A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA APPROVING GENERAL PLAN AMENDMENT NO.
85-005 AMENDING THE LA QUINTA GENERAL PLAN BY
ADDING A PUBLIC BUILDINGS AND FACILITIES ELEMENT
THERETO.
WHEREAS, a General Plan provides for both short-term and long-
term physical needs of a city; and
WHEREAS, there is considerable evidence to substantiate that the
City has major deficiencies in certain public buildings and facilities;
and
WHEREAS, the establishment of a Public Buildings and Facilities
Element as part of the La Quinta General Plan will allow the City to
establish goals and policies regarding this important component of
community development; and
WHEREAS, approval of this General Plan Amendment will not have a
significant effect on the environment, the preparation of an Environmental
Impact Report is not necessary.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
La Quinta does hereby approve General Plan Amendment No. 85-005 adding
a Public Buildings and Facilities Element, as set forth in attached
Exhibit A, to the La Quinta General Plan.

on February 19, 1985, the Council adopted Resolution No. 85-8 establishing
an interim a*tmunity infrastructure fee as an urgency measure. This action was
taken pursuant to Gov*rment Code 65962, which requires a prior noticed public
hearing and a sixty 60) day waiting period prior to taking any action enacting
or increasing a fee on residential develo*xnent. Gov. Code Section 65962
contains provisions for adoption of an interim fee as an urgency measure without
hearing, with two thirty 30) day extensions* following noticed hearing.
Resolution No. 85-8 expires March 19 and it is re**ed that Council
adopt the enclosed resolution extending the interim fee for 30 days. You will
be asked to extend an additional 30 days at a meeting in April. The intent
is to coincide with the lapse of the last 30 day extension with the effective
date May 18) of the permanent fee resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, EXTENDING RESOLUTION NO.
85-8 INTERIM COMMUNITY INFRASTRUCTURE FEE TO BE
IMPOSED ON NEW DEVELOPMENT) FOR 30 DAYS.
WHEREAS, on February 19, 1985, the City Council adopted
Resolution No. 85-8, establishing an interim community infra-
structure fee to be imposed on new development, as an urgency
measure. The provisions of said resolution are incorporated
herein by this reference; and
WHEREAS, by its terms Resolution No. 85-B expires March 19,
1985, and it is the intent of the City Council to extend the
provisions of said resolution for an additional period of 30 days;
and
WHEREAS, a noticed hearing on said extension has been conducted
in accord with the provisions of state law;
NOW, THEREFORE, the City Council of the City of La Quinta,
does hereby resolve as follows:
1. All provisions of Resolution No. 85-8, including the
establishment of an interim community infrastructure
fee, are hereby extended for a period of 30 days.
2. This Resolution is adopted as an extension of an urgency
measure as an interim fee to protect the public health,
welfare and safety. The reasons for this urgency action
are set forth in the Whereases" to this Resolution and
Resolution No. 85-8 coupled with the fact that:
a) The City's public facilities and services are at
capacity and are not available to adequately accomo-
date the additional need for public facilities and
services resulting from proposed new development;
b) City cannot and will not make required findings that
public facilities and services are available to meet
the demands of future development without financial
developer assistance to pay for such services and
facilities; and
c) Developers with developments totaling many hundreds
of units are presently in a position to request and
obtain building permits and other development entitle-
ments and, unless this Resolution is adopted as an
urgency measure, such developments may escape payment
of their pro-rata fair share of the cost of said
needed public facilities and services.

3. Applicant shall provide any necessary supporting

recordation.
4. Applicant shall provide docur*tation indicating that
all affected utility agencies have reviewed the vacation
and that satisfactory arrangements have heen made con-
cerning their facilities, if any.
At the Planni C:coission ireeting, the Commission discussed the road *aCation
portion of this request on a limited basis only. The Commission understands that
its principal responsibility with respect to road vacations is to determine General
Plan consistency.

RESOLUTION NO. 85-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, VACATING CERTAIN PORTIONS
OF CALLE TAMPICO AND AVENIDA OBREGON.
WHEREAS, the City Council did adopt its Resolution No. 85-
declaring its intention to vacate certain portions of Calle Tampico
and Avenida Obregon pursuant to the Public Streets, Highways and
Service Easements Vacation Law; and
WHEREAS, said Resolution No. 85- fixed March 19, 1985, at the
hour of 7:30 p.m. in the Council Chambers, as the time and place for
hearing all persons interested in or objecting to the proposed vacation;
and
WHEREAS, a Notice of Public Hearing was published in the time and
manner provided by law and notices of said hearing were posted along
said portions of the streets to be vacated in the time and manner
provided by law; and
WHEREAS, the Planning Commission has adopted its Resolution No.
P.C. 85-3 determining that the vacation of said streets is not in
conflict with the Circulation Element or any other element of the
General Plan; and
WHEREAS, the City Council has conducted its hearing and has
heard evidence concerning this matter.
NOW, THEREFORE, the City Council of the City of La Quinta does
RESOLVE as fcllows:
1. The City Council hereby finds and determines that the
following described portions of Calle Tampico and
Avenida Obregon are unnecessary for present or pros-
pective public use and hereby orders said streets
vacated and abandoned.
2. Said streets ordered vacated and abandoned are those
portions of Calle Tampico and Avenida Obregon as shown
on the map designating the portion of said streets to
be vacated which is attached hereto as Exhibit A" and
incorporated herein by this reference.
3. The City Council hereby finds and determines that the
streets hereby vacated and abandoned are not useful as
a non-motorized, transportation facility as defined in
Streets and Highways Code, Section 156, nor useful as
a bicycle path or route pursuant to Public Resources
Code, Section 5079.

AN ORDINANCE OF ThE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE LA QUINTA
MUNICIPAL CODE, PROHIBITING PARKING OF CERTAIN
COMMERCIAL VEHICLES IN RESIDENTIAL AREAS AND
PROHIBITING REPAIRING OF VEHICLES IN RESIDENTIAL
AREAS.
The City Council of the City of La Quinta, California, does ordain as follows:
SECTION 1. Sections 12.32.110 and 12.32.120 of the La Quinta Municipal Code
are hereby amended to read as follows:
12.32.110 Certain Commercial Vehicles Prohibited from Parking on Private
Property and Public Rights*of*way. Unless excepted pursuant to Section 12.32.120,
no commercial or construction vehicle, or towed commercial or construction equip-
ment, shall be parked on private property or on public rights*of*way unless said
vehicle or equipment is screened from public view and adjacent properties. The
terms commercial or construction vehicle and/or equipment shall include, but is
not necessarily limited to: utility body trucks, farming and construction
tractors, construction vehicles and towed equipment, semi-truck tractors,
semi-truck trailers, dump trucks, step van delivery trucks or any parts or
apparatus of any of the above.
12.32.120 Commercial Vehicles Exempte4 from Section 12.32.110. The
following commercial and construction vehicles are exempted from the prohibition
contained in Section 12.32.110:
a) pickup trucks, utility vans and similar utility vehicles, each of which
do not exceed eight feet in height or twenty feet in combined total length;
b) all vehicles while being used in actual construction work on a permit
approved construction site;
c) all vehicles in the process of making a pickup or delivery; and
d) governmental and utility emergency service vehicles.
SECTION 2. Sections 11.72.310 and 11.72.320 are hereby added to Chapter 11.72

11.72.310 Repairing Motor Vehicles on Private Property. Repairing,
storing, servicing, assembling, disassembling, wrecking, modifying or otherwise
working on any motor vehicle, parts, equipment, machinery, tools or other
automotive materials of any kind is prohibited within any residential area of
the city; and any violation of this section constitutes a public nuisance.
11.72.320 Exemptions. The provisions of Section 11.72.310 shall not
apply to:
a) Vehicles or parts thereof which are completely enclosed and are not
visible from the street or other public or private property.
b) Emergency repairs or service to a motor vehicle owned by the person
residing on said property when conducted in areas where such activity is
otherwise prohibited by this section, provided such repairs or service shall
not extend beyond a period of 72 hours.
All repairs authorized by this section shall be restricted to vehicles
owned by the persons and members of the family residing at the premises.

OF LA QUINTA, CALIFORNIA, AUTHORIZING CERTAIN
OF ITS MEMBERS TO FILE A WRITTEN ARGUMENT
REGARDING A CITY MEASURE.
WHEREAS, a general municipal election is to be held in the City
of La Quinta, California, on June 4, 1985, at which there will be
submitted to the qualified electors of the City the following
measure;
Shall the Resolution Amending the Circulation Element of the
La Quinta General Plan be Amended by adding thereto an extension
of Adams Street between Avenue 48 and Avenue 52, be adopted?
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That this City Council, being the legislative
body of the City of La Quinta, authorizes
members of that body, to file a written argument against the City
measure set forth in the recitals hereof in accordance with Article
4, Chapter 3, Division 5 of the Elections Code of the State of
California and to change the argument until and including the date
fixed by the City Clerk after which no arguments for or against
the City measure may be submitted to the City Clerk.

RESOLUTION NO. 85-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA DIRECTING THE INSTALLATION AND MAINTENANCE
OF STOP SIGNS TO FACILITATE A FOUR-WAY STOP AT THE
INTERSECTION OF WASHINGTON STREET AND AVENUE 50.
WHEREAS, Section 12.16.070 authorizes the City Council, by
Resolution, to direct the installation and maintenance of official
traffic signals at intersections where traffic conditions are such
as to require the flow of traffic be alternately interrupted and
released in order to prevent or relieve traffic congestion or to
protect life or property from exceptional hazard; and
WHEREAS, the Automobile Club of Southern California has conducted
a review of traffic volume and accident records at the intersection of
Avenue 50 and Washington Street; and
WHEREAS, the Automobile Club of Southern California has inspected
prevailing road conditions; and
WHEREAS, the Automobile Club of Southern California has determined
that the intersection of Washington Street and Avenue 50 ineets accepted
standards by both accident and volume guidelines to document the need
for stop signs; and
WHEREAS, the La Quinta Traffic Safety Committee has reviewed the
recommendations of the Automobile Club of Southern California and agrees
with their recommendation.
NOW, THEREFORE, BE IT RESOLVED that the City Traffic Engineer is
directed to install and maintain stop signs facilitating a four-way stop
at the intersection of Washington Street and Avenue 50, and in conjunction
therewith to install necessary signs and roadway markings.

We have received the feasibility report regarding a computer system
from Tug Tamaru, our consultant. This is the completion of Phase I.
Mr. Tamaru will be present at the study session on Monday, at
4:00 p.m. to explain the report.
The next steps will be the preparation of an RFP Phase II) and
evaluation and recommendation of a system Phase III). The fees
for these services will be not to exceed figures of $1120 and
$1680 respectively. It will be my recommendation that the Council
authorize proceeding with phases II and III.

All these facilities will be installed before the baseball season,

is being requested of each interested city to cover minor costs in
connection with the study.
I believe that if programs for these coverages can be developed, the
potential savings are well worth this initial participation cost.

Subject: Contractual Services Weed and Public Nuisance Abatements
In order to proceed with the public nuisance and weed abatement process, the
City must obtain a contractor to perform these services. The attached docu-
ments describe the nature of these services. The Community Safety Department
has enjoyed a large degree of success in their weed abatement procedures, and
have obtained approximately 35% voluntary compliance from persons contacted
regarding weed and/or public nuisance abatements. However, we currently
have approximately 80 cases in which we have been unable to obtain voluntary
compliance, and these properties will have to be cleaned by the City.
Upon approval of the attached contract specifications, the City will proceed
with a formal bid procedure and obtain a contractor for our abatement process.
The City will then be billed for each individual lot by the contractor, and
we will in turn place a lien against the property. Then, on an annual basis,
the properties which have been liened will have the lien amounts placed on
the property tax rolls, and the City will be reimbursed following payment of
property taxes.
RECOMMENDATION;
It is respectfully recommended that Council approve the attached Contract Specifications
regarding abatement of weeds and litter on privately owned lots, and authorize Staff
to enter into formal bid procedures regarding same.

Staff obtained necessary accident and related data and requested the Autarobile Club
of Southern California to evaluate the subject intersection to determine whether or
not the stop signs were warranted.
The Autc::obile Club reports, based upon its analysis, that the intersection of
Washington Street and Avenue 50 meets the required warrants to justify a 4-way stop.
On March 14, 1985, the Automobile*bile Club recorrirendation was revi*ed by the Traffic
