RESOLUTION OF THE
LA QUINTA REDEVELOPMENT AGENCY
APPROVING OF CERTAIN
EXPENDITURES AND FINDING THAT
SUCH EXPENDITURES
EXPAND AND IMPROVE THE
COMMUNITYS SUPPLY OF
AFFORDABLE HOUSING
WHEREAS, the La Quinta Redevelopment Agency the Agency')
Is authorized to carry out the redevelopment of the La Quinta
Redevelopment Project Area the project Area"); and
WHEREAS, the Redevelopment Plan for La Quinta Redevelopment
Project the Project"), as approved by Ordinance No. 43 of
the City of La Quinta the City"), provides for the
development of flood control facilities within the Project
Area; and
HEREAS, the lack of adequate flood control facilities has
been found and determined to constitute evidence of blight
Within the Project Area; and
WHEREAS, the continued lack of adequate flood control
facilities renders uneconomical the development of portions of
the Project Area which would otherwise be appropriate sites for
low- and moderate-income housing,' and
WHEREAS, pursuant to Section 33413 of the Health and Safety
Code, at least 15% of all new dwelling units developed within a
project area shall be available at affordable cost to persons
and families of low or moderate income Affordable Units"),. and
WHEREAS, over 5,000 housing units exclusive of Affordable
Units) are planned for development within that area of the City
of La Quinta known as La Quinta Cove"; and
WHEREAS, it is projected, consistent with the foregoing,
that over 900 Affordable Units will be developed within
La Quinta Cove; and
WHEREAS, the Coachella Valley Water District has estimated
that the cost of providing flood control facilities constitutes
a cost of 5,000 per dwelling unit within La Quinta Cove; and
WHEREAS, Section 33334.2 of the Health and Safety Code
provides that not less than twenty percent 20%) of taxes
allocated to a redevelopment agency pursuant to Section 33670
of the Health and Safety Code Tax Investment Procedures")
shall be used by the Agency for the purpose of increasing and
improving the community's supply of low- and moderate-income
housing; and

WHEREs, subsection e) of Section 33334.2 provides.
6) In carrying Out the purpose of this section the
agency may exercise any or all of its powers,
including the following..
1) Acquire land or building Sites.
2) Improve land or buildin9 sites with onsite
or offsite improvements.
3) Donate land to private or public persons or
entities.
4) Construction buildings or structures.
5) Acquire buildings or structures.
6) Rehabilitate buildin95 or structures.
7) Provide subsidies to, or for the benefit of,
very low income households, as defined by Section
50105, lower income households, as defined by
Section 50079.5, or persons and families of low
or moderate income, as defined by Section 50093.
8) Develop plans, pay principal and interest on
bonds, loans, advances, or Other indebtedness, or
pay financing or carryin9 charges.
WHEREAS, provision of flood control improvements promotes
the development of low- and moderate-income housing; and
WREREAS, Section 33445 of the Health and Safety Code
provides that a redevelopment agency may pay all or part of the
cost of installation and construction of any building,
facility, structure or improvement which is probably owned upon
determination of the legislative body that. i) the buildings,
facilities, structures, or other improvements are of benefit to
the project area or the immediate neighborhood in which the
project is located, and ii) no other reasonable means of
financing such buildings, facilities, structures, or other
improvements, are available to the community, and
WHEREAS, the Agency proposes to undertake those
improvements described in Exhibit A' hereto, which is
incorporated herein by reference the *Flood Control
Facilities"); and
WHEREAS, the community lacks the financial resources to
undertake the Flood Control Facilities except by using Tax
Increment Revenues;

NOW THEREFORE, the La Quinta Redevelopment Agency does
resolve as follows..
Section 1. The Agency find and determines that:
i) the provision of the Flood Control Facilities will be of
benefit to e Project Area, and no other reasonable means of
financing such Facilities are available to the community; and
ii) the provision of the Flood Control Facilities will
Contribute toward increasing and improving the community's
supply of low- and moderate-income housing.
PASSED, APPROVED AND ADOPTED this 3rd day of September
1985 at a regular meeting of the La Quinta Redevelopment Agency
by the following vote:
AYES: Agency Members Allen, Eohnenberger Pena and Cox.
NOES: Agency Member Wolff.
ABSENT: None.
ABSTAIN: None.
