an application for
funding under the Roberti-Z?berg Urban Open-Space and recreation Program
for La Quinta Ballfield Lighting.

Subject: Proposed Requirements far Development of Residences in the R-1 Zone
The Planning Commission has held two meetings to djscu55 and propose requirements
for the development of residences in the Bi Zone, pursuant to the Ordinance of
the City Council requiring plot plan review by the Planning Commission. The
purpose in developing these requirements is to provide any person who may be
interested in this type of development with an Objective Set of guidelines to
be followed and to provide the Planning Commission with a basis for making the
findings required by the Ordinance. The Planning Commission has reached the
agreement regarding the following requirements:
* MINIMUM gross usable living area shall he 1200 sq. ft.
* There shall be not less than 1 baths in one or two bedroom homes.
* There shall be not less than 1 3/4 baths in homes with three or more bedrooms.
* There shall be a 10 ft. minimum clear dimension in bedrooms.
Bedrooms shall have an area of not less than 110 sq. ft.
* Burglary resistant measures shall be implemented, such a?; sclid core
exterior doors, double key one inch 1") deadbolts in all exterior doors,
except sliding glass doors, a peephole or other viewing device in the
front door, lights at all exterior doors which shall be connected to a
timer.
* There shall be a two car garage, or a two car carport with 100 sq. ft.
minimum storage area, with a minimum side dimension of five feet, to be
constructed as part of the carport or house structure.
* There shall be a separate pedestrian door into a garage.
* 18 inch eave overhangs or 18 inch parapets shall be required.
* A limited fenced area shall be required for the enclosure and protection
of children and pets.
* Refuse containers and bottled gas containers shall be concealed.
* A minimum of three outside water spigots shall be required.
* When houses are developed on two adjoining lots, a zero ft. side yard
setback should be encouraged in order to maximize a useful side yard
on the opposite side of the structure.
* A landscaping plan for the front yard of all lots and the side yard of
corner lots shall be required to be approved. The plan shall include a

minimum of two 15-gallon trees for interior lots and four 15-gallon trees
for corner lots An automatic irrigation system appropriate for the type
of landscaping shall be required.
* All houses shall be identified with street numbers which are visible from
the street.
* If developer is applying for five or more plot plan approvals, he must
have no vacant homes for sale in La Quinta at the time of application.
There was general consensus of the Commission that further information from
the County Department of Building and Safety should be obtained regarding
roof pitch, drainage requirements, allowable siding materials and proper site
preparation and grading requirements. There was additional agreement that
further information should be obtained from the Riverside County planning
Department regarding structure height requirements. There was also general
consensus that the Planning Commission should consider recommendations of
the County Fire Department regarding roofing materials.

WHEREAS, the State of California has enacted Assembly Bill 3107,
creating the Local Agency Investment Fund; and
WHEREAS, it appears to be in the best interest of the City of
La Quinta to deposit monies which may from time to time be surplus to the
immediate needs of the City in said fund.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the City of La Quinta,

withdraw money in the Local Agency Investment Fund in the State Treasury in
accordance with the provisions of Section 16429.1 of the Government Code
for the purpose of investment therein; and

SUBJECT: Business License Fee
e have discussed this subject several times, and I suggest
the time has come for us to act on this, if we want to imple-
ment it the first of the year. On the basis of various dis-
cusSiOns, I would propose the following:
1. All businesses operating in La Quinta, temporarily or
perm?nently, be assessed an annual fee to be paid the first
of each year January 1 st)
1.1. he exception would be businesses such as construction
subcontractors) who operate in La Quinta less than a
year. hese shall pay at the completion of operations.
2. The annual fee shall be one tenth of one percent 0.1%) of
gross revenues.
2.1. The minimum fee shall be $25.00 and the maximum fee
shall be $500.00. Thus all businesses with gross
revenues during the proceeding year of $25,000 or
less would pay $25.00 for that year; businesses with
total revenues of $500,000 or more during the pro-
ceeding year would pay $500.00 for that year. All
those in-between pay 0.1%.
3. The basis for determination of gross sales shall be the
federal income tax report submitted by the business during
the proceeding year. These dates will vary according to
the fiscal year of the business.
* Temporary businesses shall be those who spend at least one
full day oper?ting in La Quinta. These would largely
consist of construction sub-contractors.
* I auld recommend the foe to temporary businesses
be a minimum of $25. Before the City will sign
of a completion of a construction project, evidence
must be submitted that all business license fees
have been paid.

Subject: Business License Regulations
T am presenting for Council review a copy of three sets of business license
regulations. The first is from the City of Cudahay. It features a gross
annual receipts schedule with a minimum annual fee of $50.00 and a maximum
of $2,000. It also features a provision for quarterly payments, which
include a processing premium. As with many business licenses, it also
includes special fees relative to businesses which require particular
types of regulation.
The second ordinance is the ordinance currently being proposed in the City
of Cathedral City. It features a gross receipts fee schedule with a minimum
annual fee of $15.00 and a maximum fee of $2,250. It also describes businesses
generally in three classification categories.
The third ordinance is from the City of Indio. It features a gross receipts
schedule with a minimum annual fee of $60.00. It does not have a maximum
fee. It also establishes certain fees for special businesses.
It is not possible at the present time to closely indicate the revenues
that any of these ordinances would derive. however, the fees established
should generally be similar to those of communities in the area. I would
suggest that the Council review these ordinances for a couple of weeks. A
work session might then be in order to obtain guidance as to the type of
ordinance the Council wishes to establish.

Subject: Legislative Reversal of San Francisco vs. Farrell
The recent subject Supreme Court decision provides that local taxes levied
for general purpose are not subject to the two-thirds vote required of
special taxes. Assembly Minority Leader Robert Naylor attempted to offer
an amendment to a necessary fiscal clean-up bill which would have legisla-
tively reversed the Supreme Court decision. If this had been successful,
the ability of the City to establish any general purpose tax would have
been removed, except through a two-thirds vote of the people.
I received a copy of a letter from the Office of Assemblyman Willie L. Brown,
and last week contacted the offices of Senator Presley and Assemblyman Kelley
to express, on behalf of the City, concern regarding the matter and particular
concern regarding its impact on newly incorporated cities.
A copy of Assemblyman Brown?s letter is attached for information. It is my
understanding that this amendment was not approved by the Legi?lature, but
that Assemblyman Naylor intends to attempt similar legislation in the next
ses?ion.
