1. CALL TO ORDER
Mayor Cox called the City Council meeting to order at 12:20 p.m.
2. ROLL GALL
Present: Council Members Allen, Bohnenberger, Wolff and Mayor Cox.
Absent: Council Member Pena.
Also Preeent.. City Manager Usher, City Attorney Longtin, Adninistrative Services
Coordinator Jennings and Community levelopment Director Stevens.
Moved by Council Member Wolff, seconded by Council Member Bohnenberger, to excuse
Council Member lena. Unanimously adopted.

A. The City Attorney introduced a public hearing regarding a proposed Resolution
extending Reaolution No. 85-8 an additional 30 days to May 18, 1985, at which
tine the permanent infrastructure fee would become effective. Mr. Longtin
explained that on February 19, 1985, the Council adopted Resolution No. 85-8
establishing an interim comasunity infrastructure fee as an urgency measure,
and stated that Government Code Section 65962 contains provisiona for adoption
of an interim fee as an urgency measure without hearing, with two thirty day
extensions, follo"ing noticed hearing.
Mayor Cox declared the public hearing open. There being no comments from the
public, Mayor Cox closed the public hearing.
Moved by Council Member Wolff, seconded by Council Member Allen, to adopt
the following proposed Resolution:
RESOLUTION NO. 85- A RESOLUTION OP ThE CITY COUNCIL OF ThE CITY
OF LA QUINTA, CALIFORNIA, EXTEDING RESOLUTION
NO.85-8 INTERIM COMMUNITY INFRASTRUCTURE FEE TO BE IMPOSED ON NEW DEVIIOPMENT)
FOR AN ADDITIONAL 30 DAYS.
Unanimously adopted, with Council Member Pena absent.

Moved by Council Member Allen, seconded by Council Member Bohnenberger, to adjourn
to an adjourned regular Council meeting. which will be held jointly with the La Quinta
Planning Commission, on Tuesday, April 30, 1985, at 7:00 p.m., for discussion of the
La Quints General Plan. Unanimously adopted.
The adjourned regular meeting of the La Quinta City Council was adjourned at 12:22 p.m.,
Tuesday, April 18, 1985, at City Hall, 78-105 Calle Estado, La Cuinta. California.

Subject: Interim Community Infrastructure Fee,
Second 30 Day Extension of Urgency Measure
On February 19, 1985, the Council adopted Resolution No. 85-8 establishing
an interim community infrastructure fee as an urgency measure. This action
was taken pursuant to Government Code 65962, which requires a prior noticed
public hearing and a sixty 60) day waiting period to taking any action
enacting or increasing a fee on residential development. Gov. Code
Section 65962 contains provisions for adoption of an interim fee as an
urgency measure without hearing, with two thirty 30) day extensions,
following noticed hearing.
Resolution No. 85-8 was extended on March 19 for 30 days to April 18. It
is now recommended that the City Council adopt the attached resolution
extending Resolution No. 85-8 an additional 30 days to May 18, at which time
the permanent infrastructure fee will become effective.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, EXTENDING RESOLUTION NO. 85-8 INTERIM COMMUN-
* ITY INFRASTRUCTURE FEE TO BE IMPOSED ON NEW DEVELOPMENT)
FOR AN ADDITIONAL 30 DAYS.
WHEREAS, on February 19, 1985, the City Council adopted Resolution
No. 85-8, establishing an interim community infrastructure fee to be
imposed on new development, as an urgency measure. The provisions of
said resolution are incorporated herein by this reference; and
WHEREAS, on March 19, 1985, the City Council adopted Resolution
No. 85-25 extending the provisions of said resolution for an additional
period of 30 days; and
WHEREAS, by its term said Resolution No. 85-25 expires April 18,
1985, and it is the intent of the Council to extend the provision of
Resolution No. 85-8 an additional period of 30 days until May 18,
1985; and
WHEREAS, a noticed hearing on said additional extension has been
conducted in accord with the provisions of state law;
NOW, THEREFORE, the City Council of the City of La Quinta, does
hereby resolve as follows:
1. All provisions of Resolution No. 85-8, including the
establishment of an interim community infrastructure
fee, are hereby extended for an additional period of 30
days until May 18, 1985.
2. This Resolution is adopted as an extension of an urgency
measure as an interim fee to protect the public health,
welfare and safety. The reasons for this urgency action
are set forth in the Whereases" to this Resolution and
Resolution No. 85-8 coupled with the fact that:
a) The City's public facilities and services are at
capacity and are not available to adequately accomo-
date the additional need for public facilities and
services resulting from proposed new development;
b) City cannot and will not make required findings that
public facilities and services are available to meet
the demands of future development without financial
developer assistance to pay for such services and
facilities; and
c) Developers with developments totaling many hundreds
of units are presently in a position to request and
obtain building permits and other development
entitlements and, unless this Resolution is adopted
as an urgency measure, such developments may escape
payment of their pro-rata fair share of the cost of
said needed public facilities and services.
