ORD 094 ORDINANCE NO. 94
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, ESTABLISHING THE RATE FOR
INDIVIDUAL RESIDENTIAL REFUSE PICKUP AND DISPOSAL
SERVICE, AND ELECTING TO HAVE CHARGES PAYABLE FOR SUCH
SERVICES COLLECTED ON THE TAX ROLL PURSUANT TO SECTION
5473 OF THE HEALTH AND SAFETY CODE.
The City Council of the City of La Quinta does ordain as
follows:
SECTION 1. This Ordinance is enacted pursuant to authori-
zation contained in Sections 5471 and 5473 of the Health and Safety
Code of the State of California.
SECTION 2. The rate and charge for City-furnished garbage
and refuse collection and disposal services for individual resi-
dences (curb service, once per week pickup of any combination of
six (6) cans, bags or bundles) is hereby established, prescribed
and fixed at $5.75 per month plus .45 per month dump fee
surcharge from July 1, 1986, through June 30, 1987, and $5.85 per
month plus .45 per month dump fee surcharge commencing July 1,
1987, and thereafter.
SECTION 3. The City of La Quinta hereby continues its
election to have all such charges, until such election is appro-
priately changed, established for City-furnished garbage and refuse
collection and disposal services for individual residences,
collected on the tax roll and in the same manner, by the same
persons, and at the same time as, together with and not separately
from, the general taxes.
SECTION 4. URGENCY ORDINANCE EFFECTIVE DATE. This
ordinance is an urgency ordinance for the immediate preservation of
the public peace, health, and safety of the City of La Quinta and
it shall take effect immediately upon approval by a four-fifths
vote of the City Council and signature by the Mayor and attesta-
tion by the City Clerk. It shall continue in full force and
effect until repealed by ordinance of the City Council. The facts
constituting the urgency are as follows: The City was first
advised by the City's waste disposal contractor, Palm Desert
Disposal, Inc., on June 9, 1986, that said contractor was
requesting said residential rate revision; that pursuant to Calif-
ornia Health and Safety Code, Section 5471, said rate revision
shall be adopted by ordinance; that in order to have such charges,
at said revised rate, collected on the tax roll, the City must
conduct a hearing, and adopt a resolution approving the City
Manager's report prescribing the charges for each residential
parcel within the City and directing that said charges be
collected on the tax roll; that said resolution and report, to be
effective for collection on the 1986-87 tax rolls, must be filed
with the County Assessor on or before August 11, 1986; that prior
to the adoption of said resolution and report, Sections 5471 and
Ordinance No. 94
5473 of the California Health and Safety Code require the adoption
of an ordinance electing to have such charges for the forthcoming
year and for subsequent years collected on the tax roll.
SECTION 5. POSTING. The City Clerk shall within 15 days
after the passage of this ordinance, cause it to be posted in at
least the 3 public places designated by resolution of the City
Council; shall certify to the adoption and posting of this
ordinance, and shall cause this ordinance and its certification,
together with proof of posting, to be entered in the book of
ordinances of this City.
APPROVED and ADOPTED this 5th day of August , by the
following roll call vote:
AYES: Council Members Allen, Bohnenberger, Cox, Wolff and
Mayor Pena.
