BACKGROUND AND OVERVIEW
Staff requested the City Attorney to provide her opinion as to how an if the City could deal
with the issues concerning adequate control of the style and size of the homes being
constructed. The City Attorney has indicated that the City's ability to deal with any
compatibility, or design-type issues, is governed by its development standards within the
Zoning Code." In addition she states, The key would be that the standards would need
to be as specific as possible so that there is not an unfettered discretion in the
administration of the standards."
Prior to the 1996 Code Update, the following development standards were contained in the
residential zones:
Stucco for exterior walls
Slopping roofs to have clay or concrete tile roofs;
Rear and side yard fencing;
Bedroom dimensions of 10-feet clear;
One and a half baths in one or two bedroom units and one and 3/4 baths in 3 or
more bedrooms.

The minimum livable floor area excluding garage is 1200 square feet.
Developers who had, or applied for, 20 or more approvals, were required to submit
design guidelines for Planning Commission approval specifying the method in which
the exterior appearance of the single family homes would be varied. Subsequent
homes would then have to comply with those standards approved by the Planning
Commission.
A maximum of five unsold houses may be under construction by a single applicant
at any one time.
Homes using similar architectural styles, when located within 250 feet of each other,
had to have their exterior building elevations vary by using different colors, styles,
roof treatments, window treatments, garage door treatments, or similar methods.
A precise plan procedure was used to assure all single family homes complied with
the development standards.
In 1996, the Zoning Code Update removed any reference to the preceding development
standards with the exception of the minimum house size of 1400 square feet and the
following specific development standards within the RC Cove residential) District.

Bedroom dimensions of 10-feet clear;
One and a half baths in one or two bedroom units and one and 314 baths in 3 or
more bedrooms.
Existing lots of 6,000 square feet, or less, and affordable housing projects do not
have to provide a three car garage for four bedrooms or more.
The City Council could direct staff to start a Zoning Text Amendment to add the following
options to the Zoning Code, or any combination of the following:
* Provide a uniform City-wide house standard of 1400 square feet by raising the RC
District residential standard from 1200 to 1400 square feet.
* Add the development standards that were listed in the Zoning Code from 1996 to
selective zones, or City-wide.
* Reinstate the standards that were originally in the SR Zone dealing with unsold
units and number of units, as noted above.

constructed within the 250 feet of each other for the Cove residential area only.
* Require all single family houses in the City to go before the Planning Commission,
or alternatively by Community Development staff, pursuant to detailed development
guidelines similar to the old precise plan process, for review.

This letter is to confirm your generous commitment for you and the City Council to meet with
members of the Building Industry Association Desert Chapter at a luncheon on Thursday,
February 26, 1998. This meeting will be held at the Cliflhouse Restaurant on Highway ill in
La Quinta at noon. Registration will begin at 11:45 a.m.
The outline of the meeting will be a brief presentation by you or a council member followed by a
question and answer session. This will enable all of us to discuss problems, future plans and
promote open communication.
You will be receiving a copy of the flyer we will send to promote the upcoming luncheon. We
are offering to purchase lunch for you and the City Council. We ask that reservations for those
planning to attend be made by calling the Desert Chapter Office, and at that time give their menu
selection. Menu choices are roasted California vegetarian delight or char-broiled southwestern
chicken breast with seasoned rice and vegetables.
The luncheon is open to all employees of the City of La Quinta and other interested persons who
wish to attend. They will also be required to call in with reservations with their menu choice and
will be given the member rate of $20.00.
Additionally, as a reminder, if there is a need to post a meeting notice to meet the requirements
of the Brown Act, I ask that your office handle this detail. If you have any questions or
