MINUTES
MAY 5, 1992
Regular meeting of the La Quinta Redevelopment Agency was called to
order by Chairman Pena.
PRESENT: Mr. Bohnenberger, Mrs. Franklin, Mr. Rushworth, Mr.
Sniff, Chairman Pena
ABSENT: None
APPROVAL OF MINUTES
MOTION It was moved by Mr. Sniff, seconded by Mrs. Franklin that
the Agency Minutes of April 7, 1992 be approved. Motion carried
unanimously.
PUBLIC COMMENT None
BUSINESS SESSION
1. CONSIDERATION OF ADOPTION OF RESOLUTION APPROVING A DESIGN FOR
DEVELOPMENT AND INITIATING THE OWNER/PARTICIPATION PROCESS FOR
PROPERTIES INVOLVED IN THE PROPOSED LA QUINTA CANYON CENTER.
Mr. Genovese, Ass?t. City Manager, advised that the Board has
received a proposed resolution prepared by the City Attorney
regarding property located on Highway ill as defined by the
designated area. The process which will be followed will be
similar to the one for The Village at La Quinta. The
anticipated date for receipt of proposals is July 7, 1992.
Mr. Sniff referred to the Staff Report in which it stated that
the Agency is desirous of facilitating the development of a
regional mall, a power center, and accessory uses, etc. and
asked when the Board made that decision.
Ms. Honeywell commented that the Agency is the co-applicant on
the Specific Plan Amendment, so in a sense, the Agency is
already involved in the regional center.
Mr. kiedrowski suggested that the matter can be continued for
research as to the detailed background.
Mrs. Franklin referred to the Staff Report and asked for an
explanation of the statement that the City has discussed the
possibility of establishing a Specific Plan for the subject
area. She questioned the purpose of this action.

Ms. Honeywell stated that the Resolution sets forth and
establishes as a fact that the City wishes to see a regional
shopping center an this site and sets in motion the request Cf
all property owners within the area for participation in such
a development. it gives them notice that they have so much
time to make a proposal. The purpose is Only to begin the
owner/participation process.
In response to Mr. Bohnenberger, Ms. Honeywell advised that
this action does not Comrflit the Agency to going ahead with it.
RESOLUTION NO. RA 92-5
A RESOLUTION OF THE LA QUINTA REDEVELOPMENT AGENCY, APPROVING
PROCEDURE TO IMPLEMENT OWNER PARTICIPATION RULES AND
DESIGNATED AREA FROM WHICH IT DESIRES TO RECEIVE PROPOSALS.
It was moved by Mr. Bohnenberger, seconded by Dr. Rushworth
that Resolution No. RA 92-5 be adopted. Motion carried
unanimously.
P?LIC HEARINGS
1. PUBLIC HEARING TO CONSIDER ADOPTION OF A RESOLUTION OF
NECESSITY FOR THE ACQUISITION OF CERTAIN PROPERTY LOCATED
ALONG CALLE TAMPICO.
Mr. Speer, Assistant City Engineer, advised that the matters
before the Board are the remaining properties that need to be
acquired for the completion of the widening of Calle Tampico.
Appraisals have been done and the property owners have been
offered the appraised value and they have not agreed to sell.
As a result, the matter before the Board is to adopt a
resolution of necessity for the acquisition of these
properties.
Mr. Bohnenberger questioned what the zoning is on these
parcels and Mr. Herman reviewed the current zoning. In answer
to further questions, he advised that with the property being
taken, he was not sure they will still have 10,000 sq. ft.,
but they will be grandfathered in for a single family house.
Ms. Honeywell noted that any application for development,
including a single family home, would be required to dedicate
the right-of-way as a condition of approval.
Peter Zelles, spoke with regard to the property owners desire
to have these properties zoned commercial and to be

compensated accordingly.
George Fenady, 602 North Cherokee, Los Angeles, also spoke to
the zoning of these parcels.
Mr. Herman advised that prior to 1986, the property was zoned
R-2-5,000; in 1986, the City created the SR Zone and rezoned
the area as SR and in 1969, the City adopted the Village
Specific Plan and the property was rezoned to RV 10,000. This
means that a single-family residence or multiple units are
allowed, provided that the density of 2-4 units is not
exceeded. In order to get a duplex, you have to have a 1/2
acre.
In response to Mr. Fenady, Chairman Pena advised that in order
to change the zoning, he would have to make an application for
a General Plan Amendment and a change of Zone.
PUBLIC HEARING OPENED ON PARCEL NO. 2 APN 769-030-037
Mary Martin representing this parcel advised that this parcel
is in the estate of Frances Hack and Mr. Dave Erwin was
representing the estate. It was her understanding that the
last offer of the City was not accepted.
Mr. Floyd representing Realco Consultants, advised that since
the list was published, they have been advised that there has
been litigation pending on Parcel 2 resulting in a conveyance
out of the trust back into the estate of Frances Hack for 1/2
interest. The other 1/2 interest is owned by the Altmans who
reside in Florida.

PUBLIC HEARING OPENED ON PARCEL NO. 17 APN 769-063-002
Virginia Garbutt, 81-260 Sirocco Ave., Indio, advised that
when she purchased her lots several years ago they were zoned
R-2. If she has to submit an application to upgrade her
property, she asked why the Council didn?t have to submit
something to her to downgrade her property. Once this right-
of-way is taken, her lots are going to be very small.
In response to Mr. Bohnenberger, Mr. Herman advised that when
the properties were rezoned, the law would have required a
minimum of a notice in the newspaper.

explaining that he will be liable for sewer assessment
regardless of this particular action.
Peter Zelles, asked if the sewer assessment can be negotiated
and Mr. Kiedrowski advised that to-date the City has not
negotiated any sewer assessments, but the property owner could
make such a counter-proposal to the right-of-way agent. He
noted, however, that the cost of that assessment has not yet
been determined.
In response to Mrs. Turi, Ms. Honeywell responded that
negotiations can take place up until you go to Court and at
that time a Court will determine what the fair-market price
is.
Mary Frances Fenady, 126 N. Rossmore Ave., Los Angeles,
advised that she did not recall ever receiving a notice on the
rezoning of her property. She would like to have
documentation as to when the property was rezoned and the kind
of noticing that was done. It appears that the size of her
lot after the right-of-way is taken, will only accommodate a
single-family home.
Ms. Honeywell advised that if they wish to continue
negotiations1 they should do so immediately.
