A RESOLUTION OF q-.AE CITY COUNCIL OF THE
CITY OF LA Q\3INTA RECOMMENDING ADOPTION
OF A REDEVELOPMENT PROJECT, AND IN ADOPTING
SAID PROJECT HAVE RECOGNIZED THE OVERRIDING
CONSIDERATIONS TO ADVERSE IMPACTS WHICH WILL
BENEFIT THE CITY FROM PROJECT IMPLEMENTATION.
WHEREAS, it is the goal of the City to eliminate blight
throughout major portions of the City; and
WHEREAS, the Redevelopment Agency, as lead agency, has
cause to be prepared a Final Environmental Impact Report hereinafter
FEIR) and certified as to the adequacy, accuracy, objectivity, and
completeness of the FEIR in Resolution RA-83-21 and
WHEREAS, the City Council, as responsible agency, has reviewed
and considered the FEIR and certified as to the adequacy, accuracy,
objectivity, and completeness of the FEIR in Resolution No.83-69;
and
WHEREAS, the City Council has reviewed and considered certain
overriding considerations to adverse impacts in support of the
Redevelopment Agency's actions in implementing the redevelopment
project; and
WHEREAS, the City Council has reviewed and considered the
CEQA Findings and Statement of Facts in support of the Redevelopment
Agency's actions in implementing the redevelopment project; and
WHEREAS, it is the policy of the State of California and
the City of La Quinta, in accordance with the provisions of the
California Environmental Quality Act of 1970 hereinafter CEQA) as
amended Public Resources Code, Section 21000 et seq.), and the
State Guidelines for implementation of CEQA, as amended California
Administrative Code, Section 15000 et seq.), that the City shall
balance the benefits of a proposed project against its unavoidable
environmental risks prior to project approval; meaning that if
the benefits of a proposed project outweigh the unavoidable adverse
environmental effects, the adverse environmental effects may be con-
sidered acceptable; and
WHEREAS, Section 15093(b) requires, where the decision of the
City Council allows the occurrences of significant effects which are
identified in the FEIR but are not mitigated, the City must state in
writing the reasons to support its action based on the FEIR and/or
other information in the record.
NOW, THEREFORE, BE IT RESOLVED, that the City of La Quinta,
in addition to the findings made in the body of the redevelopment
project itself, makes the following Statements of Overriding Consid-
erations in support of its action, and as required by the Guidelines.
1. The proposed redevelopment project is consistent
with the General Plan as is or as proposed for amendment.

(t 2. Implementation of the redevelopment project will result
in the elimination of the negative impacts associated
with blight in the project area.
3. public flood control improvements will be constructed1
thereby resolving the future major flood hazard
potential which has historically resulted in considerable
property damage, inconvenience, and insecurity for the
community.
4. Lands precluded from development due to the major flood
hazard potential will be afforded the opportunity for
development according to the General plan.
5. The proposed redevelopment project is needed to improve
the quality and service of various utilities, including
the water system, a sanitary sewerage system, and natural
gas and electrical systems.
6. The proposed redevelopment project is needed to
improve inadequate public services, including the local
roadway system, the parks system, the local storm drain
system, and the public education system.
7. Certain substandard, deteriorating, and obsolete buildings
may be improved by the authority granted to the redevelop-
ment agency from project implementation.
8. Land use incompatibilities in the project area resulting
when more than one use is made of a building, or if two
buildings of different uses exist on the same parcel or
adjacent to each other on abutting parcels, may be
resolved through redevelopment plan implementation.
9. The proposed project is needed to enhance the quality
of life in the project area sought as essential and
beneficial in attracting new residents, business, and
visitors to La Quinta and generally promoting increased
investment and return on property value.
10. Impacts identified as significant from redevelopment project
implementation are generally associated with normal growth,
progress and prosperity.
11. The real market potential in the project area can be
attained through the elimination of blight and protection
from flood hazards.
12. The blighted conditions in the project area, constituting
serious physical, social, and economic burden to the City,
cannot be eliminated by private enterprise acting alone.
13. Redevelopment project implementation will ultimately create
new jobs for facilities construction, future development
construction, the provision of public services for a
larger population base, and to staff new businesses.
14. The citys economic base will be enhanced through
revenues derived from increased sales, business licenses,
hotel occupancy, and other fees, taxes, and exactions
prorated from new development, otherwise precluded from
development without redevelopment plan implementation.
